Preamble

The States Parties to this Statute,

Consciousthatallpeoplesareunitedbycommonbonds,theirculturespieced
togetherinasharedheritage,andconcernedthatthisdelicatemosaicmaybe
shatteredatanytime,

Mindful thatduringthiscenturymillionsofchildren,womenandmenhavebeen
victimsofunimaginableatrocitiesthatdeeplyshocktheconscienceofhumanity,

Recognizing thatsuchgravecrimesthreatenthepeace,securityandwellbeingof
theworld,

Affirmingthatthemostseriouscrimesofconcerntotheinternationalcommunity
asawholemustnotgounpunishedandthattheireffectiveprosecutionmustbe
ensuredbytakingmeasuresatthenationalleveland
byenhancinginternationalcooperation,

Determinedtoputanendtoimpunityfortheperpetratorsofthesecrimesand
thustocontributetothepreventionofsuchcrimes,

RecallingthatitisthedutyofeveryStatetoexerciseitscriminaljurisdictionover
thoseresponsibleforinternationalcrimes,

ReaffirmingthePurposesandPrinciplesoftheCharteroftheUnitedNations,
andinparticularthatallStatesshallrefrainfromthethreatoruseofforceagainst
theterritorialintegrityorpoliticalindependenceofanyState,orinanyother
mannerinconsistentwiththePurposesoftheUnitedNations,

EmphasizinginthisconnectionthatnothinginthisStatuteshallbetakenas
authorizinganyStatePartytointerveneinanarmedconflictorintheinternal
affairsofanyState,

Determined totheseendsandforthesakeofpresentandfuturegenerations, to
establishanindependentpermanentInternationalCriminalCourtinrelationship
withtheUnitedNationssystem,withjurisdictionoverthemostseriouscrimesof
concerntotheinternationalcommunityasawhole,

EmphasizingthattheInternationalCriminalCourtestablishedunderthisStatute
shallbecomplementarytonationalcriminaljurisdictions,

Resolvedtoguaranteelastingrespectforandtheenforcementofinternational
justice,

Have agreed as follows:

Part I Establishment of the Court

Article 1
The Court
AnInternationalCriminalCourt(theCourt)isherebyestablished.Itshallbeapermanent
institutionandshallhavethepowertoexerciseitsjurisdictionoverpersonsforthemost
serious crimes of international concern, as referred to in this Statute, and shall be
complementarytonationalcriminaljurisdictions.Thejurisdictionandfunctioningofthe
CourtshallbegovernedbytheprovisionsofthisStatute.

Article 2
Relationship of the Court with the United Nations
TheCourtshallbebroughtintorelationshipwiththeUnitedNationsthroughanagreementto
beapprovedbytheAssemblyofStatesPartiestothisStatuteandthereafterconcludedbythe
PresidentoftheCourtonitsbehalf.

Article 3
Seat of the Court
1. TheseatoftheCourtshallbeestablishedatTheHagueintheNetherlands(the
hostState).

2. TheCourtshallenterintoaheadquartersagreementwiththehostState,tobe
approvedbytheAssemblyofStatesPartiesandthereafterconcludedbythe
PresidentoftheCourtonitsbehalf.

3. TheCourtmaysitelsewhere,wheneveritconsidersitdesirable,asprovidedinthis
Statute.

Article 4
Legal status and powers of the Court
1. TheCourtshallhaveinternationallegalpersonality.Itshallalsohavesuchlegal
capacityasmaybenecessaryfortheexerciseofitsfunctionsandthefulfilmentof
itspurposes.

2. TheCourtmayexerciseitsfunctionsandpowers,asprovidedinthisStatute,on
theterritoryofanyStatePartyand,byspecialagreement,ontheterritoryofany
otherState.

Part II Jurisdiction, admissibility and applicable law

Article 5
Crimes within the jurisdiction of the Court
1. ThejurisdictionoftheCourtshallbelimitedtothemostseriouscrimesofconcern
to the international community as a whole. The Court has jurisdiction in
accordancewiththisStatutewithrespecttothefollowingcrimes:

(a) Thecrimeofgenocide;

(b) Crimesagainsthumanity;

(c) Warcrimes;

(d) Thecrimeofaggression.

2. TheCourtshallexercisejurisdictionoverthecrimeofaggressiononceaprovision
isadoptedinaccordancewitharticles121and123definingthecrimeandsetting
outtheconditionsunderwhichtheCourtshallexercisejurisdictionwithrespectto
thiscrime.Suchaprovisionshallbeconsistentwiththerelevantprovisionsofthe
CharteroftheUnitedNations.

Article 6
Genocide
For the purpose of this Statute, genocide means any of the following acts
committedwithintenttodestroy,inwholeorinpart,anational,ethnical,racialor
religiousgroup,assuch:

(a) Killingmembersofthegroup;

(b) Causingseriousbodilyormentalharmtomembersofthegroup;

(c) Deliberatelyinflictingonthegroupconditionsoflifecalculatedtobring
aboutitsphysicaldestructioninwholeorinpart;

(d) Imposingmeasuresintendedtopreventbirthswithinthegroup;

(e) Forciblytransferringchildrenofthegrouptoanothergroup.

Article 7
Crimes against humanity
1. For the purpose of this Statute, crime against humanity means any of the
followingactswhencommittedaspartofawidespreadorsystematicattack
directedagainstanycivilianpopulation,withknowledgeoftheattack:

(a) Murder;

(b) Extermination;

(c) Enslavement;

(d) Deportationorforcibletransferofpopulation;

(e) Imprisonmentorotherseveredeprivationofphysicallibertyinviolationof
fundamentalrulesofinternationallaw;

(f) Torture;

(g) Rape,sexualslavery,enforcedprostitution,forcedpregnancy,enforced
sterilization,oranyotherformofsexualviolenceofcomparablegravity;

(h) Persecution against any identifiable group or collectivity on political,


racial,national,ethnic,cultural,religious,genderasdefinedinparagraph
3,orothergroundsthatareuniversallyrecognizedasimpermissibleunder
internationallaw,inconnectionwithanyactreferredtointhisparagraph
oranycrimewithinthejurisdictionoftheCourt;

(i) Enforceddisappearanceofpersons;

(j) Thecrimeofapartheid;

(k) Otherinhumaneactsofasimilarcharacterintentionallycausinggreat
suffering,orseriousinjurytobodyortomentalorphysicalhealth.

2. Forthepurposeofparagraph1:

(a) Attackdirectedagainstanycivilianpopulationmeansacourseofconduct
involvingthemultiplecommissionofactsreferredtoinparagraph1
againstanycivilianpopulation,pursuanttoorinfurtheranceofaStateor
organizationalpolicytocommitsuchattack;

(b) Exterminationincludestheintentionalinflictionofconditionsoflife,
interaliathedeprivationofaccesstofoodandmedicine,calculatedto
bringaboutthedestructionofpartofapopulation;

(c) Enslavementmeanstheexerciseofanyorallofthepowersattachingto
therightofownershipoverapersonandincludestheexerciseofsuch
powerinthecourseoftraffickinginpersons,inparticularwomenand
children;

(d) Deportationorforcibletransferofpopulationmeansforceddisplacement
ofthepersonsconcernedbyexpulsionorothercoerciveactsfromthearea
inwhichtheyarelawfullypresent,withoutgroundspermittedunder
internationallaw;

(e) Torture means the intentional infliction of severe pain or suffering,


whetherphysicalormental,uponapersoninthecustodyorunderthe
control of the accused; except that torture shall not include pain or
sufferingarisingonlyfrom,inherentinorincidentalto,lawfulsanctions;

(f) Forcedpregnancymeanstheunlawfulconfinementofawomanforcibly
madepregnant,withtheintentofaffectingtheethniccompositionofany
populationorcarryingoutothergraveviolationsofinternationallaw.This
definitionshallnotinanywaybeinterpretedasaffectingnationallaws
relatingtopregnancy;

(g) Persecutionmeanstheintentionalandseveredeprivationoffundamental
rightscontrarytointernationallawbyreasonoftheidentityofthegroup
orcollectivity;

(h) Thecrimeofapartheidmeansinhumaneactsofacharactersimilarto
those referred to in paragraph 1, committed in the context of an
institutionalizedregimeofsystematicoppressionanddominationbyone
racialgroupoveranyotherracialgrouporgroupsandcommittedwiththe
intentionofmaintainingthatregime;

(i) Enforced disappearance of persons means the arrest, detention or


abduction of persons by, or with the authorization, support or
acquiescenceof,aStateorapoliticalorganization,followedbyarefusalto
acknowledgethatdeprivationoffreedomortogiveinformationonthe
fateorwhereaboutsofthosepersons,withtheintentionofremovingthem
fromtheprotectionofthelawforaprolongedperiodoftime.

3. ForthepurposeofthisStatute,itisunderstoodthatthetermgenderreferstothe
twosexes,maleandfemale,withinthecontextofsociety.Thetermgenderdoes
notindicateanymeaningdifferentfromtheabove.

Article 8
War crimes
1. TheCourtshallhavejurisdictioninrespectofwarcrimesinparticularwhen
committedaspartofaplanorpolicyoraspartofalargescalecommissionofsuch
crimes.

2. ForthepurposeofthisStatute,warcrimesmeans:

(a) GravebreachesoftheGenevaConventionsof12August1949,namely,
anyofthefollowingactsagainstpersonsorpropertyprotectedunderthe
provisionsoftherelevantGenevaConvention:

(i) Wilfulkilling;

(ii) Tortureorinhumantreatment,includingbiologicalexperiments;

(iii) Wilfullycausinggreatsuffering,orseriousinjurytobodyorhealth;

(iv) Extensivedestructionandappropriationofproperty,notjustifiedby
militarynecessityandcarriedoutunlawfullyandwantonly;

(v) Compellingaprisonerofwarorotherprotectedpersontoservein
theforcesofahostilePower;

(vi) Wilfullydeprivingaprisonerofwarorotherprotectedpersonofthe
rightsoffairandregulartrial;

(vii) Unlawfuldeportationortransferorunlawfulconfinement;

(viii) Takingofhostages.

(b) Other serious violations of the laws and customs applicable in


international armed conflict, within the established framework of
internationallaw,namely,anyofthefollowingacts:

(i) Intentionally directing attacks against the civilian population as


such or against individual civilians not taking direct part in
hostilities;

(ii) Intentionally directing attacks against civilian objects, that is,


objectswhicharenotmilitaryobjectives;

(iii) Intentionally directing attacks against personnel, installations,


material,unitsorvehiclesinvolvedinahumanitarianassistance
orpeacekeepingmissioninaccordancewiththeCharterofthe
United Nations, as long as they are entitled to the protection
giventociviliansorcivilianobjectsundertheinternationallaw
ofarmedconflict;

(iv) Intentionally launching an attack in the knowledge that such


attack will cause incidental loss of life or injury to civilians or
damagetocivilianobjectsorwidespread,longtermandsevere
damage to the natural environment which would be clearly
excessive in relation to the concrete and direct overall military
advantageanticipated;

(v) Attacking or bombarding, by whatever means, towns, villages,


dwellingsorbuildingswhichareundefendedandwhicharenot
militaryobjectives;

(vi) Killingorwoundingacombatantwho,havinglaiddownhisarmsor
havingnolongermeansofdefence,hassurrenderedatdiscretion;

(vii) Making improper use of a flag of truce, of the flag or of the


military insignia and uniform of the enemy or of the United
Nations, as well as of the distinctive emblems of the Geneva
Conventions,resultingindeathorseriouspersonalinjury;

(viii) Thetransfer,directlyorindirectly,bytheOccupyingPowerofparts
ofitsowncivilianpopulationintotheterritoryitoccupies,orthe
deportationortransferofallorpartsofthepopulationofthe
occupiedterritorywithinoroutsidethisterritory;

(ix) Intentionally directing attacks against buildings dedicated to


religion, education, art, science or charitable purposes, historic
monuments, hospitals and places where the sick and wounded
arecollected,providedtheyarenotmilitaryobjectives;

(x) Subjectingpersonswhoareinthepowerofanadversepartyto
physicalmutilationortomedicalorscientificexperimentsofany
kind which are neither justified by the medical, dental or
hospitaltreatmentofthepersonconcernednorcarriedoutinhisor
herinterest,andwhichcausedeathtoorseriouslyendangerthe
healthofsuchpersonorpersons;

(xi) Killing or wounding treacherously individuals belonging to the


hostilenationorarmy;

(xii) Declaringthatnoquarterwillbegiven;

(xiii) Destroyingorseizingtheenemy'spropertyunlesssuchdestruction
orseizurebeimperativelydemandedbythenecessitiesofwar;

(xiv) Declaringabolished,suspendedorinadmissibleinacourtoflawthe
rightsandactionsofthenationalsofthehostileparty;

(xv) Compellingthenationalsofthehostilepartytotakepartinthe
operationsofwardirectedagainsttheirowncountry,evenifthey
wereinthebelligerent'sservicebeforethecommencementofthe
war;

(xvi) Pillagingatownorplace,evenwhentakenbyassault;

(xvii) Employingpoisonorpoisonedweapons;

(xviii)Employing asphyxiating, poisonous or other gases, and all


analogousliquids,materialsordevices;

(xix) Employingbulletswhichexpandorflatteneasilyinthehumanbody,
suchasbulletswithahardenvelopewhichdoesnotentirelycover
thecoreorispiercedwithincisions;

(xx) Employing weapons, projectiles and material and methods of


warfare which are of a nature to cause superfluous injury or
unnecessary suffering or which are inherently indiscriminate in
violation of the international law of armed conflict, provided
that such weapons, projectiles and material and methods of
warfarearethesubjectofacomprehensiveprohibitionandare
included in an annex to this Statute, by an amendment in
accordancewiththerelevantprovisionssetforthinarticles121
and123;

(xxi) Committing outrages upon personal dignity, in particular


humiliatinganddegradingtreatment;

(xxii) Committing rape, sexual slavery, enforced prostitution, forced


pregnancy, as defined in article 7, paragraph 2 (f), enforced
sterilization,oranyotherformofsexualviolencealsoconstitutinga
gravebreachoftheGenevaConventions;

(xxiii)Utilizingthepresenceofacivilianorotherprotectedpersonto
rendercertainpoints,areasormilitaryforcesimmunefrommilitary
operations;

(xxiv)Intentionallydirectingattacksagainstbuildings,material,medical
unitsandtransport,andpersonnelusingthedistinctiveemblemsof
theGenevaConventionsinconformitywithinternationallaw;

(xxv) Intentionallyusingstarvationofciviliansasamethodofwarfare
by depriving them of objects indispensable to their survival,
includingwilfullyimpedingreliefsuppliesasprovidedforunderthe
GenevaConventions;

(xxvi)Conscriptingorenlistingchildrenundertheageoffifteenyearsinto
thenationalarmedforcesorusingthemtoparticipateactivelyin
hostilities.

(c) Inthecaseofanarmedconflictnotofaninternationalcharacter,serious
violationsofarticle3commontothefourGenevaConventionsof12
August1949,namely,anyofthefollowingactscommittedagainstpersons
takingnoactivepartinthehostilities,includingmembersofarmedforces
who have laid down their arms and those placed hors de combat by
sickness,wounds,detentionoranyothercause:

(i) Violence to life and person, in particular murder of all kinds,


mutilation,crueltreatmentandtorture;

(ii) Committing outrages upon personal dignity, in particular


humiliatinganddegradingtreatment;

(iii) Takingofhostages;

(iv) The passing of sentences and the carrying out of executions


withoutpreviousjudgementpronouncedbyaregularlyconstituted
court, affording all judicial guarantees which are generally
recognizedasindispensable.

(d) Paragraph2(c)appliestoarmedconflictsnotofaninternationalcharacter
and thus does not apply to situations of internal disturbances and
tensions,suchasriots,isolatedandsporadicactsofviolenceorotheracts
ofasimilarnature.

(e) Otherseriousviolationsofthelawsandcustomsapplicableinarmed
conflicts not of an international character, within the established
frameworkofinternationallaw,namely,anyofthefollowingacts:

(i) Intentionally directing attacks against the civilian population as


such or against individual civilians not taking direct part in
hostilities;

(ii) Intentionallydirectingattacksagainstbuildings,material,medical
unitsandtransport,andpersonnelusingthedistinctiveemblemsof
theGenevaConventionsinconformitywithinternationallaw;

(iii) Intentionally directing attacks against personnel, installations,


material,unitsorvehiclesinvolvedinahumanitarianassistanceor
peacekeepingmissioninaccordancewiththeCharteroftheUnited
Nations,aslongastheyareentitledtotheprotectiongivento
civiliansorcivilianobjectsundertheinternationallawofarmed
conflict;

(iv) Intentionally directing attacks against buildings dedicated to


religion, education, art, science or charitable purposes, historic
monuments, hospitals and places where the sick and wounded
arecollected,providedtheyarenotmilitaryobjectives;

(v) Pillagingatownorplace,evenwhentakenbyassault;

(vi) Committing rape, sexual slavery, enforced prostitution, forced


pregnancy, as defined in article 7, paragraph 2 (f), enforced
sterilization,andanyotherformofsexualviolencealsoconstituting
a serious violation of article 3 common to the four Geneva
Conventions;

(vii) Conscriptingorenlistingchildrenundertheageoffifteenyearsinto
armedforcesorgroupsorusingthemtoparticipateactivelyin
hostilities;

(viii) Orderingthedisplacementofthecivilianpopulationforreasons
relatedtotheconflict,unlessthesecurityoftheciviliansinvolvedor
imperativemilitaryreasonssodemand;

(ix) Killingorwoundingtreacherouslyacombatantadversary;

(x) Declaringthatnoquarterwillbegiven;

(xi) Subjectingpersonswhoareinthepowerofanotherpartytothe
conflicttophysicalmutilationortomedicalorscientificexperiments
ofanykindwhichareneitherjustifiedbythemedical,dentalor
hospitaltreatmentofthepersonconcernednorcarriedoutinhisor
herinterest,andwhichcausedeathtoorseriouslyendangerthe
healthofsuchpersonorpersons;

(xii) Destroyingorseizingthepropertyofanadversaryunlesssuch
destructionorseizurebeimperativelydemandedbythenecessities
oftheconflict;

(f) Paragraph 2 (e) applies to armed conflicts not of an international


characterandthusdoesnotapplytosituationsofinternaldisturbances
andtensions,suchasriots,isolatedandsporadicactsofviolenceorother
actsofasimilarnature.Itappliestoarmedconflictsthattakeplaceinthe
territory of a State when there is protracted armed conflict between
governmentalauthoritiesandorganizedarmedgroupsorbetweensuch
groups.

3. Nothinginparagraph2(c)and(e)shallaffecttheresponsibilityofaGovernment
tomaintainorreestablishlawandorderintheStateortodefendtheunityand
territorialintegrityoftheState,byalllegitimatemeans.

Article 9
Elements of Crimes
1. ElementsofCrimesshallassisttheCourtintheinterpretationandapplicationof
articles6,7and8.Theyshallbeadoptedbyatwothirdsmajorityofthemembers
oftheAssemblyofStatesParties.

2. AmendmentstotheElementsofCrimesmaybeproposedby:

(a) AnyStateParty;

(b) Thejudgesactingbyanabsolutemajority;

(c) TheProsecutor.

Suchamendmentsshallbeadoptedbyatwothirdsmajorityofthemembersof
theAssemblyofStatesParties.

3. TheElementsofCrimesandamendmentstheretoshallbeconsistentwiththis
Statute.

Article 10
NothinginthisPartshallbeinterpretedaslimitingorprejudicinginanywayexistingor
developingrulesofinternationallawforpurposesotherthanthisStatute.

Article 11
Jurisdiction ratione temporis
1. TheCourthasjurisdictiononlywithrespecttocrimescommittedaftertheentry
intoforceofthisStatute.

2. IfaStatebecomesaPartytothisStatuteafteritsentryintoforce,theCourtmay
exerciseitsjurisdictiononlywithrespecttocrimescommittedaftertheentryinto
forceofthisStatuteforthatState,unlessthatStatehasmadeadeclarationunder
article12,paragraph3.

Article 12
Preconditions to the exercise of jurisdiction
1. AStatewhichbecomesaPartytothisStatutetherebyacceptsthejurisdictionof
theCourtwithrespecttothecrimesreferredtoinarticle5.

2. Inthecaseofarticle13,paragraph(a)or(c),theCourtmayexerciseitsjurisdiction
ifoneormoreofthefollowingStatesarePartiestothisStatuteorhaveaccepted
thejurisdictionoftheCourtinaccordancewithparagraph3:

(a) TheStateontheterritoryofwhichtheconductinquestionoccurredor,if
the crime was committed on board a vessel or aircraft, the State of
registrationofthatvesseloraircraft;

(b) TheStateofwhichthepersonaccusedofthecrimeisanational.

3. IftheacceptanceofaStatewhichisnotaPartytothisStatuteisrequiredunder
paragraph2,thatStatemay,bydeclarationlodgedwiththeRegistrar,acceptthe
exerciseofjurisdictionbytheCourtwithrespecttothecrimeinquestion.The
acceptingStateshallcooperatewiththeCourtwithoutanydelayorexceptionin
accordancewithPart9.

Article 13
Exercise of jurisdiction
TheCourtmayexerciseitsjurisdictionwithrespecttoacrimereferredtoinarticle5in
accordancewiththeprovisionsofthisStatuteif:

(a) Asituationinwhichoneormoreofsuchcrimesappearstohavebeen
committedisreferredtotheProsecutorbyaStatePartyinaccordancewith
article14;

(b) Asituationinwhichoneormoreofsuchcrimesappearstohavebeen
committedisreferredtotheProsecutorbytheSecurityCouncilacting
underChapterVIIoftheCharteroftheUnitedNations;or

(c) TheProsecutorhasinitiatedaninvestigationinrespectofsuchacrimein
accordancewitharticle15.

