The S-1 Report

There is no easy or good way to put this so I suppose the direct
approach is as good as it gets. “William “BO” Bowers died Friday
night. For those who do not remember BO, he was the center CSM and
an instructor at the O&I committee and later on the deputy Division
chief for the doctrine division at the SWC. Bo was in severe pain as
result of all the years of injury and combat. Bo took his life a result of
this pain and suffering.
Most of you should remember Bo and his smiling face. He was
a vertically challenged man who made up for his lack of height with
the depth of his commitment and passion for taking care of SF. We owe
much of our SF doctrine to CSM Bowers (Ret). He was a great mentor
to many of us through the years regardless if you were in uniform or
retired and without concern for the rank you wore past or present.
Bo and Pappy Jones updated the SF Base Camp handbook
which is now called TACFAC. Bo was instrumental in creating the first
MTOE for "Delta." He was also one of the original nuclear artillery men
in the 82nd Abn Div. No matter what his accomplishments, accolades
or faults, Bo was the man most of us know as the guy who would give
you the shirt off his back if you needed it. He was instrumental in
helping many of us get jobs in GS and all he ever asked in return was to
do a good job and not embarass the Regiment.
He was a father to many, a sounding board for those who
needed an ear, a role model, mentor, standard bearer and friend and he
will be missed terribly. Bo had been struggling with terrible pains from
his numerous injuries sustained early in his life while in uniform and
had recently gone through treatment for skin cancer, had both knees
replaced, and a series of other illnesses which he seldom even
mentioned to anyone other than those closest to him. He never wanted
anyone to worry about him because as he would often put it, "they have
enough troubles of their own, they don't need to hear about mine."
The world was a better place when Bo was in it. It is a tragic
event. Please keep Dolly, Michelle, Billie and the rest of Bo's family in
your prayers during this their time of need just as Bo would have and
has so many times in the past done for all of us.

A Failed Obama Hero

Let's think about President Obama's failed economic
stimulus program. Before getting to the nitty-gritty of why stimulus
packages fail, let's look at the failed stimulus program of Obama's
hero, Franklin Delano Roosevelt. FDR's Treasury Secretary, Henry
Morgenthau, wrote in his diary: "We have tried spending money.
We are spending more than we have ever spent before and it does
not work. ... We have never made good on our promises. ... I say
after eight years of this Administration we have just as much
unemployment as when we started ... and an enormous debt to
boot!"
Morgenthau was being a bit gracious. The unemployment
figures for FDR's first eight years were: 18 percent in 1935; 14
percent in 1936; by 1938, unemployment was back to 20 percent.
The stock market fell nearly 50 percent between August 1937 and
March 1938. Columnist Walter Lippmann wrote, "With almost no
important exception every measure he (Roosevelt) has been
interested in for the past five months has been to reduce or
discourage the production of wealth." The last year of the Herbert
Hoover administration, the top marginal income tax rate was raised
from 24 to 63 percent. During the Roosevelt administration, the top
rate was raised at first to 79 percent and then later to 90 percent.
Hillsdale College economic historian Professor Burton Folsom notes
that in 1941, Roosevelt even proposed a whopping 99.5 percent
marginal rate on all incomes over $100,000. Much more of the
Hoover/FDR fiasco can be found in "Great Myths of the Great
Depression".
The Great Depression did not end until after WWII. Why it
lasted so long went unanswered until Harold L. Cole, professor of
economics at the University of Pennsylvania, and Lee E. Ohanian,
professor of economics at UCLA, published their research project
"How Government Prolonged the Depression" in the Journal of
Political Economy (August 2004). Professor Cole explained, "The
fact that the Depression dragged on for years convinced generations
of economists and policy-makers that capitalism could not be
trusted to recover from depressions and that significant government
intervention was required to achieve good outcomes. Ironically, our
work shows that the recovery would have been very rapid had the
government not intervened." Professors Cole and Ohanian argue
that FDR's economic policies added at least seven years to the
depression.
Where do the trillion-plus dollars come from that Congress
and Obama are spending in an effort to stimulate the economy?
How about Santa Claus, or maybe the Tooth Fairy? If you said,
"Come on, Williams, you're being silly! The only way government
can spend a dollar is to tax or borrow it," go to the head of the
class. In the case of a tax, one should ask what would that taxpayer
have done with the dollar had it not been taxed away. He would
have spent it on something that would have created a job for
someone. If the government hadn't borrowed the dollar, it might
have been invested in some project that would have created a job.
When government taxes, borrows and spends, it shifts
unemployment from one sector to another. Of course, the sector
that benefits tends to be a political favorite of the shifter.
Between 1787 and 1930, our nation has seen both mild
and severe economic downturns, sometimes called panics, that

Combat is an unpredictable and inexact environment, but we were well led.
As a rifle platoon and company commander, I served under a succession of
three regimental commanders who had cut their teeth in World War II, and
four different battalion commanders, three of whom had seen combat in
Korea. The company commanders were typically captains on their second
combat tour in Vietnam, or young first lieutenants like myself who were
given companies after many months of "bush time" as platoon commanders
in he Basin's tough and unforgiving environs.
The Basin was one of the most heavily contested areas in Vietnam,
its torn, cratered earth offering every sort of wartime possibility. In the
mountains just to the west, not far from the Ho Chi Minh Trail, the North
Vietnamese Army operated an infantry division from an area called Base
Area 112. In the valleys of the Basin, main-force Viet Cong battalions whose
ranks were 80 percent North Vietnamese Army regulars moved against the
Americans every day. Local Viet Cong units sniped and harassed.
Ridgelines and paddy dikes were laced with sophisticated booby traps of
every size, from a hand grenade to a 250-pound bomb. The villages sat in
the rice paddies and tree lines like individual fortresses, crisscrossed with
the trenches and spider holes, their homes sporting bunkers capable of
surviving direct hits from large-caliber artillery shells. The Viet Cong
infrastructure was intricate and permeating. Except for the old and the very
young, villagers who did not side with the Communists had either been
killed or driven out to the government controlled enclaves near Danang.
In the rifle companies, we spent the endless months patrolling
ridgelines and villages and mountains, far away from any notion of tents,
barbed wire, hot food, or electricity. Luxuries were limited to what would fit
inside one's pack, which after a few "humps" usually boiled down to letter-
writing material, towel, soap, toothbrush, poncho liner, and a small
transistor radio.
We moved through the boiling heat with 60 pounds of weapons
and gear, causing a typical Marine to drop 20 percent of his body weight
while in the bush. When we stopped we dug chest-deep fighting holes and
slit trenches for toilets. We slept on the ground under makeshift poncho
hootches, and when it rained we usually took our hootches down because
wet ponchos shined under illumination flares, making great targets. Sleep
itself was fitful, never more than an hour or two at a stretch for months at a
time as we mixed daytime patrolling with night-time ambushes, listening
posts, foxhole duty, and radio watches. Ringworm, hookworm, malaria, and
dysentery were common, as was trench foot when the monsoons came.
Respite was rotating back to the mud-filled regimental combat base at An
Hoa for four or five days, where rocket and mortar attacks were frequent
and our troops manned defensive bunkers at night. Which makes it kind of
hard to get excited about tales of Woodstock, or camping at the Vineyard
during summer break.
We had been told while training that Marine officers in the rifle
companies had an 85 percent probability of being killed or wounded, and
the experience of "Dying Delta," as our company was known, bore that out.
Of the officers in the bush when I arrived, our company commander was
wounded, the weapons platoon commander wounded, the first platoon
commander was killed, the second platoon commander was wounded twice,
and I, commanding the third platoons fared no better. Two of my original
three-squad leaders were killed, and the third shot in the stomach. My
platoon sergeant was severely wounded, as was my right guide. By the time
I left, my platoon I had gone through six radio operators, five of them
casualties.
These figures were hardly unique; in fact, they were typical. Many
other units; for instance, those who fought the hill battles around Khe Sanh,
or were with the famed Walking Dead of the Ninth Marine Regiment, or
were in the battle of Hue City or at Dai Do, had it far worse.
When I remember those days and the very young men who spent
them with me, I am continually amazed, for these were mostly recent
civilians, barely out of high school, called up from the cities and the farms
to do their year in hell and then return. Visions haunt me every day, not of

the nightmares of war but of the steady consistency with which my
Marines faced their responsibilities, and of how uncomplaining most of
them were in the face of constant danger. The salty, battle-hardened 20-
year-olds teaching green 19-year-olds the intricate lessons of the hostile
battlefield. The unerring skill of the young squad leaders as we moved
through unfamiliar villages and weed-choked trails in the black of night.
The quick certainty when a fellow Marine was wounded and needed help.
Their willingness to risk their lives to save other Marines in peril. To this
day it stuns me that their own countrymen have so completely missed the
story of their service, lost in the bitter confusion of the war itself.
Like every military unit throughout history we had occasional
laggards, cowards, and complainers. But in the aggregate, these Marines
were the finest people I have ever been around. It has been my privilege
to keep up with many of them over the years since we all came home. One
finds in them very little bitterness about the war in which they fought.
The most common regret, almost to a man, is that they were not able to
do more for each other and for the people they came to help.
It would be redundant to say that I would trust my life to these
men. Because I already have, in more ways than I can ever recount. I am
alive today because of their quiet, unaffected heroism. Such valor
epitomizes the conduct of Americans at war from the first days of our
existence. That the boomer elites can canonize this sort of conduct in our
fathers' generation while ignoring it in our own is more than simple
oversight. It is a conscious, continuing travesty.

Unilateral Disarmament

WASHINGTON -- While President Barack Obama golfs his way
through the Gulf Coast's oil-drenched environmental calamity,
another crisis is looming across the Potomac. America's military, in
harm's way in a two-front war, is about to get staggered by a
double whammy below the belt. Unfortunately for those who wear
our nation's uniform, the commander in chief and his cronies in
Congress are throwing the punches.
The first blow will land in the next two weeks unless Harry
Reid's Senate and Nancy Pelosi's House of Representatives can get
their acts together to pass a supplemental appropriations bill to
fund combat operations in Iraq and Afghanistan. In May, while
proselytizing for homosexuals in our military, Defense Secretary
Robert Gates gently reminded the congressional Armed Services
committees that he needed the appropriation by Memorial Day.
They ignored him.
Last month, he went again and told them the funds had to
be approved before the Independence Day recess or the Pentagon
would have to start doing "stupid things" -- such as shifting funds
within the overall Defense Department budget just to keep the
troops in the field supplied with beans, bullets and bandages. Once
again, Congress -- taking its cue from Obama's virtual silence on
the matter -- did nothing.
On July 13, Gates went up to Capitol Hill again, urging the
solons to break the deadlock before the House recesses for

"campaign season" at the end of the month. The defense secretary
warned that without action by then, he will have to start canceling
contracts on everything from weapons and equipment repairs to
ammunition and fuel purchases in order to pay the troops. Not exactly
what a soldier, sailor, airman, guardsman or Marine needs to hear in
the middle of Afghanistan's "fighting season."
Senate Minority Leader Mitch McConnell, R-Ky., describes the
situation as "a true emergency." Yet despite dire predictions of higher
unemployment as defense suppliers shed employees when contracts
for munitions and equipment are delayed, there doesn't seem to be
any sense of urgency at the Obama White House. Perhaps that's
because this is just the first low blow.
A second salvo is making its way through Washington's
"think tanks" and elite soirees. For more than a month, while Gates
has been begging Congress to act on this year's $33 billion war
supplemental, the Sustainable Defense Task Force quietly has been
circulating a report, titled "Debt, Deficits, & Defense: A Way
Forward," to the same congressional offices. The 56-page document
lays the groundwork for drastic cuts in U.S. military spending --
starting next year.
The 14-member, allegedly nonpartisan task force was
convened last year at the direction of Reps. Barney Frank, D-Mass.,
Walter B. Jones, R-N.C., and Ron Paul, R-Texas, and Sen. Ron
Wyden, D-Ore. Its mandate was to "explore possible defense budget
contributions to deficit reduction efforts that would not compromise
the essential security of the United States."
No one from the so-called "mainstream media" has inquired
about which, if any, members of the Obama administration have read
the report. They should. The document not only proffers an entirely
new definition of the word "contribution" but also provides a blueprint
for unilateral disarmament in the midst of a war and a global spike in
the development and acquisition of weapons of mass destruction.
Though few would argue with the task force's conclusions
that better acquisition, contracting and auditing at the Pentagon are
essential to saving billions, the authors' base line budget urges the
U.S. to reduce military spending by nearly a trillion dollars over the
course of the next decade by making drastic cuts in ships, aircraft,
weapons systems and military personnel. The premise for making
such major strategic and conventional force structure cuts is naive
and dangerous.
For example, in Section 3 of the report, labeled "Realistic
Goals, Sustainable Strategy," the authors preface their proposed cuts
by baldly claiming, "In the conventional realm, the United States
today faces no global threat remotely comparable to that once posed
by the Soviet Union and its allies." Somehow they seem to have
missed a salient fact: More Americans have been killed by radical
Islamists than by the entire Soviet nuclear arsenal.
Section 7, "A Strategy of Restraint Would Allow Even Greater
Savings," posits that billions more can be saved by our adopting a
"strategy of restraint -- one that reacts to danger rather than going
out in search of it." For those of us who once learned what happened
at Pearl Harbor on Dec. 7, 1941, or who vividly recall planes flying
into buildings on Sept. 11, 2001, those words are highly offensive.
But at the Obama White House -- where it's blame America first and
apologize globally -- they undoubtedly will get a high-five.

