AIR OPERATOR CERTIFICATION

SUBPART. GENERAL
119.1.Purpose
(a) This Part prescribes the certification requirements for operators to conduct air
operations under Part 121 and Part 135 and operating requirements for the continuation of
this certification.
119.3.Definitions
1/ "Airline air operator certificate" means an air operator certificate that authorises the
holder to conduct:

1.1 air operations using an aeroplane that has a passenger seating configuration of
13 seats or more, excluding any required crew member seat, or a payload
capacity of more than 2000 kg, in accordance with Part 121;
1.2 air operations using an aeroplane that has a passenger seating configuration of
12 seats or less, excluding any required crew member seat, or a payload capacity
of less than 2000 kg, or using a helicopter, in accordance with Part 135.

2/ "Exposition" unless context otherwise requires, means the exposition required by


119.81 or 119.125.
119.5. Requirement for certificate
() Each person having operational responsibility for an air operation shall hold, and
comply with, an air operator certificate issued under this Part.
(b) No person shall perform an air operation except under the authority of, and in
accordance with, an air operator certificate issued under this Part.
119.7. Reserved
119.9. Application for certificate
(a) Each applicant shall complete form CAA 119/01, which shall require:
1/ the name and address for service in Mongolia of the applicant;
2/ the details required by 119.15 (b), for the operations specifications;
3/ the exposition required by 119.81 or 119.125;
4/ such further particulars relating to the applicant as may be required by the Director as
indicated on the form.

(b) An applicant shall submit the further particulars to the Director with a payment of the
appropriate application fee, not less than 90 days before the date of intended operation
unless otherwise acceptable to the Director.

119.11. Issue of certificate


() An applicant for the grant of an air operator certificate shall be entitled to an air
operator certificate authorizes to conduct air operations under Part 121 if the Director is
satisfied that:
1/ the applicant meets the applicable requirements of Subpart B;
2/ the applicant meets requirements of 119.51 () 1/ and 2/;
3/ the granting of the certificate is not contrary to the interests of aviation safety.

(b) An applicant for the grant of an air operator certificate shall be entitled to an air
operator certificate authorizes to conduct air operations under Part 135 if the Director is
satisfied that:
1/ the applicant meets the applicable requirements of Subpart C;
2/ the applicant meets requirements prescribed in rule 119.101 () 1/ and 2/;
3/ the granting of the certificate is not contrary to the interests of aviation safety.
119.13. Privileges of certificate holder
() An operator certificate specifies the privileges that the certificate holder is authorized
to perform.
(b) An air operator certificate shall specify:
1/ the name and address for service in Mongolia of the applicant;
2/ certificate number, period of validity and date of issue;
3/ the name, signature and title of the authority representative;
4/ telephone and fax details of person who has appropriate responsible for air
transport operation and other contact details.
119.15. Operations specifications
() An air operator certificate issued in accordance with this Part shall be accompanied
by the operations specifications specified in paragraph (b).
(b) The operations specifications must contain:
1/ details of the physical location of the certificate holders principal base of
operations;
2/ name and address for service in Mongolia of the certificate holder;
3/ other business names and address under which the certificate holder may operate;
4/ the type, serial number, and registration of every aircraft that is authorised for use;
5/ details of the air operation types authorised;
6/ the authorisation and limitations for routes and areas of operations;
7/ details of the special authorisation;
8/ the telephone, fax of the issuing authority of MCAA and other contact details;
9/ any exemption granted from any requirement of this or any other Part;
10/ any other item that the Director determines is necessary to cover.

(c) When authorizing SEIFR passenger operations in a certificate holders operations


specifications, the Director shall specify that the authorization is valid for a period less than
that for which the air operator certificate is valid.
119.17. Duration of certificate
() An air operator certificate may be granted for a period of up to 3 years.
(b) An air operator certificate remains in force until it expires or is revoked by the
Director.

(c) The holder of an air operator certificate that expires or is revoked shall forthwith
surrender the certificate to the Director.
(d) The holder of an air operator certificate that is suspended shall forthwith produce the
certificate to the Director for appropriate endorsement.
119.19. Notification of termination of operations
() Each holder of an air operator certificate that terminates air operations shall notify the
Director of the termination in writing within 30 days of the date of termination.
119.21. Renewal of certificate
() The holder of the air operator certificate shall make application for the renewal of an
air operator certificate on form CAA 119/01.
(b) The application required by paragraph (a) shall be submitted to the Director with
payment of appropriate application fee, not less than 60 days before the certificate expires.

B SUBPART. AIR OPERATOR UNDER PART 121 OPERATIONS CERTIFICATION


REQUIREMENTS
119.51. Personnel requirements
() An applicant for the grant of an air operator certificate authorizes to conduct air
operations under Part 121 shall employ, contract or otherwise engage:
1/ a senior person identified as the Chief Executive who:
1.1 has the authority within the applicants organisation to ensure that every
activity undertaken by the organisation can be financed and carried out in
accordance with the requirements and standards prescribed by this Part
and
1.2 is responsible for ensuring that the organisation complies with the
requirements of this Part; and
2/ senior persons:
2.1 responsible for ensuring that the applicants organisation complies with its
exposition; and
2.2 responsible for the functions referred to in paragraph (b) 1/; and
2.3 ultimately responsible to the Chief Executive; and
3/ sufficient personnel to plan, perform, supervise, inspect and certify the operations
listed in the applicants exposition.

