Jeffery Thomas Pendzimas, did engage in masturbation or lewd exhibition of the genitals in the presence
of a minor under the age of 16 years, knowing or having reason to know the minor is present, and having
beenpreviouslyconvictedwithin7yearsoffelonyindecentexposurepursuantto617.23,subd.3.

 STATEMENTOFPROBABLECAUSE

Atapproximately2:00PMonAugust28,2017,OfficerWinkelwasonfootpatrolattheMinnesotaState
FairgroundsinFalconHeights,RamseyCountywhenhewasapproachedbyapersonwhosaid,Some
guyisshowinghisdicktopeople.ThepersonsaidthesuspecthadbeenchasedintotheColiseum.
OfficerswenttotheColiseumandsawJEFFREYTHOMASPENDZIMAS(DOB:06/15/1955)being
chasedbyanotherman.ThepersonwhohadfirstapproachedOfficerWinkelyelled,Thatstheguyright
there!Gethim!

OfficerWinkelgrabbedPendzimasrightarmsaidheneededtotalktoPendzimas.Pendzimastried
pullingaway,butofficerswereabletogetcontrolofPendzimas.WhileofficerswereidentifyingPendzimas
theyheardacallcomeovertheirradioaboutamanexposinghimselfattheCHSMiracleofBirthCenter.
ThedescriptionprovidedovertheradiomatchedPendzimasdescription.

OfficerWinkelmadecontactwithawoman(YOB:1986)whohadbeenwatchingchickenshatchatthe
CHSMiracleofBirthCenterwithherson(YOB:2015)andhernephew(YOB:2013).Thewomanfelta
handreachintohershortsfromthebottom.Thehandsqueezedtheskinofthewomansbuttcheekina
cuppingmotion.ThewomanturnedaroundandmadeeyecontactwithPendzimasthinkingwasan
accident.ThewomanmovedawaybeforesheturnedandlookedatPendzimaswhowasstandingright
behindher.ThewomansawPendzimasmakingupanddownmotionwithhishandsasifhewereplaying
withhimself.Pendzimasthenliftedhisshirtexposinghispeniswhichheactivelystrokedwhileitwas
stickingoutofhiszipper.Thewomancoveredtheeyesofhersonandnephewwhohadturnedin
Pendzimasdirection.Thewomanscreamedatthetopofherlungs,Whatareyoudoing?!?Thatmanhas
hispenisout!Pendzimasturnedaroundandfled.

Thewomantoldofficersshewoulddefinitelybeabletoidentifythemanwhereshetoseehimagain.An
officerturnedPendzimastofacethewomanwhosaid,Yes,thatisthesickfuckthatshowedmehissmall
penis.ThewomanlatertoldpolicethatthetwochildrenwithherhadseenPendzimasmasturbating.

AnotherwitnesstoldofficersshewasstandingbehindPendzimasandthewomanintheMiracleofBirth
Centerwhenthewomanyelled,Whatareyoudoing?Oh,thatisgross.Hehashispenisout.Gethim.
ThewitnesssawPendzimasadjustingthefrontofhispantsashefled.

TwootherwitnessesidentifiedPendzimasasthemanwhohadbeenchasedfromthebuilding.

Pendzimaswasarrested.

OnAugust29,2017,anofficerspoketoafairemployeewhowitnessedtheincident.Theemployeesaid
sheenteredtheMiracleofBirthCenterwithamotherwhohad4childrenundertheageof6withher.The
employeehelpedthemotherandherchildrenseetheanimals.Theemployeefeltsomeoneelbowherfrom
behindandsheturnedaround.Theemployeesawascruffy60-year-oldwhitemalebehindher.Theman
wasmasturbatinginfrontoftheemployeeandthe4children.Theemployeesawthetipofthemans
penis.Awomannexttotheemployeescreamedandthemanran.

PendzimaswasadvisedofhisconstitutionalrightsandagreedspeaktoSergeantZebro.Pendzimassaid
hehadnoideawhyhehadbeenarrestedanddeniedhehadbeenrunningwhenofficersapproachedhim.
Hedenieddoinganythingwrong.Hedeniedputtinghishandupwomansshortsandhealsodenied
masturbating.WhenaskedwhathewasdoingintheMiracleofLifeCenter,Pendzimassaidhedidnt
know.

Pendzimashasfivepriorfelonyconvictions:interferencewithprivacyofaminorand4indecentexposures.

Pendzimashasthreepriorgrossmisdemeanorconvictionsforindecentexposure.

Pendzimashasapriorgrossmisdemeanorconvictionforcriminalsexualconductinthefifthdegree.

Pendzimasfirstindecentexposurearrestwasin1979.Hewasconvictedofdisorderlyconductonthat
case.

OnFebruary12,2012,Pendzimaswassentencedonafelonyindecentexposureinthepresenceofa
minorpursuanttoMinnesotaStatute617.23,subd.3fromanoffensedateofJune3,2011.Pendzimas
masturbatedinthepresenceoftwoteenagegirls.

NOTICE:PursuanttoMinnesotaStatute609.49,subd.1(a)Apersonchargedwithorconvictedofafelony
andreleasedfromcustody,withorwithoutbailorrecognizance,whointentionallyfailstoappearwhen
requiredafterhavingbeennotifiedthatafailuretoappearforacourtappearanceisacriminaloffense,or
afterhavingbeenreleasedonanorderorconditionthatthereleaseepersonallyappearwhenrequiredwith
respecttothechargeorconviction,isguiltyofacrimeforfailuretoappearandmaybesentencedtonot
morethanone-halfofthemaximumtermofimprisonmentorfine,orboth,providedfortheunderlyingcrime
forwhichthepersonfailedtoappear,butthismaximumsentenceshall,innocase,belessthanatermof
imprisonmentofoneyearandonedayorafineof$1,500,orboth.