America’s first central bank, the Bank of North America, was
created in 1781 by Continental congressman Robert Morris, who
modeled the bank after the Bank of England. The bank was formed
before the Constitution was drafted and was wrought with fraud and
plagued by inflation caused by the creation of baseless “fiat” currency.
The bank lasted for three years. Morris’s former aide, Alexander
Hamilton, became secretary of the Treasury and in 1791 headed the
next attempt at a central bank by establishing the First Bank of the
United States. He was strongly opposed by Jefferson and his
followers. In 1811, the charter of the First Bank of the United States
was not renewed.
Jefferson knew from British and European history that a
central bank trading on interest could quickly become the master of a
nation, noting to John Taylor in 1816 that “ . . . the other nations of
Europe have tried\ and trodden every path of force or folly in fruitless
quest of the same object, yet we still expect to find in juggling tricks
and banking dreams, that money can be made out of nothing. . . .
[B]anking establishments are more dangerous than standing armies;
and that the principle of spending money to be paid by posterity,
under the name of funding, is but swindling futurity on a large scale.”
Jefferson added, “Already they have raised up a money aristocracy. . .
. The issuing power should be taken from the banks and restored to
the people to whom it properly belongs.” Jefferson believed that
instituting a central bank would be unconstitutional.
“I consider the foundation of the Constitution as laid on this
ground [enshrined in the Tenth Amendment]: That ‘all powers not
delegated to the United States, by the Constitution, nor prohibited by
it to the States, are reserved to the States or to the people.’ To take a
single step beyond the boundaries thus specially drawn around the
powers of Congress, is to take possession of a boundless field of
power, no longer susceptible of any definition. The incorporation of a
bank, and the powers assumed by this bill, have not, in my opinion,
been delegated to the United States, by the Constitution.”
Despite Jefferson’s lobbying, the financial chaos that
resulted from the War of 1812 prompted Congress to issue a twenty-
year charter to the Second Bank of the United States in 1816. Andrew
Jackson, the first president from west of the Appalachian Mountains,
denounced the central bank as unconstitutional and as “a curse to a
republic; inasmuch as it is calculated to raise around the
administration a moneyed aristocracy dangerous to the liberties of
the country.” This central bank ended in 1836, after President
Jackson vetoed a congressional bill to extend its charter.
Much to bankers’ dismay, Jackson fully eliminated the
national debt by the end of his two terms as president. It was
probably no coincidence that America’s first assassination attempt
was made on Jackson by a man named Richard Lawrence, a man who
claimed to be in touch with “the powers in Europe,” who had
promised to intervene if any attempt was made to punish him.
Lawrence was a painter, and many speculate that at the time the lead
in his paints had caused him to become mentally unbalanced and
fancy himself the rightful king of England. After stalking Jackson for
several weeks, on January 30, 1835, a particularly humid day, he
approached the president coming from a funeral. Stepping suddenly
from behind a pillar, Lawrence pulled two pistols but both misfired,
most likely due to damp powder. Lawrence was swiftly wrestled to the
ground by onlookers, including Congressman Davy Crockett aided by
Jackson. At his trial, Lawrence was prosecuted by Francis Scott Key,
author of “The Star-Spangled Banner.” The jury took only five

minutes to find Lawrence insane and he spent the rest of his life in
mental institutions, dying in 1861.
Although many persons, including Jackson, believed
Lawrence was part of a larger conspiracy, at the time there was no
evidence to prove whether he was merely a lone-nut assassin or an
early-day patsy somehow manipulated into attacking Jackson, an
implacable enemy of the international bankers. However, it might be
worth noting that in two successful presidential assassinations—those
of Abraham Lincoln and John F. Kennedy— both men were attempting
to thwart the international bankers— Lincoln by issuing his own
money, greenbacks, and Kennedy in bypassing the Fed with U.S. notes
in 1963.
“While most people understand what took place when the
American Revolution was fought, many are not aware of the permanent
financial evolution that [was] being fought over the world’s monetary
system since 1694 when the Bank of England was created,” explained
international reporter Joan Veon. “At that time, a group of private
individuals decided that they could make a great deal of money if they
changed the laws of the land to shift control of the country’s finances
from the government to them. The Bank of England, which is England’s
‘central bank,’ is a private corporation which earns a continuous stream
of income when the British government borrows from them to run the
country. England was the ingenious country that recognized they could
run the world’s finances if they established private corporations in all
the countries of the world. The combined debt of all the world’s
country’s [sic] would create an income stream of unbelievable amounts.
In 1913, Congress passed the Federal Reserve Act creating our central
bank. Most Americans don’t know that this organization is a private
corporation established to control America’s monetary system through
the banking industry.”
Other attempts were made to resurrect a central bank in
America but none succeeded until the creation of the Federal Reserve
System at the hands of a well-documented conspiracy. “The situation
we are confronted with did not happen in the last few years, but began
in 1913 when a group of cunningly deceitful legislators passed the
Federal Reserve Act on December 24 at 11:45 p.m., after those who
were opposed went home for Christmas,” Veon noted.
“[T]here was an occasion near the close of 1910, when I was as
secretive, indeed, as furtive as any conspirator. . . . I do not feel it is any
exaggeration to speak of our secret expedition to Jekyll Island as the
occasion of the actual conception of what eventually became the
Federal Reserve System . . . ,” wrote Frank A. Vanderlip, one of the men
who created the Fed. He went on to become president of New York’s
National City Bank, a forebear of today’s Citibank.
What Vanderlip was referring to was a secretive trip on the
night of November 22, 1910, by seven men who perhaps held as much
as one fourth of the world’s wealth. Jekyll Island was J. P. Morgan’s
fashionable hunting retreat off the coast of Georgia, and the men went
under secrecy so strict that they only used first names when addressing
one another and brought in new servants who were unaware of their
identities.
During their week on Jekyll Island, the men worked on a plan
for a banking reform that the government deemed necessary after a
series of financial panics in 1879, 1893, and 1907. In fact, Princeton
University president and future U.S. president Woodrow Wilson
proclaimed that the solution to the financial panics laid in the
appointment of “a committee of six or seven public-spirited men like J.
P. Morgan to handle the affairs of our country.” Cries arose for a stable
national system that could regulate banking and prevent crises and

panics. Today, many researchers believe these panics were artificially
created as a pretext for the “reforms.”

GM's Move Away from 'Government Motors'

My friend Matt Lewis recently authored a thoughtful column
about General Motors. As he pointed out, regardless of how one
feels about the government bailout of GM – which he and I both
vigorously opposed – there is reason for optimism about the
company’s future.
To be sure, there is an argument to be made for
conservatives to actually root for GM continued failure. Presumably,
this would lessen the odds that the government would attempt such
a heavy-handed maneuver in the future.
But as a former Cincinnati Mayor -- and Treasurer of State
of Ohio (another state struggling to adapt from a manufacturing
economy to an information economy) – my strong philosophical
opposition to bailouts is tempered by my realization that the
decision was made, and now we must move forward.
It’s also important for someone to make this point before
it’s too late – if GM does succeed at turning things around, it should
not be construed as “proof” the bailout “worked,” nor should
President Obama attempt some sort of victory tour to score political
points. For one thing, it’s impossible to say that bailing out GM –
even if GM turns things around – was good. It very well may be that
allowing GM to fail would have forced the industry to modernize,
and would have allowed competitors like Ford to gain market share.
We can have that debate, but that’s water under the bridge now.
It’s too early to predict how things will play out (I’ll be
more charitable toward GM once the taxpayers are fully
compensated, and once the government no longer owns stock in the
company), but evidence suggests the new GM regime is
miraculously attempting to implement conservative free market
principles. Should GM succeed in achieving long-term profitability,
the credit will belong to the new leadership, not the federal
government.
Based on early reports, it seems the old days of GM
producing cars that no one really wanted and then offering steep
discounts just to move subpar products, are over. Also gone are the
days when GM was in a variety of businesses that were unrelated to
the automobile industry. Now the company concentrates solely on
producing high quality cars, trucks and SUVs, nothing else. I’m told
that within GM there is a deep desire to pay back the government
loan and turn the company around to permanent profitability. Again,
I will believe it when I see it, but, so far, indications are positive
that GM will do just that.
It’s also worth noting that General Motors’ June U.S. sales
rose 11 percent from the same month last year. Sales of GM’s
Camaro, Malibu, and its family SUV, the Equinox, are flourishing
The Camaro outsold Ford’s Mustang for 11 straight months until
Ford was forced to offer big incentives to lure buyers.
Ten GM models ranked in the Top 3 of their segment, more
than any other manufacturer and GM now boasts four award
winning models; Tahoe; Avalanche; Sierra LD and the Escalade.
Motor Trend recently reported, “Buick Is Back,” and featured a story
applauding the brand’s quality and performance.

In addition, the company has completely restructured its
labor agreement to bring its labor costs in line with what Toyota is
paying. The company has inked a new contract with labor that
includes a “no-strike” provision that extends beyond five years. GM
also now has more flexibility to bring on temporary skilled and non-
skilled workers to keep plants open and production lines running.
Within a few months, I am sure we will see a high profile
victory tour by members of the Obama Administration who will want
to claim a lion’s share of the credit for GM’s turnaround. But make no
mistake about it, if GM turns the corner, it will be the result of new
leadership by a determined CEO who is demanding a strong work
ethic and utilizing sound free market principles to return General
Motors to icon status within the automobile industry.

Why Taking Mel Gibson's Guns Is Wrong

Since Mel Gibson has never been convicted of a violent crime,
since he has never used a gun in a violent fashion, and since there is
increasing suspicion as to the release of those awful tapes this week, the
judge presiding over the nastiness between Gibson and former girlfriend
should be careful in how he proceeds.
I listened to the Mel Gibson tapes this week. I'm fully aware of the
horrendous things Mel Gibson said to another human being. Nothing that I
am about to explain defends those actions in any way.
It is also true that while Perez Hilton and the rest of the voyeur
industry of muck and shame have taken great delight in Gibson's downfall
over the past few weeks, nary a word is mentioned about that other
Hollywood icon who got to rape young girls with impunity a few years back,
and this week went free. In fact when the Swiss decided to allow Roman
Polanski to walk it may have been the only significant statement they've
made on an international matter in a century or two. The Swiss never can
quite seem to summon up the courage to call nazism, totalitarianism, or
even terrorism--immoral.
So what's a little child rape between soulless nations?
But I digress.
This week a judge ordered Mel Gibson to turn in or get rid of all
firearms in his possession and to submit a statement to the court asserting
as much. The impetus for doing so is a claim by Gibson's former girlfriend
that the actor waived a gun in her face and mumbled something about
showing her "how to get out of here real fast (link) ." This is a claim that has
no evidence besides the girlfriend's testimony. Testimony that needs to be
questioned for a variety of reasons. All such accusations should always be
tested and verified before singularly usurping a non-felon's Constitutionally
protected second amendment rights.
This week besides the horrific audio that got splashed
conveniently across every news channel, while the Polanski get-away-with-
rape-for-free-fest transpired simultaneously, the media also failed to
mention the evaluation of those leaked tapes by two top audio forensic
experts. "Exceptional quality" and "professionally made" were just the early
observations (link) by the experts identified in Hollywood based media
outlets this week. One of the experts demonstrated through sophisticated
audio analysis (link) how many redactions had been eliminated from the
original recording.
What the tapes do have on them are Mel Gibson's voice saying
horrific things, but if you were like me scratching your head trying to figure
out what caused the seemingly absurd changes in mood, random thought
patterns, and extreme elevations of intensity on the tapes absent hardly any

audio from the girlfriend, you weren't crazy. The tapes were doctored and
much of what likely caused Mel's trigger temper to explode is missing
from the discussions.
My point?
If Oksana and her merry band of dishonest audio pirates were
purposefully luring Mel into what were designed to be premeditated
discussions, designed to set off the unsuspecting actor, only to then be
dishonestly released to the public, then no judge has any business taking
Oksana's word on a he said, she said account of something like waiving a
gun and issuing a death threat. (What she claimed his "show you how to
get out of here real fast" comment supposedly was.)
For the record the comment sounds to me like he's referring to
her getting out of the house.
There is no doubt that Mel is a troubled man. The left hate him
because he made a movie about God's message of redemption for sinners.
Redemption has actually been a consistent theme in many of Mel's works
over the years. So when the chance comes to pound the man to a bloody
pulp, the Perez Hiltons, Joy Behars and "others who hate Christians" of
the world can't resist. Behar going so far this week on her own show as to
proclaim herself perfect (link) . I kid you not... she said it.
Mel Gibson's problems are bigger than he can deal with on his
own. From his racially tinged remarks ("tinged" because he never said
that you should be "killing" other races... "and they babies" (link) (Gotta
love the Philadelphia public school English grammar classes!)) that he
has apologized for, to his issues with alcohol, and most recently his
seemingly out-of-context temper Mel is a broken man, with a lot of
problems to sort out.
Even in all the ways he's fallen short of being a role model, his
own ex-wife defended his honor and behavior as a father and human
being (link) this week with a certified letter to the court.
The judge is basing his entire case on confiscating Gibson's guns
on the hearsay of a woman who is seeking to hurt Gibson very publicly at
this time. Two top forensic experts pointed out this week that she has
been dishonest already in how she has leaked information to the public to
hurt Gibson.
It is an illegitimate, and unconstitutional demand to force
Gibson to get rid of his guns, and the judge knows it.
But if the judiciary in this nation truly cared about weapons and
intimidation, a host of prosecutors would be indicting members of the
Justice Department for racist policies by continuing to allow intimidation
by violent groups, i.e. the New Black Panthers (the mirror image of the Ku
Klux Klan), to threaten "to kill crackers."
"...AND they babies!"

When Did the Rules Change?

When Rome was "falling," did it feel like it? When all of the
tasty, leafy fronds started vanishing, did the dinosaurs say, "So this
is what extinction looks like"? When British troops signed up for a
quick war, they expected to be "home by Christmas." They certainly
didn't say "goodbye to all that" -- in the words of Robert Graves --
until long after they realized "all that" had in fact disappeared.
I'm beginning to wonder if the political moment is much,
much, more significant than most of us realize. The rules may have
changed in ways no one would have predicted two years ago. And
perhaps 10 years from now we'll look back on this moment and it
will all seem so obvious.

In 2008, American liberalism seemed poised for its
comeback. The pendulum of Arthur Schlesinger's "cycle of history"
was swinging back toward a new progressive era. Obama would be
the liberal Reagan.
Now that all looks preposterous. Of course, considerable
blame can be laid at a White House that seems confused about how
to relate to the American people when the American people don't
share the White House's ideological agenda. Indeed, the White House
seems particularly gifted at generating issues that put it crosswise
with the majority of voters, from the Arizona immigration lawsuit to
the cotton-mouthed explanations about whether or not it considers
NASA's primary mission to be boosting the self-esteem of Muslim
youth.
But it would be foolish to over-read the importance of much
of that. Politicians are sometimes dealt bad cards and play them well
and sometimes they are dealt good cards and play them badly. But
the basic political rules stay the same.
But what about when the rules change? For nearly a century
now, the rules have said that tough economic times make big
government more popular. For more than 40 years it has been a rule
that environmental disasters -- and scares over alleged ones -- help
environmentalists push tighter regulations. According to the rules,
Americans never want to let go of an entitlement once they have it.
According to the rules, populism is a force for getting the government
to do more, not less. According to the rules, Americans don't care
about the deficit during a recession.
And yet none of these rules seem to be applying; at least not
too strongly. Big government seems more unpopular today than ever.
The Gulf oil spill should be a Gaiasend for environmentalists, and yet
three quarters of the American people oppose Obama's drilling ban.
Sixty percent of likely voters want their newly minted right to health
care repealed. Unlike Europe, where protestors take to the streets to
save their cushy perks and protect a large welfare state, the Tea
Party protestors have been taking to the streets to trim back
government.
But even on the continent the rules are changing. European
governments have turned into deficit hawks to the point where the
American president feels the need to lecture them on their stinginess.
Of course, he increasingly feels the same need here at home
as our out-of-control debt is becoming a live issue, despite the fact
that voters should be clamoring -- according to the rules -- for more
taxpayer-funded jobs.
Barack Obama recently recruited Bill Clinton to stump for the
Democrats as a surrogate because the former president is more
popular than the current one. It's ironic because candidate Obama
had once disparaged the Clinton presidency as not ambitious enough.
Obama wanted to be a liberal Reagan who would reverse the rising
conservative tide in American politics (just as he would reverse the
rise of the oceans), not be the sort of president who accepted the tide
and merely navigated its currents.
But is it really so outlandish to imagine that Bill Clinton, a
creature spawned from politics like a golem from clay, had a better
sense of political reality than the ivory tower intellectual currently
occupying the White House? Clinton proclaimed the era of Big
Government was over, and left office quite popular. Barack Obama
said, in effect, "Oh no it's not" and his presidency and his party are in
freefall, despite an economic climate that, according to the rules, says
he should be not only running the table but be popular for it.
As a conservative, I'm very reluctant to believe that the rules
change easily or often. And there's no end of explanations for the
political climate that would leave the rules intact. But it's just

