21 MANDATORY JUDICIAL NOTICE that allen-lutzke marcie-lynn, by and through

her own right, having revealed her self onto evidence, is present and appears upon the
23
court in a non-representative capacity as legatee, and private person by special
24
appearance, and by special deposit, reserving all rights to admit onto evidence, as per
25
26 California Rules of Evidence, wherein there is evidence, by admission that Claimant

27 was in fact the source of funds for the reason that Claimants Note was the source of
28 funds at closing.

2 1. Page 1 of Claimants Settlement Statement in box 120 it reflects a balance
3
due of $330,366.10 from Claimant for the payoff of Countrywide loan. In box 220 it
4
reflects that Claimant paid $330,366.10 bringing the balance to zero.

6 2. On page 2 WELLS FARGO BANK, N.A. added a whole new loan of

7 $329,650.00 after the obligation had been fulfilled.

8 3. If WELLS FARGO BANK, N.A. had actually loaned claimant funds of its
9
own reserves, this would have been shown on page 1 as a new loan for the payoff to
10
COUNTRYWIDE BANK. The numbers are different as well. Claimant brought in
11
$330,366.10 and WELLS FARGO BANK, N.A. frivolously claims they loaned
12
13 $329,650.00 which is a difference of $716.10.

14 4. In addition, if WELLS FARGO BANK, N.A. had actually loaned Claimant


15
$329,650.00, they could not have added an amount of $329,650 on the second page,
16
hence, this would imply Claimant took out a $660,016.10 loan.

5. The numbers are completely contrary to general accounting principals.

19 6. So what actually happened and proof thereof attached hereto as page 5

20 is Claimants Note that WELLS FARGO BANK, N.A. endorsed and received the full
21 amount of the loan by cashing Claimants Note. WELLS FARGO BANK, N.A. then
22
added a new loan to a fulfilled obligation which is fraud.

7. Claimant references Jerome Daly vs First National Bank confirming
24
25 Claimants claims and defenses that she was the source of funds.

26 8. Claimant has provided sample delivery instructions to WELLS FARGO


27 BANK, N.A. on how to fraudulently claim borrowers property through the DTCC by way
28

1 of 1099-A. Abandonment of Property, as the borrower is unaware of its existence
2 under a false assumed name of Griffin Hospital Development.

9. Lastly Claimant provides a statement from CTS LINK aka
4
WELLS FARGO BANK, where they claimed borrowers/Claimants funds by way of IRS
5
6 1099-A Abandonment of Real Property through the WFHET 2004-2 HE TRUST.
