AN ORDINANCE APPROVING THE AMENDMENT OF THE MT. JULIET


CITY CHARTER AND AUTHORIZING SUCH AMENDMENT TO BE PLACED
ON THE AUGUST 2012 NOVEMBER 2010 BALLOT FOR A REFERENDUM VOTE

WHEREAS, the Board of Commissioners of the City of Mt. Juliet desires to amend the
Mt. Juliet City Charter (“the Charter”) to preclude a person from holding a county, state
or federal office while simultaneously serving as a member of the city’s governing body;

WHEREAS, the City of Mt. Juliet has a home rule charter, which may be amended upon
the passage of an ordinance by the Mt. Juliet Board of Commissioners reflecting the
amendment to the Charter and upon the adoption of such amendment in a voter
referendum;

BE IT, THEREFORE, RESOLVED THAT:

Section 1. The Mt. Juliet Board of Commissioners votes to amend Section 6-20-103 of
the Charter by adding “or as mayor” to the end of the heading and by adding the
following to the end of this section: “or mayor. No person may serve simultaneously as
a commissioner or mayor and in an elected office within the county, state or federal
government. A person who holds an elected office within the county, state or federal
government shall resign that office prior to taking the oath of office as a commissioner or
mayor, and a person who holds office as a commissioner or mayor shall resign that office
prior to taking the oath of office as an elected official in the county, state or federal
government.” The amended section shall read:

6-20-103. Persons eligible as commissioners or as


mayor. – A qualified voter of the city, other than a person
qualified to vote based only on nonresident ownership of
real property under the provisions of § 6-20-106(b), shall
be eligible for election to the office of commissioner or
mayor. No person may serve simultaneously as a
commissioner or mayor and in an elected office within the
county, state or federal government. A person who holds
an elected office within the county, state or federal
government shall resign that office prior to taking the oath
of office as a commissioner or mayor, and a person who
holds office as a commissioner or mayor shall resign that
office prior to taking the oath of office as an elected official
in the county, state or federal government.

Section 2. The City of Mt. Juliet Board of Commissioners hereby authorizes that the
above be placed on the August 2012 November 2010 ballot.