Attacks on Freedom

Something's happened to America, and it isn't good. It's
become easier to get into trouble. We've become a nation of a million
rules. Not the kind of bottom-up rules that people generate through
voluntary associations. Those are fine. I mean imposed, top-down
rules formed in the brains of meddling bureaucrats who think they
know better than we how to manage our lives.
Cross them, and we are in trouble.
The National Marine Fishery Service (NMFS) received an
anonymous fax that a seafood shipment to Alabama from David
McNab contained "undersized lobster tails" and was improperly
packed in clear plastic bags, rather than the cardboard boxes
allegedly required under Honduran law. When the $4 million
shipment arrived, NMFS agents seized it. McNab served eight years
in prison, even though the Honduran government informed the court
that the regulation requiring cardboard boxes had been repealed.
How about this one? Four kindergartners -- yes, 5-year-old
boys -- played cops and robbers at Wilson Elementary in New Jersey.
One yelled: "Boom! I have a bazooka, and I want to shoot you." He
did not, of course, have a bazooka. Nevertheless, all four boys were
suspended from school for three days for "making threats," a
violation of their school district's zero-tolerance policy. School
Principal Georgia Baumann said, "We cannot take any of these
statements in a light manner." District Superintendent William Bauer
said: "This is a no-tolerance policy. We're very firm on weapons and
threats."
Give me a break. These are just some of the stories featured
in a new book, "One Nation Under Arrest". I'll discuss more on my
Fox Business show Thursday night.
Here's another: Ansche Hedgepeth, 12, committed this
heinous crime: She left school in Washington, D.C., entered a
Metrorail station to head home and ate a French fry. An undercover
officer arrested her, confiscating her jacket, backpack and shoelaces.
She was handcuffed and taken to the Juvenile Processing Center.
Only after three hours in custody was the 12-year-old released into
her mother's custody. The chief of Metro Transit Police said: "We
really do believe in zero-tolerance. Anyone taken into custody has to
be handcuffed for officer safety." She was sentenced to community
service and now carries an arrest record. Washington's Metro has
since rescinded its zero-tolerance policy.
Keith John Sampson, a student-employee at Indiana-Purdue
University Indianapolis, had the temerity to read "Notre Dame
Versus the Klan: How the Fighting Irish Defeated the Ku Klux Klan"
during breaks on the job. One student complained because the book's
cover depicted the Klan. The university then found Sampson guilty of
racial harassment! Thankfully, a great organization, the Foundation
for Individual Rights in Education (FIRE), came to his defense and
got his school record cleared.
Palo Alto, Calif., ordered Kay Leibrand, a grandmother, to
lower her carefully trimmed hedges. Leibrand argued that no one's

White House vs. Boy Scouts, Part 4

In the first three parts of this series, I showed how the
Obama administration is distancing itself from the Boy Scouts of
America because of the organization's conservative positions.
Well, the White House just did it again.
At the June 29 White House press briefing, press
secretary Robert Gibbs was given another opportunity to show
support for the BSA on behalf of the honorary president of the
BSA, U.S. President Barack Obama. Ironically, once again Gibbs
ducked and dodged questions about the White House's sentiment
toward the BSA, by claiming ignorance of the BSA's recent legal
victory against the Philadelphia City Council, which accused the
BSA of violating the city's nondiscrimination policies (or of being
anti-homosexual).
Here is Gibbs' actual exchange with WorldNetDaily
correspondent Lester Kinsolving:
Kinsolving: What is the president's reaction to the
unanimous jury decision in the U.S. District Court for eastern
Pennsylvania in support of the Boy Scouts and against the
Philadelphia City Council, who tried to bar them from their

Gibbs: You're going to find this surprising, but I'm not

Speaking of reading, in February an article was published
by the nonpartisan research and education institute First Things
that proposed that The Boy Scout Handbook is "the most
influential conservative book ever produced in America." It never
has gone out of print since its formation in 1910.
Therefore, The Boy Scout Handbook also must be one of
the most dangerous threats to the White House's plan and goals
to inculcate the progressive agenda and beliefs into the hearts
and minds of every youth in America. Though most would not
label the BSA handbook a conservative text, it certainly has
become that in light of contemporary culture. It truly is a shining
light for traditional values.
Literary historian and cultural critic Paul Fussell once
described the Boy Scout Handbook as "among the very few
remaining popular repositories of something like classical ethics,
deriving from Aristotle and Cicero."
Or as Joe Carter at First Things wrote: "And then there is
the Scout Motto ('Be Prepared') and the 12 point Scout Law which
includes the politically incorrect admonition to be reverent: 'A
Scout is reverent toward God. He is faithful in his religious duties.
He respects the beliefs of others.'"
If President Obama concurred that the BSA handbook's
principles enrich the lives of youth, develop quality leaders and
help produce a new generation of patriotic American citizens,

espousing the BSA like past administrations?
I know, I know. I shouldn't expect so much. After all,
President Obama is probably too busy trying to fix the economy,
the border problems, the Gulf oil crisis and the Afghanistan war,
right? Such is the case also with deadbeat dads across the
country; they're too busy to support or do anything with their
kids. Know what I mean? (Why don't you try that explanation
on the Scouts and see how well it goes over.)
There I go again, sounding like Glenn Beck. And
besides, those Boy Scouts should be reading other, more
meaningful materials than what Fussell labeled "a popular
repository of something like classical ethics," right? Maybe
Scouts need to broaden their horizons, right? Maybe Scouts
should be reading progressive texts, such as "The Communist
Manifesto" or the book that Doug Mills of The New York Times
inadvertently photographed Obama reading on the presidential
campaign trail in Bozeman, Mont.: "The Post-American World."
Whom are we kidding?! Not the kids!
Last week, I challenged Obama, the honorary BSA
president, to attend the upcoming National Scout Jamboree
from July 26-Aug. 4 in Virginia, as past U.S. presidents have
done. I concluded by respectfully challenging the BSA's
leadership with two straightforward objectives.
First, don't ever compromise your core principles and
values. You've impacted millions upon millions of young lives
and enriched our country and world because of your presence
and contributions. Don't sell out now, especially on account of
others' progressive agendas.
Secondly, I would appeal to the BSA's national
president, Rex Tillerson, himself to please consider approving
the new BSA patriotism merit badge. More than ever, our
country needs to commend those young people who
demonstrate a unique commitment to not only God but also
country. With our republic facing some of its greatest trials and
a potentially perilous future, it's time to reward valiant and
exceptional patriotism, especially among our youth.

Throwing Others Under the Bus and Patting
Ourselves on the Back on Race

I realize that the hot topic today is racism and that both
liberals and conservatives are falling all over themselves to prove how
non-racist they are and, in the process, throwing anyone and
everyone under the bus just to prove their bona fides.
I think it's sad, especially when the people who are emerging
unscathed from this are far from blameless and those accused of the
dastardly deeds of reporting this incompletely aren't quite the villains
they're being portrayed as. It bothers me how little courage people
have to stand up for what is right on the issue of race, mainly for fear
they'll be stigmatized with charges of insensitivity toward race or,
worse, racism.

It seems to me that President Obama's unchecked liberalism is
in such disfavor among the electorate that supporters of his agenda
often invoke the race card against opponents of his agenda both to
distract attention from substantive issues and to demonize
conservatives.
I truly don't believe this Shirley Sherrod story is primarily
about sloppy, negligent or even malicious reporting. Obviously, fairness
dictates that quotes should be reported in context. And it is
indefensible for a reporter to misrepresent a person's meaning
intentionally, whether from failing to provide the context or otherwise.
Having met Andrew Breitbart, I sincerely doubt he reported this story
with any intent to mislead.
But even if we are willing to assume, for purposes of
discussion, the worst about Breitbart and condemn him for whatever
reason -- e.g., because it makes us feel superior, makes us appear above
racism ourselves, or serves a political cause to demonize him (and thus
tea partiers and conservatives) -- where does that leave us?
Let's just say Breitbart is the worst human being on the planet
(though I reject that he's even a bad guy). Are we going to allow
ourselves to be distracted from the rest of the back story and from all
the other vitally important issues facing us today?
Have all those who are patting themselves on the back for
pointing out how badly Shirley Sherrod was mistreated studied her
views? Do they automatically give her a pass for some of the other
things she did say that at least bear on her class warfare mindset or,
even more to the point, her willingness to imply -- unfairly -- others are
racists?
My friend Andy McCarthy at National Review Online
highlighted certain statements of Sherrod's in that same speech.
She was presumably referring to the people who established
slavery at this nation's founding (but don't take my word or even
Andy's for what she said; listen to or read her words yourself, because
there's not enough space to include her entire speech). She said: "So
that's when they made black people servants for life. That's when they
put laws in place forbidding them (i.e., blacks and whites) to marry
each other. That's when they created the racism that we know of today.
They did it to keep us divided. And ... it started working so well they
said, 'Gosh, looks like we've come upon something here that could last
generations.' And here we are, over 400 years later, and it's still
working."
McCarthy goes on to quote Sherrod apparently addressing the
motives of some of Obamacare's opponents. She said: "I haven't seen
such a mean-spirited people as I've seen lately over this issue of health
care. Some of the racism we thought was buried. Didn't it surface?
Now, we endured eight years of the Bushes, and we didn't do the stuff
these Republicans are doing because you have a black president."
Do we not see the irony in this mad rush to lionize Shirley
Sherrod because she was falsely depicted as a racist by someone who
took her comments out of context, when that very same Shirley Sherrod
seems to be, in effect, unfairly and categorically demonizing people as
racists? How about the irony in the castigation of Breitbart for
smearing someone as a racist by people who routinely smear an entire
group of people (conservatives) as racists?
To be clear, I'm not suggesting two wrongs make a right. But I
am saying that we shouldn't allow this incident to distract us from: a)
other important issues; b) the troubling statements that Sherrod did
make (in context); or c) the ongoing malicious charges of racism
constantly leveled against tea partiers, other conservatives and other
Obama opponents, even by many of the people exploiting this incident.

Racism is an indefensible sin, but false charges of racism are
right up there with it -- bearing false witness against people and
putting them in the worst possible light.

Obama's US Assassination Program?

Sound too conspiratorial to be true? Like the cover-up
ops of spy novels? Well, it's reality. And it is possibly the most
bizarre, inhumane and abusive way that the White House is
expanding its power over the American people.
It's not an extremist belief or theory of the far right.
It's a fact that has been confirmed by The New York Times, The
Washington Post and MSNBC and even documented by the far-
left online magazine Salon.com.
And it's the gravest nightmare of U.S. citizens and
abandonment of our Constitution to date: a presidential
assassination program in which U.S. citizens are in the literal
scopes of the executive branch based upon nothing more than
allegations of terrorism involvement as the branch defines it.
Of course, the CIA has executed covert assassinations
of foreigners for decades. But tragically, Obama is expanding
this program to include American, non-Islamic, stateside,
homegrown terrorists.
It all started in January, when The Washington Post
reported: "As part of the operations, Obama approved a Dec. 24
strike against a (Yemeni) compound where a U.S. citizen, Anwar
al-Aulaqi, was thought to be meeting with other regional al-
Qaeda leaders. Although he was not the focus of the strike and
was not killed, he has since been added to a shortlist of U.S.
citizens specifically targeted for killing or capture."

killing"?
That's right. No arrest. No Miranda rights. No due
process. No trial. Just a bullet.
While the Obama administration continues its Bush-
blaming for the economy, it is mega-morphing Bush policy in
covert ops overseas, which was, according to the Post, "to kill
U.S. citizens abroad if strong evidence existed that an American
was involved in organizing or carrying out terrorist actions
against the United States or U.S. interests."
Well, in recent weeks, the Obama administration has
taken this overseas killing op to a new low: stateside
assassinations.
A former director of national intelligence, Adm. Dennis
Blair, confessed before Congress: "We take direct actions
against terrorists in the intelligence community. If we think that
direct action will involve killing an American, we get specific
permission to do that."
If you are wondering who the "we" are to whom Adm.
Blair refers, they are Smith, Wesson and the White House.

Now we know what deputy national security adviser John
Brennan meant when he admitted in May, "And under President
Obama, we have built upon the work of the previous
administration and have accelerated efforts in many areas."
(Remember when Bush's eavesdropping on U.S. citizens seemed
harsh?)
Brennan further explained then that the problem of
homegrown terrorists ranks as a top priority because of the
increasing number of U.S. individuals who have become
"captivated by extremist ideology or causes." He went on to say,
"There are ... dozens of U.S. persons who are in different parts of
the world and ... are very concerning to us."
Do you think "different parts of the world" doesn't include
their country of origin?
Conveniently, the Obama administration also is
integrating a pervasive plan to ensure the termination of radicals
as the feds deem them abroad and domestic, too, with the
resurrection of the Violent Radicalization and Homegrown
Terrorism Prevention Act of 2007, introduced by Rep. Jane
Harman, D-Calif. Also known as H.R. 1955, it was passed in the
House by the Democratic majority but was rejected by the
Senate.
Everyone thought that legislation was dead until the
Obama administration resurrected its tenets in its 52-page
"National Security Strategy," released in May. So alarming is the
feds' potential abuse of power that officials from London to the
Kremlin are recognizing the threat to U.S. citizens.
The European Union Times reported, "Foreign Ministry
reports circulating in the Kremlin today are warning that an
already explosive situation in the United States is about to get a
whole lot worse as a new law put forth by President Obama is
said capable of seeing up to 500,000 American citizens jailed for
the crime of opposing their government."
Woodrow Wilson, during his reign as president,
incarcerated more than 2,000 U.S. citizens for speaking out
against the government. And now for the first time since, a U.S.
president is highlighting the threats of homegrown terror and
literally hunting U.S. citizens as terrorists. One senior
administration official said, "For the first time since 9/11, the
(national security strategy) integrates homeland security and
national security."
And what type of "integration" does that entail?
President Obama explained in an often overlooked
statement within the "National Security Strategy": "We are now
moving beyond traditional distinctions between homeland and
national security. ... This includes a determination to prevent
terrorist attacks against the American people by fully coordinating
the actions that we take abroad with the actions and precautions
that we take at home."
Could it be any clearer? Right out of the horse's mouth.
Or do I need to spell out what "fully coordinating the actions that
we take abroad with the actions and precautions that we take at
home" means?
Remember the words "a shortlist of U.S. citizens
specifically targeted for killing"?
That's right. No arrest. No Miranda rights. No due
process. No trial. Just a bullet.