Article 14
Referral of a situation by a State Party
1. AStatePartymayrefertotheProsecutorasituationinwhichoneormorecrimes
withinthejurisdictionoftheCourtappeartohavebeencommittedrequestingthe
Prosecutortoinvestigatethesituationforthepurposeofdeterminingwhetherone
ormorespecificpersonsshouldbechargedwiththecommissionofsuchcrimes.

2. Asfaraspossible,areferralshallspecifytherelevantcircumstancesandbe
accompanied by such supporting documentation as is available to the State
referringthesituation.

Article 15
Prosecutor
1. The Prosecutor may initiate investigations proprio motu on the basis of
informationoncrimeswithinthejurisdictionoftheCourt.

2. TheProsecutorshallanalysetheseriousnessoftheinformationreceived.Forthis
purpose,heorshemayseekadditionalinformationfromStates,organsofthe
UnitedNations,intergovernmentalornongovernmentalorganizations,orother
reliablesourcesthatheorshedeemsappropriate,andmayreceivewrittenororal
testimonyattheseatoftheCourt.

3. IftheProsecutorconcludesthatthereisareasonablebasistoproceedwithan
investigation,heorsheshallsubmittothePreTrialChamberarequestfor
authorizationofaninvestigation,togetherwithanysupportingmaterialcollected.
VictimsmaymakerepresentationstothePreTrialChamber,inaccordancewith
theRulesofProcedureandEvidence.

4. IfthePreTrialChamber,uponexaminationoftherequestandthesupporting
material, considers that there is a reasonable basis to proceed with an
investigation,andthatthecaseappearstofallwithinthejurisdictionoftheCourt,
itshallauthorizethecommencementoftheinvestigation,withoutprejudiceto
subsequent determinations by the Court with regard to the jurisdiction and
admissibilityofacase.

5. TherefusalofthePreTrialChambertoauthorizetheinvestigationshallnot
precludethepresentationofasubsequentrequestbytheProsecutorbasedonnew
factsorevidenceregardingthesamesituation.

6. If, after the preliminary examination referred to in paragraphs 1 and 2, the


Prosecutor concludes that the information provided does not constitute a
reasonablebasisforaninvestigation,heorsheshallinformthosewhoprovided
theinformation.ThisshallnotprecludetheProsecutorfromconsideringfurther
informationsubmittedtohimorherregardingthesamesituationinthelightof
newfactsorevidence.

Article 16
Deferral of investigation or prosecution
NoinvestigationorprosecutionmaybecommencedorproceededwithunderthisStatutefora
periodof12monthsaftertheSecurityCouncil,inaresolutionadoptedunderChapterVIIof
theCharteroftheUnitedNations,hasrequestedtheCourttothateffect;thatrequestmaybe
renewedbytheCouncilunderthesameconditions.

Article 17
Issues of admissibility
1. Havingregardtoparagraph10ofthePreambleandarticle1,theCourtshall
determinethatacaseisinadmissiblewhere:

(a) The case is being investigated or prosecuted by a State which has


jurisdictionoverit,unlesstheStateisunwillingorunablegenuinelyto
carryouttheinvestigationorprosecution;

(b) ThecasehasbeeninvestigatedbyaStatewhichhasjurisdictionoverit
andtheStatehasdecidednottoprosecutethepersonconcerned,unless
thedecisionresultedfromtheunwillingnessorinabilityoftheState

(c) Thepersonconcernedhasalreadybeentriedforconductwhichisthe
subjectofthecomplaint,andatrialbytheCourtisnotpermittedunder
article20,paragraph3;

(d) ThecaseisnotofsufficientgravitytojustifyfurtheractionbytheCourt.

2. Inordertodetermineunwillingnessinaparticularcase,theCourtshallconsider,
havingregardtotheprinciplesofdueprocessrecognizedbyinternationallaw,
whetheroneormoreofthefollowingexist,asapplicable:

(a) Theproceedingswereorarebeingundertakenorthenationaldecision
wasmadeforthepurposeofshieldingthepersonconcernedfromcriminal
responsibilityforcrimeswithinthejurisdictionoftheCourtreferredtoin
article5;

(b) Therehasbeenanunjustifieddelayintheproceedingswhichinthe
circumstancesisinconsistentwithanintenttobringthepersonconcerned
tojustice;

(c) Theproceedingswerenotorarenotbeingconductedindependentlyor
impartially,andtheywereorarebeingconductedinamannerwhich,in
thecircumstances,isinconsistentwithanintenttobringtheperson
concernedtojustice.

3. Inordertodetermineinabilityinaparticularcase,theCourtshallconsider
whether,duetoatotalorsubstantialcollapseorunavailabilityofitsnational
judicialsystem,theStateisunabletoobtaintheaccusedorthenecessaryevidence
andtestimonyorotherwiseunabletocarryoutitsproceedings.

Article 18
Preliminary rulings regarding admissibility
1. WhenasituationhasbeenreferredtotheCourtpursuanttoarticle13(a)andthe
Prosecutorhasdeterminedthattherewouldbeareasonablebasistocommencean
investigation,ortheProsecutorinitiatesaninvestigationpursuanttoarticles13(c)
and15,theProsecutorshallnotifyallStatesPartiesandthoseStateswhich,taking
intoaccounttheinformationavailable,wouldnormallyexercisejurisdictionover
thecrimesconcerned.TheProsecutormaynotifysuchStatesonaconfidential
basisand,wheretheProsecutorbelievesitnecessarytoprotectpersons,prevent
destructionofevidenceorpreventtheabscondingofpersons,maylimitthescope
oftheinformationprovidedtoStates.

2. Withinonemonthofreceiptofthatnotification,aStatemayinformtheCourtthat
itisinvestigatingorhasinvestigateditsnationalsorotherswithinitsjurisdiction
withrespecttocriminalactswhichmayconstitutecrimesreferredtoinarticle5
andwhichrelatetotheinformationprovidedinthenotificationtoStates.Atthe
requestofthatState,theProsecutorshalldefertotheState'sinvestigationof
thosepersonsunlessthePreTrialChamber,ontheapplicationoftheProsecutor,
decidestoauthorizetheinvestigation.

3. TheProsecutor'sdeferraltoaState'sinvestigationshallbeopentoreviewbythe
Prosecutorsixmonthsafterthedateofdeferraloratanytimewhentherehasbeen
a significant change of circumstances based on the State's unwillingness or
inabilitygenuinelytocarryouttheinvestigation.

4. TheStateconcernedortheProsecutormayappealtotheAppealsChamber
againstarulingofthePreTrialChamber,inaccordancewitharticle82.Theappeal
maybeheardonanexpeditedbasis.

5. WhentheProsecutorhasdeferredaninvestigationinaccordancewithparagraph
2,theProsecutormayrequestthattheStateconcernedperiodicallyinformthe
Prosecutoroftheprogressofitsinvestigationsandanysubsequentprosecutions.
StatesPartiesshallrespondtosuchrequestswithoutunduedelay.

6. PendingarulingbythePreTrialChamber,oratanytimewhentheProsecutorhas
deferredaninvestigationunderthisarticle,theProsecutormay,onanexceptional
basis,seekauthorityfromthePreTrialChambertopursuenecessaryinvestigative
stepsforthepurposeofpreservingevidencewherethereisauniqueopportunity
toobtainimportantevidenceorthereisasignificantriskthatsuchevidencemay
notbesubsequentlyavailable.

7. AStatewhichhaschallengedarulingofthePreTrialChamberunderthisarticle
maychallengetheadmissibilityofacaseunderarticle19onthegroundsof
additionalsignificantfactsorsignificantchangeofcircumstances.

Article 19
Challenges to the jurisdiction of the Court or the admissibility of a case
1. TheCourtshallsatisfyitselfthatithasjurisdictioninanycasebroughtbeforeit.
TheCourtmay,onitsownmotion,determinetheadmissibilityofacasein
accordancewitharticle17.

2. Challengestotheadmissibilityofacaseonthegroundsreferredtoinarticle17or
challengestothejurisdictionoftheCourtmaybemadeby:

(a) Anaccusedorapersonforwhomawarrantofarrestorasummonsto
appearhasbeenissuedunderarticle58;

(b) AState which has jurisdiction over a case, on the ground that it is
investigatingorprosecutingthecaseorhasinvestigatedorprosecuted;or

(c) AStatefromwhichacceptanceofjurisdictionisrequiredunderarticle12.

3. The Prosecutor may seek a ruling from the Court regarding a question of
jurisdiction or admissibility. In proceedings with respect to jurisdiction or
admissibility,thosewhohavereferredthesituationunderarticle13,aswellas
victims,mayalsosubmitobservationstotheCourt.

4. TheadmissibilityofacaseorthejurisdictionoftheCourtmaybechallengedonly
oncebyanypersonorStatereferredtoinparagraph2.Thechallengeshalltake
placepriortooratthecommencementofthetrial.Inexceptionalcircumstances,
theCourtmaygrantleaveforachallengetobebroughtmorethanonceorata
timelaterthanthecommencementofthetrial.Challengestotheadmissibilityofa
case,atthecommencementofatrial,orsubsequentlywiththeleaveoftheCourt,
maybebasedonlyonarticle17,paragraph1(c).

5. AStatereferredtoinparagraph2(b)and(c)shallmakeachallengeattheearliest
opportunity.

6. Priortotheconfirmationofthecharges,challengestotheadmissibilityofacaseor
challenges to the jurisdiction of the Court shall be referred to the PreTrial
Chamber. After confirmation of the charges, they shall be referred to the
TrialChamber.Decisionswithrespecttojurisdictionoradmissibilitymaybe
appealedtotheAppealsChamberinaccordancewitharticle82.

7. IfachallengeismadebyaStatereferredtoinparagraph2(b)or(c),the
ProsecutorshallsuspendtheinvestigationuntilsuchtimeastheCourtmakesa
determinationinaccordancewitharticle17.

8. PendingarulingbytheCourt,theProsecutormayseekauthorityfromtheCourt:

(a) Topursuenecessaryinvestigativestepsofthekindreferredtoinarticle18,
paragraph6;

(b) Totakeastatementortestimonyfromawitnessorcompletethecollection
andexaminationofevidencewhichhadbegunpriortothemakingofthe
challenge;and

(c) IncooperationwiththerelevantStates,topreventtheabscondingof
persons in respect of whom the Prosecutor has already requested a
warrantofarrestunderarticle58.

9. Themakingofachallengeshallnotaffectthevalidityofanyactperformedbythe
ProsecutororanyorderorwarrantissuedbytheCourtpriortothemakingofthe
challenge.

10. IftheCourthasdecidedthatacaseisinadmissibleunderarticle17,theProsecutor
maysubmitarequestforareviewofthedecisionwhenheorsheisfullysatisfied
that new facts have arisen which negate the basis on which the case had
previouslybeenfoundinadmissibleunderarticle17.

11. IftheProsecutor,havingregardtothemattersreferredtoinarticle17,defersan
investigation,theProsecutormayrequestthattherelevantStatemakeavailableto
theProsecutorinformationontheproceedings.Thatinformationshall,atthe
requestoftheStateconcerned,beconfidential.IftheProsecutorthereafterdecides
toproceedwithaninvestigation,heorsheshallnotifytheStatetowhichdeferral
oftheproceedingshastakenplace.

Article 20
Ne bis in idem
1. ExceptasprovidedinthisStatute,nopersonshallbetriedbeforetheCourtwith
respecttoconductwhichformedthebasisofcrimesforwhichthepersonhasbeen
convictedoracquittedbytheCourt.

2. Nopersonshallbetriedbyanothercourtforacrimereferredtoinarticle5for
whichthatpersonhasalreadybeenconvictedoracquittedbytheCourt.

3. Nopersonwhohasbeentriedbyanothercourtforconductalsoproscribedunder
article6,7or8shallbetriedbytheCourtwithrespecttothesameconductunless
theproceedingsintheothercourt:

(a) Wereforthepurposeofshieldingthepersonconcernedfromcriminal
responsibilityforcrimeswithinthejurisdictionoftheCourt;or

(b) Otherwisewerenotconductedindependentlyorimpartiallyinaccordance
withthenormsofdueprocessrecognizedbyinternationallawandwere
conductedinamannerwhich,inthecircumstances,wasinconsistentwith
anintenttobringthepersonconcernedtojustice.

Article 21
Applicable law
1. TheCourtshallapply:

(a) In the first place, this Statute, Elements of Crimes and its Rules of
ProcedureandEvidence;

(b) In the second place, where appropriate, applicable treaties and the
principles and rules of international law, including the established
principlesoftheinternationallawofarmedconflict;

(c) Failingthat,generalprinciplesoflawderivedbytheCourtfromnational
lawsoflegalsystemsoftheworldincluding,asappropriate,thenational
lawsofStatesthatwouldnormallyexercisejurisdictionoverthecrime,
providedthatthoseprinciplesarenotinconsistentwiththisStatuteand
with international law and internationally recognized norms and
standards.

2. TheCourtmayapplyprinciplesandrulesoflawasinterpretedinitsprevious
decisions.

3. The application and interpretation of law pursuant to this article must be


consistentwithinternationallyrecognizedhumanrights,andbewithoutany
adversedistinctionfoundedongroundssuchasgenderasdefinedinarticle7,
paragraph3,age,race,colour,language,religionorbelief,politicalorother
opinion,national,ethnicorsocialorigin,wealth,birthorotherstatus.

Article 22
Nullum crimen sine lege
1. ApersonshallnotbecriminallyresponsibleunderthisStatuteunlesstheconduct
inquestionconstitutes,atthetimeittakesplace,acrimewithinthejurisdictionof
theCourt.

2. Thedefinitionofacrimeshallbestrictlyconstruedandshallnotbeextendedby
analogy.Incaseofambiguity,thedefinitionshallbeinterpretedinfavourofthe
personbeinginvestigated,prosecutedorconvicted.

3. Thisarticleshallnotaffectthecharacterizationofanyconductascriminalunder
internationallawindependentlyofthisStatute.

Article 23
Nulla poena sine lege
ApersonconvictedbytheCourtmaybepunishedonlyinaccordancewiththisStatute.

Article 24
Non-retroactivity ratione personae
1. NopersonshallbecriminallyresponsibleunderthisStatuteforconductpriorto
theentryintoforceoftheStatute.

2. Intheeventofachangeinthelawapplicabletoagivencasepriortoafinal
judgement,thelawmorefavourabletothepersonbeinginvestigated,prosecuted
orconvictedshallapply.

Article 25
Individual criminal responsibility
1. TheCourtshallhavejurisdictionovernaturalpersonspursuanttothisStatute.

2. ApersonwhocommitsacrimewithinthejurisdictionoftheCourtshallbe
individuallyresponsibleandliableforpunishmentinaccordancewiththisStatute.

3. InaccordancewiththisStatute,apersonshallbecriminallyresponsibleandliable
forpunishmentforacrimewithinthejurisdictionoftheCourtifthatperson:

(a) Commitssuchacrime,whetherasanindividual,jointlywithanotheror
through another person, regardless of whether that other person is
criminallyresponsible;

(b) Orders,solicitsorinducesthecommissionofsuchacrimewhichinfact
occursorisattempted;

(c) Forthepurposeoffacilitatingthecommissionofsuchacrime,aids,abets
or otherwise assists in its commission or its attempted commission,
includingprovidingthemeansforitscommission;

(d) Inanyotherwaycontributestothecommissionorattemptedcommission
ofsuchacrimebyagroupofpersonsactingwithacommonpurpose.Such
contributionshallbeintentionalandshalleither:

purposeofthegroup,wheresuchactivityorpurposeinvolvesthe
commissionofacrimewithinthejurisdictionoftheCourt;or

(ii) Bemadeintheknowledgeoftheintentionofthegrouptocommit
thecrime;

(e) Inrespectofthecrimeofgenocide,directlyandpubliclyincitesothersto
commitgenocide;

(f) Attemptstocommitsuchacrimebytakingactionthatcommencesits
executionbymeansofasubstantialstep,butthecrimedoesnotoccur
because of circumstances independent of the person's intentions.
However,apersonwhoabandonstheefforttocommitthecrimeor
otherwisepreventsthecompletionofthecrimeshallnotbeliablefor
punishmentunderthisStatutefortheattempttocommitthatcrimeifthat
personcompletelyandvoluntarilygaveupthecriminalpurpose.

4. NoprovisioninthisStatuterelatingtoindividualcriminalresponsibilityshall
affecttheresponsibilityofStatesunderinternationallaw.

Article 26
Exclusion of jurisdiction over persons under eighteen
TheCourtshallhavenojurisdictionoveranypersonwhowasundertheageof18atthetime
oftheallegedcommissionofacrime.

Article 27
Irrelevance of official capacity
1. ThisStatuteshallapplyequallytoallpersonswithoutanydistinctionbasedon
officialcapacity.Inparticular,officialcapacityasaHeadofStateorGovernment,a
member of a Government or parliament, an elected representative or a
governmentofficialshallinnocaseexemptapersonfromcriminalresponsibility
underthisStatute,norshallit,inandofitself,constituteagroundforreductionof
sentence.

2. Immunitiesorspecialproceduralruleswhichmayattachtotheofficialcapacityof
aperson,whetherundernationalorinternationallaw,shallnotbartheCourtfrom
exercisingitsjurisdictionoversuchaperson.

Article 28
Responsibility of commanders and other superiors
InadditiontoothergroundsofcriminalresponsibilityunderthisStatuteforcrimeswithinthe
jurisdictionoftheCourt:

(a) Amilitary commander or person effectively acting as a military


commander shall be criminally responsible for crimes within the
jurisdictionoftheCourtcommittedbyforcesunderhisorhereffective
commandandcontrol,oreffectiveauthorityandcontrolasthecasemay
be,asaresultofhisorherfailuretoexercisecontrolproperlyoversuch
forces,where:

(i) Thatmilitarycommanderorpersoneitherknewor,owingtothe
circumstances at the time, should have known that the forces
werecommittingorabouttocommitsuchcrimes;and

(ii) Thatmilitarycommanderorpersonfailedtotakeallnecessary
andreasonablemeasureswithinhisorherpowertopreventor
represstheircommissionortosubmitthemattertothecompetent
authoritiesforinvestigationandprosecution.

(b) Withrespecttosuperiorandsubordinaterelationshipsnotdescribedin
paragraph(a),asuperiorshallbecriminallyresponsibleforcrimeswithin
thejurisdictionoftheCourtcommittedbysubordinatesunderhisorher
effectiveauthorityandcontrol,asaresultofhisorherfailuretoexercise
controlproperlyoversuchsubordinates,where:

(i) Thesuperioreitherknew,orconsciouslydisregardedinformation
whichclearlyindicated,thatthesubordinateswerecommittingor
abouttocommitsuchcrimes;

(ii) The crimes concerned activities that were within the effective
responsibilityandcontrolofthesuperior;and

(iii) Thesuperiorfailedtotakeallnecessaryandreasonablemeasures
withinhisorherpowertopreventorrepresstheircommissionorto
submitthemattertothecompetentauthoritiesforinvestigationand
prosecution.

Article 29
Non-applicability of statute of limitations
The crimes within the jurisdiction of the Court shall not be subject to any statute of
limitations.

Article 30
Mental element
1. Unlessotherwiseprovided,apersonshallbecriminallyresponsibleandliablefor
punishmentforacrimewithinthejurisdictionoftheCourtonlyifthematerial
elementsarecommittedwithintentandknowledge.

2. Forthepurposesofthisarticle,apersonhasintentwhere:

(a) Inrelationtoconduct,thatpersonmeanstoengageintheconduct;

(b) Inrelationtoaconsequence,thatpersonmeanstocausethatconsequence
orisawarethatitwilloccurintheordinarycourseofevents.

3. Forthepurposesofthisarticle,knowledgemeansawarenessthatacircumstance
existsoraconsequencewilloccurintheordinarycourseofevents.Knowand
knowinglyshallbeconstruedaccordingly.

Article 31
Grounds for excluding criminal responsibility
1. Inadditiontoothergroundsforexcludingcriminalresponsibilityprovidedforin
thisStatute,apersonshallnotbecriminallyresponsibleif,atthetimeofthat
person'sconduct:

(a) Thepersonsuffersfromamentaldiseaseordefectthatdestroysthat
person'scapacitytoappreciatetheunlawfulnessornatureofhisorher
conduct,orcapacitytocontrolhisorherconducttoconformtothe
requirementsoflaw;

(b) Thepersonisinastateofintoxicationthatdestroysthatperson'scapacity
toappreciatetheunlawfulnessornatureofhisorherconduct,orcapacity
tocontrolhisorherconducttoconformtotherequirementsoflaw,unless
thepersonhasbecomevoluntarilyintoxicatedundersuchcircumstances
thatthepersonknew,ordisregardedtherisk,that,asaresultofthe
intoxication,heorshewaslikelytoengageinconductconstitutingacrime
withinthejurisdictionoftheCourt;

(c) Thepersonactsreasonablytodefendhimselforherselforanotherperson
or,inthecaseofwarcrimes,propertywhichisessentialforthesurvivalof
the person or another person or property which is essential for
accomplishingamilitarymission,againstanimminentandunlawfuluse
offorceinamannerproportionatetothedegreeofdangertothepersonor
theotherpersonorpropertyprotected.Thefactthatthepersonwas
involvedinadefensiveoperationconductedbyforcesshallnotinitself
constitute a ground for excluding criminal responsibility under this
subparagraph;

(d) Theconductwhichisallegedtoconstituteacrimewithinthejurisdiction
oftheCourthasbeencausedbyduressresultingfromathreatofimminent
deathorofcontinuingorimminentseriousbodilyharmagainstthat
personoranotherperson,andthepersonactsnecessarilyandreasonably
toavoidthisthreat,providedthatthepersondoesnotintendtocausea
greaterharmthantheonesoughttobeavoided.Suchathreatmayeither
be:

(i) Madebyotherpersons;or

(ii) Constitutedbyothercircumstancesbeyondthatperson'scontrol.

