ABSTRACT
The project will discuss in length the need for the emergence of High Courts over the
previous system of Courts in India. For this, it highlights the developments made in 1833 and
1853 and also, the major change of events that took place in 1857 that made it imperative for
the British Parliament to introduce a new system of justice. This change was bought into
effect by the Indian High Court Act, 1861 whose constitution and jurisdiction will be
discussed at length. Then the changes to this act by the amendments made in 1911, 1915 and
1935 will also be discussed. The changes in 1935, being significant, will be discussed at
length. Also, the post-independence scenarios of High Courts in India will also be discussed.

RESEARCH METHODOLOGY

The researcher shall carry-on qualitative analyses of the available material i.e. the books on
the subject matter. The objective of the research project is to study the importance of a major
step taken in the Constitutional History of India. The post-independence High Courts are a
major organ of judicial justice. The study will aim to study the pre-independence
establishment and reforms in the High Courts with comparison and critical appraisal of the
various reforms taken in this regard. A comparison with the previous courts before the
establishment of the High Courts and the post-independence High Courts will also be done.

RESEARCH OBJECTIVE

The objective of this research project is to lay emphasis on the importance of a major organ
in the judicial history of India i.e. the High Courts. This importance will be realised through
an analysis of the reasons which led to the formation of the first High Courts in India. The
subsequent importance of this organ and the reforms carried on afterwards to improve on its
efficacy will also be emphasised upon. The aim is to also try and evaluate the post-
independence High Courts in light of the ongoing research on the pre-independence High
Courts.