Why Eric Holder Will Not Last

There may be more incompetent Attorneys General who
have served Presidential administrations in U.S. History, but few if
any of them have had a worse record than the present head of the
Justice Department. And should the miraculous happen, and
President Obama do the unthinkable, and cut taxes for small
businesses, and thereby win re-election in 2012, I wouldn't expect to
see Mr Holder make it to term number two.
In blunder after blunder the President has already
repeatedly been forced to back away from the decision making at the
Justice Department. But the trail of disasters has left legal litter for
the administration to clean up in even more ways than they could
have predicted.
Holder has overreached so many times people have begun to
wonder if his arms were attached backwards at the joint.
Yet no over-reach will have been more embarrassing than
the shellacking he is taking in the DOJ vs. the State of Arizona. If the
early signals are indicative of the judge's final outcome I personally
don't know how he survives in the administration.
Since the administration announced it would be suing the
state of Arizona of its own rights to enforce the law within it's
boundaries, legal scholars I've spoken with have by the dozens
scratched their heads, and issued muted puzzled responses on what
the clear legal strategy was for Holder to win. Evidently the judge in
the case, Susan Bolton - a democratic appointee - had some of the
same strange curiosities. She is openly questioning the grounds on
which the government brought its case against state law SB 1070 - the
non-controversial state law that allows the local police and sheriffs to
assist federal authorities in determining the legal status of those
coming into contact with the state.
As most of America now knows, SB 1070 maintains the same
guidelines as federal immigration law, but goes one step further in
toughness--against those in law enforcement. It clearly penalizes
abuse of the statute by an entity attempting to racially profile with
enforcement of it.
The DOJ under Eric Holder's direction is attempting to
argue that the state law preempts federal law. The judge has openly,
almost mockingly, poked holes in the thinking behind such a claim.
Bolton has also openly wondered why the government should
concern itself in any regard with a state's desire to be seen as
hospitable or not.
Since these two arguments seem to be the primary planks of
Holder's case against Arizona, I expect this case to be dealt with
quickly, and Holder to be again seen as the laughingstock or worse
yet ruthless pragmatist he's come to be seen as in the legal
community. I even have repeatedly told the students as much at the
various Summit conferences I've been speaking to this summer.
Few reputable legal scholars believe Holder and the DOJ
had a leg to stand on to begin with. Even Holder himself seemed to
intimate that he might lose the case while being questioned on CBS
two Sundays ago. Pledging that if he lost this first round he might
find legal bearing to file a suit on the basis of racial profiling--an

Most of us won't get a dime and will have to pay the entire
cost of the retrofit out of our own pockets. More transfer of wealth,

Performance Labeling Program establishes a labeling program that for
each individual residence will identify the achieved energy efficiency
performance for "at least 90 percent of the residential market within 5
years after the date of the enactment of this Act."
This means that within 5 years 90% of all residential homes
in the U..S. must be measured and labeled. The EPA administrator
will get $50M each year to enforce the labeling program. The
Secretary of the Department of Energy will get an additional $20M
each year to help the EPA. Some of this money will, of course, be
spent on coming up with tougher standards each year...
Oh, the label will be like a license for your car. You will be
required to post the label in a conspicuous location in your home and
will not be allowed to sell your home without having this label. And,
just like your car license, you will probably be required to get a new
label every so often - maybe every year.
But, the government estimates the cost of measuring the
energy efficiency of your home should only cost about $200 each
time. Remember what they said about the auto smog inspections
when they first started: that in California ? It would only cost $15.
That was when the program started. Now the cost is about $50 for
the inspection and certificate.
Expect the same from the home labeling program. Sect. 304
- Greater Energy Efficiency in Building Codes establishes new energy
efficiency guidelines for the National Building Code and mandates at
304(d) that one year after enactment of this Act, all state and local
jurisdictions must adopt the National Building Code energy efficiency
provisions or must obtain a certification from the federal government
that their state and/or local codes have been brought into full
compliance with the National Building Code energy efficiency
standards.

"Our federal government should be doing its job to secure
our borders rather than trying to bully and intimidate the people of
Arizona," argued Republican amendment sponsor Sen. Jim DeMint
of South Carolina. "We should not be suing and really hassling the
people of Arizona for doing what we should be doing here, and that's
protecting the citizenry."
All but five Senate Democrats (Indiana's Evan Bayh took a
pass and didn't vote) sided with the anti-Arizona Obama
administration -- and against not only a majority of Arizonans, but a
majority of Americans who support the state's effort to restore order
on the chaotic southern border and protect American workers facing
double-digit unemployment.
Several House Democrats have actively lobbied to boycott
Arizona and crush its economy -- most notably, southern Arizona's
own Democrat Rep. Raul Grijalva, who urged civic, religious and
political groups to take their convention dollars elsewhere.
"Do not do business with this state," Grijalva told open-
borders zealots bent on punishing law-abiding citizens to "send a
message."
For its part, the Obama Justice Department's Civil Rights
Division has targeted Maricopa County, Ariz., Sheriff Joe Arpaio for
more than a year over his strict enforcement policies against illegal
alien criminals. The hell-bent Civil Rights Division is helmed by
veteran illegal immigration advocate Thomas Perez, who has lobbied
for driver's licenses, in-state tuition discounts and blanket amnesty
for millions of border-jumpers, visa overstayers and deportation
fugitives.
Arizona's neighbor to the north, Utah, is under fire by a
different set of left-wing bureaucrats. When Interior Secretary Ken
Salazar isn't busy destroying jobs through his radical offshore drilling
moratorium, he's been blocking onshore development and wreaking
havoc on the Beehive State's energy industry.
Last week, Salazar defended pulling 77 oil lease contracts
granted in the final days of the George W. Bush administration.
Salazar's inspector general concluded that there was no evidence of
any rush to auction off the parcels -- as baselessly claimed by
environmental groups and Salazar himself. In fact, the leases were
granted only after seven full years of rigorous study and debate.
That makes two Salazar job-destroying bans based off bogus
eco-claims. (Remember: Loathsome cowboy Salazar was behind the
shameless doctoring of a scientific report to bolster the Obama
administration's devastating offshore drilling ban.)
Uintah County, Utah, officials have sued the Interior
Department over the rescinded leases, which have cost the state
untold millions of dollars and countless jobs in a tough economy. Not
to mention the court expenses, legal morass and regulatory
uncertainty.
Other Western states are reeling as a result of the
Democrats' eco-radicalism -- and the rest of America is paying a high
price, too. Salazar was a leading opponent of oil shale development

The Morning Sentinel, a small paper from the state of
Maine, has a travelogue story of the Obama’s vacation in and
about North Carolina today. It has a very interesting little
tidbit in it that should enrage every American. It is something
that really shows Barack Obama’s arrogance and his obviously
assumed air of noblesse oblige. Among the exciting details of
the Obama’s visit to Acadia National Park in Bar Harbor is
this tidbit:

Air traffic at the small Hancock County-Bar Harbor
Airport in Trenton was shut down for the presidential
arrival. A U.S. Coast Guard helicopter patrolled the air in
anticipation of the first family’s touchdown, and a pair of
local fire and rescue trucks stood ready on an otherwise
empty tarmac at the private air hangar. The Obamas then
traveled onto Mount Desert Island in a motorcade of at least
16 vehicles. It was led by two Maine State Police cruisers and
included five black Chevrolet Suburbans.
And all this on OUR dime, folks. We are paying for
our monarch to fly his pets around the country on their own
special jets, folks. Perhaps Barack Obama isn’t like a king.
Perhaps he’s more like an emperor? An emperor like the
fiddling Nero.

In what could be deemed an act of war against the sovereign
borders of the United States, Mexican drug cartels have seized control
of at least two American ranches inside the U.S. territory near
Laredo, Texas.
Two sources inside the Laredo Police Department confirmed
the incident is unfolding and they would continue to coordinate with
U.S. Border Patrol today. “We consider this an act of war,” said one
police officer on the ground near the scene. There is a news blackout
of this incident at this time and the sources inside Laredo PD spoke
on the condition of anonymity.
Word broke late last night that Laredo police have requested
help from the federal government regarding the incursion by the Los

Zetas. It appears that the ranch owners have escaped without incident
but their ranches remain in the hands of the blood thirsty cartels.
Laredo Border Patrol is conducting aerial surveillance over the
ranches to determine the best way to regain control of the U.S. ranches,
according to the Laredo Police department.
The approximate location of the U.S. ranches are10 miles
northwest of I-35 off Mines Road and Minerales Annex Road. Just off
1472 (Mines road) near Santa Isabel Creek north of the city of Laredo,
Texas.
The Los Zetas drug cartel is an offshoot of the elite Mexican
military trained in special ops. The mercenary organization is said to
include members of corrupt Mexican Federales, politicians as well as
drug traffickers. The group was once part of the Gulf cartel, but has
since splintered and now directly competes with the Gulf cartel for
premium drug smuggling routes in the Texas region.
The new leader of Los Zetas is Heriberto “El Lazca” Lazcano
and is considered the most violent paramilitary group in Mexico by the
DEA.
Recently the drug organization has kidnapped tourists,
infiltrated local municipalities and continues to smuggle narcotics into
a very hungry U.S. market.
The violence south of the border continues to spin out of
control and has left Nuevo Laredo, Mexico on virtual lockdown with
businesses refusing to open the doors. Last week a particularly violent
attack by the Los Zetas included the use of grenades and resulted in a
dozen deaths and 21 injuries.
The hostile takeover of the ranches has met with silence with
local and national media; however sources say they could be waiting to
report the stories once the ranches are back in U.S. control. This
journalist questions if this was a Middle Eastern terrorist attack if the
media would sit on their hands.

"Should we let Americans fall off a cliff or should we help
them? There shouldn't be a debate as to where the money comes
from. I mean, if your brother or your sister needed something, you
wouldn't say, 'When are you going to pay me back?'"
That's Jim Chukalas a car-parts manager who has been
unemployed for nearly two years. He's received unemployment
benefits for 79 weeks and desperately wants those benefits extended
again. He feels so strongly about it, he agreed to be one of the White
House's human props on Monday.
"It's time to stop holding workers laid off in this recession
hostage to Washington politics," President Obama proclaimed with
Chukalas at his side. "It's time to do what is right, not for the next
election but for the middle class."
While it's hardly new for Obama to claim that anyone who
holds a position different from his own is merely playing partisan
politics -- that's his default response to all disagreements -- it's at
least amusing to hear him suggest that budget balancing is now a
sign of pandering to popular sentiments.

Obama had signed an earlier extension of unemployment
benefits in November, when the economy was worse. He later
bragged that it was "fiscally responsible" and consistent with the
"pay-as-you-go" legislation he championed and signed, which says,
in Obama's words, "Congress can only spend a dollar if it saves a
dollar elsewhere."
Officially, the Republicans do not oppose extending
unemployment benefits yet again. Rather, they merely want to
observe the rules Obama championed last fall. In other words,
Democrats should pay for the spending by finding cuts elsewhere in
the budget. What is "fiscally responsible" when Obama is for it, is
rank partisanship when he's against it.
But enough with the point scoring, I want to get back to
Mr. Chukalas, a father of two and a diligent, decent man for all I
know. Again, he says, "If your brother or your sister needed
something, you wouldn't say, 'When are you going to pay me
back?'"
I don't know about the Chukalas clan, but in my family and
my wife's family, and in the families of most people I know, asking,
"When are you going to pay me back?" isn't so unimaginable. Sure,
in a crisis, kin come to the rescue if they can. But they also usually
expect to be repaid once everyone is back on their feet. Does
Chukalas have any intention of paying taxpayers back once he gets
a job?
"Extending benefits" means paying the unemployed more
than they paid into the unemployment system. (The money
Chukalas paid into that system -- his money -- ran out long, long
ago.) In other words, this is direct assistance from the federal
government, which actually means direct assistance from
taxpayers, which means Chukalas is really asking for money from
complete strangers. Moreover, he thinks all of the moral equities
line up on his side of the argument, and that there shouldn't even
be a discussion about where the money comes from or any talk of
paying it back.
Chukalas is a moral philosopher compared with many of
the C-SPAN callers these days who simply demand "their money."
By what math is it their money, I wonder, given that 60 percent of
Americans get more from government than they pay in taxes.
Now I know this all sounds terribly harsh, and, truth be
told, I do not think the government should consider benefit
extensions to be loans. Nor do I think it's a slam-dunk argument
that such aid should be cut off. This is not a normal downturn.
But I do think this illustrates how fuzzy our thinking is
about the role of government. Comparing government to a wealthy
brother or sister is, simply, a category error. Can you get a gift or
loan from your relatives by shouting, "Give me my money!"?
It turns out, perhaps not coincidentally, that President
Obama shares Chukalas' outlook.
On countless occasions he has said that his central vision
of government is to fulfill the Biblical mandate to be "my brother's
keeper, my sister's keeper." Health care reform, for instance, was
an effort to meet this "core moral and ethical obligation."
Leave aside that the Bible does not tell anyone to be their
brother's keeper (the phrase appears once, when Cain sarcastically
tries to dodge a murder rap from God). It is just plain weird that
anyone thinks we should all view government as a Big Brother.

Kagan, as a Supreme Court justice, will be required to
rule frequently on possible applications of Shariah law in the
United States. She has already noted that she welcomes "good
ideas wherever they originate" and is open to applications of
foreign law to the interpretation of U.S. statutes and common
law. In fact, a lawsuit seeking to ban Shariah Compliance Funds
in banks that accepted TARP money (as violating the First
Amendment separation of church and state) is now making its
way up to the Supreme Court. Kagan cannot be trusted to rule
dispassionately on this case, nor can we rely on her to exclude
Shariah law from American jurisprudence.
For this reason -- if for no other -- senators should vote
no on her confirmation.