2. TheCourtshalldeterminetheapplicabilityofthegroundsforexcludingcriminal
responsibilityprovidedforinthisStatutetothecasebeforeit.

3. Attrial,theCourtmayconsideragroundforexcludingcriminalresponsibility
otherthanthosereferredtoinparagraph1wheresuchagroundisderivedfrom
applicable law as set forth in article 21. The procedures relating to the
considerationofsuchagroundshallbeprovidedforintheRulesofProcedureand
Evidence.

Article 32
Mistake of fact or mistake of law
1. Amistakeoffactshallbeagroundforexcludingcriminalresponsibilityonlyifit
negatesthementalelementrequiredbythecrime.

2. Amistakeoflawastowhetheraparticulartypeofconductisacrimewithinthe
jurisdictionoftheCourtshallnotbeagroundforexcludingcriminalresponsibility.
Amistakeoflawmay,however,beagroundforexcludingcriminalresponsibilityif
itnegatesthementalelementrequiredbysuchacrime,orasprovidedforin
article33.

Article 33
Superior orders and prescription of law
1. ThefactthatacrimewithinthejurisdictionoftheCourthasbeencommittedbya
personpursuanttoanorderofaGovernmentorofasuperior,whether militaryor
civilian,shallnotrelievethatpersonofcriminalresponsibilityunless:

(a) ThepersonwasunderalegalobligationtoobeyordersoftheGovernment
orthesuperiorinquestion;

(b) Thepersondidnotknowthattheorderwasunlawful;and

(c) Theorderwasnotmanifestlyunlawful.

2. Forthepurposesofthisarticle,orderstocommitgenocideorcrimesagainst
humanityaremanifestlyunlawful.

Article 34
Organs of the Court
TheCourtshallbecomposedofthefollowingorgans:

(a) ThePresidency;

(b) AnAppealsDivision,aTrialDivisionandaPreTrialDivision;

(c) TheOfficeoftheProsecutor;

(d) TheRegistry.

Article 35
Service of judges
1. AlljudgesshallbeelectedasfulltimemembersoftheCourtandshallbeavailable
toserveonthatbasisfromthecommencementoftheirtermsofoffice.

2. ThejudgescomposingthePresidencyshallserveonafulltimebasisassoonas
theyareelected.

3. ThePresidencymay,onthebasisoftheworkloadoftheCourtandinconsultation
withitsmembers,decidefromtimetotimetowhatextenttheremainingjudges
shallberequiredtoserveonafulltimebasis.Anysucharrangementshallbe
withoutprejudicetotheprovisionsofarticle40.

4. Thefinancialarrangementsforjudgesnotrequiredtoserveonafulltimebasis
shallbemadeinaccordancewitharticle49.

Article 36
Qualifications, nomination and election of judges
1. Subjecttotheprovisionsofparagraph2,thereshallbe18judgesoftheCourt.

2. (a) ThePresidency,actingonbehalfoftheCourt,mayproposeanincreasein
thenumberofjudgesspecifiedinparagraph1,indicatingthereasonswhy
thisisconsiderednecessaryandappropriate.TheRegistrarshallpromptly
circulateanysuchproposaltoallStatesParties.

(b) AnysuchproposalshallthenbeconsideredatameetingoftheAssembly
of States Parties to be convened in accordance with article 112. The
proposalshallbeconsideredadoptedifapprovedatthemeetingbyavote
oftwothirdsofthemembersoftheAssemblyofStatesPartiesandshall
enterintoforceatsuchtimeasdecidedbytheAssemblyofStatesParties.

(c) (i) Onceaproposalforanincreaseinthenumberofjudgeshasbeen


adopted under subparagraph (b), the election of the additional
judgesshalltakeplaceatthenextsessionoftheAssemblyofStates
Parties in accordance with paragraphs 3 to 8, and article 37,
paragraph2;

(ii) Once a proposal for an increase in the number of judges has


been adopted and brought into effect under subparagraphs (b)
and (c) (i), it shall be open to the Presidency at any time
thereafter,iftheworkloadoftheCourtjustifiesit,toproposea
reductioninthenumberofjudges,providedthatthenumberof
judgesshallnotbereducedbelowthatspecifiedinparagraph1.
The proposal shall be dealt with in accordance with the
procedurelaiddowninsubparagraphs(a)and(b).Intheevent
that the proposal is adopted, the number of judges shall be
progressivelydecreasedasthetermsofofficeofservingjudges
expire,untilthenecessarynumberhasbeenreached.

3. (a) Thejudgesshallbechosenfromamongpersonsofhighmoralcharacter,
impartiality and integrity who possess the qualifications required in
theirrespectiveStatesforappointmenttothehighestjudicialoffices.

(b) EverycandidateforelectiontotheCourtshall:

(i) Haveestablishedcompetenceincriminallawandprocedure,and
thenecessaryrelevantexperience,whetherasjudge,prosecutor,
advocateorinothersimilarcapacity,incriminalproceedings;or

(ii) Haveestablishedcompetenceinrelevantareasofinternationallaw
suchasinternationalhumanitarianlawandthelawofhumanrights,
andextensiveexperienceinaprofessionallegalcapacitywhichisof
relevancetothejudicialworkoftheCourt;

(c) Every candidate for election to the Court shall have an excellent
knowledgeofandbefluentinatleastoneoftheworkinglanguagesofthe
Court.

4. (a) NominationsofcandidatesforelectiontotheCourtmaybemadebyany
StatePartytothisStatute,andshallbemadeeither:

(i) Bytheprocedureforthenominationofcandidatesforappointment
tothehighestjudicialofficesintheStateinquestion;or

(ii) Bytheprocedureprovidedforthenominationofcandidatesforthe
InternationalCourtofJusticeintheStatuteofthatCourt.

Nominations shall be accompanied by a statement in the necessary detail


specifyinghowthecandidatefulfilstherequirementsofparagraph3.

(b) EachStatePartymayputforwardonecandidateforanygivenelection
whoneednotnecessarilybeanationalofthatStatePartybutshallinany
casebeanationalofaStateParty.

(c) TheAssemblyofStatesPartiesmaydecidetoestablish,ifappropriate,an
Advisory Committee on nominations. In that event, the Committee's
compositionandmandateshallbeestablishedbytheAssemblyofStates
Parties.

5. Forthepurposesoftheelection,thereshallbetwolistsofcandidates:
ListAcontainingthenamesofcandidateswiththequalificationsspecifiedin
paragraph3(b)(i);and
ListBcontainingthenamesofcandidateswiththequalificationsspecifiedin
paragraph3(b)(ii).
Acandidatewithsufficientqualificationsforbothlistsmaychooseonwhichlistto
appear.AtthefirstelectiontotheCourt,atleastninejudgesshallbeelectedfrom
listAand at least five judges from list B. Subsequent elections shall be so
organized as to maintain the equivalent proportion on the Court of judges
qualifiedonthetwolists.

6. (a) ThejudgesshallbeelectedbysecretballotatameetingoftheAssemblyof
StatesPartiesconvenedforthatpurposeunderarticle112.Subjectto
paragraph7,thepersonselectedtotheCourtshallbethe18candidates
whoobtainthehighestnumberofvotesandatwothirdsmajorityofthe
StatesPartiespresentandvoting.

(b) Intheeventthatasufficientnumberofjudgesisnotelectedonthefirst
ballot,successiveballotsshallbeheldinaccordancewiththeprocedures
laiddowninsubparagraph(a)untiltheremainingplaceshavebeenfilled.

7. NotwojudgesmaybenationalsofthesameState.Apersonwho,forthepurposes
ofmembershipoftheCourt,couldberegardedasanationalofmorethanone
StateshallbedeemedtobeanationaloftheStateinwhichthatpersonordinarily
exercisescivilandpoliticalrights.

8. (a) TheStatesPartiesshall,intheselectionofjudges,takeintoaccount
theneed,withinthemembershipoftheCourt,for:

(i) Therepresentationoftheprincipallegalsystemsoftheworld;

(ii) Equitablegeographicalrepresentation;and

(iii) Afairrepresentationoffemaleandmalejudges.

(b) StatesPartiesshallalsotakeintoaccounttheneedtoincludejudgeswith
legalexpertiseonspecificissues,including,butnotlimitedto,violence
againstwomenorchildren.

9. (a) Subjecttosubparagraph(b),judgesshallholdofficeforatermofnine
yearsand,subjecttosubparagraph(c)andtoarticle37,paragraph2,
shallnotbeeligibleforreelection.

(b) Atthefirstelection,onethirdofthejudgeselectedshallbeselectedbylot
toserveforatermofthreeyears;onethirdofthejudgeselectedshallbe
selectedbylottoserveforatermofsixyears;andtheremaindershall
serveforatermofnineyears.

(c) Ajudge who is selected to serve for a term of three years under
subparagraph(b)shallbeeligibleforreelectionforafullterm.

10. Notwithstandingparagraph9,ajudgeassignedtoaTrialorAppealsChamberin
accordancewitharticle39shallcontinueinofficetocompleteanytrialorappeal
thehearingofwhichhasalreadycommencedbeforethatChamber.

Article 37
Judicial vacancies
1. Intheeventofavacancy,anelectionshallbeheldinaccordancewitharticle36to
fillthevacancy.

2. Ajudgeelectedtofillavacancyshallservefortheremainderofthepredecessor's
termand,ifthatperiodisthreeyearsorless,shallbeeligibleforreelectionfora
fulltermunderarticle36.

Article 38
The Presidency
1. ThePresidentandtheFirstandSecondVicePresidentsshallbeelectedbyan
absolutemajorityofthejudges.Theyshalleachserveforatermofthreeyearsor
untiltheendoftheirrespectivetermsofofficeasjudges,whicheverexpiresearlier.
Theyshallbeeligibleforreelectiononce.

2. TheFirstVicePresidentshallactinplaceofthePresidentintheeventthat
the President is unavailable or disqualified. The Second VicePresident shall
actinplaceofthePresidentintheeventthatboththePresidentandtheFirst
VicePresidentareunavailableordisqualified.

3. ThePresident,togetherwiththeFirstandSecondVicePresidents,shallconstitute
thePresidency,whichshallberesponsiblefor:

(a) TheproperadministrationoftheCourt,withtheexceptionoftheOfficeof
theProsecutor;and

(b) TheotherfunctionsconferreduponitinaccordancewiththisStatute.

4. In discharging its responsibility under paragraph 3 (a), the Presidency shall


coordinatewithandseektheconcurrenceoftheProsecutoronallmattersof
mutualconcern.

Article 39
Chambers
1. Assoonaspossibleaftertheelectionofthejudges,theCourtshallorganizeitself
intothedivisionsspecifiedinarticle34,paragraph(b).TheAppealsDivisionshall
becomposedofthePresidentandfourotherjudges,theTrialDivisionofnotless
than six judges and the PreTrial Division of not less than six judges. The
assignmentofjudgestodivisionsshallbebasedonthenatureofthefunctionsto
beperformedbyeachdivisionandthequalificationsandexperienceofthejudges
electedtotheCourt,insuchawaythateachdivisionshallcontainanappropriate
combinationofexpertiseincriminallawandprocedureandininternationallaw.
TheTrialandPreTrialDivisionsshallbecomposedpredominantlyofjudgeswith
criminaltrialexperience.

2. (a) The judicial functions of the Court shall be carried out in each
divisionbyChambers.

(b) (i) TheAppealsChambershallbecomposedofallthejudgesofthe


AppealsDivision;

(ii) ThefunctionsoftheTrialChambershallbecarriedoutbythree
judgesoftheTrialDivision;

(iii) ThefunctionsofthePreTrialChambershallbecarriedouteitherby
threejudgesofthePreTrialDivisionorbyasinglejudgeofthat
divisioninaccordancewiththisStatuteandtheRulesofProcedure
andEvidence;

(c) Nothinginthisparagraphshallprecludethesimultaneousconstitutionof
morethanoneTrialChamberorPreTrialChamberwhentheefficient
managementoftheCourt'sworkloadsorequires.

3. (a) JudgesassignedtotheTrialandPreTrialDivisionsshallserveinthose
divisionsforaperiodofthreeyears,andthereafteruntilthecompletionof
anycasethehearingofwhichhasalreadycommencedinthedivision
concerned.

(b) Judges assigned to the Appeals Division shall serve in that division
fortheirentiretermofoffice.

4. JudgesassignedtotheAppealsDivisionshallserveonlyinthatdivision.Nothing
inthisarticleshall,however,precludethetemporaryattachmentofjudgesfrom
theTrialDivisiontothePreTrialDivisionorviceversa,ifthePresidencyconsiders
thattheefficientmanagementoftheCourt'sworkloadsorequires,providedthat
undernocircumstancesshallajudgewhohasparticipatedinthepretrialphaseof
acasebeeligibletositontheTrialChamberhearingthatcase.

Article 40
Independence of the judges
1. Thejudgesshallbeindependentintheperformanceoftheirfunctions.

2. Judgesshallnotengageinanyactivitywhichislikelytointerferewiththeir
judicialfunctionsortoaffectconfidenceintheirindependence.

3. JudgesrequiredtoserveonafulltimebasisattheseatoftheCourtshallnot
engageinanyotheroccupationofaprofessionalnature.

4. Anyquestionregardingtheapplicationofparagraphs2and3shallbedecidedby
an absolute majority of the judges. Where any such question concerns an
individualjudge,thatjudgeshallnottakepartinthedecision.

Article 41
Excusing and disqualification of judges
1. ThePresidencymay,attherequestofajudge,excusethatjudgefromtheexercise
ofafunctionunderthisStatute,inaccordancewiththeRulesofProcedureand
Evidence.

2. (a) Ajudgeshallnotparticipateinanycaseinwhichhisorherimpartiality
mightreasonablybedoubtedonanyground.Ajudgeshallbedisqualified
fromacaseinaccordancewiththisparagraphif,interalia,thatjudgehas
previouslybeeninvolvedinanycapacityinthatcasebeforetheCourtorin
arelatedcriminalcaseatthenationallevelinvolvingthepersonbeing
investigatedorprosecuted.Ajudgeshallalsobedisqualifiedonsuchother
groundsasmaybeprovidedforintheRulesofProcedureandEvidence.

(b) The Prosecutor or the person being investigated or prosecuted may


requestthedisqualificationofajudgeunderthisparagraph.

(c) Anyquestionastothedisqualificationofajudgeshallbedecidedbyan
absolutemajorityofthejudges.Thechallengedjudgeshallbeentitledto
presenthisorhercommentsonthematter,butshallnottakepartinthe
decision.

Article 42
The Office of the Prosecutor
1. TheOfficeoftheProsecutorshallactindependentlyasaseparateorganofthe
Court. It shall be responsible for receiving referrals and any substantiated
informationoncrimeswithinthejurisdictionoftheCourt,forexaminingthemand
forconductinginvestigationsandprosecutionsbeforetheCourt.Amemberofthe
Officeshallnotseekoractoninstructionsfromanyexternalsource.

2. TheOfficeshallbeheadedbytheProsecutor.TheProsecutorshallhavefull
authorityoverthemanagementandadministrationoftheOffice,includingthe
staff,facilitiesandotherresourcesthereof.TheProsecutorshallbeassistedbyone
ormoreDeputyProsecutors,whoshallbeentitledtocarryoutanyoftheacts
requiredoftheProsecutorunderthisStatute.TheProsecutorandtheDeputy
Prosecutorsshallbeofdifferentnationalities.Theyshallserveonafulltimebasis.

3. The Prosecutor and the Deputy Prosecutors shall be persons of high moral
character,behighlycompetentinandhaveextensivepracticalexperienceinthe
prosecutionortrialofcriminalcases.Theyshallhaveanexcellentknowledgeof
andbefluentinatleastoneoftheworkinglanguagesoftheCourt.

4. TheProsecutorshallbeelectedbysecretballotbyanabsolutemajorityofthe
membersoftheAssemblyofStatesParties.TheDeputyProsecutorsshallbe
electedinthesamewayfromalistofcandidatesprovidedbytheProsecutor.The
ProsecutorshallnominatethreecandidatesforeachpositionofDeputyProsecutor
tobefilled.Unlessashortertermisdecideduponatthetimeoftheirelection,the
ProsecutorandtheDeputyProsecutorsshallholdofficeforatermofnineyears
andshallnotbeeligibleforreelection.

5. NeithertheProsecutornoraDeputyProsecutorshallengageinanyactivitywhich
islikelytointerferewithhisorherprosecutorialfunctionsortoaffectconfidence
inhisorherindependence.Theyshallnotengageinanyotheroccupationofa
professionalnature.

6. ThePresidencymayexcusetheProsecutororaDeputyProsecutor,athisorher
request,fromactinginaparticularcase.

7. NeithertheProsecutornoraDeputyProsecutorshallparticipateinanymatterin
whichtheirimpartialitymightreasonablybedoubtedonanyground.Theyshall
bedisqualifiedfromacaseinaccordancewiththisparagraphif,interalia,they
havepreviouslybeeninvolvedinanycapacityinthatcasebeforetheCourtorina
relatedcriminalcaseatthenationallevelinvolvingthepersonbeinginvestigated
orprosecuted.

8. AnyquestionastothedisqualificationoftheProsecutororaDeputyProsecutor
shallbedecidedbytheAppealsChamber.

(a) Thepersonbeinginvestigatedorprosecutedmayatanytimerequestthe
disqualificationoftheProsecutororaDeputyProsecutoronthegrounds
setoutinthisarticle;

(b) TheProsecutorortheDeputyProsecutor,asappropriate,shallbeentitled
topresenthisorhercommentsonthematter.

9. TheProsecutorshallappointadviserswithlegalexpertiseonspecificissues,
including,butnotlimitedto,sexualandgenderviolenceandviolenceagainst
children.

Article 43
The Registry
1. TheRegistryshallberesponsibleforthenonjudicialaspectsoftheadministration
andservicingoftheCourt,withoutprejudicetothefunctionsandpowersofthe
Prosecutorinaccordancewitharticle42.

2. The Registry shall be headed by the Registrar, who shall be the principal
administrativeofficeroftheCourt.TheRegistrarshallexercisehisorherfunctions
undertheauthorityofthePresidentoftheCourt.

3. TheRegistrarandtheDeputyRegistrarshallbepersonsofhighmoralcharacter,
behighlycompetentandhaveanexcellentknowledgeofandbefluentinatleast
oneoftheworkinglanguagesoftheCourt.

4. ThejudgesshallelecttheRegistrarbyanabsolutemajoritybysecretballot,taking
intoaccountanyrecommendationbytheAssemblyofStatesParties.Iftheneed
arisesandupontherecommendationoftheRegistrar,thejudgesshallelect,inthe
samemanner,aDeputyRegistrar.

5. TheRegistrarshallholdofficeforatermoffiveyears,shallbeeligibleforre
electiononceandshallserveonafulltimebasis.TheDeputyRegistrarshallhold
officeforatermoffiveyearsorsuchshortertermasmaybedecideduponbyan
absolutemajorityofthejudges,andmaybeelectedonthebasisthattheDeputy
Registrarshallbecalledupontoserveasrequired.

6. TheRegistrarshallsetupaVictimsandWitnessesUnitwithintheRegistry.This
Unitshallprovide,inconsultationwiththeOfficeoftheProsecutor,protective
measuresandsecurityarrangements,counsellingandotherappropriateassistance
forwitnesses,victimswhoappearbeforetheCourt,andotherswhoareatriskon
accountoftestimonygivenbysuchwitnesses.TheUnitshallincludestaffwith
expertiseintrauma,includingtraumarelatedtocrimesofsexualviolence.

Article 44
Staf
1. TheProsecutorandtheRegistrarshallappointsuchqualifiedstaffasmaybe
requiredtotheirrespectiveoffices.InthecaseoftheProsecutor,thisshallinclude
theappointmentofinvestigators.

2. Intheemploymentofstaff,theProsecutorandtheRegistrarshallensurethe
higheststandardsofefficiency,competencyandintegrity,andshallhaveregard,
mutatismutandis,tothecriteriasetforthinarticle36,paragraph8.

3. TheRegistrar,withtheagreementofthePresidencyandtheProsecutor,shall
proposeStaffRegulationswhichincludethetermsandconditionsuponwhichthe
staffoftheCourtshallbeappointed,remuneratedanddismissed.TheStaff
RegulationsshallbeapprovedbytheAssemblyofStatesParties.

4. The Court may, in exceptional circumstances, employ the expertise of gratis


personnel offered by States Parties, intergovernmental organizations or non
governmental organizations to assist with the work of any of the organs
oftheCourt.TheProsecutormayacceptanysuchofferonbehalfoftheOfficeof
the Prosecutor. Such gratis personnel shall be employed in accordance with
guidelinestobeestablishedbytheAssemblyofStatesParties.

Article 45
Solemn undertaking
Before taking up their respective duties under this Statute, the judges, the
Prosecutor,theDeputyProsecutors,theRegistrarandtheDeputyRegistrarshall
eachmakeasolemnundertakinginopencourttoexercisehisorherrespective
functionsimpartiallyandconscientiously.

Article 46
Removal from office
1. Ajudge,theProsecutor,aDeputyProsecutor,theRegistrarortheDeputyRegistrar
shallberemovedfromofficeifadecisiontothiseffectismadeinaccordancewith
paragraph2,incaseswherethatperson:

(a) Isfoundtohavecommittedseriousmisconductoraseriousbreachofhis

2. Adecisionastotheremovalfromofficeofajudge,theProsecutororaDeputy
Prosecutorunderparagraph1shallbemadebytheAssemblyofStatesParties,by
secretballot:

(a) Inthecaseofajudge,byatwothirdsmajorityoftheStatesPartiesupona
recommendationadoptedbyatwothirdsmajorityoftheotherjudges;

(b) InthecaseoftheProsecutor,byanabsolutemajorityoftheStatesParties;

(c) InthecaseofaDeputyProsecutor,byanabsolutemajorityoftheStates
PartiesupontherecommendationoftheProsecutor.

3. AdecisionastotheremovalfromofficeoftheRegistrarorDeputyRegistrarshall
bemadebyanabsolutemajorityofthejudges.

4. Ajudge,Prosecutor,DeputyProsecutor,RegistrarorDeputyRegistrarwhose
conductorabilitytoexercisethefunctionsoftheofficeasrequiredbythisStatute
ischallengedunderthisarticleshallhavefullopportunitytopresentandreceive
evidenceandtomakesubmissionsinaccordancewiththeRulesofProcedureand
Evidence. The person in question shall not otherwise participate in the
considerationofthematter.

Article 47
Disciplinary measures
Ajudge,Prosecutor,DeputyProsecutor,RegistrarorDeputyRegistrarwhohascommitted
misconductofalessseriousnaturethanthatsetoutinarticle46,paragraph1,shallbesubject
todisciplinarymeasures,inaccordancewiththeRulesofProcedureandEvidence.

Article 48
Privileges and immunities
1. TheCourtshallenjoyintheterritoryofeachStatePartysuchprivilegesand
immunitiesasarenecessaryforthefulfilmentofitspurposes.

2. Thejudges,theProsecutor,theDeputyProsecutorsandtheRegistrarshall,when
engagedonorwithrespecttothebusinessoftheCourt,enjoythesameprivileges
andimmunitiesasareaccordedtoheadsofdiplomaticmissionsandshall,after
theexpiryoftheirtermsofoffice,continuetobeaccordedimmunityfromlegal
processofeverykindinrespectofwordsspokenorwrittenandactsperformedby
themintheirofficialcapacity.

3. TheDeputyRegistrar,thestaffoftheOfficeoftheProsecutorandthestaff
oftheRegistryshallenjoytheprivilegesandimmunitiesandfacilitiesnecessary

privilegesandimmunitiesoftheCourt.

4. Counsel,experts,witnessesoranyotherpersonrequiredtobepresentattheseat
oftheCourtshallbeaccordedsuchtreatmentasisnecessaryfortheproper
functioningoftheCourt,inaccordancewiththeagreementontheprivilegesand
immunitiesoftheCourt.

5. Theprivilegesandimmunitiesof:

(a) AjudgeortheProsecutormaybewaivedbyanabsolutemajorityofthe
judges;

(b) TheRegistrarmaybewaivedbythePresidency;

(c) TheDeputyProsecutorsandstaffoftheOfficeoftheProsecutormaybe
waivedbytheProsecutor;

(d) TheDeputyRegistrarandstaffoftheRegistrymaybewaivedbythe
Registrar.

Article 49
Salaries, allowances and expenses
Thejudges,theProsecutor,theDeputyProsecutors,theRegistrarandtheDeputyRegistrar
shallreceivesuchsalaries,allowancesandexpensesasmaybedecideduponbytheAssembly
ofStatesParties.Thesesalariesandallowancesshallnotbereducedduringtheirtermsof
office.

Article 50
Official and working languages
1. TheofficiallanguagesoftheCourtshallbeArabic,Chinese,English,French,
RussianandSpanish.ThejudgementsoftheCourt,aswellasotherdecisions
resolvingfundamentalissuesbeforetheCourt,shallbepublishedintheofficial
languages.ThePresidencyshall,inaccordancewiththecriteriaestablishedbythe
RulesofProcedureandEvidence,determinewhichdecisionsmaybeconsideredas
resolvingfundamentalissuesforthepurposesofthisparagraph.

2. TheworkinglanguagesoftheCourtshallbeEnglishandFrench.TheRulesof
Procedure and Evidence shall determine the cases in which other official
languagesmaybeusedasworkinglanguages.

3. AttherequestofanypartytoaproceedingoraStateallowedtointerveneina
proceeding,theCourtshallauthorizealanguageotherthanEnglishorFrenchto
be used by such a party or State, provided that the Court considers such
authorizationtobeadequatelyjustified.

Article 51
Rules of Procedure and Evidence
1. TheRulesofProcedureandEvidenceshallenterintoforceuponadoptionbya
twothirdsmajorityofthemembersoftheAssemblyofStatesParties.

2. AmendmentstotheRulesofProcedureandEvidencemaybeproposedby:

(a) AnyStateParty;

(b) Thejudgesactingbyanabsolutemajority;or

(c) TheProsecutor.

Suchamendmentsshallenterintoforceuponadoptionbyatwothirdsmajorityof
themembersoftheAssemblyofStatesParties.

3. AftertheadoptionoftheRulesofProcedureandEvidence,inurgentcaseswhere
theRulesdonotprovideforaspecificsituationbeforetheCourt,thejudgesmay,
byatwothirdsmajority,drawupprovisionalRulestobeapplieduntiladopted,
amendedorrejectedatthenextordinaryorspecialsessionoftheAssemblyof
StatesParties.

4. TheRulesofProcedureandEvidence,amendmentstheretoandanyprovisional
RuleshallbeconsistentwiththisStatute.AmendmentstotheRulesofProcedure
andEvidenceaswellasprovisionalRulesshallnotbeappliedretroactivelytothe
detrimentofthepersonwhoisbeinginvestigatedorprosecutedorwhohasbeen
convicted.

5. IntheeventofconflictbetweentheStatuteandtheRulesofProcedureand
Evidence,theStatuteshallprevail.

Article 52
Regulations of the Court
1. Thejudgesshall,inaccordancewiththisStatuteandtheRulesofProcedureand
Evidence,adopt,byanabsolutemajority,theRegulationsoftheCourtnecessary
foritsroutinefunctioning.

2. TheProsecutorandtheRegistrarshallbeconsultedintheelaborationofthe
Regulationsandanyamendmentsthereto.

3. TheRegulationsandanyamendmentstheretoshalltakeeffectuponadoption
unlessotherwisedecidedbythejudges.Immediatelyuponadoption,theyshallbe
circulatedtoStatesPartiesforcomments.Ifwithinsixmonthsthereareno
objectionsfromamajorityofStatesParties,theyshallremaininforce.

Article 53
Initiation of an investigation
1. TheProsecutorshall,havingevaluatedtheinformationmadeavailabletohimor
her, initiate an investigation unless he or she determines that there is no
reasonablebasistoproceedunderthisStatute.Indecidingwhethertoinitiatean
investigation,theProsecutorshallconsiderwhether:

(a) TheinformationavailabletotheProsecutorprovidesareasonablebasisto
believethatacrimewithinthejurisdictionoftheCourthasbeenoris
beingcommitted;

(b) Thecaseisorwouldbeadmissibleunderarticle17;and

(c) Takingintoaccountthegravityofthecrimeandtheinterestsofvictims,
therearenonethelesssubstantialreasonstobelievethataninvestigation
wouldnotservetheinterestsofjustice.

IftheProsecutordeterminesthatthereisnoreasonablebasistoproceedandhisor
herdeterminationisbasedsolelyonsubparagraph(c)above,heorsheshall
informthePreTrialChamber.

2. If,uponinvestigation,theProsecutorconcludesthatthereisnotasufficientbasis
foraprosecutionbecause:

(a) There is not a sufficient legal or factual basis to seek a warrant or


summonsunderarticle58;

(b) Thecaseisinadmissibleunderarticle17;or

(c) Aprosecution is not in the interests of justice, taking into account


allthecircumstances,includingthegravityofthecrime,theinterests
of victims and the age or infirmity of the alleged perpetrator, and
his or her role in the alleged crime; the Prosecutor shall inform
thePreTrialChamberandtheStatemakingareferralunderarticle14
ortheSecurityCouncilinacaseunderarticle13,paragraph(b),ofhis
orherconclusionandthereasonsfortheconclusion.

3. (a) AttherequestoftheStatemakingareferralunderarticle14orthe
SecurityCouncilunderarticle13,paragraph(b),thePreTrialChamber
mayreviewadecisionoftheProsecutorunderparagraph1or2notto
proceedandmayrequesttheProsecutortoreconsiderthatdecision.

(b) Inaddition,thePreTrialChambermay,onitsowninitiative,review
a decision of the Prosecutor not to proceed if it is based solely on
paragraph1(c)or2(c).Insuchacase,thedecisionoftheProsecutorshall
beeffectiveonlyifconfirmedbythePreTrialChamber.

4. TheProsecutormay,atanytime,reconsideradecisionwhethertoinitiatean
investigationorprosecutionbasedonnewfactsorinformation.

Article 54
Duties and powers of the Prosecutor with respect to investigations
1. TheProsecutorshall:

(a) In order to establish the truth, extend the investigation to cover all
facts and evidence relevant to an assessment of whether there is
criminalresponsibilityunderthisStatute,and,indoingso,investigate
incriminatingandexoneratingcircumstancesequally;

(b) Take appropriate measures to ensure the effective investigation and


prosecutionofcrimeswithinthejurisdictionoftheCourt,andindoingso,
respecttheinterestsandpersonalcircumstancesofvictimsandwitnesses,
includingage,genderasdefinedinarticle7,paragraph3,andhealth,and
takeintoaccountthenatureofthecrime,inparticularwhereitinvolves
sexualviolence,genderviolenceorviolenceagainstchildren;and

(c) FullyrespecttherightsofpersonsarisingunderthisStatute.

2. TheProsecutormayconductinvestigationsontheterritoryofaState:

(a) InaccordancewiththeprovisionsofPart9;or

(b) AsauthorizedbythePreTrialChamberunderarticle57,paragraph3(d).

3. TheProsecutormay:

(a) Collectandexamineevidence;

(b) Requestthepresenceofandquestionpersonsbeinginvestigated,victims
andwitnesses;

(c) SeekthecooperationofanyStateorintergovernmentalorganizationor
arrangement in accordance with its respective competence and/or
mandate;

(d) Enterintosucharrangementsoragreements,notinconsistentwiththis
Statute,asmaybenecessarytofacilitatethecooperationofaState,
intergovernmentalorganizationorperson;

(e) Agreenottodisclose,atanystageoftheproceedings,documentsor
informationthattheProsecutorobtainsontheconditionofconfidentiality
andsolelyforthepurposeofgeneratingnewevidence,unlesstheprovider
oftheinformationconsents;and

(f) Takenecessarymeasures,orrequestthatnecessarymeasuresbetaken,to
ensuretheconfidentialityofinformation,theprotectionofanypersonor
thepreservationofevidence.

Article 55
Rights of persons during an investigation
1. InrespectofaninvestigationunderthisStatute,aperson:

(a) Shallnotbecompelledtoincriminatehimselforherselfortoconfessguilt;

(b) Shallnotbesubjectedtoanyformofcoercion,duressorthreat,totorture
or to any other form of cruel, inhuman or degrading treatment or
punishment;

(c) Shall,ifquestionedinalanguageotherthanalanguagethepersonfully
understands and speaks, have, free of any cost, the assistance of a
competentinterpreterandsuchtranslationsasarenecessarytomeetthe
requirementsoffairness;and

(d) Shallnotbesubjectedtoarbitraryarrestordetention,andshallnotbe
deprivedofhisorherlibertyexceptonsuchgroundsandinaccordance
withsuchproceduresasareestablishedinthisStatute.

2. Wheretherearegroundstobelievethatapersonhascommittedacrimewithin
thejurisdictionoftheCourtandthatpersonisabouttobequestionedeitherby
theProsecutor,orbynationalauthoritiespursuanttoarequestmadeunderPart9,
thatpersonshallalsohavethefollowingrightsofwhichheorsheshallbe
informedpriortobeingquestioned:

(a) Tobeinformed,priortobeingquestioned,thattherearegroundsto
believethatheorshehascommittedacrimewithinthejurisdictionofthe
Court;

(b) To remain silent, without such silence being a consideration in the


determinationofguiltorinnocence;

(c) Tohavelegalassistanceoftheperson'schoosing,or,ifthepersondoesnot
havelegalassistance,tohavelegalassistanceassignedtohimorher,in
anycasewheretheinterestsofjusticesorequire,andwithoutpaymentby
thepersoninanysuchcaseifthepersondoesnothavesufficientmeansto
payforit;and

(d) To be questioned in the presence of counsel unless the person has


voluntarilywaivedhisorherrighttocounsel.

Article 56
Role of the Pre-Trial Chamber in relation to a unique investigative
opportunity
1. (a) Where the Prosecutor considers an investigation to present a unique
opportunitytotaketestimonyorastatementfromawitnessortoexamine,
collectortestevidence,whichmaynotbeavailablesubsequentlyforthe
purposesofatrial,theProsecutorshallsoinformthePreTrialChamber.

(b) Inthatcase,thePreTrialChambermay,uponrequestoftheProsecutor,
takesuchmeasuresasmaybenecessarytoensuretheefficiencyand
integrityoftheproceedingsand,inparticular,toprotecttherightsofthe
defence.

(c) Unless the PreTrial Chamber orders otherwise, the Prosecutor shall
providetherelevantinformationtothepersonwhohasbeenarrestedor
appearedinresponsetoasummonsinconnectionwiththeinvestigation
referredtoinsubparagraph(a),inorderthatheorshemaybeheardon
thematter.

2. Themeasuresreferredtoinparagraph1(b)mayinclude:

(a) Makingrecommendationsorordersregardingprocedurestobefollowed;

(b) Directingthatarecordbemadeoftheproceedings;

(c) Appointinganexperttoassist;

(d) Authorizingcounselforapersonwhohasbeenarrested,orappeared
beforetheCourtinresponsetoasummons,toparticipate,orwherethere
hasnotyetbeensuchanarrestorappearanceorcounselhasnotbeen
designated, appointing another counsel to attend and represent the
interestsofthedefence;

(e) Namingoneofitsmembersor,ifnecessary,anotheravailablejudgeofthe
PreTrialorTrialDivisiontoobserveandmakerecommendationsororders
regardingthecollectionandpreservationofevidenceandthequestioning
ofpersons;

(f) Taking such other action as may be necessary to collect or preserve


evidence.

3. (a) WheretheProsecutorhasnotsoughtmeasurespursuanttothisarticlebut
the PreTrial Chamber considers that such measures are required to
preserveevidencethatitdeemswouldbeessentialforthedefenceattrial,
itshallconsultwiththeProsecutorastowhetherthereisgoodreasonfor
theProsecutor'sfailuretorequestthemeasures.Ifuponconsultation,the
PreTrialChamberconcludesthattheProsecutor'sfailuretorequestsuch
measuresisunjustified,thePreTrialChambermaytakesuchmeasureson
itsowninitiative.

(b) AdecisionofthePreTrialChambertoactonitsowninitiativeunderthis
paragraphmaybeappealedbytheProsecutor.Theappealshallbeheard
onanexpeditedbasis.

4. Theadmissibilityofevidencepreservedorcollectedfortrialpursuanttothis
article,ortherecordthereof,shallbegovernedattrialbyarticle69,andgivensuch
weightasdeterminedbytheTrialChamber.

Article 57
Functions and powers of the Pre-Trial Chamber
1. UnlessotherwiseprovidedinthisStatute,thePreTrialChambershallexerciseits
functionsinaccordancewiththeprovisionsofthisarticle.

2. (a) OrdersorrulingsofthePreTrialChamberissuedunderarticles15,18,19,
54,paragraph2,61,paragraph7,and72mustbeconcurredinbya
majorityofitsjudges.

(b) Inallothercases,asinglejudgeofthePreTrialChambermayexercisethe
functionsprovidedforinthisStatute,unlessotherwiseprovidedforin
theRulesofProcedureandEvidenceorbyamajorityofthePreTrial
Chamber.

3. InadditiontoitsotherfunctionsunderthisStatute,thePreTrialChambermay:

(a) AttherequestoftheProsecutor,issuesuchordersandwarrantsasmaybe
requiredforthepurposesofaninvestigation;

(b) Upontherequestofapersonwhohasbeenarrestedorhasappeared
pursuanttoasummonsunderarticle58,issuesuchorders,including
measuressuchasthosedescribedinarticle56,orseeksuchcooperation
pursuant to Part 9 as may be necessary to assist the person in the
preparationofhisorherdefence;

(c) Wherenecessary,providefortheprotectionandprivacyofvictimsand
witnesses,thepreservationofevidence,theprotectionofpersonswho
have been arrested or appeared in response to a summons, and the
protectionofnationalsecurityinformation;

(d) AuthorizetheProsecutortotakespecificinvestigativestepswithinthe
territoryofaStatePartywithouthavingsecuredthecooperationofthat
StateunderPart9if,wheneverpossiblehavingregardtotheviewsofthe
Stateconcerned,thePreTrialChamberhasdeterminedinthatcasethat
theStateisclearlyunabletoexecutearequestforcooperationduetothe
unavailabilityofanyauthorityoranycomponentofitsjudicialsystem
competenttoexecutetherequestforcooperationunderPart9;

(e) Whereawarrantofarrestorasummonshasbeenissuedunderarticle58,
andhavingdueregardtothestrengthoftheevidenceandtherightsofthe
parties concerned, as provided for in this Statute and the Rules of
ProcedureandEvidence,seekthecooperationofStatespursuanttoarticle
93, paragraph 1 (k), to take protective measures for the purpose of
forfeiture,inparticularfortheultimatebenefitofvictims.

Article 58
Issuance by the Pre-Trial Chamber of a warrant of arrest or a
summons to appear
1. Atanytimeaftertheinitiationofaninvestigation,thePreTrialChambershall,on
theapplicationoftheProsecutor,issueawarrantofarrestofapersonif,having
examinedtheapplicationandtheevidenceorotherinformationsubmittedbythe
Prosecutor,itissatisfiedthat:

(a) Therearereasonablegroundstobelievethatthepersonhascommitteda
crimewithinthejurisdictionoftheCourt;and

(b) Thearrestofthepersonappearsnecessary:

(i) Toensuretheperson'sappearanceattrial;

(ii) To ensure that the person does not obstruct or endanger the
investigationorthecourtproceedings;or

(iii) Whereapplicable,topreventthepersonfromcontinuingwiththe
commissionofthatcrimeorarelatedcrimewhichiswithinthe
jurisdiction of the Court and which arises out of the same
circumstances.

2. TheapplicationoftheProsecutorshallcontain:

(a) Thenameofthepersonandanyotherrelevantidentifyinginformation;

(b) AspecificreferencetothecrimeswithinthejurisdictionoftheCourt
whichthepersonisallegedtohavecommitted;

(c) Aconcisestatementofthefactswhichareallegedtoconstitutethose
crimes;

(d) Asummaryoftheevidenceandanyotherinformationwhichestablish
reasonablegroundstobelievethatthepersoncommittedthosecrimes;
and

(e) ThereasonwhytheProsecutorbelievesthatthearrestofthepersonis
necessary.

3. Thewarrantofarrestshallcontain:

(a) Thenameofthepersonandanyotherrelevantidentifyinginformation;

(b) AspecificreferencetothecrimeswithinthejurisdictionoftheCourtfor
whichtheperson'sarrestissought;and

(c) Aconcisestatementofthefactswhichareallegedtoconstitutethose
crimes.

4. ThewarrantofarrestshallremainineffectuntilotherwiseorderedbytheCourt.

5. Onthebasisofthewarrantofarrest,theCourtmayrequesttheprovisionalarrest
orthearrestandsurrenderofthepersonunderPart9.

6. TheProsecutormayrequestthePreTrialChambertoamendthewarrantofarrest
bymodifyingoraddingtothecrimesspecifiedtherein.ThePreTrialChamber
shallsoamendthewarrantifitissatisfiedthattherearereasonablegroundsto
believethatthepersoncommittedthemodifiedoradditionalcrimes.

7. Asanalternativetoseekingawarrantofarrest,theProsecutormaysubmitan
applicationrequestingthatthePreTrialChamberissueasummonsfortheperson
toappear.IfthePreTrialChamberissatisfiedthattherearereasonablegroundsto
believethatthepersoncommittedthecrimeallegedandthatasummonsis
sufficienttoensuretheperson'sappearance,itshallissuethesummons,withor
withoutconditionsrestrictingliberty(otherthandetention)ifprovidedforby
nationallaw,forthepersontoappear.Thesummonsshallcontain:

(a) Thenameofthepersonandanyotherrelevantidentifyinginformation;

(b) Thespecifieddateonwhichthepersonistoappear;

(c) AspecificreferencetothecrimeswithinthejurisdictionoftheCourt
whichthepersonisallegedtohavecommitted;and

(d) Aconcisestatementofthefactswhichareallegedtoconstitutethecrime.

Thesummonsshallbeservedontheperson.

Article 59
Arrest proceedings in the custodial State
1. AStatePartywhichhasreceivedarequestforprovisionalarrestorforarrestand
surrender shall immediately take steps to arrest the person in question in
accordancewithitslawsandtheprovisionsofPart9.