Illinois Failures Go Nationwide Under Obama

'Unsustainable" is a scary word that recently entered political
discourse, coming authoritatively from Congressional Budget Office
Director Douglas Elmendorf. Unsustainability is the operative moniker for
Barack Obama's massive deficit spending, which Elmendorf said "cannot be
solved through minor tinkering."
The CBO predicts an increase in our public debt from $7.5 trillion
at the end of 2009 to $20.3 trillion at the end of 2020 if Obama's fiscal 2011
budget is implemented. As a percentage of gross domestic product, the debt
will rise to 90% from 53%.
Sen. Kent Conrad, D-N.D., sharpened the focus by asking the CBO
director: "What's going to be necessary (is) either a 25% increase in taxes or
a 20% reduction in spending, or some combination thereof. Is that
correct?" Elmendorf replied "yes."
Americans are beginning to wonder if Greece is the picture of the
U.S.' future. But we need look no further than the place where Obama and
his team were trained in community organizing and bully tactics to
redistribute the wealth: Illinois.

promoted themselves to Washington to run the country, other Obama
associates who didn't make the cut continued to run Illinois into the
ground, as the Illinois unemployment rate jumped from less than 5% to
nearly 11%.
For years, we thought California was the most fiscally
irresponsible of all 50 states, but Illinois has now taken the lead. A
lengthy news article in the New York Times was headlined: "Illinois Stops
Paying Its Bills, but Can't Stop Digging Hole."
Under years of Democratic leadership, Illinois has refused to
honor its obligations, cut spending or trim its shockingly large deficit,
which at $12 billion per year approaches nearly half its budget. As a
result, Illinois' credit rating has been downgraded and it pays a massive
amount in interest on its loans.
That's like a family making $50,000 but spending $75,000 each
year. Obviously, it won't take long before such a family would lose
everything it has.
The big-majority Democratic state legislature, defying Illinois'
balanced-budget law, has been passing deficit budgets for years. The new
definition of a liberal is no longer tax-and-spend; it's borrow-and-spend.
It's no surprise that unemployment keeps increasing, and the
reason why the rate isn't higher than we are told is that the government
has stopped counting people who have given up looking for a job.
Employers are not hiring because taxes and regulations are expected to
rise.
Starting Jan. 1, 28 million middle Americans will be socked with
a massive Alternative Minimum Tax (AMT), which Republicans had
suspended. That's a "gotcha" that penalizes taxpayers in ways they never
expect, adding big tax penalties based on an "alternative" way of
calculating taxes due.
Upper-income Americans will see a big jump in their marginal
tax rates. Their accountants are already telling them that the more they
work, the less additional money they will take home, so they may be
already slowing down, canceling investments or retiring to draw Social
Security.
Hardworking parents who are saving for their children's future
will be hit by the reinstatement of the massive "death tax" on Jan. 1. They
may wonder why they work hard and save if their money will go to Uncle
Sam and to people who choose not to work.
Marriage penalties will hit couples hard, both in the income tax
law and in ObamaCare. Obama's financial favoritism toward unmarried
women, his second biggest voting bloc, has become common knowledge.
Those who choose to control their own health care through
Health Savings Accounts will be slapped with new taxes. That's just one
more way to promote Obama's goal of moving all health care to
government control.
Employers are not hiring because they know they will soon be
paying not only higher taxes but also more health care costs or penalties.
Depreciation allowances for investment in equipment will be lowered
from $250,000 to $25,000, which means businesses will do less
investing.
Our ability to compete in the marketplace, of course, depends
on our advanced research and development. New taxes will hit R&D hard,
which means more slowdowns and more outsourcing overseas.
The expiration of the GOP tax cuts will impose the largest tax
hikes in history, affecting all taxpayers. The nearly 50% who pay no taxes
will also be hurt by more loss of jobs.
There is only one antidote for these depressing
prognostications. On Nov. 2, American voters will have the chance to
choose real change from Obama's failed Illinois borrow-and-spend
policies by electing Republicans who commit to extend the expiring tax
cuts.

An independent panel has
warned that U.S. national security is
headed for a "train wreck" if decisive
action isn't taken to increase the size of
the Navy, improve training of U.S.
military personnel and replace aging
equipment used by the military services.

former Defense Secretary William Perry under the Clinton
administration and former National Security adviser Stephen Hadley
under the Bush administration warned that the United States will be
unable to meet its international commitments unless it modernizes its
armed forces.
In addition, current force structure will be unable to respond "vigorous" diplomacy, coupled with "robust" intelligence services
to a homeland catastrophe that could occur during a period of
ongoing contingency operations abroad, said the panel, claiming that
military forces for homeland defense are deficient.
"The Department of Defense must plan for contingencies in
which it may be asked to perform a more expansive homeland
defense mission on short notice," the report said. "The Department
needs to plan for and exercise a response to a major natural disaster
or a catastrophic attack in the United Sates that causes major loss of
life."
In so doing, the report said that the Defense Department
would have to take the lead over the Department of Homeland
Security. It proposed that Congress give the Defense Department that recapitalize large parts of the force," the panel said. "The general
authority.
"Whereas whole-of-government solutions are highly
desirable," the report said, "the Department of Defense is often the
only agency with the mission, structure, organization, experience and
capability necessary to meet the challenges associated with a
catastrophe."
In undertaking defense planning since the end of the Cold
War, the panel members said that national security interests were
facing multiple threats and "struggled to adapt to a series of
surprises."
"In the past 15 years," the report said, "America has too
often been chasing the future rather than working to shape it."
It said the Department of Defense must prepare for the
future "within the context of the strategic legacy it has inherited.
There is no blank slate, no beginning over.
"Emerging trends will present challenges and opportunities
for the United States," the report added. In this context, the panel
identified trends which will have the greatest impact on traditional
U.S. strategy and offered new ways of operating to better employ
existing forces.

It identified five key global trends which the U.S. will face
in the 21st century. They include:
 Radical Islamist extremism and the threat of terrorism,
with the prospect that weapons of mass destruction will fall
into terrorists' hands.
 Rise of new global great powers in Asia such as India and
China suggesting an emerging, multi-polar great power
balance.
 Continued struggle for power in the Persian Gulf and the
greater Middle East.
 Accelerating global competition for resources; and
 Persistent problems stemming from failed and failing
states.
"These five trends frame a range of choices for U.S.
government and Department of Defense planners," the report said.
At the same time, the U.S. needs to guide continued adaptation of
existing international institutions and alliances and support the
development of new institutions."
The report made clear that there is a choice planners do
not have.
"America does not have the option of abandoning a
leadership role in support of its national interests," the report said.
"Those interests are vital to the security of the United States.
Failure to anticipate and manage the conflicts that threaten those
interests will not make those conflicts go away or make America's
interests any less important."
In this regard, the report said, the U.S. will need to play a
strong international role, requiring a strong and vibrant economy,
and "superb" defense capabilities.
"U.S. defense strategy for the near and long term must
continue to shape the international environment to advance U.S.
interests, maintain the capability to respond to the full spectrum of
threats and prepare for the threats and dangers of tomorrow."
Despite fighting two wars simultaneously, the panel said
that the U.S. armed forces has declined by a third since the end of
the Cold War, especially the Air Force and Navy. In addition, the
age of equipment has been magnified by the wear and tear on that
equipment through "intensified use."
"The Department of Defense now faces the urgent need to
trend has been to replace more with fewer more capable systems.
We are concerned that, beyond a certain point, quality cannot
substitute for quantity.
The report called for technology to be used not only to
increase performance but also to drive down cost in an effort to
increase quantity. These changes should include investment in long-
range strike systems and their associated sensors and to operate in
an "information-denied environment."
These essential changes will not happen if the Defense
Department and Congress maintain the status quo on managing
fiscal resources, the report said. Instead, they will have to
"reestablish tools that were lost when balanced budget rules were
abandoned and restore fiscal responsibility to the budget process."

The recent case involving the arrest and deportation of the Russian
intelligence network in the United States has once again raised the subject of
document fraud in general and passport fraud in particular. The FBI’s
investigation into the group of Russian operatives discovered that several of the
suspects had assumed fraudulent identities and had obtained genuine passports
(and other identity documents) in their assumed names. One of the suspects
assumed the identity of a Canadian by the name of Christopher Robert Mestos,
who died in childhood. The suspect was arrested in Cyprus but fled after posting
bail; his true identity remains unknown. Three other members of the group also
assumed Canadian identities, with Andrey Bezrukov posing as Donald
Heathfield, Elena Vavilova as Tracey Foley and Natalia Pereverzeva as Patricia
Mills.
Passport fraud is a topic that surfaces with some frequency in relation
to espionage cases. (The Israelis used passport fraud during the January 2010
operation to assassinate Mahmoud al-Mabhouh, a senior Hamas militant
commander.) Passport fraud is also frequently committed by individuals
involved in crimes such as narcotics smuggling and arms trafficking, as well as
by militants involved in terrorist plots. Because of the frequency with which
passport fraud is used in these types of activities — and due to the importance
that curtailing passport fraud can have in combating espionage, terrorism and
crime — we thought it a topic worth discussing this week in greater detail.
Passports and Investigations
While the use of passports goes back centuries, the idea of a travel
document that can be used to absolutely verify the identity of a traveler is a
relatively new concept. Passports containing the photos of the bearer have only
been widely used and mandated for international travel for about a century now,
and in the United States, it was not until 1918 that Congress enacted laws
mandating the use of U.S. passports for Americans returning from overseas and
home country passports with visas for foreigners wishing to visit the United
States. Passport fraud followed closely on the heels of these regulations.
Following the American entry into World War I, special agents from the State
Department’s Bureau of Secret Intelligence became very involved in hunting
down German and Austrian intelligence officers who were then using forged
documents to operate inside the United States.
In the decades after World War I, the Bureau of Secret Intelligence’s
successor organization, the Office of the Chief Special Agent, became very
involved in investigating Nazi and Communist agents who committed passport
fraud to operate inside the United States. As the Office of the Chief Special Agent
evolved into the State Department’s Office of Security and then finally the
Bureau of Diplomatic Security (DS), special agents from the organization
continued to investigate passport and visa fraud. In addition to foreign
intelligence officers, they have also investigated terrorists, fugitives and other
criminals who have committed passport fraud. Since the State Department is the
agency that issues U.S. passports and visas, it is also the primary agency charged
with ensuring the integrity of those documents. Therefore, in much the same
manner that U.S. Secret Service agents are charged with investigating
counterfeit currency (and ensuring the integrity of currency for the Treasury
Department), DS agents are charged with investigating passport fraud.

DS agents are not the only ones who investigate passport fraud,
however. As the FBI matured organizationally and became the primary
domestic counterintelligence agency, the bureau also began to work passport
fraud investigations involving foreign intelligence officers. Soviet and other
Communist “illegals” — intelligence officers operating without official cover —
frequently assumed the identities of deceased infants, and because of this, the
FBI developed a particular interest in passport fraud investigations involving
infant death identity (IDI) cases. However, passport fraud is only one of the
many criminal violations that the FBI investigates, and most FBI agents will
not investigate a passport fraud case during their career.
As the agency primarily responsible for border and immigration
enforcement, Immigration and Customs Enforcement (ICE) also investigates
identity-document fraud, including passport fraud, although many of the
cases ICE agents work involve foreign passports. ICE also has a forensic
document laboratory that is the best in the world when it comes to the
technical investigation of fraudulent identity documents.
Another U.S. government agency that watches passport fraud with a
great deal of interest is the CIA. Not only does it have an operational interest
in the topic — the agency wants to be able to use fraud for its own purposes —
but it is also very interested in being able to verify the true identities of walk-
ins and other potential sources. Because of this, the CIA needs to have the
ability to spot fraudulent documents. During the 1980s, the CIA produced an
excellent series of unclassified guides on the terrorist use of passport and visa
fraud called the “Redbook.” The Redbook was discontinued in 1992, just as the
jihadist threat to the United States was beginning to emerge.
As in any area where there are overlapping jurisdictions and
investigations, there is sometimes tension and bureaucratic jealously between
the various agencies involved in investigating passport fraud. The level of
tension is frequently lower in scenarios where the agencies work together (as
on joint terrorism task forces) and where the agents and agencies have become
accustomed to working together. In the forensic realm, the ICE laboratory
generally has an excellent relationship with the State Department, the FBI
(and the document section of the FBI laboratory) and the CIA’s document
laboratory.
Types of Passport Fraud
There are several different types of passport fraud. The first is the
intentional issuing of a genuine passport in a false identity by a government.
Real passports are often issued in false identities to provide cover for
intelligence officers, but this can also be done for other reasons. For example,
in late 1990, during Operation Desert Shield, the Iraqi government provided a
large group of Iraqi intelligence officers with Iraqi passports in false identities
so that these officials could travel abroad and conduct terrorist attacks against
U.S. interests. These Iraqi teams were dispatched all over the world and were
provided direction (as well as weapons and IED components) by Iraqi
intelligence officers stationed in embassies abroad. The explosives and
firearms were sent around the world via diplomatic pouches (which are
exempt from search). Following failed terrorist attacks in Manila and Jakarta
in January 1991, DS agents investigating the case discovered that the Iraqi
operatives were traveling on sequentially numbered Iraqi passports. This
discovery allowed a worldwide alert to go out and governments in several
different regions of the world were able to arrest or deport scores of Iraqi
agents.
A second type of fraud involving genuine passports is where the
government is not knowingly involved in the issuance of the passport for the
fraudulent identity. In such cases, an applicant uses fraudulent identification
documents to apply for a passport. The group of documents needed to obtain a
passport — called “breeder” documents — normally includes a birth certificate,
a Social Security card and a driver’s license. A set of fraudulent breeder
documents can be counterfeit, genuine but altered (this can be done by
changing the name or date of birth) or genuine documents obtained by fraud.
This is where the IDI cases come in. In these cases, someone applies
for a replacement birth certificate of a deceased infant or child of their
approximate age and then uses the birth certificate to obtain a Social Security
card and driver’s license. The person applying for the replacement birth
certificate usually claims their original birth certificate was lost or stolen.
Due to changes in procedure and technology, however, it has
become more difficult in recent years to obtain a copy of the birth

certificate of an infant or child who died in the United States. Birth-certificate
registries are now tied electronically to death registries in every state, and if
someone attempts to get the birth certificate of a dead person, it is quickly
noticed and an investigation launched. Also, Social Security numbers are now
issued at birth, so it is very difficult for a 25- or 30-year-old person to apply for a
new Social Security number. Because of these factors, IDI cases have declined
significantly in the United States.
Breeder documents are generally easier to counterfeit or obtain by
fraud than a passport. However, as identity documents become more cross-
referenced in databases, it is becoming more difficult to obtain a passport using
a counterfeit birth certificate and Social Security number. Because of this, it has
become more common for a person to buy a set of genuine breeder documents
from a drug user or criminal looking for some quick cash. It is also possible to
buy a genuine birth certificate and Social Security card from a corrupt official.
While such documents are genuine, and can carry the applicant’s true or chosen
name, such genuine documents are much more expensive than the other
options. Of course, passport office employees can also be bribed to issue a
genuine passport with fraudulent breeder documents, though there is a remote
risk that such fraud will be caught in an audit.
At the present time, it is far easier and cheaper to obtain a genuine
foreign passport by fraud than it is a U.S. passport, but corruption and plain old
mistakes still allow a small number of fraudulent U.S. passports to get into the
system. There are still some countries where a genuine passport in any identity
can be obtained for just a few hundred dollars. Generally, it is more difficult to
get passports from more developed nations (such as those that participate in the
U.S. visa waiver program) than it is from less developed nations, where
corruption is more prevalent. Still, corruption is a worldwide problem when it
comes to passports and other identity documents.
Stolen blank passports have also been used over the years. For
example, after Operation Desert Storm, an Iraqi passport office in Basra was
sacked and thousands of blank Iraqi passports were stolen and then sold on the
black market. One of those blanks was bought by a Pakistani jihadist operative
named Abdul Basit, who had the blank passport filled out with his photograph
and the name of a fictitious Iraqi citizen named Ramzi Yousef. After he entered
the United States, Basit organized the 1993 World Trade Center bombing. The
problem with stolen blanks is that they are usually reported fairly quickly and
their numbers are entered into international databases. Furthermore, like a
counterfeit passport, a stolen blank passport will not correspond to information
entered into passport databases, and it is therefore difficult to travel using one.
In the case of Basit, he used a British passport altered to include his photo to
leave Pakistan but then used the Iraqi passport to make an asylum claim once he
arrived in the United States.
This highlights another category of genuine passports used in
passport fraud, those that are real but have been altered, usually by replacing
the photo appearing on the passport. Passport fraud investigators refer to this as
a photo-subbed passport. In the 1970s, it was fairly easy to photo-sub passports
from most countries, but in the past couple of decades, many countries have
taken great efforts to make this process more difficult. The use of high-tech
laminates and now, in current U.S. passports, RFID chips that contain a photo
that must match the one appearing on the passport make it far harder to photo-
sub passports today. Of course, efforts to increase passport security haven’t
always worked as planned. In 1993, the State Department began issuing a new
high-tech passport with a green cover that was supposed to be impossible to
photo-sub. Within a few months of the first issuance of the passports, document
vendors discovered that the laminate on the green passports could be easily
removed by placing a block of dry ice on the passport, changing the photo and
then pressing the laminate back down with an iron. Due to the ease of photo-
subbing these passports, their value on the black market skyrocketed, and the
“fraud proof” green passports had to be taken out of circulation after less than a
year.
Finally, we have counterfeit passports, which are passports created
from scratch by a document vendor. Like counterfeit currency, there is a vast
range of quality when it comes to counterfeit passports, and as a rule of thumb,
you get what you pay for. On the streets of places like Bangkok, Hong Kong or
New York, one can buy counterfeit passports from a wide array of countries.
There is, however, a vast difference between the passport one can purchase for
$100 and the one that can be purchased for $10,000. Also, like currency, some