2. Aperson arrested shall be brought promptly before the competent judicial


authorityinthecustodialStatewhichshalldetermine,inaccordancewiththelaw
ofthatState,that:

(a) Thewarrantappliestothatperson;

(b) Thepersonhasbeenarrestedinaccordancewiththeproperprocess;and

(c) Theperson'srightshavebeenrespected.

3. Thepersonarrestedshallhavetherighttoapplytothecompetentauthorityinthe
custodialStateforinterimreleasependingsurrender.

4. Inreachingadecisiononanysuchapplication,thecompetentauthorityinthe
custodialStateshallconsiderwhether,giventhegravityoftheallegedcrimes,
thereareurgentandexceptionalcircumstancestojustifyinterimreleaseand
whethernecessarysafeguardsexisttoensurethatthecustodialStatecanfulfilits
dutytosurrenderthepersontotheCourt.Itshallnotbeopentothecompetent
authorityofthecustodialStatetoconsiderwhetherthewarrantofarrestwas
properlyissuedinaccordancewitharticle58,paragraph1(a)and(b).

5. ThePreTrialChambershallbenotifiedofanyrequestforinterimreleaseandshall
makerecommendationstothecompetentauthorityinthecustodialState.The
competentauthorityinthecustodialStateshallgivefullconsiderationtosuch
recommendations,includinganyrecommendationsonmeasurestopreventthe
escapeoftheperson,beforerenderingitsdecision.

6. Ifthepersonisgrantedinterimrelease,thePreTrialChambermayrequest
periodicreportsonthestatusoftheinterimrelease.

7. Once ordered to be surrendered by the custodial State, the person shall be


deliveredtotheCourtassoonaspossible.

Article 60
Initial proceedings before the Court
1. UponthesurrenderofthepersontotheCourt,ortheperson'sappearancebefore
theCourtvoluntarilyorpursuanttoasummons,thePreTrialChambershall
satisfyitselfthatthepersonhasbeeninformedofthecrimeswhichheorsheis
allegedtohavecommitted,andofhisorherrightsunderthisStatute,including
therighttoapplyforinterimreleasependingtrial.

2. Apersonsubjecttoawarrantofarrestmayapplyforinterimreleasependingtrial.
IfthePreTrialChamberissatisfiedthattheconditionssetforthinarticle58,
paragraph1,aremet,thepersonshallcontinuetobedetained.Ifitisnotso
satisfied, the PreTrial Chamber shall release the person, with or without
conditions.

3. The PreTrial Chamber shall periodically review its ruling on the release or
detentionoftheperson,andmaydosoatanytimeontherequestofthe
Prosecutor or the person. Upon such review, it may modify its ruling as to
detention, release or conditions of release, if it is satisfied that changed
circumstancessorequire.

4. The PreTrial Chamber shall ensure that a person is not detained for an
unreasonableperiodpriortotrialduetoinexcusabledelaybytheProsecutor.If
suchdelayoccurs,theCourtshallconsiderreleasingtheperson,withorwithout

Article 61
Confirmation of the charges before trial
1. Subjecttotheprovisionsofparagraph2,withinareasonabletimeafterthe
person's surrender or voluntary appearance before the Court, the PreTrial
ChambershallholdahearingtoconfirmthechargesonwhichtheProsecutor
intends to seek trial. The hearing shall be held in the presence of the
Prosecutorandthepersoncharged,aswellashisorhercounsel.

2. ThePreTrialChambermay,uponrequestoftheProsecutororonitsownmotion,
holdahearingintheabsenceofthepersonchargedtoconfirmthechargeson
whichtheProsecutorintendstoseektrialwhenthepersonhas:

(a) Waivedhisorherrighttobepresent;or

(b) Fledorcannotbefoundandallreasonablestepshavebeentakentosecure
hisorherappearancebeforetheCourtandtoinformthepersonofthe
chargesandthatahearingtoconfirmthosechargeswillbeheld.

Inthatcase,thepersonshallberepresentedbycounselwherethePreTrial
Chamberdeterminesthatitisintheinterestsofjustice.

3. Withinareasonabletimebeforethehearing,thepersonshall:

(a) Beprovidedwithacopyofthedocumentcontainingthechargesonwhich
theProsecutorintendstobringthepersontotrial;and

(b) BeinformedoftheevidenceonwhichtheProsecutorintendstorelyatthe
hearing.

ThePreTrialChambermayissueordersregardingthedisclosureofinformation
forthepurposesofthehearing.

4. Beforethehearing,theProsecutormaycontinuetheinvestigationandmayamend
orwithdrawanycharges.Thepersonshallbegivenreasonablenoticebeforethe
hearingofanyamendmenttoorwithdrawalofcharges.Incaseofawithdrawalof
charges,theProsecutorshallnotifythePreTrialChamberofthereasonsforthe
withdrawal.

5. Atthehearing,theProsecutorshallsupporteachchargewithsufficientevidence
toestablishsubstantialgroundstobelievethatthepersoncommittedthecrime
charged.TheProsecutormayrelyondocumentaryorsummaryevidenceandneed
notcallthewitnessesexpectedtotestifyatthetrial.

6. Atthehearing,thepersonmay:

(a) Objecttothecharges;

(b) ChallengetheevidencepresentedbytheProsecutor;and

(c) Presentevidence.

7. ThePreTrialChambershall,onthebasisofthehearing,determinewhetherthere
issufficientevidencetoestablishsubstantialgroundstobelievethattheperson
committedeachofthecrimescharged.Basedonitsdetermination,thePreTrial
Chambershall:

(a) Confirmthosechargesinrelationtowhichithasdeterminedthatthereis
sufficientevidence,andcommitthepersontoaTrialChamberfortrialon
thechargesasconfirmed;

(b) Declinetoconfirmthosechargesinrelationtowhichithasdetermined
thatthereisinsufficientevidence;

(c) AdjournthehearingandrequesttheProsecutortoconsider:

respecttoaparticularcharge;or

(ii) Amendingachargebecausetheevidencesubmittedappearsto
establishadifferentcrimewithinthejurisdictionoftheCourt.

8. WherethePreTrialChamberdeclinestoconfirmacharge,theProsecutorshall
notbeprecludedfromsubsequentlyrequestingitsconfirmationiftherequestis
supportedbyadditionalevidence.

9. Afterthechargesareconfirmedandbeforethetrialhasbegun,theProsecutormay,
withthepermissionofthePreTrialChamberandafternoticetotheaccused,
amend the charges. If the Prosecutor seeks to add additional charges or to
substitutemoreseriouscharges,ahearingunderthisarticletoconfirmthose
chargesmustbeheld.Aftercommencementofthetrial,theProsecutormay,with
thepermissionoftheTrialChamber,withdrawthecharges.

10. Anywarrantpreviouslyissuedshallceasetohaveeffectwithrespecttoany
chargeswhichhavenotbeenconfirmedbythePreTrialChamberorwhichhave
beenwithdrawnbytheProsecutor.

11. Once the charges have been confirmed in accordance with this article, the
PresidencyshallconstituteaTrialChamberwhich,subjecttoparagraph9andto
article 64, paragraph 4, shall be responsible for the conduct of subsequent
proceedingsandmayexerciseanyfunctionofthePreTrialChamberthatis
relevantandcapableofapplicationinthoseproceedings.

Trial in the presence of the accused

2. Iftheaccused,beingpresentbeforetheCourt,continuestodisruptthetrial,the
TrialChambermayremovetheaccusedandshallmakeprovisionforhimorherto
observethetrialandinstructcounselfromoutsidethecourtroom,throughtheuse
ofcommunicationstechnology,ifrequired.Suchmeasuresshallbetakenonlyin
exceptional circumstances after other reasonable alternatives have proved
inadequate,andonlyforsuchdurationasisstrictlyrequired.

Article 64
Functions and powers of the Trial Chamber
1. ThefunctionsandpowersoftheTrialChambersetoutinthisarticleshallbe
exercisedinaccordancewiththisStatuteandtheRulesofProcedureandEvidence.

2. TheTrialChambershallensurethatatrialisfairandexpeditiousandisconducted
withfullrespectfortherightsoftheaccusedanddueregardfortheprotectionof
victimsandwitnesses.

3. UponassignmentofacasefortrialinaccordancewiththisStatute,theTrial
Chamberassignedtodealwiththecaseshall:

(a) Conferwiththepartiesandadoptsuchproceduresasarenecessaryto
facilitatethefairandexpeditiousconductoftheproceedings;

(b) Determinethelanguageorlanguagestobeusedattrial;and

(c) Subject to any other relevant provisions of this Statute, provide for
disclosure of documents or information not previously disclosed,
sufficiently in advance of the commencement of the trial to enable
adequatepreparationfortrial.

4. TheTrialChambermay,ifnecessaryforitseffectiveandfairfunctioning,refer
preliminaryissuestothePreTrialChamberor,ifnecessary,toanotheravailable
judgeofthePreTrialDivision.

5. Uponnoticetotheparties,theTrialChambermay,asappropriate,directthatthere
bejoinderorseveranceinrespectofchargesagainstmorethanoneaccused.

specialcircumstancesrequirethatcertainproceedingsbeinclosedsessionforthe
purposessetforthinarticle68,ortoprotectconfidentialorsensitiveinformation
tobegiveninevidence.

8. (a) Atthecommencementofthetrial,theTrialChambershallhavereadto
theaccusedthechargespreviouslyconfirmedbythePreTrialChamber.
TheTrialChambershallsatisfyitselfthattheaccusedunderstandsthe
natureofthecharges.Itshallaffordhimorhertheopportunitytomakean
admissionofguiltinaccordancewitharticle65ortopleadnotguilty.

(b) Atthetrial,thepresidingjudgemaygivedirectionsfortheconductof
proceedings,includingtoensurethattheyareconductedinafairand
impartialmanner.Subjecttoanydirectionsofthepresidingjudge,the
partiesmaysubmitevidenceinaccordancewiththeprovisionsofthis
Statute.

9. TheTrialChambershallhave,interalia,thepoweronapplicationofapartyoron
itsownmotionto:

(a) Ruleontheadmissibilityorrelevanceofevidence;and

(b) Takeallnecessarystepstomaintainorderinthecourseofahearing.

10. The Trial Chamber shall ensure that a complete record of the trial, which
accurately reflects the proceedings, is made and that it is maintained and
preservedbytheRegistrar.

Article 65
Proceedings on an admission of guilt
1. Wheretheaccusedmakesanadmissionofguiltpursuanttoarticle64,paragraph
8(a),theTrialChambershalldeterminewhether:

(a) Theaccusedunderstandsthenatureandconsequencesoftheadmissionof
guilt;

(b) The admission is voluntarily made by the accused after sufficient


consultationwithdefencecounsel;and

(c) Theadmissionofguiltissupportedbythefactsofthecasethatare
containedin:

(i) ThechargesbroughtbytheProsecutorandadmittedbytheaccused;

(ii) AnymaterialspresentedbytheProsecutorwhichsupplementthe
chargesandwhichtheaccusedaccepts;and

(iii) Anyotherevidence,suchasthetestimonyofwitnesses,presented
bytheProsecutorortheaccused.

2. WheretheTrialChamberissatisfiedthatthemattersreferredtoinparagraph1are
established,itshallconsidertheadmissionofguilt,togetherwithanyadditional
evidencepresented,asestablishingalltheessentialfactsthatarerequiredtoprove
thecrimetowhichtheadmissionofguiltrelates,andmayconvicttheaccusedof
thatcrime.

3. WheretheTrialChamberisnotsatisfiedthatthemattersreferredtoinparagraph
1areestablished,itshallconsidertheadmissionofguiltasnothavingbeenmade,
inwhichcaseitshallorderthatthetrialbecontinuedundertheordinarytrial
proceduresprovidedbythisStatuteandmayremitthecasetoanotherTrial
Chamber.

4. WheretheTrialChamberisoftheopinionthatamorecompletepresentationof
thefactsofthecaseisrequiredintheinterestsofjustice,inparticulartheinterests
ofthevictims,theTrialChambermay:

(a) Request the Prosecutor to present additional evidence, including the


testimonyofwitnesses;or

(b) Orderthatthetrialbecontinuedundertheordinarytrialprocedures
providedbythisStatute,inwhichcaseitshallconsidertheadmissionof
guiltasnothavingbeenmadeandmayremitthecasetoanotherTrial
Chamber.

5. AnydiscussionsbetweentheProsecutorandthedefenceregardingmodification
ofthecharges,theadmissionofguiltorthepenaltytobeimposedshallnotbe
bindingontheCourt.

Article 66
Presumption of innocence
1. EveryoneshallbepresumedinnocentuntilprovedguiltybeforetheCourtin
accordancewiththeapplicablelaw.

2. TheonusisontheProsecutortoprovetheguiltoftheaccused.

3. Inordertoconvicttheaccused,theCourtmustbeconvincedoftheguiltofthe
accusedbeyondreasonabledoubt.

Article 67
Rights of the accused
1. Inthedeterminationofanycharge,theaccusedshallbeentitledtoapublic
hearing,havingregardtotheprovisionsofthisStatute,toafairhearingconducted
impartially,andtothefollowingminimumguarantees,infullequality:

(a) Tobeinformedpromptlyandindetailofthenature,causeandcontentof
thecharge,inalanguagewhichtheaccusedfullyunderstandsandspeaks;

(b) Tohaveadequatetimeandfacilitiesforthepreparationofthedefenceand
to communicate freely with counsel of the accused's choosing in
confidence;

(c) Tobetriedwithoutunduedelay;

(d) Subjecttoarticle63,paragraph2,tobepresentatthetrial,toconductthe
defenceinpersonorthroughlegalassistanceoftheaccused'schoosing,to
beinformed,iftheaccuseddoesnothavelegalassistance,ofthisrightand
tohavelegalassistanceassignedbytheCourtinanycasewherethe
interestsofjusticesorequire,andwithoutpaymentiftheaccusedlacks
sufficientmeanstopayforit;

(e) Toexamine,orhaveexamined,thewitnessesagainsthimorherandto
obtaintheattendanceandexaminationofwitnessesonhisorherbehalf
underthesameconditionsaswitnessesagainsthimorher.Theaccused
shallalsobeentitledtoraisedefencesandtopresentotherevidence
admissibleunderthisStatute;

(f) Tohave,freeofanycost,theassistanceofacompetentinterpreterandsuch
translationsasarenecessarytomeettherequirementsoffairness,ifanyof
theproceedingsofordocumentspresentedtotheCourtarenotina
languagewhichtheaccusedfullyunderstandsandspeaks;

(g) Nottobecompelledtotestifyortoconfessguiltandtoremainsilent,
withoutsuchsilencebeingaconsiderationinthedeterminationofguiltor
innocence;

(h) Tomakeanunswornoralorwrittenstatementinhisorherdefence;and

(i) Nottohaveimposedonhimorheranyreversaloftheburdenofproofor
anyonusofrebuttal.

2. InadditiontoanyotherdisclosureprovidedforinthisStatute,theProsecutor
shall,assoonaspracticable,disclosetothedefenceevidenceintheProsecutor's
possessionorcontrolwhichheorshebelievesshowsortendstoshowthe
innocenceoftheaccused,ortomitigatetheguiltoftheaccused,orwhichmay
affectthecredibilityofprosecutionevidence.Incaseofdoubtastotheapplication
ofthisparagraph,theCourtshalldecide.

Article 68
Protection of the victims and witnesses and their participation in the
proceedings
1. TheCourtshalltakeappropriatemeasurestoprotectthesafety,physicaland
psychologicalwellbeing,dignityandprivacyofvictimsandwitnesses.Inso
doing,theCourtshallhaveregardtoallrelevantfactors,includingage,genderas
definedinarticle7,paragraph3,andhealth,andthenatureofthecrime,in
particular,butnotlimitedto,wherethecrimeinvolvessexualorgenderviolence
orviolenceagainstchildren.TheProsecutorshalltakesuchmeasuresparticularly
duringtheinvestigationandprosecutionofsuchcrimes.Thesemeasuresshallnot
beprejudicialtoorinconsistentwiththerightsoftheaccusedandafairand
impartialtrial.

2. Asanexceptiontotheprincipleofpublichearingsprovidedforinarticle67,the
ChambersoftheCourtmay,toprotectvictimsandwitnessesoranaccused,
conduct any part of the proceedings in camera or allow the presentation of
evidencebyelectronicorotherspecialmeans.Inparticular,suchmeasuresshallbe
implementedinthecaseofavictimofsexualviolenceorachildwhoisavictimor
a witness, unless otherwise ordered by the Court, having regard to all the
circumstances,particularlytheviewsofthevictimorwitness.

3. Wherethepersonalinterestsofthevictimsareaffected,theCourtshallpermit
their views and concerns to be presented and considered at stages of the
proceedingsdeterminedtobeappropriatebytheCourtandinamannerwhichis
notprejudicialtoorinconsistentwiththerightsoftheaccusedandafairand
impartial trial. Such views and concerns may be presented by the legal
representatives of the victims where the Court considers it appropriate, in
accordancewiththeRulesofProcedureandEvidence.

4. TheVictimsandWitnessesUnitmayadvisetheProsecutorandtheCourton
appropriate protective measures, security arrangements, counselling and
assistanceasreferredtoinarticle43,paragraph6.

5. WherethedisclosureofevidenceorinformationpursuanttothisStatutemaylead
tothegraveendangermentofthesecurityofawitnessorhisorherfamily,the
Prosecutormay,forthepurposesofanyproceedingsconductedpriortothe
commencementofthetrial,withholdsuchevidenceorinformationandinstead
submitasummarythereof.Suchmeasuresshallbeexercisedinamannerwhichis
notprejudicialtoorinconsistentwiththerightsoftheaccusedandafairand
impartialtrial.

6. AStatemaymakeanapplicationfornecessarymeasurestobetakeninrespectof
theprotectionofitsservantsoragentsandtheprotectionofconfidentialor
sensitiveinformation.

Article 69
Evidence
1. Beforetestifying,eachwitnessshall,inaccordancewiththeRulesofProcedure
andEvidence,giveanundertakingastothetruthfulnessoftheevidencetobe
givenbythatwitness.

2. Thetestimonyofawitnessattrialshallbegiveninperson,excepttotheextent
providedbythemeasuressetforthinarticle68orintheRulesofProcedureand
Evidence.TheCourtmayalsopermitthegivingofvivavoce(oral)orrecorded
testimonyofawitnessbymeansofvideooraudiotechnology,aswellasthe
introductionofdocumentsorwrittentranscripts,subjecttothisStatuteandin
accordancewiththeRulesofProcedureandEvidence.Thesemeasuresshallnotbe
prejudicialtoorinconsistentwiththerightsoftheaccused.

3. Thepartiesmaysubmitevidencerelevanttothecase,inaccordancewitharticle
64.TheCourtshallhavetheauthoritytorequestthesubmissionofallevidence
thatitconsidersnecessaryforthedeterminationofthetruth.

4. TheCourtmayruleontherelevanceoradmissibilityofanyevidence,takinginto
account,interalia,theprobativevalueoftheevidenceandanyprejudicethatsuch
evidencemaycausetoafairtrialortoafairevaluationofthetestimonyofa
witness,inaccordancewiththeRulesofProcedureandEvidence.

5. TheCourtshallrespectandobserveprivilegesonconfidentialityasprovidedforin
theRulesofProcedureandEvidence.

6. TheCourtshallnotrequireproofoffactsofcommonknowledgebutmaytake
judicialnoticeofthem.

7. Evidence obtained by means of a violation of this Statute or internationally


recognizedhumanrightsshallnotbeadmissibleif:

(a) Theviolationcastssubstantialdoubtonthereliabilityoftheevidence;or

(b) The admission of the evidence would be antithetical to and would


seriouslydamagetheintegrityoftheproceedings.

8. WhendecidingontherelevanceoradmissibilityofevidencecollectedbyaState,
theCourtshallnotruleontheapplicationoftheState'snationallaw.

Article 70
Ofences against the administration of justice
1. The Court shall have jurisdiction over the following offences against its
administrationofjusticewhencommittedintentionally:

(a) Givingfalsetestimonywhenunderanobligationpursuanttoarticle69,
paragraph1,totellthetruth;

(b) Presentingevidencethatthepartyknowsisfalseorforged;

(c) Corruptly influencing a witness, obstructing or interfering with the


attendanceortestimonyofawitness,retaliatingagainstawitnessfor
givingtestimonyordestroying,tamperingwithorinterferingwiththe
collectionofevidence;

(d) Impeding,intimidatingorcorruptlyinfluencinganofficialoftheCourtfor
thepurposeofforcingorpersuadingtheofficialnottoperform,orto
performimproperly,hisorherduties;

(e) RetaliatingagainstanofficialoftheCourtonaccountofdutiesperformed
bythatoranotherofficial;

(f) SolicitingoracceptingabribeasanofficialoftheCourtinconnectionwith
hisorherofficialduties.

2. TheprinciplesandproceduresgoverningtheCourt'sexerciseofjurisdictionover
offencesunderthisarticleshallbethoseprovidedforintheRulesofProcedure
andEvidence.TheconditionsforprovidinginternationalcooperationtotheCourt
withrespecttoitsproceedingsunderthisarticleshallbegovernedbythedomestic
lawsoftherequestedState.

3. Intheeventofconviction,theCourtmayimposeatermofimprisonmentnot
exceedingfiveyears,orafineinaccordancewiththeRulesofProcedureand
Evidence,orboth.