passport counterfeiters will even attempt to use elements of genuine
passports, like the optically “dead” paper with little or no fluorescence used for
the pages and the holographic laminates used on the photo pages. However,
like photo-subbed passports, it is far more difficult to create a functional
counterfeit passport today than it was several years ago. Not only does the
passport have to be of high quality, but the number needs to correspond to the
database of legitimately issued passports. Therefore, most counterfeit
passports are useful for traveling in the third world but would not withstand
the scrutiny of authorities in the developed world.
In spite of these problems, there is still a market for counterfeit and
photo-subbed passports. While they may not be useful for traveling to a
country like the United States or France, they can be used to travel from a
place like Pakistan or China to a gateway country in the Western Hemisphere
like Venezuela or a gateway country in Europe like Albania. Because of this,
American and European passports still fetch a decent price on the black
market and are frequently stolen from or sold by Westerners. Citizens of
Western countries who travel to terrorist training camps are also frequently
encouraged to “donate” their passports and other documents to the group that
trains them. There are also many reports that Mossad makes use of the
passports of foreign Jews who move to Israel and give their passports to the
intelligence agency. Stolen or deliberately lost passports not only can be
altered or cloned but also can be used for travel by people who physically
resemble the original bearer, although once they are reported stolen or lost
and entered into lookout databases, their utility declines.
A Shifting Focus
The difficulty in obtaining functional travel documents has affected
the way criminal and terrorist organizations operate. With increasing scrutiny
of travel documents, groups like al Qaeda have found it progressively more
difficult to travel to the West. This is one of the factors that has led to their
increasing use of operatives who have the ability to travel to where the
planned attack is to be conducted, rather than sending a more professional
terrorist operative to conduct the attack.
This difficulty in counterfeiting passports has even affected
intelligence agencies, which are the best passport counterfeiters in the world.
This is why we see intelligence agencies like Mossad having to clone passports
— that is, create a counterfeit passport that bears the same name and number
of a legitimate passport — or even resort to other types of fraud to obtain
genuine passports for operatives. It has become difficult to fabricate a usable
passport using a fictitious name. Mossad operatives have gotten in trouble for
attempting to fraudulently obtain genuine passports in places like New
Zealand. And Mossad is certainly not the only intelligence service
experiencing this difficulty in obtaining documents for its operatives.
Because of these difficulties, intelligence agencies and militant and
criminal organizations have begun to place increasing importance on
recruiting assets involved in the issuance of identity documents. At an
embassy, a consular officer is viewed as almost as important a person to
recruit as a code clerk. A corrupt consular officer can make a great deal of
money selling documents. But the threat can extend far from an overseas
embassy. If an organization like the Russian Foreign Intelligence Service (or
the Sinaloa cartel) can recruit an employee at the New Jersey Office of Vital
Statistics, they can arrange to have their agent occasionally issue a genuine
birth certificate (camouflaged in a large stack of legitimately issued
documents) in a fraudulent identity for their use. Likewise, if they can recruit
a clerk at the Social Security office in Jersey City, they can get that agent to
occasionally issue a Social Security number and card that corresponds to the
birth certificate. These primary documents can then be used to obtain a
driver’s license (the key identity document for living in the United States) and
eventually a passport for international travel.
Of course, recruiting an agent who works inside an agency is not the
only way to obtain identification documents. Several years ago, a cleaning
company owned by a group of Nigerians placed a low bid on the contract to
provide cleaning services to Department of Motor Vehicles (DMV) offices in
Florida. Shortly after the company began providing services to the DMV, the
agency suffered a rash of thefts across the state that included not only blank
driver’s licenses and laminates but an entire machine that took the photos and
processed the blank licenses.

The advent of cross-referencing databases, machine-readable
passports routinely checked against such databases, radio frequency
identification technology and procedures intended to prevent fraud have helped
curtail many types of passport fraud. That said, passports are still required to
travel for nefarious purposes, and these security measures have caused
resourceful criminals, terrorists and intelligence agencies to shift their focus
from technical methods of fraud toward exploiting humans in the process. In
many places, the effort made to vet and monitor employees issuing documents is
far less extensive than the effort made to physically protect documents from
counterfeiting. The end result is that humans have become the weakest link in
the equation.

Russian Spies and Strategic Intelligence

The United States has captured a group of Russian spies and
exchanged them for four individuals held by the Russians on
espionage charges. The ways the media have reported on the issue
fall into three groups:
 That the Cold War is back,
 That, given that the Cold War is over, the point of
such outmoded intelligence operations is questionable,
 And that the Russian spy ring was spending its time
aimlessly nosing around in think tanks and open meetings in
an archaic and incompetent effort.
It is said that the world is global and interdependent. This
makes it vital for a given nation to know three things about all of the
nations with which it interacts.
First, it needs to know what other nations are capable of
doing. Whether militarily, economically or politically, knowing what
other nations are capable of narrows down those nations’ possible
actions, eliminating fantasies and rhetoric from the spectrum of
possible moves. Second, the nation needs to know what other nations
intend to do. This is important in the short run, especially when
intentions and capabilities match up. And third, the nation needs to
know what will happen in other nations that those nations’
governments didn’t anticipate.
The more powerful a nation is, the more important it is to
understand what it is doing. The United States is the most powerful
country in the world. It therefore follows that it is one of the prime
focuses of every country in the world. Knowing what the United
States will do, and shifting policy based on that, can save countries
from difficulties and even disaster. This need is not confined, of
course, to the United States. Each country in the world has a list of
nations that it is interdependent with, and it keeps an eye on those
nations. These can be enemies, friends or just acquaintances. It is
impossible for nations not to keep their eyes on other nations,
corporations not to keep their eyes on other corporations and

individuals not to keep their eyes on other people. How they do so
varies; that they do so is a permanent part of the human condition.
The shock at learning that the Russians really do want to know what
is going on in the United States is, to say the least, overdone.
Russian Tradecraft Examined
Let’s consider whether the Russian spies were amateurish.
During the 1920s and 1930s, the Soviets developed a unique model
of espionage. They would certainly recruit government officials or
steal documents. What they excelled at, however, was placing
undetectable operatives in key positions. Soviet talent scouts would
range around left-wing meetings to discover potential recruits.
These would be young people with impeccable backgrounds and
only limited contact with the left. They would be recruited based on
ideology, and less often via money, sex or blackmail. They would
never again be in contact with communists or fellow travelers. They
would apply for jobs in their countries’ intelligence services, foreign
or defense ministries, and so on. Given their family and academic
backgrounds, they would be hired. They would then be left in place
for 20 or 30 years while they rose in the ranks — and, on occasion,
aided with bits of information from the Soviet side to move their
careers ahead.
The Soviets understood that a recruited employee might be
a double agent. But stealing information on an ad hoc basis was
also risky, as the provenance of such material was always murky.
Recruiting people who were not yet agents, creating psychological
and material bonds over long years of management and allowing
them to mature into senior intelligence or ministry officials allowed
ample time for testing loyalty and positioning. The Soviets not only
got more reliable information this way but also the ability to
influence the other country’s decision-making. Recruiting a young
man in the 1930s, having him work with the OSS and later the CIA,
and having him rise to the top levels of the CIA — had that ever
happened — would thus give the Soviets information and control.
These operations took decades, and Soviet handlers would
spend their entire careers managing one career. There were four
phases:
 Identifying likely candidates,
 Evaluating and recruiting them,
 Placing them and managing their rise in the organization,
 And exploiting them.
The longer the third phase took, the more effective the
fourth phase would be.
It is difficult to know what the Russian team was up to in
the United States from news reports, but there are two things we
know about the Russians: They are not stupid, and they are
extremely patient. If we were to guess — and we are guessing —
this was a team of talent scouts. They were not going to meetings
at the think tanks because they were interested in listening to the
papers; rather, they were searching for recruits. These were people
between the ages of 22 and 30, doing internships or entry-level
jobs, with family and academic backgrounds that would make
employment in classified areas of the U.S. government easy — and
who in 20 to 30 years would provide intelligence and control to
Moscow.
In our view, the media may have conflated two of
Moscow’s missions.
Twin Goals and the Espionage Challenge
One of the Russian operatives, Don Heathfield, once
approached a STRATFOR employee in a series of five meetings.
There appeared to be no goal of recruitment; rather, the Russian
operative tried to get the STRATFOR employee to try out software
he said his company had developed. We suspect that had this

been done, our servers would be outputting to Moscow. We did not
know at the time who he was. (We have since reported the incident to
the FBI, but these folks were everywhere, and we were one among
many.)
Thus, the group apparently included a man using software
sales as cover — or as we suspect, as a way to intrude on computers.
As discussed, the group also included talent scouts. We would guess
that Anna Chapman was brought in as part of the recruitment phase
of talent scouting. No one at STRATFOR ever had a chance to meet
her, having apparently failed the first screening.
Each of the phases of the operatives’ tasks required a
tremendous amount of time, patience and, above all, cover. The
operatives had to blend in (in this case, they didn’t do so well
enough). Russians have always had a tremendous advantage over
Americans in this regard. A Russian long-term deployment took you
to the United States, for example. Were the Americans to try the
same thing, they would have to convince people to spend years
learning Russian to near-native perfection and then to spend 20-30
years of their lives in Russia. Some would be willing to do so, but not
nearly as many as there are Russians prepared to spend that amount
of time in the United States or Western Europe.
The United States can thus recruit sources (and sometimes it
gets genuine ones). It can buy documents. But the extremely patient,
long-term deployments are very difficult for it. It doesn’t fit with U.S.
career patterns or family expectations.
The United States has substituted technical intelligence for
this process. Thus, the most important U.S. intelligence-collection
agency is not the CIA; it is the National Security Agency (NSA). The
NSA focuses on intercepting communications, penetrating computer
networks, encryption and the like. (We will assume that they are
successful at this.) So whereas the Russians seek to control the
career of a recruit through retirement, the NSA seeks access to
everything that is recorded electronically. The goal here is
understanding capabilities and intentions. To the extent that the
target is unaware of the NSA’s capabilities, the NSA does well. In
many ways, this provides better and faster intelligence than the
placement of agents, except that this does not provide influence.
The Intelligence Assumption
In the end, both the U.S. and Russian models — indeed most
intelligence models — are built on the core assumption that the more
senior the individual, the more knowledge he and his staff have. To
put it more starkly, it assumes that what senior (and other)
individuals say, write or even think reveals the most important things
about the country in question. Thus, controlling a senior government
official or listening to his phone conversations or e-mails makes one
privy to the actions that country will take — thus allowing one to tell
the future.
Let’s consider two cases: Iran in 1979 and the Soviet Union
from 1989 to 1991. The fall of the shah of Iran and the collapse of the
Soviet empire were events of towering importance for the United
States. Assume that the United States knew everything the shah’s
senior officials and their staffs knew, wrote, or said in the period
leading up to the Iranian Revolution. Or assume that the shah’s prime
minister or a member of the Soviet Union’s Politburo was a long-term
mole.
Either of those scenarios would not have made any
difference to how events played out. This is because, in the end, the
respective senior leadership didn’t know how events were going to
play out. Partly this is because they were in denial, but mostly this is
because they didn’t have the facts and they didn’t interpret the facts
they did have properly. At these critical turning points in history, the
most thorough penetration using either American or Russian

techniques would have failed to provide warning of the change
ahead. This is because the basic premise of the intelligence
operation was wrong. The people being spied on and penetrated
simply didn’t understand their own capabilities — i.e., the reality on
the ground in their respective countries — and therefore their
intentions about what to do were irrelevant and actually misleading.
In saying this, we must be very cautious, since obviously
there are many instances in which targets of intelligence agencies
do have valuable information and their decisions do actually
represent what will happen. But if we regard anticipating systemic
changes as one of the most important categories of intelligence,
then these are cases where the targets of intelligence may well
know the least and know it last. The Japanese knew they were
going to hit Pearl Harbor, and having intelligence on that fact was
enormously important. But that the British would collapse at
Singapore was a fact not known to the British, so there would have
been no way to obtain that information in advance from the British.
We started with three classes of intelligence: capabilities,
intentions and what will actually happen. The first is an objective
measure that can sometimes be seen directly but more frequently is
obtained through data held by someone in the target country. The
most important issue is not what this data says but how accurate it
is. Intentions, by contrast, represent the subjective plans of
decision-makers. History is filled with intentions that were never
implemented, or that, when implemented, had wildly different
outcomes than the decision-maker expected. From our point of
view, the most important aspect of this category is the potential for
unintended consequences. For example, George W. Bush did not
intend to get bogged down in a guerrilla war in Iraq. What he
intended and what happened were two different things because his
view of American and Iraqi capabilities were not tied to reality.
American and Russian intelligence is source-based. There is
value in sources, but they need to be taken with many grains of
salt, not because they necessarily lie but because the highest-
placed source may simply be wrong — and at times, an entire
government can be wrong. If the purpose of intelligence is to
predict what will happen, and it is source-based, then that assumes
that the sources know what is going on and how it will play out. But
often they don’t.
Russian and American intelligence agencies are both
source-obsessed. On the surface, this is reasonable and essential.
But it assumes something about sources that is frequently true, but
not always — and in fact is true only with great infrequency on the
most important issues. From our point of view, the purpose of
intelligence is obvious: It is to collect as much information as
possible, and surely from the most highly placed sources. But in the
end, the most important question to ask is whether the most highly
placed source has any clue as to what is going to happen.
Knowledge of what is being thought is essential. But
gaming out how the objective and impersonal forces will interact
and play out it is the most important thing of all. The focus on
sources allows the universe of intelligence to be populated by the
thoughts of the target. Sometimes that is of enormous value. But
sometimes the most highly placed source has no idea what is about
to happen. Sometimes it is necessary to listen to the tape of
Gorbachev or Bush planning the future and recognize that what
they think will happen and what is about to happen are very
different things.