4. (a) EachStatePartyshallextenditscriminallawspenalizingoffencesagainst
theintegrityofitsowninvestigativeorjudicialprocesstooffencesagainst
theadministrationofjusticereferredtointhisarticle,committedonits
territory,orbyoneofitsnationals;

(b) UponrequestbytheCourt,wheneveritdeemsitproper,theStateParty
shallsubmitthecasetoitscompetentauthoritiesforthepurposeof
prosecution.Thoseauthoritiesshalltreatsuchcaseswithdiligenceand
devotesufficientresourcestoenablethemtobeconductedeffectively.

Article 71
Sanctions for misconduct before the Court
1. The Court may sanction persons present before it who commit misconduct,
includingdisruptionofitsproceedingsordeliberaterefusaltocomplywithits
directions, by administrative measures other than imprisonment, such as
temporaryorpermanentremovalfromthecourtroom,afineorothersimilar
measuresprovidedforintheRulesofProcedureandEvidence.

2. Theproceduresgoverningtheimpositionofthemeasuressetforthinparagraph1
shallbethoseprovidedforintheRulesofProcedureandEvidence.

Article 72
Protection of national security information
1. This article applies in any case where the disclosure of the information or
documentsofaStatewould,intheopinionofthatState,prejudiceitsnational
securityinterests.Suchcasesincludethosefallingwithinthescopeofarticle56,
paragraphs2and3,article61,paragraph3,article64,paragraph3,article67,
paragraph2,article68,paragraph6,article87,paragraph6andarticle93,aswell
ascasesarisingatanyotherstageoftheproceedingswheresuchdisclosuremay
beatissue.

2. Thisarticleshallalsoapplywhenapersonwhohasbeenrequestedtogive
informationorevidencehasrefusedtodosoorhasreferredthemattertotheState
onthegroundthatdisclosurewouldprejudicethenationalsecurityinterestsofa
StateandtheStateconcernedconfirmsthatitisoftheopinionthatdisclosure
wouldprejudiceitsnationalsecurityinterests.

3. Nothing in this article shall prejudice the requirements of confidentiality


applicableunderarticle54,paragraph3(e)and(f),ortheapplicationofarticle73.

4. IfaStatelearnsthatinformationordocumentsoftheStatearebeing,orarelikely
tobe,disclosedatanystageoftheproceedings,anditisoftheopinionthat
disclosurewouldprejudiceitsnationalsecurityinterests,thatStateshallhavethe
righttointerveneinordertoobtainresolutionoftheissueinaccordancewiththis
article.

5. If,intheopinionofaState,disclosureofinformationwouldprejudiceitsnational
security interests, all reasonable steps will be taken by the State, acting in
conjunctionwiththeProsecutor,thedefenceorthePreTrialChamberorTrial
Chamber,asthecasemaybe,toseektoresolvethematterbycooperativemeans.
Suchstepsmayinclude:

(a) Modificationorclarificationoftherequest;

(b) AdeterminationbytheCourtregardingtherelevanceoftheinformation
orevidencesought,oradeterminationastowhethertheevidence,though
relevant,couldbeorhasbeenobtainedfromasourceotherthanthe
requestedState;

(c) Obtainingtheinformationorevidencefromadifferentsourceorina
differentform;or

(d) Agreementonconditionsunderwhichtheassistancecouldbeprovided
including, among other things, providing summaries or redactions,
limitationsondisclosure,useofincameraorexparteproceedings,orother
protective measures permissible under the Statute and the Rules of
ProcedureandEvidence.

6. Once all reasonable steps have been taken to resolve the matter through
cooperative means, and if the State considers that there are no means or
conditions under which the information or documents could be provided or
disclosedwithoutprejudicetoitsnationalsecurityinterests,itshallsonotifythe
ProsecutorortheCourtofthespecificreasonsforitsdecision,unlessaspecific
descriptionofthereasonswoulditselfnecessarilyresultinsuchprejudicetothe
State'snationalsecurityinterests.

7. Thereafter,iftheCourtdeterminesthattheevidenceisrelevantandnecessaryfor
the establishment of the guilt or innocence of the accused, the Court may
undertakethefollowingactions:

(a) Wheredisclosureoftheinformationordocumentissoughtpursuanttoa
requestforcooperationunderPart9orthecircumstancesdescribedin
paragraph2,andtheStatehasinvokedthegroundforrefusalreferredto
inarticle93,paragraph4:

(i) The Court may, before making any conclusion referred to in


subparagraph7(a)(ii),requestfurtherconsultationsforthepurpose
ofconsideringtheState'srepresentations,whichmayinclude,as
appropriate,hearingsincameraandexparte;

(ii) IftheCourtconcludesthat,byinvokingthegroundforrefusal

Article 73
Third-party information or documents
IfaStatePartyisrequestedbytheCourttoprovideadocumentorinformationinitscustody,
possessionorcontrol,whichwasdisclosedtoitinconfidencebyaState,intergovernmental
organizationorinternationalorganization,itshallseektheconsentoftheoriginatorto
disclosethatdocumentorinformation.IftheoriginatorisaStateParty,itshalleitherconsent
todisclosureoftheinformationordocumentorundertaketoresolvetheissueofdisclosure
withtheCourt,subjecttotheprovisionsofarticle72.IftheoriginatorisnotaStatePartyand
refusestoconsenttodisclosure,therequestedStateshallinformtheCourtthatitisunableto
providethedocumentorinformationbecauseofapreexistingobligationofconfidentialityto
theoriginator.

Article 74
Requirements for the decision
1. AllthejudgesoftheTrialChambershallbepresentateachstageofthetrialand
throughouttheirdeliberations.ThePresidencymay,onacasebycasebasis,
designate,asavailable,oneormorealternatejudgestobepresentateachstageof
thetrialandtoreplaceamemberoftheTrialChamberifthatmemberisunableto
continueattending.

2. TheTrialChamber'sdecisionshallbebasedonitsevaluationoftheevidenceand
theentireproceedings.Thedecisionshallnotexceedthefactsandcircumstances
describedinthechargesandanyamendmentstothecharges.TheCourtmaybase
itsdecisiononlyonevidencesubmittedanddiscussedbeforeitatthetrial.

3. Thejudgesshallattempttoachieveunanimityintheirdecision,failingwhichthe
decisionshallbetakenbyamajorityofthejudges.

4. ThedeliberationsoftheTrialChambershallremainsecret.

5. Thedecisionshallbeinwritingandshallcontainafullandreasonedstatementof
theTrialChamber'sfindingsontheevidenceandconclusions.TheTrialChamber
shallissueonedecision.Whenthereisnounanimity,theTrialChamber'sdecision
shall contain the views of the majority and the minority. The decision or a
summarythereofshallbedeliveredinopencourt.

Article 75
Reparations to victims
1. TheCourtshallestablishprinciplesrelatingtoreparationsto,orinrespectof,
victims,includingrestitution,compensationandrehabilitation.Onthisbasis,in
its decision the Court may, either upon request or on its own motion in
exceptionalcircumstances,determinethescopeandextentofanydamage,loss
andinjuryto,orinrespectof,victimsandwillstatetheprinciplesonwhichitis
acting.

2. TheCourtmaymakeanorderdirectlyagainstaconvictedpersonspecifying
appropriate reparations to, or in respect of, victims, including restitution,
compensationandrehabilitation.

Whereappropriate,theCourtmayorderthattheawardforreparationsbemade
throughtheTrustFundprovidedforinarticle79.

3. Beforemakinganorderunderthisarticle,theCourtmayinviteandshalltake
accountofrepresentationsfromoronbehalfoftheconvictedperson,victims,
otherinterestedpersonsorinterestedStates.

4. Inexercisingitspowerunderthisarticle,theCourtmay,afterapersonisconvicted
ofacrimewithinthejurisdictionoftheCourt,determinewhether,inordertogive
effecttoanorderwhichitmaymakeunderthisarticle,itisnecessarytoseek
measuresunderarticle93,paragraph1.

5. AStatePartyshallgiveeffecttoadecisionunderthisarticleasiftheprovisionsof
article109wereapplicabletothisarticle.

Article 76
Sentencing
1. Intheeventofaconviction,theTrialChambershallconsidertheappropriate
sentencetobeimposedandshalltakeintoaccounttheevidencepresentedand
submissionsmadeduringthetrialthatarerelevanttothesentence.

2. Exceptwherearticle65appliesandbeforethecompletionofthetrial,theTrial
Chambermayonitsownmotionandshall,attherequestoftheProsecutororthe
accused,holdafurtherhearingtohearanyadditionalevidenceorsubmissions
relevanttothesentence,inaccordancewiththeRulesofProcedureandEvidence.

3. Whereparagraph2applies,anyrepresentationsunderarticle75shallbeheard

4. The sentence shall be pronounced in public and, wherever possible, in the

Article 77
Applicable penalties
1. Subjecttoarticle110,theCourtmayimposeoneofthefollowingpenaltiesona
personconvictedofacrimereferredtoinarticle5ofthisStatute:

(a) Imprisonmentforaspecifiednumberofyears,whichmaynotexceeda
maximumof30years;or

(b) Atermoflifeimprisonmentwhenjustifiedbytheextremegravityofthe
crimeandtheindividualcircumstancesoftheconvictedperson.

2. Inadditiontoimprisonment,theCourtmayorder:

(a) AfineunderthecriteriaprovidedforintheRulesofProcedureand
Evidence;

(b) Aforfeitureofproceeds,propertyandassetsderiveddirectlyorindirectly
fromthatcrime,withoutprejudicetotherightsofbonafidethirdparties.

Article 78
Determination of the sentence
1. Indeterminingthesentence,theCourtshall,inaccordancewiththeRulesof
ProcedureandEvidence,takeintoaccountsuchfactorsasthegravityofthecrime
andtheindividualcircumstancesoftheconvictedperson.

2. Inimposingasentenceofimprisonment,theCourtshalldeductthetime,ifany,
previouslyspentindetentioninaccordancewithanorderoftheCourt.TheCourt
maydeductanytimeotherwisespentindetentioninconnectionwithconduct
underlyingthecrime.

3. Whenapersonhasbeenconvictedofmorethanonecrime,theCourtshall
pronounceasentenceforeachcrimeandajointsentencespecifyingthetotal
periodofimprisonment.Thisperiodshallbenolessthanthehighestindividual
sentencepronouncedandshallnotexceed30yearsimprisonmentorasentenceof
lifeimprisonmentinconformitywitharticle77,paragraph1(b).

Article 79
Trust Fund
1. ATrustFundshallbeestablishedbydecisionoftheAssemblyofStatesPartiesfor
thebenefitofvictimsofcrimeswithinthejurisdictionoftheCourt,andofthe
familiesofsuchvictims.

2. The Court may order money and other property collected through fines or
forfeituretobetransferred,byorderoftheCourt,totheTrustFund.

3. TheTrustFundshallbemanagedaccordingtocriteriatobedeterminedbythe
AssemblyofStatesParties.

Appeal against decision of acquittal or conviction or against sentence

Appeal against other decisions
1. Either party may appeal any of the following decisions in accordance with
theRulesofProcedureandEvidence:

(b) Adecisiongrantingordenyingreleaseofthepersonbeinginvestigatedor
prosecuted;

(c) AdecisionofthePreTrialChambertoactonitsowninitiativeunder
article56,paragraph3;

(d) Adecisionthatinvolvesanissuethatwouldsignificantlyaffectthefairand
expeditiousconductoftheproceedingsortheoutcomeofthetrial,andfor
which,intheopinionofthePreTrialorTrialChamber,animmediate
resolution by the Appeals Chamber may materially advance the
proceedings.

2. AdecisionofthePreTrialChamberunderarticle57,paragraph3(d),maybe
appealedagainstbytheStateconcernedorbytheProsecutor,withtheleaveofthe
PreTrialChamber.Theappealshallbeheardonanexpeditedbasis.

3. AnappealshallnotofitselfhavesuspensiveeffectunlesstheAppealsChamberso
orders,uponrequest,inaccordancewiththeRulesofProcedureandEvidence.

4. Alegalrepresentativeofthevictims,theconvictedpersonorabonafideownerof

Article 83
Proceedings on appeal
1. Forthepurposesofproceedingsunderarticle81andthisarticle,theAppeals
ChambershallhaveallthepowersoftheTrialChamber.

2. IftheAppealsChamberfindsthattheproceedingsappealedfromwereunfairina
waythataffectedthereliabilityofthedecisionorsentence,orthatthedecisionor
sentence appealed from was materially affected by error of fact or law or
proceduralerror,itmay:

(a) Reverseoramendthedecisionorsentence;or

(b) OrderanewtrialbeforeadifferentTrialChamber.

Forthesepurposes,theAppealsChambermayremandafactualissuetothe
originalTrialChamberforittodeterminetheissueandtoreportbackaccordingly,
ormayitselfcallevidencetodeterminetheissue.Whenthedecisionorsentence
has been appealed only by the person convicted, or the Prosecutor on that
person'sbehalf,itcannotbeamendedtohisorherdetriment.

3. IfinanappealagainstsentencetheAppealsChamberfindsthatthesentenceis
disproportionatetothecrime,itmayvarythesentenceinaccordancewithPart7.

4. ThejudgementoftheAppealsChambershallbetakenbyamajorityofthejudges
andshallbedeliveredinopencourt.Thejudgementshallstatethereasonson
whichitisbased.Whenthereisnounanimity,thejudgementoftheAppeals
Chambershallcontaintheviewsofthemajorityandtheminority, butajudgemay
deliveraseparateordissentingopiniononaquestionoflaw.

5. TheAppealsChambermaydeliveritsjudgementintheabsenceoftheperson
acquittedorconvicted.

Article 84
Revision of conviction or sentence
1. Theconvictedpersonor,afterdeath,spouses,children,parentsoroneperson
aliveatthetimeoftheaccused'sdeathwhohasbeengivenexpresswritten
instructionsfromtheaccusedtobringsuchaclaim,ortheProsecutoronthe
person'sbehalf,mayapplytotheAppealsChambertorevisethefinaljudgement
ofconvictionorsentenceonthegroundsthat:

(a) Newevidencehasbeendiscoveredthat:

(i) Wasnotavailableatthetimeoftrial,andsuchunavailabilitywas
notwhollyorpartiallyattributabletothepartymakingapplication;
and

(ii) Issufficientlyimportantthathaditbeenprovedattrialitwould
havebeenlikelytohaveresultedinadifferentverdict;

(b) Ithasbeennewlydiscoveredthatdecisiveevidence,takenintoaccountat
trialanduponwhichtheconvictiondepends,wasfalse,forgedorfalsified;

(c) Oneormoreofthejudgeswhoparticipatedinconvictionorconfirmation
ofthechargeshascommitted,inthatcase,anactofseriousmisconductor
seriousbreachofdutyofsufficientgravitytojustifytheremovalofthat
judgeorthosejudgesfromofficeunderarticle46.

2. The Appeals Chamber shall reject the application if it considers it to be


unfounded. If it determines that the application is meritorious, it may, as
appropriate:

(a) ReconvenetheoriginalTrialChamber;

(b) ConstituteanewTrialChamber;or

(c) Retainjurisdictionoverthematter,

withaviewto,afterhearingthepartiesinthemannersetforthintheRulesof
ProcedureandEvidence,arrivingatadeterminationonwhetherthejudgement
shouldberevised.

Article 85
Compensation to an arrested or convicted person
1. Anyonewhohasbeenthevictimofunlawfularrestordetentionshallhave
anenforceablerighttocompensation.

2. Whenapersonhasbyafinaldecisionbeenconvictedofacriminaloffence,and
whensubsequentlyhisorherconvictionhasbeenreversedonthegroundthata
newornewlydiscoveredfactshowsconclusivelythattherehasbeenamiscarriage
ofjustice,thepersonwhohassufferedpunishmentasaresultofsuchconviction
shallbecompensatedaccordingtolaw,unlessitisprovedthatthenondisclosure
oftheunknownfactintimeiswhollyorpartlyattributabletohimorher.

3. Inexceptionalcircumstances,wheretheCourtfindsconclusivefactsshowingthat
therehasbeenagraveandmanifestmiscarriageofjustice,itmayinitsdiscretion
awardcompensation,accordingtothecriteriaprovidedintheRulesofProcedure
andEvidence,toapersonwhohasbeenreleasedfromdetentionfollowingafinal
decisionofacquittaloraterminationoftheproceedingsforthatreason.

Article 86
General obligation to cooperate
StatesPartiesshall,inaccordancewiththeprovisionsofthisStatute,cooperatefullywiththe
CourtinitsinvestigationandprosecutionofcrimeswithinthejurisdictionoftheCourt.

Article 87
Requests for cooperation: general provisions
1. (a) TheCourtshallhavetheauthoritytomakerequeststoStatesPartiesfor
cooperation.Therequestsshallbetransmittedthroughthediplomatic
channeloranyotherappropriatechannelasmaybedesignatedbyeach
StatePartyuponratification,acceptance,approvaloraccession.

SubsequentchangestothedesignationshallbemadebyeachStatePartyin
accordancewiththeRulesofProcedureandEvidence.

(b) Whenappropriate,withoutprejudicetotheprovisionsofsubparagraph
(a),requestsmayalsobetransmittedthroughtheInternationalCriminal
PoliceOrganizationoranyappropriateregionalorganization.

2. Requestsforcooperationandanydocumentssupportingtherequestshalleither
beinorbeaccompaniedbyatranslationintoanofficiallanguageoftherequested
StateoroneoftheworkinglanguagesoftheCourt,inaccordancewiththechoice
madebythatStateuponratification,acceptance,approvaloraccession.
SubsequentchangestothischoiceshallbemadeinaccordancewiththeRulesof
ProcedureandEvidence.

3. TherequestedStateshallkeepconfidentialarequestforcooperationandany
documentssupportingtherequest,excepttotheextentthatthedisclosureis
necessaryforexecutionoftherequest.

4. InrelationtoanyrequestforassistancepresentedunderthisPart,theCourtmay
takesuchmeasures,includingmeasuresrelatedtotheprotectionofinformation,
asmaybenecessarytoensurethesafetyorphysicalorpsychologicalwellbeingof
anyvictims,potentialwitnessesandtheirfamilies.TheCourtmayrequestthatany
informationthatismadeavailableunderthisPartshallbeprovidedandhandled
inamannerthatprotectsthesafetyandphysicalorpsychologicalwellbeingof
anyvictims,potentialwitnessesandtheirfamilies.

5. (a) The Court may invite any State not party to this Statute to provide
assistanceunderthisPartonthebasisofanadhoc arrangement,an
agreementwithsuchStateoranyotherappropriatebasis.

(b) WhereaStatenotpartytothisStatute,whichhasenteredintoanadhoc
arrangementoranagreementwiththeCourt,failstocooperatewith
requestspursuanttoanysucharrangementoragreement,theCourtmay
soinformtheAssemblyofStatesPartiesor,wheretheSecurityCouncil
referredthemattertotheCourt,theSecurityCouncil.

6. TheCourtmayaskanyintergovernmentalorganizationtoprovideinformationor
documents.TheCourtmayalsoaskforotherformsofcooperationandassistance

7. WhereaStatePartyfailstocomplywitharequesttocooperatebytheCourt
contrarytotheprovisionsofthisStatute,therebypreventingtheCourtfrom

findingtothateffectandreferthemattertotheAssemblyofStatesPartiesor,
wheretheSecurityCouncilreferredthemattertotheCourt,totheSecurity
Council.

Article 88
Availability of procedures under national law
StatesPartiesshallensurethatthereareproceduresavailableundertheirnationallawforall
oftheformsofcooperationwhicharespecifiedunderthisPart.

Article 89
Surrender of persons to the Court
1. TheCourtmaytransmitarequestforthearrestandsurrenderofaperson,
togetherwiththematerialsupportingtherequestoutlinedinarticle91,toany
Stateontheterritoryofwhichthatpersonmaybefoundandshallrequestthe
cooperationofthatStateinthearrestandsurrenderofsuchaperson.States
Partiesshall,inaccordancewiththeprovisionsofthisPartandtheprocedure
undertheirnationallaw,complywithrequestsforarrestandsurrender.

2. Wherethepersonsoughtforsurrenderbringsachallengebeforeanationalcourt
onthebasisoftheprincipleofnebisinidemasprovidedinarticle20,the
requestedStateshallimmediatelyconsultwiththeCourttodetermineiftherehas
beenarelevantrulingonadmissibility.Ifthecaseisadmissible,therequested
Stateshallproceedwiththeexecutionoftherequest.Ifanadmissibilityrulingis
pending,therequestedStatemaypostponetheexecutionoftherequestfor
surrenderofthepersonuntiltheCourtmakesadeterminationonadmissibility.

3. (a) AStatePartyshallauthorize,inaccordancewithitsnationalprocedural
law,transportationthroughitsterritoryofapersonbeingsurrenderedto
theCourtbyanotherState,exceptwheretransitthroughthatStatewould
impedeordelaythesurrender.

(b) ArequestbytheCourtfortransitshallbetransmittedinaccordancewith
article87.Therequestfortransitshallcontain:

(i) Adescriptionofthepersonbeingtransported;

(ii) Abrief statement of the facts of the case and their legal
characterization;and

(iii) Thewarrantforarrestandsurrender;

(c) Apersonbeingtransportedshallbedetainedincustodyduringtheperiod
oftransit;

(d) Noauthorizationisrequiredifthepersonistransportedbyairandno
landingisscheduledontheterritoryofthetransitState;

(e) IfanunscheduledlandingoccursontheterritoryofthetransitState,that

subparagraph (b). The transit State shall detain the person being
transporteduntiltherequestfortransitisreceivedandthetransitis
effected,providedthatdetentionforpurposesofthissubparagraphmay
notbeextendedbeyond96hoursfromtheunscheduledlandingunlessthe
requestisreceivedwithinthattime.

4. Ifthepersonsoughtisbeingproceededagainstorisservingasentencein
therequestedStateforacrimedifferentfromthatforwhichsurrendertotheCourt
issought,therequestedState,aftermakingitsdecisiontogranttherequest,shall
consultwiththeCourt.

Article 90
Competing requests
1. AStatePartywhichreceivesarequestfromtheCourtforthesurrenderofaperson
underarticle89shall,ifitalsoreceivesarequestfromanyotherStateforthe
extraditionofthesamepersonforthesameconductwhichformsthebasisofthe
crimeforwhichtheCourtseekstheperson'ssurrender,notifytheCourtandthe
requestingStateofthatfact.

2. WheretherequestingStateisaStateParty,therequestedStateshallgivepriority
totherequestfromtheCourtif:

(a) TheCourthas,pursuanttoarticle18or19,madeadeterminationthatthe
case in respect of which surrender is sought is admissible and that
determination takes into account the investigation or prosecution
conductedbytherequestingStateinrespectofitsrequestforextradition;
or

(b) The Court makes the determination described in subparagraph (a)


pursuanttotherequestedState'snotificationunderparagraph1.

3. Whereadeterminationunderparagraph2(a)hasnotbeenmade,therequested
State may, at its discretion, pending the determination of the Court under
paragraph 2 (b), proceed to deal with the request for extradition from the
requestingStatebutshallnotextraditethepersonuntiltheCourthasdetermined
thatthecaseisinadmissible.TheCourt'sdeterminationshallbemadeonan
expeditedbasis.

4. IftherequestingStateisaStatenotPartytothisStatutetherequestedState,ifitis
notunderaninternationalobligationtoextraditethepersontotherequesting
State,shallgiveprioritytotherequestforsurrenderfromtheCourt,iftheCourt
hasdeterminedthatthecaseisadmissible.

5. Whereacaseunderparagraph4hasnotbeendeterminedtobeadmissiblebythe
Court,therequestedStatemay,atitsdiscretion,proceedtodealwiththerequest
forextraditionfromtherequestingState.

6. Incaseswhereparagraph4appliesexceptthattherequestedStateisunderan
existinginternationalobligationtoextraditethepersontotherequestingStatenot

persontotheCourtorextraditethepersontotherequestingState.Inmakingits
decision,therequestedStateshallconsideralltherelevantfactors,includingbut
notlimitedto:

(a) Therespectivedatesoftherequests;

(b) TheinterestsoftherequestingStateincluding,whererelevant,whether
thecrimewascommittedinitsterritoryandthenationalityofthevictims
andofthepersonsought;and

(c) The possibility of subsequent surrender between the Court and the
requestingState.

7. WhereaStatePartywhichreceivesarequestfromtheCourtforthesurrenderofa
personalsoreceivesarequestfromanyStatefortheextraditionofthesame
personforconductotherthanthatwhichconstitutesthecrimeforwhichthe
Courtseekstheperson'ssurrender:

(a) TherequestedStateshall,ifitisnotunderanexistinginternational
obligationtoextraditethepersontotherequestingState,givepriorityto
therequestfromtheCourt;

(b) TherequestedStateshall,ifitisunderanexistinginternationalobligation
toextraditethepersontotherequestingState,determinewhetherto
surrender the person to the Court or to extradite the person to the
requestingState.Inmakingitsdecision,therequestedStateshallconsider
alltherelevantfactors,includingbutnotlimitedtothosesetoutin
paragraph6,butshallgivespecialconsiderationtotherelativenatureand
gravityoftheconductinquestion.

. Wherepursuanttoanotificationunderthisarticle,theCourthasdetermineda
casetobeinadmissible,andsubsequentlyextraditiontotherequestingStateis
refused,therequestedStateshallnotifytheCourtofthisdecision.

Article 91
Contents of request for arrest and surrender
1. Arequestforarrestandsurrendershallbemadeinwriting.Inurgentcases,a
requestmaybemadebyanymediumcapableofdeliveringawrittenrecord,
providedthattherequestshallbeconfirmedthroughthechannelprovidedforin
article87,paragraph1(a).

2. Inthecaseofarequestforthearrestandsurrenderofapersonforwhoma
warrantofarresthasbeenissuedbythePreTrialChamberunderarticle58,the
requestshallcontainorbesupportedby:

(a) Informationdescribingthepersonsought,sufficienttoidentifytheperson,
andinformationastothatperson'sprobablelocation;

(b) Acopyofthewarrantofarrest;and

(c) Suchdocuments,statementsorinformationasmaybenecessarytomeet
therequirementsforthesurrenderprocessintherequestedState,except
that those requirements should not be more burdensome than those
applicabletorequestsforextraditionpursuanttotreatiesorarrangements
betweentherequestedStateandotherStatesandshould,ifpossible,be
lessburdensome,takingintoaccountthedistinctnatureoftheCourt.

3. Inthecaseofarequestforthearrestandsurrenderofapersonalreadyconvicted,
therequestshallcontainorbesupportedby:

(a) Acopyofanywarrantofarrestforthatperson;

(b) Acopyofthejudgementofconviction;

(c) Informationtodemonstratethatthepersonsoughtistheonereferredto
inthejudgementofconviction;and

(d) Ifthepersonsoughthasbeensentenced,acopyofthesentenceimposed
and,inthecaseofasentenceforimprisonment,astatementofanytime
alreadyservedandthetimeremainingtobeserved.

4. UpontherequestoftheCourt,aStatePartyshallconsultwiththeCourt,either
generallyorwithrespecttoaspecificmatter,regardinganyrequirementsunderits
nationallawthatmayapplyunderparagraph2(c).Duringtheconsultations,the
StatePartyshalladvisetheCourtofthespecificrequirementsofitsnationallaw.

Article 92
Provisional arrest
1. Inurgentcases,theCourtmayrequesttheprovisionalarrestofthepersonsought,
pendingpresentationoftherequestforsurrenderandthedocumentssupporting
therequestasspecifiedinarticle91.

2. The request for provisional arrest shall be made by any medium capable of
deliveringawrittenrecordandshallcontain:

(a) Informationdescribingthepersonsought,sufficienttoidentifytheperson,
andinformationastothatperson'sprobablelocation;

(b) Aconcisestatementofthecrimesforwhichtheperson'sarrestissought
andofthefactswhichareallegedtoconstitutethosecrimes,including,
wherepossible,thedateandlocationofthecrime;

(c) Astatementoftheexistenceofawarrantofarrestorajudgementof
convictionagainstthepersonsought;and

(d) Astatementthatarequestforsurrenderofthepersonsoughtwillfollow.

3. Aperson who is provisionally arrested may be released from custody if the


requestedStatehasnotreceivedtherequestforsurrenderandthedocuments
supportingtherequestasspecifiedinarticle91withinthetimelimitsspecifiedin
the Rules of Procedure and Evidence. However, the person may consent to
surrenderbeforetheexpirationofthisperiodifpermittedbythelawofthe
requestedState.Insuchacase,therequestedStateshallproceedtosurrenderthe
persontotheCourtassoonaspossible.

4. Thefactthatthepersonsoughthasbeenreleasedfromcustodypursuantto
paragraph3shallnotprejudicethesubsequentarrestandsurrenderofthatperson
if the request for surrender and the documents supporting the request are
deliveredatalaterdate.

Article 93
Other forms of cooperation
1. StatesPartiesshall,inaccordancewiththeprovisionsofthisPartandunder
proceduresofnationallaw,complywithrequestsbytheCourttoprovidethe
followingassistanceinrelationtoinvestigationsorprosecutions:

(a) Theidentificationandwhereaboutsofpersonsorthelocationofitems;

(b) The taking of evidence, including testimony under oath, and the
productionofevidence,includingexpertopinionsandreportsnecessaryto
theCourt;

(c) Thequestioningofanypersonbeinginvestigatedorprosecuted;

(d) Theserviceofdocuments,includingjudicialdocuments;

(e) Facilitatingthevoluntaryappearanceofpersonsaswitnessesorexperts
beforetheCourt;

(f) Thetemporarytransferofpersonsasprovidedinparagraph7;

(g) The examination of places or sites, including the exhumation and


examinationofgravesites;

(h) Theexecutionofsearchesandseizures;

(i) Theprovisionofrecordsanddocuments,includingofficialrecordsand
documents;

(j) Theprotectionofvictimsandwitnessesandthepreservationofevidence;

(k) Theidentification,tracingandfreezingorseizureofproceeds,property
andassetsandinstrumentalitiesofcrimesforthepurposeofeventual
forfeiture,withoutprejudicetotherightsofbonafidethirdparties;and

(l) Any other type of assistance which is not prohibited by the law of
the requested State, with a view to facilitating the investigation and
prosecutionofcrimeswithinthejurisdictionoftheCourt.

2. TheCourtshallhavetheauthoritytoprovideanassurancetoawitnessoran
expertappearingbeforetheCourtthatheorshewillnotbeprosecuted,detained
orsubjectedtoanyrestrictionofpersonalfreedombytheCourtinrespectofany
actoromissionthatprecededthedepartureofthatpersonfromtherequested
State.

3. Where execution of a particular measure of assistance detailed in a request


presentedunderparagraph1,isprohibitedintherequestedStateonthebasisof
anexistingfundamentallegalprincipleofgeneralapplication,therequestedState
shall promptly consult with the Court to try to resolve the matter. In the
consultations,considerationshouldbegiventowhethertheassistancecanbe
renderedinanothermannerorsubjecttoconditions.Ifafterconsultationsthe
mattercannotberesolved,theCourtshallmodifytherequestasnecessary.

4. Inaccordancewitharticle72,aStatePartymaydenyarequestforassistance,in
wholeorinpart,onlyiftherequestconcernstheproductionofanydocumentsor
disclosureofevidencewhichrelatestoitsnationalsecurity.

5. Beforedenyingarequestforassistanceunderparagraph1(l),therequestedState
shall consider whether the assistance can be provided subject to specified
conditions,orwhethertheassistancecanbeprovidedatalaterdateorinan
alternativemanner,providedthatiftheCourtortheProsecutoracceptsthe
assistancesubjecttoconditions,theCourtortheProsecutorshallabidebythem.

6. Ifarequestforassistanceisdenied,therequestedStatePartyshallpromptly
informtheCourtortheProsecutorofthereasonsforsuchdenial.

7. (a) TheCourtmayrequestthetemporarytransferofapersonincustodyfor
purposesofidentificationorforobtainingtestimonyorotherassistance.
Thepersonmaybetransferredifthefollowingconditionsarefulfilled:

(i) Thepersonfreelygiveshisorherinformedconsenttothetransfer;
and

(ii) TherequestedStateagreestothetransfer,subjecttosuchconditions
asthatStateandtheCourtmayagree.

(b) Thepersonbeingtransferredshallremainincustody.Whenthepurposes
ofthetransferhavebeenfulfilled,theCourtshallreturntheperson
withoutdelaytotherequestedState.

8. (a) TheCourtshallensuretheconfidentialityofdocumentsandinformation,
exceptasrequiredfortheinvestigationandproceedingsdescribedinthe
request.

(b) The requested State may, when necessary, transmit documents or


informationtotheProsecutoronaconfidentialbasis.TheProsecutormay
thenusethemsolelyforthepurposeofgeneratingnewevidence.

(c) TherequestedStatemay,onitsownmotionorattherequestofthe
Prosecutor,subsequentlyconsenttothedisclosureofsuchdocumentsor
information. They may then be used as evidence pursuant to the
provisionsofParts5and6andinaccordancewiththeRulesofProcedure
andEvidence.

9. (a) (i) IntheeventthataStatePartyreceivescompetingrequests,other


thanforsurrenderorextradition,fromtheCourtandfromanother
Statepursuanttoaninternationalobligation,theStatePartyshall
endeavour,inconsultationwiththeCourtandtheotherState,to
meet both requests, if necessary by postponing or attaching
conditionstooneortheotherrequest.

(ii) Failingthat,competingrequestsshallberesolvedinaccordance
withtheprinciplesestablishedinarticle90.

(b) Where, however, the request from the Court concerns information,
propertyorpersonswhicharesubjecttothecontrolofathirdStateoran
internationalorganizationbyvirtueofaninternationalagreement,the
requestedStatesshallsoinformtheCourtandtheCourtshalldirectits
requesttothethirdStateorinternationalorganization.

10. (a) TheCourtmay,uponrequest,cooperatewithandprovideassistancetoa


StatePartyconductinganinvestigationintoortrialinrespectofconduct
whichconstitutesacrimewithinthejurisdictionoftheCourtorwhich
constitutesaseriouscrimeunderthenationallawoftherequestingState.

(b) (i) The assistance provided under subparagraph (a) shall include,
interalia:
a.Thetransmissionofstatements,documentsorothertypesof
evidence obtained in the course of an investigation or a trial
conductedbytheCourt;and
b.ThequestioningofanypersondetainedbyorderoftheCourt;

(ii) Inthecaseofassistanceundersubparagraph(b)(i)a:
a. If the documents or other types of evidence have been
obtainedwiththeassistanceofaState,suchtransmissionshall
requiretheconsentofthatState;
b.Ifthestatements,documentsorothertypesofevidencehave
beenprovidedbyawitnessorexpert,suchtransmissionshallbe
subjecttotheprovisionsofarticle68.

(c) TheCourtmay,undertheconditionssetoutinthisparagraph,granta
requestforassistanceunderthisparagraphfromaStatewhichisnota
PartytothisStatute.

Article 94
Postponement of execution of a request in respect of ongoing
investigation or prosecution
1. If the immediate execution of a request would interfere with an ongoing
investigationorprosecutionofacasedifferentfromthattowhichtherequest
relates,therequestedStatemaypostponetheexecutionoftherequestforaperiod
oftimeagreeduponwiththeCourt.However,thepostponementshallbeno
longerthanisnecessarytocompletetherelevantinvestigationorprosecutionin
therequestedState.Beforemakingadecisiontopostpone,therequestedState
shouldconsiderwhethertheassistancemaybeimmediatelyprovidedsubjectto
certainconditions.

2. If a decision to postpone is taken pursuant to paragraph 1, the Prosecutor


may, however, seek measures to preserve evidence, pursuant to article 93,
paragraph1(j).

Article 95
Postponement of execution of a request in respect of an admissibility
challenge
WherethereisanadmissibilitychallengeunderconsiderationbytheCourtpursuanttoarticle
18or19,therequestedStatemaypostponetheexecutionofarequestunderthisPartpending
adeterminationbytheCourt,unlesstheCourthasspecificallyorderedthattheProsecutor
maypursuethecollectionofsuchevidencepursuanttoarticle18or19.

Article 96
Contents of request for other forms of assistance under article 93
1. Arequestforotherformsofassistancereferredtoinarticle93shallbemadein
writing.Inurgentcases,arequestmaybemadebyanymediumcapableof
deliveringawrittenrecord,providedthattherequestshallbeconfirmedthrough
thechannelprovidedforinarticle87,paragraph1(a).

2. Therequestshall,asapplicable,containorbesupportedbythefollowing:

(a) Aconcisestatementofthepurposeoftherequestandtheassistance
sought,includingthelegalbasisandthegroundsfortherequest;

(b) As much detailed information as possible about the location or


identificationofanypersonorplacethatmustbefoundoridentifiedin
orderfortheassistancesoughttobeprovided;

(c) Aconcisestatementoftheessentialfactsunderlyingtherequest;

(d) The reasons for and details of any procedure or requirement to be


followed;

(e) SuchinformationasmayberequiredunderthelawoftherequestedState
inordertoexecutetherequest;and

(f) Anyotherinformationrelevantinorderfortheassistancesoughttobe
provided.

3. UpontherequestoftheCourt,aStatePartyshallconsultwiththeCourt,either
generallyorwithrespecttoaspecificmatter,regardinganyrequirementsunderits
nationallawthatmayapplyunderparagraph2(e).Duringtheconsultations,the
StatePartyshalladvisetheCourtofthespecificrequirementsofitsnationallaw.

4. Theprovisionsofthisarticleshall,whereapplicable,alsoapplyinrespectofa
requestforassistancemadetotheCourt.

Article 97
Consultations
WhereaStatePartyreceivesarequestunderthisPartinrelationtowhichitidentifies
problemswhichmayimpedeorpreventtheexecutionoftherequest,thatStateshallconsult
withtheCourtwithoutdelayinordertoresolvethematter.Suchproblemsmayinclude,inter
alia:

(a) Insufficientinformationtoexecutetherequest;

(b) Inthecaseofarequestforsurrender,thefactthatdespitebestefforts,the
personsoughtcannotbelocatedorthattheinvestigationconductedhas
determinedthatthepersonintherequestedStateisclearlynottheperson
namedinthewarrant;or

(c) Thefactthatexecutionoftherequestinitscurrentformwouldrequirethe
requestedStatetobreachapreexistingtreatyobligationundertakenwith
respecttoanotherState.

Article 98
Cooperation with respect to waiver of immunity and consent to
surrender
1. TheCourtmaynotproceedwitharequestforsurrenderorassistancewhichwould
require the requested State to act inconsistently with its obligations under
internationallawwithrespecttotheStateordiplomaticimmunityofapersonor
propertyofathirdState,unlesstheCourtcanfirstobtainthecooperationofthat
thirdStateforthewaiveroftheimmunity.

2. TheCourtmaynotproceedwitharequestforsurrenderwhichwouldrequirethe
requested State to act inconsistently with its obligations under international
agreementspursuanttowhichtheconsentofasendingStateisrequiredto
surrenderapersonofthatStatetotheCourt,unlesstheCourtcanfirstobtainthe
cooperationofthesendingStateforthegivingofconsentforthesurrender.

Article 99
Execution of requests under articles 93 and 96
1. Requests for assistance shall be executed in accordance with the relevant
procedureunderthelawoftherequestedStateand,unlessprohibitedbysuchlaw,
inthemannerspecifiedintherequest,includingfollowinganyprocedureoutlined
thereinorpermittingpersonsspecifiedintherequesttobepresentatandassistin
theexecutionprocess.

2. Inthecaseofanurgentrequest,thedocumentsorevidenceproducedinresponse
shall,attherequestoftheCourt,besenturgently.

3. RepliesfromtherequestedStateshallbetransmittedintheiroriginallanguage
andform.

4. WithoutprejudicetootherarticlesinthisPart,whereitisnecessaryforthe
successfulexecutionofarequestwhichcanbeexecutedwithoutanycompulsory
measures,includingspecificallytheinterviewofortakingevidencefromaperson
onavoluntarybasis,includingdoingsowithoutthepresenceoftheauthoritiesof
therequestedStatePartyifitisessentialfortherequesttobeexecuted,andthe
examination without modification of a public site or other public place, the
ProsecutormayexecutesuchrequestdirectlyontheterritoryofaStateasfollows:

(a) WhentheStatePartyrequestedisaStateontheterritoryofwhichthe
crime is alleged to have been committed, and there has been a
determinationofadmissibilitypursuanttoarticle18or19,theProsecutor
maydirectlyexecutesuchrequestfollowingallpossibleconsultationswith
therequestedStateParty;

(b) In other cases, the Prosecutor may execute such request following
consultationswiththerequestedStatePartyandsubjecttoanyreasonable
conditionsorconcernsraisedbythatStateParty.Wheretherequested
StatePartyidentifiesproblemswiththeexecutionofarequestpursuantto
thissubparagraphitshall,withoutdelay,consultwiththeCourttoresolve
thematter.

5. ProvisionsallowingapersonheardorexaminedbytheCourtunderarticle72to
invoke restrictions designed to prevent disclosure of confidential information
connectedwithnationalsecurityshallalsoapplytotheexecutionofrequestsfor
assistanceunderthisarticle.

Article 100
Costs
1. TheordinarycostsforexecutionofrequestsintheterritoryoftherequestedState
shallbebornebythatState,exceptforthefollowing,whichshallbebornebythe
Court:

(a) Costsassociatedwiththetravelandsecurityofwitnessesandexpertsor
thetransferunderarticle93ofpersonsincustody;

(b) Costsoftranslation,interpretationandtranscription;

(c) Travelandsubsistencecostsofthejudges,theProsecutor,theDeputy
Prosecutors,theRegistrar,theDeputyRegistrarandstaffofanyorganof
theCourt;

(d) CostsofanyexpertopinionorreportrequestedbytheCourt;

(e) Costsassociatedwiththetransportofapersonbeingsurrenderedtothe
CourtbyacustodialState;and

(f) Followingconsultations,anyextraordinarycoststhatmayresultfromthe
executionofarequest.

2. Theprovisionsofparagraph1shall,asappropriate,applytorequestsfromStates
PartiestotheCourt.Inthatcase,theCourtshallbeartheordinarycostsof
execution.

Article 101
Rule of speciality
1. ApersonsurrenderedtotheCourtunderthisStatuteshallnotbeproceeded
against,punishedordetainedforanyconductcommittedpriortosurrender,other
thantheconductorcourseofconductwhichformsthebasisofthecrimesfor
whichthatpersonhasbeensurrendered.

2. TheCourtmayrequestawaiveroftherequirementsofparagraph1fromtheState
whichsurrenderedthepersontotheCourtand,ifnecessary,theCourtshall
provide additional information in accordance with article 91. States Parties
shallhavetheauthoritytoprovideawaivertotheCourtandshouldendeavourto
doso.

Article 102
Use of terms
ForthepurposesofthisStatute:

(a) "surrender"meansthedeliveringupofapersonbyaStatetotheCourt,
pursuanttothisStatute.