intentional) attacks, the Naxalites reiterated their intention to drive
multinational corporations (MNCs) out of India and that they would use
violence to do so. This most recent threat reflects the primary interest of
the Naxalites, and it is backed by a proven tactical ability to strike
economic targets, which is a top concern for the Indian government. It is
this situation that leads STRATFOR to look at one of the world’s longest-
running insurgencies to see what makes it tick.

extending its writ throughout the land. The Naxalites are not the only
militant movement in India; groups in northwest and northeast India also
take advantage of the terrain and the distance from New Delhi to challenge
the government for control of the territory they inhabit. The Naxalites
specifically inhabit an area known as the “Red Corridor,” which stretches
from West Bengal state southwest to Karnataka state. The most violent
states in this corridor have been Chhattisgarh, West Bengal and Orissa. The
region is defined by rolling hills covered in dense jungle and has few
improved roads, which allows the Naxalites to control access. The dense
jungle also protects them from government aircraft.
The region’s geographic isolation has created a tribal mentality,
and while the government lumps militant groups in the area under the
Naxalite umbrella, the militant community is actually quite diffuse, with
small units acting with varying levels of autonomy throughout the region.
For example, there is little indication that a unit from Chhattisgarh would
also be able to conduct operations in West Bengal. Transportation is
expensive and dangerous, so people tend to stay close to home and defend
it fiercely. This makes it difficult for outsiders to gain influence in (and
access to) the area.
It also means the area is extremely poor. Although the region has
an abundance of raw materials in its hills and forests, the state of India has
been hard-pressed to get at those resources because it cannot effectively
control them. And while Naxalites call for the improvement of the lives of
the people they claim to represent, they have resisted any government
attempt to develop the area’s economy. Indeed, the low level of trust
between the Naxalites and New Delhi creates the conundrum of how the
government can possibly provide security without developing sufficient
infrastructure and how infrastructure can possibly be developed without
sufficient security. An example of this can be seen in the Naxalites’ constant
sabotaging of area roads by planting improvised explosive devices (IEDs)
under road surfaces or simply digging roads up. Roads are necessary for
development, but Naxalites view roads as a means for the government to
send its forces into their territory.
Eager to stimulate growth in the region, the central government
promised foreign investors land without communicating, much less
negotiating, with locals inhabiting the land, which naturally led to disputes
between the locals, the foreign companies and the government. A famous
example of an ongoing dispute involves the South Korean steel
conglomerate POSCO, which is in the process of acquiring some 4,000
acres in Orissa state on which to build a $12 billion steel mill. The project
has been delayed by protests and violence by locals opposed to the project,

and police have been unable to secure the area to permit construction.
Only now, some five years after the government promised the land to
POSCO, is local compensation being negotiated.
India’s economic success has meant that foreign investors like
POSCO are increasing their presence in India, which means that locals
like the Naxalites are faced with both a threat and an opportunity.
Outside business interests (whether investors from South Korea or
wealthy prospectors from central India) in partnership with the
government pose the greatest threat to the Naxalite movement. On the
other hand, outside investment could bring jobs and development to an
area that is desperately poor. But Naxalites are skeptical of letting the
government control anything in their region, and successful economic
development would have a calming effect on the region’s radicalized
militants. Movements like that of the Naxalites have an array of
motivations for why they do what they do, but self-preservation is always
a very high priority.
The other opportunity is to force the central government or
foreign investors to pay the group directly for any land in the region.
Naxalites can raise the stakes by organizing more militant force to deny
access to certain areas, sabotage transportation and commercial activity
and otherwise mobilize the locals. This would essentially be a large-scale
protection racket. The model has been implemented and followed
successfully by other militant groups, most notably Nigeria’s Movement
for the Emancipation of the Niger Delta (MEND), which manages to
extract concessions from energy giants operating in Nigeria’s oil-rich but
dismally poor Niger Delta, and even from the Nigerian government itself.
While Maoist leaders in eastern and central India do make statements
about how commercial projects in the area need to provide locals with
jobs, it is clear that Naxalites are also trying to enhance their capability to
pursue the second option.
The Threat
Naxalites are honing the capability to construct and deploy
IEDs, conduct armed raids and maintain an extensive, agile and
responsive intelligence network. As seen in the examples above, Naxalite
fighters can be opportunistic in their attacks. The April 6 raid on the
soldiers in Dantewada and the May 17 bus attack were both actions that
took advantage of opportunities to target and kill police forces. The April
6 raid was the culmination of two or three days of stalking the CRPF unit
in the forest and waiting for the right time to strike. The May 17 bus
attack was organized in a matter of hours, with spotters noticing the
police on the bus and alerting other cadres who planted the device further
down the road. This flexibility and autonomy among its various
component parts, along with the group’s local support and indigenous
knowledge of its turf, make the Naxalites a dangerous adversary against
the slower moving, more deliberate and more predictable CRPF.
New Delhi insists that, according to the constitution, the
Naxalite problem is one of law and order and, thus, a responsibility for
the states to address. New Delhi has deployed the CRPF, but it has not
gone so far as to deploy the military, something that many Indian
politicians have called for as the only solution to the problem. While
military advisers have been sent in to train local and federal police forces
in the Red Corridor, they have not engaged in any known anti-Naxalite
operations. India has unpleasant memories of past deployments of its
military forces to address domestic threats. In the 1980s, use of the army
to deal with Sikh militancy was criticized as being too heavy-handed.
Military action at the Golden Temple in Amritsar, codenamed Operation
Blue Star, also fanned the flames of Sikh militancy and sparked a series of
serious reprisal attacks that included the assassination of Indian Prime
Minister Indira Gandhi, who had ordered the operation.
Also, the Indian military insists it is currently focused on
fighting Islamist and separatist forces in Jammu and Kashmir in
northwest India, along the disputed border with Pakistan, and is dealing
with multiple ethno-separatist movements in the northeast region of

India surrounded by China and Bangladesh. While Indian Prime Minister
Manmohan Singh has labeled the Naxalite issue the biggest threat to the
country’s internal security, incidents like the 2008 Mumbai attacks provide
evidence to most Indians that Pakistan and the militants who hide there
pose a greater external threat.
In the end, Naxalism is fairly contained. Despite threats and
indications from Naxalites that they will attack urban targets throughout
India, the group has yet to demonstrate the intent or ability to strike
outside of the Red Corridor. But the group’s leaders and bombmakers could
develop such a capability, and it will be important to watch for any
indication that cadres are developing the tradecraft for urban terrorism.
Even if they do not expand their target set and conduct more “terrorist-
type” attacks, the Naxalite challenge to the state could materialize in other
ways. The Naxalite organization is a sophisticated one that relies not only
on militant tactics but also on social unrest and political tactics to increase
its power. Naxalites have formed sympathetic student groups in
universities, and human-rights groups in New Delhi and other regional
capitals are advocating for the local tribal cause in rural eastern India.
Instead of using violence, these groups stage protests to express
their grievances against the state. And they underscore the Naxalite ability
to use both militant violence and subtle social pressure to achieve their
goals. Even if the government did decide to deploy the military to combat
the Naxalites in eastern India, it would face a tough fight against a well-
entrenched movement — something New Delhi is not likely to undertake
lightly or any time soon.

WikiLeaks and the Afghan War

On Sunday, The New York Times and two other newspapers
published summaries and excerpts of tens of thousands of documents
leaked to a website known as WikiLeaks. The documents comprise a
vast array of material concerning the war in Afghanistan. They range
from tactical reports from small unit operations to broader strategic
analyses of politico-military relations between the United States and
Pakistan. It appears to be an extraordinary collection.

Tactical intelligence on firefights is intermingled with reports
on confrontations between senior U.S. and Pakistani officials in which
lists of Pakistani operatives in Afghanistan are handed over to the
Pakistanis. Reports on the use of surface-to-air missiles by militants
in Afghanistan are intermingled with reports on the activities of
former Pakistani intelligence chief Lt. Gen. Hamid Gul, who reportedly
continues to liaise with the Afghan Taliban in an informal capacity.

At first glance, it is difficult to imagine a single database in
which such a diverse range of intelligence was stored, or the

existence of a single individual cleared to see such diverse
intelligence stored across multiple databases and able to collect,
collate and transmit the intelligence without detection. Intriguingly,
all of what has been released so far has been not-so-sensitive
material rated secret or below. The Times reports that Gul’s name
appears all over the documents, yet very few documents have been
released in the current batch, and it is very hard to imagine
intelligence on Gul and his organization, the Inter-Services
Intelligence (ISI) directorate, being classified as only secret. So,
this was either low-grade material hyped by the media, or there is
material reviewed by the selected newspapers but not yet made
public. Still, what was released and what the Times discussed is
consistent with what most thought was happening in Afghanistan.
The obvious comparison is to the Pentagon Papers,
commissioned by the Defense Department to gather lessons from
the Vietnam War and leaked by Daniel Ellsberg to the Times during
the Nixon administration. Many people worked on the Pentagon
Papers, each of whom was focused on part of it and few of whom
would have had access to all of it.
Ellsberg did not give the Times the supporting
documentation; he gave it the finished product. By contrast, in the
WikiLeaks case, someone managed to access a lot of information
that would seem to have been contained in many different places. If
this was an unauthorized leak, then it had to have involved a
massive failure in security. Certainly, the culprit should be known by
now and his arrest should have been announced. And certainly, the
gathering of such diverse material in one place accessible to one or
even a few people who could move it without detection is odd.
Like the Pentagon Papers, the WikiLeaks (as I will call
them) elicited a great deal of feigned surprise, not real surprise.
Apart from the charge that the Johnson administration contrived the
Gulf of Tonkin incident, much of what the Pentagon Papers
contained was generally known. Most striking about the Pentagon
Papers was not how much surprising material they contained, but
how little. Certainly, they contradicted the official line on the war,
but there were few, including supporters of the war, who were
buying the official line anyway.
In the case of the WikiLeaks, what is revealed also is not
far from what most people believed, although they provide
enormous detail. Nor is it that far from what government and
military officials are saying about the war. No one is saying the war
is going well, though some say that given time it might go better.
The view of the Taliban as a capable fighting force is, of
course, widespread. If they weren’t a capable fighting force, then
the United States would not be having so much trouble defeating
them. The WikiLeaks seem to contain two strategically significant
claims, however. The first is that the Taliban are a more
sophisticated fighting force than has been generally believed. An
example is the claim that Taliban fighters have used man-portable
air defense systems (MANPADS) against U.S. aircraft. This claim
matters in a number of ways. First, it indicates that the Taliban are
using technologies similar to those used against the Soviets.
Second, it raises the question of where the Taliban are getting them
— they certainly don’t manufacture MANPADS themselves.
If they have obtained advanced technologies, this would
have significance on the battlefield. For example, if reasonably
modern MANPADS were to be deployed in numbers, the use of
American airpower would either need to be further constrained or
higher attrition rates accepted. Thus far, only first- and second-
generation MANPADS without Infrared Counter-Countermeasures
(which are more dangerous) appear to have been encountered, and
not with decisive or prohibitive effectiveness. But in any event, this

doesn’t change the fundamental character of the war.
Supply Lines and Sanctuaries
What it does raise is the question of supply lines and
sanctuaries. The most important charge contained in the leaks is
about Pakistan. The WikiLeaks contain documents that charge that
the Pakistanis are providing both supplies and sanctuary to Taliban
fighters while objecting to American forces entering Pakistan to clean
out the sanctuaries and are unwilling or unable to carry out that
operation by themselves (as they have continued to do in North
Waziristan).
Just as important, the documents charge that the ISI has
continued to maintain liaison and support for the Taliban in spite of
claims by the Pakistani government that pro-Taliban officers had been
cleaned out of the ISI years ago. The document charges that Gul, the
director-general of the ISI from 1987 to 1989, still operates in
Pakistan, informally serving the ISI and helping give the ISI plausible
deniability.
Though startling, the charge that Islamabad is protecting
and sustaining forces fighting and killing Americans is not a new one.
When the United States halted operations in Afghanistan after the
defeat of the Soviets in 1989, U.S. policy was to turn over operations
in Afghanistan to Pakistan. U.S. strategy was to use Islamist militants
to fight the Soviets and to use Pakistani liaisons through the ISI to
supply and coordinate with them. When the Soviets and Americans
left Afghanistan, the ISI struggled to install a government composed
of its allies until the Taliban took over Kabul in 1996. The ISI’s
relationship with the Taliban — which in many ways are the heirs to
the anti-Soviet mujahideen — is widely known. In my book,
“America’s Secret War,” I discussed both this issue and the role of
Gul. These documents claim that this relationship remains intact.
Apart from Pakistani denials, U.S. officials and military officers
frequently made this charge off the record, and on the record
occasionally. The leaks on this score are interesting, but they will
shock only those who didn’t pay attention or who want to be shocked.
Let’s step back and consider the conflict dispassionately. The
United States forced the Taliban from power. It never defeated the
Taliban nor did it make a serious effort to do so, as that would require
massive resources the United States doesn’t have. Afghanistan is a
secondary issue for the United States, especially since al Qaeda has
established bases in a number of other countries, particularly
Pakistan, making the occupation of Afghanistan irrelevant to fighting
al Qaeda.
For Pakistan, however, Afghanistan is an area of
fundamental strategic interest. The region’s main ethnic group, the
Pashtun, stretch across the Afghan-Pakistani border. Moreover, were
a hostile force present in Afghanistan, as one was during the Soviet
occupation, Pakistan would face threats in the west as well as the
challenge posed by India in the east. For Pakistan, an Afghanistan
under Pakistani influence or at least a benign Afghanistan is a matter
of overriding strategic importance.
It is therefore irrational to expect the Pakistanis to halt
collaboration with the force that they expect to be a major part of the
government of Afghanistan when the United States leaves. The
Pakistanis never expected the United States to maintain a presence in
Afghanistan permanently. They understood that Afghanistan was a
means toward an end, and not an end in itself. They understood this
under George W. Bush. They understand it even more clearly under
Barack Obama, who made withdrawal a policy goal.
Given that they don’t expect the Taliban to be defeated, and
given that they are not interested in chaos in Afghanistan, it follows
that they will maintain close relations with and support for the
Taliban. Given that the United States is powerful and is Pakistan’s

only lever against India, the Pakistanis will not make this their
public policy, however. The United States has thus created a
situation in which the only rational policy for Pakistan is two-tiered,
consisting of overt opposition to the Taliban and covert support for
the Taliban.
This is duplicitous only if you close your eyes to the
Pakistani reality, which the Americans never did. There was ample
evidence, as the WikiLeaks show, of covert ISI ties to the Taliban.
The Americans knew they couldn’t break those ties. They settled for
what support Pakistan could give them while constantly pressing
them harder and harder until genuine fears in Washington emerged
that Pakistan could destabilize altogether. Since a stable Pakistan is
more important to the United States than a victory in Afghanistan —
which it wasn’t going to get anyway — the United States released
pressure and increased aid. If Pakistan collapsed, then India would
be the sole regional power, not something the United States wants.
The WikiLeaks seem to show that like sausage-making, one
should never look too closely at how wars are fought, particularly
coalition warfare. Even the strongest alliances, such as that
between the United States and the United Kingdom in World War II,
are fraught with deceit and dissension. London was fighting to save
its empire, an end Washington was hostile to; much intrigue
ensued. The U.S.-Pakistani alliance is not nearly as trusting. The
United States is fighting to deny al Qaeda a base in Afghanistan
while Pakistan is fighting to secure its western frontier and its
internal stability. These are very different ends that have very
different levels of urgency.
The WikiLeaks portray a war in which the United States has
a vastly insufficient force on the ground that is fighting a capable
and dedicated enemy who isn’t going anywhere. The Taliban know
that they win just by not being defeated, and they know that they
won’t be defeated. The Americans are leaving, meaning the Taliban
need only wait and prepare.
The Pakistanis also know that the Americans are leaving
and that the Taliban or a coalition including the Taliban will be in
charge of Afghanistan when the Americans leave. They will make
certain that they maintain good relations with the Taliban. They will
deny that they are doing this because they want no impediments to
a good relationship with the United States before or after it leaves
Afghanistan. They need a patron to secure their interests against
India. Since the United States wants neither an India outside a
balance of power nor China taking the role of Pakistan’s patron, it
follows that the risk the United States will bear grudges is small.

regrettable that certain scientists are willing to put their families at risk by
choosing to do wasteful animal experiments.”
According to the ATF affidavit, a search of Bond’s backpack after
his arrest revealed that he had a copy of an ALF publication titled “The
Declaration of War: Killing People to Save the Animals and the
Environment.” The book, which was first published by the ALF in 1991,
contends that nonviolent methods such as those laid out by Gandhi and
Jesus are not productive (especially when applied to animals) and explains
that violence is justified to protect animals, who cannot protect themselves.
The book’s author contends that people who seek to liberate animals (which
the author refers to as “brothers” and “sisters”) from human oppression
and abuse will “use any and every tactic necessary to win the freedom of our
brothers and sisters. This means they cheat, steal, lie, plunder, disable,
threaten, and physically harm others to achieve their objective.”
The Challenges of Leaderless Resistance
This ideological split within the movement appears to be what
ultimately led to Bond’s arrest. According to the ATF affidavit, on July 1,
2010, a confidential informant (CI) called the ATF to report that Bond was
the person responsible for the Sheepskin Factory fire as well as the fire at
the leather factory in Salt Lake City. The CI said that he or she had recently
been called by Bond after a period of 12 years, and that when the CI asked
Bond what he had been up to, Bond told the CI to go to an ALF-related
website and scroll down to the Sheepskin Factory fire story and the leather
factory fire story and that those arsons were what he had been up to. Upon
hearing of Bond’s activities, the CI became concerned that firefighters could
be harmed while responding to an arson fire lit by Bond and called the ATF
in order to prevent Bond from lighting more fires.
At the ATF’s request, the CI then met with Bond on July 22 at a
Denver hotel room that the ATF had wired for audio and video. During the
meeting, Bond reportedly was captured on tape admitting that he had
committed the Sheepskin Factory and leather factory fires as well as the
July 3 fire at a restaurant in Sandy, Utah, that served foie gras. He admitted
that he used the nom de guerre Lone Wolf and stated that he was planning
future arson attacks. This meeting provided the government with the
probable cause required to arrest Bond and charge him with the fires,
though the ATF and FBI will certainly be working hard to find other
evidence linking him to the crimes.
In general, lone wolf and small cell attacks conducted by
ELF/ALF operatives are very difficult to investigate. First of all, as
discussed, the ELF and ALF are intentionally nebulous and promote
leaderless resistance, which means there is no centralized command
structure for law enforcement to target. Second, many people associated
with the ELF/ALF are transient and nomadic. Because of this lifestyle, they
are often very hard to track using public records and credit card
transactions, making it a challenge for law enforcement to know they are in
an area or where they went to when they left. They are also frequently
known by nicknames within their activist/fringe communities and
frequently don’t carry identification documents. This makes it difficult for
law enforcement to figure out who a potential suspect is even if they know
his or her nickname.
This ambiguity is compounded by the fact that organizations like
the ELF and ALF have produced some very good instruction manuals
pertaining to the construction of timed incendiary devices. These manuals
not only provide sound instruction on constructing and placing incendiary
devices but also describe in great detail steps that can be taken to minimize
the physical evidence left at a crime scene. ALF operatives have long
favored isolated targets without much security — what we refer to as soft
targets. While they occasionally have targeted the offices and laboratories of
companies involved in animal testing, such targets have increased their
security in the wake of past attacks and many ALF operatives have diverted
their efforts toward the homes of executives and researchers (like the UC-
Santa Cruz researchers) and other soft targets.

Gravitating toward softer targets makes it less likely operatives
will be caught in the act. Additionally, the surveillance tradecraft utilized
by the ALF and its operatives and the operational security they practice is
usually better than that demonstrated by jihadist lone wolves.
Organizations such as the Ruckus Society conduct detailed courses on
preoperational surveillance, which is called “scouting” in their parlance.
Also, since ELF/ALF activists tend to be young Caucasians, they are
generally not viewed as a potential threat, even if they are spotted
conducting surveillance. Moreover, since these activists have focused
mainly on attacks that cause property damage, law enforcement has
understandably not placed the same priority on catching ELF/ALF
activists as it has other actors such as jihadists, who intentionally target
people.
In Bond’s case, he might have had some difficulty not drawing
attention to himself as he cased leather stores and foie gras restaurants
because he had tattoos covering half his face with the word “vegan”
tattooed across his throat in large block letters flanked on either side by
crossed wrenches. “Monkey wrenching” is a term widely used by activists
associated with ELF/ALF and anarchist groups to refer to direct-action
attacks that involve property destruction such as arson. Anyone involved
in animal research or selling animal products who is observant enough
would surely look suspiciously upon a person with such distinctive
markings.
When all of these factors combine, it is usually very difficult to
solve an ELF/ALF arson or bombing case unless a mistake is made, or a
confidential informant comes forward. Most successful prosecutions in
such cases have come as a result of informants, and because of this we
have witnessed a cat-and-mouse game between activists and the
government regarding informants, with activist groups pressing
informants to commit illegal activities before being accepted and the
government giving them permission to do so. Although the CI in the Bond
case was just an acquaintance of Bond who was concerned about his
arson activities and not a person specifically dispatched to penetrate the
movement, without the help of the CI, the government probably had very
little chance of identifying Bond.
Animal rights blogs and websites have already begun dissecting
the Bond case and providing lessons learned to current (and aspiring)
animal rights activists. Many of these sites have focused on Bond’s
mistake in confiding in the CI and have indicated that they believe the
informant is a woman, which is a fair guess, based on the way Bond
appeared to be trying to impress the CI with his exploits. In all likelihood,
such sites will soon learn the identity of the CI through court documents
and appearances and will publish the CI’s name and photo in order to
prevent the CI from informing on other activists. The ALF has threatened
informants, and has even created websites devoted to identifying
“informants, infiltrators, snitches and agents.” As previously imprisoned
ALF activist Peter Young once said: “For the sake of clarity, let us be
uncomfortably honest: To snitch is to take a life. By words and by
weapons, each day lives are taken in the most egregious of crimes. When
this happens in the courtroom, we call it ‘cooperation.’ I call it violence,
and I call anything done to keep an informant out of the courtroom ‘self-
defense.’” Despite this rhetoric, however, to date, none of the people
identified by the ALF as an informant have been harmed.
And despite the uproar the Bond case has caused on websites
affiliated with animal liberation, when it comes to the national media, the
case appears to have received more coverage because of Bond’s dramatic
facial tattoos than for his string of successful arsons. Yet even with a
dearth of media reporting, a review of the communiques carried on the
websites of groups such as ALF and Stop Huntington Animal Cruelty
shows that animal rights activists remain surprisingly active, not just in
the United States but also in Mexico and elsewhere. Operationally, many
of their lone wolves have been more successful in conducting attacks than
jihadist lone wolves.

Polarization in the animal rights community continues to grow, as
do calls for lone wolves to remain isolated from more moderate elements of
the community, who are seen as potential security threats. As those
activists favoring violence draw further from the more moderate members
of the movement — either due to ideological differences or the need for
operational security — any moderating influence on the radicals will also be
removed, and the lack of this influence will result in the more radical
elements becoming even more violent. This dynamic will certainly produce
more attacks against property and can be expected to lead to more attacks
of the kind advocated by the book found in Bond’s backpack — attacks
against people.

ABOARD THE USS GEORGE WASHINGTON (AP) — Nothing
projects U.S. global air and sea power more vividly than supercarriers.
Bristling with fighter jets that can reach deep into even landlocked trouble
zones, America's virtually invincible carrier fleet long has enforced its
dominance of the high seas.
China soon may put an end to that.
U.S. naval planners are scrambling to deal with what analysts say
is a game-changing weapon being developed by China: an unprecedented
carrier-killing missile called the Dong Feng 21D that could be launched
from land with enough accuracy to penetrate the defenses of even the most
advanced moving aircraft carrier at a distance of more than 900 miles.
Analysts say final testing of the missile could come as soon as the
end of this year, though questions remain about how fast China will be able
to perfect its accuracy to the level needed to threaten a moving carrier at
sea.
The weapon, a version of which was displayed last year in a
Chinese military parade, could revolutionize China's role in the Pacific
balance of power, seriously weakening Washington's ability to intervene in
any potential conflict over Taiwan or North Korea. It also could deny U.S.
ships safe access to international waters near China's 11,200-mile-long
coastline.
While a nuclear bomb theoretically could sink a carrier, assuming
its user was willing to raise the stakes to atomic levels, the conventionally-

armed Dong Feng 21D's uniqueness is in its ability to hit a powerfully
defended moving target with pin-point precision.
The Chinese Defense Ministry did not immediately respond to
the AP's request for a comment.
Funded by annual double-digit increases in the defense budget
for almost every year of the past two decades, the Chinese navy has
become Asia's largest and has expanded beyond its traditional mission of
retaking Taiwan to push its sphere of influence deeper into the Pacific
and protect vital maritime trade routes.
"The Navy has long had to fear carrier-killing capabilities," said
Patrick Cronin, senior director of the Asia-Pacific Security Program at the
nonpartisan, Washington-based Center for a New American Security.
"The emerging Chinese antiship missile capability, and in particular the
DF 21D, represents the first post-Cold War capability that is both
potentially capable of stopping our naval power projection and
deliberately designed for that purpose."
Setting the stage for a possible conflict, Beijing has grown
increasingly vocal in its demands for the United States to stay away from
the wide swaths of ocean — covering much of the Yellow Sea, East
Sea/Sea of Japan and South China Sea — where it claims exclusivity.
It strongly opposed plans to hold U.S.-South Korean war games
in the Yellow Sea off the northeastern Chinese coast, saying the
participation of the USS George Washington supercarrier, with its 1,092-
foot flight deck and 6,250 personnel, would be a provocation because it
put Beijing within striking range of U.S. F-18 warplanes.
The carrier instead took part in maneuvers held farther away in
the East Sea/Sea of Japan.
U.S. officials deny Chinese pressure kept it away and say they
will not be told by Beijing where they can operate.
"We reserve the right to exercise in international waters
anywhere in the world," Rear Adm. Daniel Cloyd, who headed the U.S.
side of the exercises, said aboard the carrier during the maneuvers, which
ended last week.
But the new missile could undermine that policy.
"China can reach out and hit the U.S. well before the U.S. can
get close enough to the mainland to hit back," said Toshi Yoshihara, an
associate professor at the U.S. Naval War College. He said U.S. ships have
been that vulnerable only twice — against Japan in World War II and
against Soviet bombers in the Cold War.
Carrier-killing missiles "could have an enduring psychological
effect on U.S. policymakers," he e-mailed the AP. "It underscores more
broadly that the U.S. Navy no longer rules the waves as it has since the
end of World War II. The stark reality is that sea control cannot be taken
for granted anymore."
Mr. Yoshihara said the weapon is causing considerable
consternation in Washington, though with attention focused on land wars
in Afghanistan and Iraq, its implications haven't been widely discussed in
public.
Analysts note that while much has been made of China's efforts
to ready a carrier fleet of its own, it likely would take decades to catch U.S.
carrier crews' level of expertise, training and experience.
But Beijing does not need to match the U.S. carrier for carrier.
The Dong Feng 21D — smarter and vastly cheaper — could attack a U.S.
carrier successfully, or at least deter it from getting too close.
U.S. Defense Secretary Robert Mr. Gates warned of the threat in
a speech last September at the Air Force Association Convention.
"When considering the military-modernization programs of
countries like China, we should be concerned less with their potential
ability to challenge the U.S. symmetrically — fighter to fighter or ship to
ship — and more with their ability to disrupt our freedom of movement
and narrow our strategic options," he said.
Mr. Gates said China's investments in cyber and anti-satellite

set just five years from now in which a Deng Feng 21D missile with a

That would usher in a "new epoch of international order in which
Beijing emerges to displace the United States."
While China's Defense Ministry never comments on new weapons
before they become operational, the DF 21D — which would travel at 10
times the speed of sound and carry conventional payloads — has been much
discussed by military buffs online.
A pseudonymous article posted on Xinhuanet, website of China's
official news agency, imagines the U.S. dispatching the George Washington
to aid Taiwan against a Chinese attack.
The Chinese would respond with three salvos of DF 21D, the first
of which would pierce the hull, start fires and shut down flight operations,
the article says. The second would knock out its engines and be
accompanied by air attacks. The third wave, the article says, would "send
the George Washington to the bottom of the ocean."
Comments on the article were mostly positive.

strike hard against U.S. Navy in Asian waters
WMR's sources in China reveal that during a recent military anti-
aircraft exercise conducted by the People's Liberation Army, a high-tech
mobile missile unit was seen moving toward the Pacific coast. The missile
unit and its complement of support vehicles was observed to be entirely
self-sufficient.
The movement of the missile unit toward the Pacific coast came at
the same time the South China Morning Post was reporting that China was
deploying its first anti-ship ballistic missile (ASBM). It is believed that the
missiles are armed with nuclear warheads and are designed to destroy U.S.
aircraft carriers like the USS George Washington.
The carrier, normally based at the U.S. naval base in Yokosuka,
Japan, is in East Asian waters and is participating in a joint naval exercise
with South Korea in the Yellow Sea following the ratcheting of tensions
between South and North Korea over the sinking of the Cheonan, a South
Korean naval vessel. The South and its American allies blame the North for
the sinking, while the North and some of its allies suspect the sinking of the
Cheonan was a U.S.-South Korean "false flag" attack staged to blame the
North and increase tensions.