(b) "extradition"meansthedeliveringupofapersonbyoneStatetoanother
asprovidedbytreaty,conventionornationallegislation.

Part X Enforcement

Article 103
Role of States in enforcement of sentences of imprisonment
1. (a) AsentenceofimprisonmentshallbeservedinaStatedesignatedbythe
Court from a list of States which have indicated to the Court their
willingnesstoacceptsentencedpersons.

(b) Atthetimeofdeclaringitswillingnesstoacceptsentencedpersons,a
StatemayattachconditionstoitsacceptanceasagreedbytheCourtandin
accordancewiththisPart.

(c) AStatedesignatedinaparticularcaseshallpromptlyinformtheCourt
whetheritacceptstheCourt'sdesignation.

2. (a) TheStateofenforcementshallnotifytheCourtofanycircumstances,
includingtheexerciseofanyconditionsagreedunderparagraph1,which
couldmateriallyaffectthetermsorextentoftheimprisonment.TheCourt
shallbegivenatleast45days'noticeofanysuchknownorforeseeable
circumstances.Duringthisperiod,theStateofenforcementshalltakeno
actionthatmightprejudiceitsobligationsunderarticle110.

(b) Where the Court cannot agree to the circumstances referred to in


subparagraph(a),itshallnotifytheStateofenforcementandproceedin
accordancewitharticle104,paragraph1.

3. Inexercisingitsdiscretiontomakeadesignationunderparagraph1,theCourt
shalltakeintoaccountthefollowing:

(a) The principle that States Parties should share the responsibility for
enforcingsentencesofimprisonment,inaccordancewithprinciplesof
equitabledistribution,asprovidedintheRulesofProcedureandEvidence;

(b) The application of widely accepted international treaty standards


governingthetreatmentofprisoners;

(c) Theviewsofthesentencedperson;

(d) Thenationalityofthesentencedperson;

(e) Suchotherfactorsregardingthecircumstancesofthecrimeortheperson
sentenced, or the effective enforcement of the sentence, as may be
appropriateindesignatingtheStateofenforcement.

4. IfnoStateisdesignatedunderparagraph1,thesentenceofimprisonmentshallbe
servedinaprisonfacilitymadeavailablebythehostState,inaccordancewiththe
conditions set out in the headquarters agreement referred to in article 3,
paragraph2.Insuchacase,thecostsarisingoutoftheenforcementofasentence
ofimprisonmentshallbebornebytheCourt.

Article 104
Change in designation of State of enforcement
1. TheCourtmay,atanytime,decidetotransferasentencedpersontoaprisonof
anotherState.

2. Asentencedpersonmay,atanytime,applytotheCourttobetransferredfromthe
Stateofenforcement.

Article 105
Enforcement of the sentence
1. SubjecttoconditionswhichaStatemayhavespecifiedinaccordancewitharticle
103,paragraph1(b),thesentenceofimprisonmentshallbebindingontheStates
Parties,whichshallinnocasemodifyit.

2. TheCourtaloneshallhavetherighttodecideanyapplicationforappealand
revision.TheStateofenforcementshallnotimpedethemakingofanysuch
applicationbyasentencedperson.

Article 106
Supervision of enforcement of sentences and conditions of
imprisonment
1. Theenforcementofasentenceofimprisonmentshallbesubjecttothesupervision
oftheCourtandshallbeconsistentwithwidelyacceptedinternationaltreaty
standardsgoverningtreatmentofprisoners.

2. The conditions of imprisonment shall be governed by the law of the State


ofenforcementandshallbeconsistentwithwidelyacceptedinternationaltreaty
standardsgoverningtreatmentofprisoners;innocaseshallsuchconditionsbe
moreorlessfavourablethanthoseavailabletoprisonersconvictedofsimilar
offencesintheStateofenforcement.

3. CommunicationsbetweenasentencedpersonandtheCourtshallbeunimpeded
andconfidential.

Article 107
Transfer of the person upon completion of sentence
1. Followingcompletionofthesentence,apersonwhoisnotanationaloftheState
ofenforcementmay,inaccordancewiththelawoftheStateofenforcement,be
transferredtoaStatewhichisobligedtoreceivehimorher,ortoanotherState
whichagreestoreceivehimorher,takingintoaccountanywishesofthepersonto
betransferredtothatState,unlesstheStateofenforcementauthorizestheperson
toremaininitsterritory.

2. IfnoStatebearsthecostsarisingoutoftransferringthepersontoanotherState
pursuanttoparagraph1,suchcostsshallbebornebytheCourt.

3. Subjecttotheprovisionsofarticle108,theStateofenforcementmayalso,in
accordancewithitsnationallaw,extraditeorotherwisesurrenderthepersontoa
Statewhichhasrequestedtheextraditionorsurrenderofthepersonforpurposes
oftrialorenforcementofasentence.

Article 108
Limitation on the prosecution or punishment of other ofences
1. AsentencedpersoninthecustodyoftheStateofenforcementshallnotbesubject
toprosecutionorpunishmentortoextraditiontoathirdStateforanyconduct
engagedinpriortothatperson'sdeliverytotheStateofenforcement,unlesssuch
prosecution,punishmentorextraditionhasbeenapprovedbytheCourtatthe
requestoftheStateofenforcement.

2. TheCourtshalldecidethematterafterhavingheardtheviewsofthesentenced
person.

3. Paragraph1shallceasetoapplyifthesentencedpersonremainsvoluntarilyfor
morethan30daysintheterritoryoftheStateofenforcementafterhavingserved
thefullsentenceimposedbytheCourt,orreturnstotheterritoryofthatState
afterhavingleftit.

Article 109
Enforcement of fines and forfeiture measures
1. StatesPartiesshallgiveeffecttofinesorforfeituresorderedbytheCourtunder

2. IfaStatePartyisunabletogiveeffecttoanorderforforfeiture,itshalltake
measurestorecoverthevalueoftheproceeds,propertyorassetsorderedbythe
Courttobeforfeited,withoutprejudicetotherightsofbonafidethirdparties.

3. Property,ortheproceedsofthesaleofrealpropertyor,whereappropriate,thesale
ofotherproperty,whichisobtainedbyaStatePartyasaresultofitsenforcement
ofajudgementoftheCourtshallbetransferredtotheCourt.

Article 110
Review by the Court concerning reduction of sentence
1. TheStateofenforcementshallnotreleasethepersonbeforeexpiryofthesentence
pronouncedbytheCourt.

2. TheCourtaloneshallhavetherighttodecideanyreductionofsentence,andshall
ruleonthematterafterhavingheardtheperson.

3. Whenthepersonhasservedtwothirdsofthesentence,or25yearsinthecaseof
lifeimprisonment,theCourtshallreviewthesentencetodeterminewhetherit
shouldbereduced.Suchareviewshallnotbeconductedbeforethattime.

4. Initsreviewunderparagraph3,theCourtmayreducethesentenceifitfindsthat
oneormoreofthefollowingfactorsarepresent:

(a) Theearlyandcontinuingwillingnessofthepersontocooperatewiththe
Courtinitsinvestigationsandprosecutions;

(b) Thevoluntaryassistanceofthepersoninenablingtheenforcementofthe
judgementsandordersoftheCourtinothercases,andinparticular
providingassistanceinlocatingassetssubjecttoordersoffine,forfeiture

(c) Otherfactorsestablishingaclearandsignificantchangeofcircumstances
sufficienttojustifythereductionofsentence,asprovidedintheRulesof
ProcedureandEvidence.

5. IftheCourtdeterminesinitsinitialreviewunderparagraph3thatitisnot
appropriatetoreducethesentence,itshallthereafterreviewthequestionof
reductionofsentenceatsuchintervalsandapplyingsuchcriteriaasprovidedfor
intheRulesofProcedureandEvidence.

Article 111
Escape
IfaconvictedpersonescapesfromcustodyandfleestheStateofenforcement,thatStatemay,
afterconsultationwiththeCourt,requesttheperson'ssurrenderfromtheStateinwhichthe
personislocatedpursuanttoexistingbilateralormultilateralarrangements,ormayrequest
thattheCourtseektheperson'ssurrender,inaccordancewithPart9.Itmaydirectthatthe
personbedeliveredtotheStateinwhichheorshewasservingthesentenceortoanother
StatedesignatedbytheCourt.

Article 112
Assembly of States Parties
1. AnAssemblyofStatesPartiestothisStatuteisherebyestablished.EachState
PartyshallhaveonerepresentativeintheAssemblywhomaybeaccompaniedby
alternatesandadvisers.OtherStateswhichhavesignedthisStatuteortheFinal
ActmaybeobserversintheAssembly.

2. TheAssemblyshall:

(a) Considerandadopt,asappropriate,recommendationsofthePreparatory
Commission;

(b) ProvidemanagementoversighttothePresidency,theProsecutorandthe
RegistrarregardingtheadministrationoftheCourt;

(c) Consider the reports and activities of the Bureau established under
paragraph3andtakeappropriateactioninregardthereto;

(d) ConsideranddecidethebudgetfortheCourt;

(e) Decidewhethertoalter,inaccordancewitharticle36,thenumberof
judges;

(f) Considerpursuanttoarticle87,paragraphs5and7,anyquestionrelating
tononcooperation;

(g) PerformanyotherfunctionconsistentwiththisStatuteortheRulesof
ProcedureandEvidence.

3. (a) The Assembly shall have a Bureau consisting of a President, two


VicePresidentsand18memberselectedbytheAssemblyforthreeyear
terms.

(b) TheBureaushallhavearepresentativecharacter,takingintoaccount,in
particular, equitable geographical distribution and the adequate
representationoftheprincipallegalsystemsoftheworld.

(c) TheBureaushallmeetasoftenasnecessary,butatleastonceayear.It
shallassisttheAssemblyinthedischargeofitsresponsibilities.

4. TheAssemblymayestablishsuchsubsidiarybodiesasmaybenecessary,including
anindependentoversightmechanismforinspection,evaluationandinvestigation
oftheCourt,inordertoenhanceitsefficiencyandeconomy.

5. The President of the Court, the Prosecutor and the Registrar or their
representativesmayparticipate,asappropriate,inmeetingsoftheAssemblyand
oftheBureau.

6. TheAssemblyshallmeetattheseatoftheCourtorattheHeadquartersofthe
UnitedNationsonceayearand,whencircumstancessorequire,holdspecial
sessions.ExceptasotherwisespecifiedinthisStatute,specialsessionsshallbe
convenedbytheBureauonitsowninitiativeorattherequestofonethirdofthe
StatesParties.

7. EachStatePartyshallhaveonevote.Everyeffortshallbemadetoreachdecisions
byconsensusintheAssemblyandintheBureau.Ifconsensuscannotbereached,
exceptasotherwiseprovidedintheStatute:

(a) Decisionsonmattersofsubstancemustbeapprovedbyatwothirds
majorityofthosepresentandvotingprovidedthatanabsolutemajorityof
StatesPartiesconstitutesthequorumforvoting;

(b) Decisionsonmattersofprocedureshallbetakenbyasimplemajorityof
StatesPartiespresentandvoting.

8. AStatePartywhichisinarrearsinthepaymentofitsfinancialcontributions
towardsthecostsoftheCourtshallhavenovoteintheAssemblyandinthe
Bureau if the amount of its arrears equals or exceeds the amount of the
contributionsduefromitfortheprecedingtwofullyears.TheAssemblymay,
nevertheless,permitsuchaStatePartytovoteintheAssemblyandintheBureau
ifitissatisfiedthatthefailuretopayisduetoconditionsbeyondthecontrolofthe
StateParty.

9. TheAssemblyshalladoptitsownrulesofprocedure.

10. TheofficialandworkinglanguagesoftheAssemblyshallbethoseoftheGeneral
AssemblyoftheUnitedNations.

Part XII Financing

Article 113
Financial Regulations
Exceptasotherwisespecificallyprovided,allfinancialmattersrelatedtotheCourtandthe
meetingsoftheAssemblyofStatesParties,includingitsBureauandsubsidiarybodies,shall
begovernedbythisStatuteandtheFinancialRegulationsandRulesadoptedbytheAssembly
ofStatesParties.

Article 114
Payment of expenses
ExpensesoftheCourtandtheAssemblyofStatesParties,includingitsBureauandsubsidiary
bodies,shallbepaidfromthefundsoftheCourt.

Article 115
Funds of the Court and of the Assembly of States Parties
TheexpensesoftheCourtandtheAssemblyofStatesParties,includingitsBureauand
subsidiarybodies,asprovidedforinthebudgetdecidedbytheAssemblyofStatesParties,
shallbeprovidedbythefollowingsources:

(a) AssessedcontributionsmadebyStatesParties;

(b) FundsprovidedbytheUnitedNations,subjecttotheapprovalofthe
GeneralAssembly,inparticularinrelationtotheexpensesincurreddueto
referralsbytheSecurityCouncil.

Article 116
Voluntary contributions
Withoutprejudicetoarticle115,theCourtmayreceiveandutilize,asadditionalfunds,
voluntary contributions from Governments, international organizations, individuals,
corporationsandotherentities,inaccordancewithrelevantcriteriaadoptedbytheAssembly
ofStatesParties.

Article 117
Assessment of contributions
ThecontributionsofStatesPartiesshallbeassessedinaccordancewithanagreedscaleof
assessment,basedonthescaleadoptedbytheUnitedNationsforitsregularbudgetand
adjustedinaccordancewiththeprinciplesonwhichthatscaleisbased.

Article 118
Annual audit
Therecords,booksandaccountsoftheCourt,includingitsannualfinancialstatements,shall
beauditedannuallybyanindependentauditor.

Part XIII Final clauses

Article 119
Settlement of disputes
1. AnydisputeconcerningthejudicialfunctionsoftheCourtshallbesettledbythe
decisionoftheCourt.

2. Any other dispute between two or more States Parties relating to the
interpretation or application of this Statute which is not settled through
negotiationswithinthreemonthsoftheircommencementshallbereferredtothe
AssemblyofStatesParties.TheAssemblymayitselfseektosettlethedisputeor
may make recommendations on further means of settlement of the dispute,
includingreferraltotheInternationalCourtofJusticeinconformitywiththe
StatuteofthatCourt.

Article 120
Reservations
NoreservationsmaybemadetothisStatute.

Article 121
Amendments
1. AftertheexpiryofsevenyearsfromtheentryintoforceofthisStatute,anyState
Partymayproposeamendmentsthereto.Thetextofanyproposedamendment
shallbesubmittedtotheSecretaryGeneraloftheUnitedNations,whoshall
promptlycirculateittoallStatesParties.

2. Nosoonerthanthreemonthsfromthedateofnotification,theAssemblyofStates
Parties,atitsnextmeeting,shall,byamajorityofthosepresentandvoting,decide
whethertotakeuptheproposal.TheAssemblymaydealwiththeproposal
directlyorconveneaReviewConferenceiftheissueinvolvedsowarrants.

3. TheadoptionofanamendmentatameetingoftheAssemblyofStatesPartiesor
ataReviewConferenceonwhichconsensuscannotbereachedshallrequirea
twothirdsmajorityofStatesParties.

4. Exceptasprovidedinparagraph5,anamendmentshallenterintoforceforall
StatesPartiesoneyearafterinstrumentsofratificationoracceptancehavebeen
depositedwiththeSecretaryGeneraloftheUnitedNationsbyseveneighthsof
them.

5. Anyamendmenttoarticles5,6,7and8ofthisStatuteshallenterintoforcefor
thoseStatesPartieswhichhaveacceptedtheamendmentoneyearafterthe
depositoftheirinstrumentsofratificationoracceptance.InrespectofaState
Partywhichhasnotacceptedtheamendment,theCourtshallnotexerciseits
jurisdictionregardingacrimecoveredbytheamendmentwhencommittedbythat
StateParty'snationalsoronitsterritory.

6. If an amendment has been accepted by seveneighths of States Parties in


accordance with paragraph 4, any State Party which has not accepted the
amendment may withdraw from this Statute with immediate effect,
notwithstandingarticle127,paragraph1,butsubjecttoarticle127,paragraph2,
by giving notice no later than one year after the entry into force of such
amendment.

7. TheSecretaryGeneraloftheUnitedNationsshallcirculatetoallStatesParties
anyamendmentadoptedatameetingoftheAssemblyofStatesPartiesorata
ReviewConference.

Article 122
Amendments to provisions of an institutional nature
1. AmendmentstoprovisionsofthisStatutewhichareofanexclusivelyinstitutional
nature,namely,article35,article36,paragraphs8and9,article37,article38,
article39,paragraphs1(firsttwosentences),2and4,article42,paragraphs4to9,
article43,paragraphs2and3,andarticles44,46,47and49,maybeproposedat
anytime,notwithstandingarticle121,paragraph1,byanyStateParty.Thetextof
anyproposedamendmentshallbesubmittedtotheSecretaryGeneralofthe
UnitedNationsorsuchotherpersondesignatedbytheAssemblyofStatesParties
whoshallpromptlycirculateittoallStatesPartiesandtoothersparticipatingin
theAssembly.

2. Amendmentsunderthisarticleonwhichconsensuscannotbereachedshallbe
adoptedbytheAssemblyofStatesPartiesorbyaReviewConference,byatwo
thirdsmajorityofStatesParties.Suchamendmentsshallenterintoforceforall
StatesPartiessixmonthsaftertheiradoptionbytheAssemblyor,asthecasemay
be,bytheConference.

Article 123
Review of the Statute
1. SevenyearsaftertheentryintoforceofthisStatutetheSecretaryGeneralofthe
UnitedNationsshallconveneaReviewConferencetoconsideranyamendments
tothisStatute.Suchreviewmayinclude,butisnotlimitedto,thelistofcrimes
containedinarticle5.TheConferenceshallbeopentothoseparticipatinginthe
AssemblyofStatesPartiesandonthesameconditions.

2. Atanytimethereafter,attherequestofaStatePartyandforthepurposessetout
inparagraph1,theSecretaryGeneraloftheUnitedNationsshall,uponapproval
byamajorityofStatesParties,conveneaReviewConference.

3. Theprovisionsofarticle121,paragraphs3to7,shallapplytotheadoptionand
entry into force of any amendment to the Statute considered at a Review
Conference.

Article 124
Transitional Provision
Notwithstandingarticle12,paragraphs1and2,aState,onbecomingapartytothisStatute,
maydeclarethat,foraperiodofsevenyearsaftertheentryintoforceofthisStatuteforthe
Stateconcerned,itdoesnotacceptthejurisdictionoftheCourtwithrespecttothecategoryof
crimesreferredtoinarticle8whenacrimeisallegedtohavebeencommittedbyitsnationals
oronitsterritory.Adeclarationunderthisarticlemaybewithdrawnatanytime.The
provisionsofthisarticleshallbereviewedattheReviewConferenceconvenedinaccordance
witharticle123,paragraph1.

Article 125
Signature, ratification, acceptance, approval or accession
1. ThisStatuteshallbeopenforsignaturebyallStatesinRome,attheheadquarters
oftheFoodandAgricultureOrganizationoftheUnitedNations, on17July1998.
Thereafter,itshallremainopenforsignatureinRomeattheMinistryofForeign
Affairs of Italy until 17 October 1998. After that date, the Statute shall
remainopenforsignatureinNewYork,atUnitedNationsHeadquarters,until31
December2000.

2. ThisStatuteissubjecttoratification,acceptanceorapprovalbysignatoryStates.
Instrumentsofratification,acceptanceorapprovalshallbedepositedwiththe
SecretaryGeneraloftheUnitedNations.

3. ThisStatuteshallbeopentoaccessionbyallStates.Instrumentsofaccessionshall
bedepositedwiththeSecretaryGeneraloftheUnitedNations.

Article 126
Entry into force
1. ThisStatuteshallenterintoforceonthefirstdayofthemonthafterthe60thday
followingthedateofthedepositofthe60thinstrumentofratification,acceptance,
approvaloraccessionwiththeSecretaryGeneraloftheUnitedNations.

2. ForeachStateratifying,accepting,approvingoraccedingtothisStatuteafterthe
depositofthe60thinstrumentofratification,acceptance,approvaloraccession,
theStatuteshallenterintoforceonthefirstdayofthemonthafterthe60thday
followingthedepositbysuchStateofitsinstrumentofratification,acceptance,
approvaloraccession.

Article 127
Withdrawal
1. AStatePartymay,bywrittennotificationaddressedtotheSecretaryGeneralof
theUnitedNations,withdrawfromthisStatute.Thewithdrawalshalltakeeffect
oneyearafterthedateofreceiptofthenotification,unlessthenotification
specifiesalaterdate.

2. AStateshallnotbedischarged,byreasonofitswithdrawal,fromtheobligations
arisingfromthisStatutewhileitwasaPartytotheStatute,includinganyfinancial
obligations which may have accrued. Its withdrawal shall not affect any
cooperation with the Court in connection with criminal investigations and
proceedingsinrelationtowhichthewithdrawingStatehadadutytocooperate
andwhichwerecommencedpriortothedateonwhichthewithdrawalbecame
effective,norshallitprejudiceinanywaythecontinuedconsiderationofany
matterwhichwasalreadyunderconsiderationbytheCourtpriortothedateon
whichthewithdrawalbecameeffective.

Article 128
Authentic texts
TheoriginalofthisStatute,ofwhichtheArabic,Chinese,English,French,Russianand
Spanishtextsareequallyauthentic,shallbedepositedwiththeSecretaryGeneralofthe
UnitedNations,whoshallsendcertifiedcopiesthereoftoallStates.

Inwitnesswhereof,the undersigned, being duly authorized thereto by their respective


Governments,havesignedthisStatute.