(b) The senior persons required by paragraph (a) must:


1/ unless otherwise acceptable to the Director as a consequence of the size and
expected scope of the applicants orgainsation, each be responsible for no more than one of
the following functions:

1.1 air operations including the flight operations and the supporting ground
operations;
1.2 maintenance;
1.3 flight safety;
1.4 crew training and competency assessment;
1.5 internal quality assurance;

2/ hold the minimum qualifications and experience listed in the Appendix A as


applicable to the function for which they are responsible.

(c) Dependent on size of an applicants organisation and the expected scope of its
activities, the following senior persons responsibilities may be combined as responsible for
more than one if such arrangement is acceptable to the Director:
1/ a senior person responsible for the function referred to in paragraph 1.1 may be
nominated as responsible for the function to the paragraph (b) 1.4;
2/ the function referred to in paragraph (b) 1.3 and the function referred to in
paragraph (b) 1.5 may be integrated.

(d) Any function referred to in paragraph (b) 1/ may be delegated to other personnel
provided the senior person responsible for the function retains responsibility for the function
and the delegation is acceptable to the Director.
119.53. Personnel competency requirements
() Each applicant for the grant of an air operator certificate authorizes to conduct air
operations under Part 121 shall establish procedures:
1/ to initially access and to maintain the competency of personnel authorised to plan,
perform, supervise, inspect, or certify the air operations listed in the applicants
exposition;
2/ to ensure personnel are provided with written evidence of scope of their
authorisation.

(b) Each applicant for the grant of an air operator certificate authorizes to conduct air
operations under Part 121 may contract with an organisation that is certificated under Part
141 and appropriately authorised under that certificate to perform the functions of checking to
assess, or training to maintain, the competence of the applicants personnel in accordance
with paragraph () 1/.

(c) Each applicant for the grant of an air operator certificate authorizes to conduct air
operations under Part 121 that contracts with an organisation under paragraph (b) shall
include in its exposition details of:
1/ the functions to be transferred to the organisation;
2/ the scope of the checking or training to be carried out by the organisation;
3/ the authority of the organisation in respect of the checking or training functions to
be carried out.
119.55. Resource requirements
() Each applicant for an air operator certificate authorizes to conduct air operations
under Part 121 shall provide resources, acceptable to the Director:
1/ that enable the satisfactory provision of the operations listed in the applicants
exposition; and that shall , where appropriate, include:
1.1 accomodation, offices, workshops, hangars and buildings; and
1.2 equipment, tools, material aids, data, and documentation necessary to
perform the operations listed in the applicants exposition.

(b) The applicant for the grant of an air operator certificate authorizes to conduct air
operations under Part 121 shall ensure the environment it provides-
1/ is appropriate for the tasks to be performed;
2/ where appropriate, offers protection from weather elements.

119.57. Proving flights or tests


() Each applicant for the grant or amendment of an air operator certificate authorizes to
conduct air operations under Part 121 shall, if required by the Director, perform proving
flights or tests to satisfy the Director that it can meet any relevant prescribed requirement.
(b) The flights or tests shall be conducted in a manner acceptable to the Director.
119.59. Reserved
119.61. Requirements for the Maintenance Control Manual
() The applicant for the grant of an air operator certificate authorizes to conduct air
operations under Part 121 must establish a maintenance control manual that meets the
requirements of Appendix D. The design of the manual shall observe human factors
principles.

(b) An applicant for the grant of an air operator certificate authorizes to conduct air
operations under Part 121 shall ensure that the maintenance control manual is amended or
revised and the information contained therein is kept up to date.

(c) Copies of all amendments to the maintenance control manual shall be distributed
promptly to all organisations and persons to whom that has been issued.

(d) An applicant for the grant of an air operator certificate authorizes to conduct air
operations under Part 121 shall provide the State of the Operator and the State of Registry
with a copy of the maintenance control manual together with all amendments and/or
revisions to it and shall incorporate in it mandatory material as the State of the Operator and
the State of Registry may require.

(e) An applicant for the grant of an air operator certificate authorizes to conduct air
operations under Part 121 shall establish a procedure in the maintenance control manual
required by paragraph (a) to ensure each aircraft an AOC holder operates is in an airworthy
condition; the operational emergency equipment for each flight is serviceable.
(f) An applicant for the grant of an air operator certificate authorizes to conduct air
operations under Part 121 that contracts with another person to perform maintenance on the
applicants aircraft shall include in the exposition required under rule 119.81 details of:
1/ the functions to be transferred to the person;
2/ the scope of the maintenance to be carried out by the other person;
3/ the authority of the other person in respect of the functions and maintenance to be
carried out.
119.63. Maintenance programme
() An applicant for the grant of an air operator certificate authorizes to conduct air
operations under Part 121 shall establish a maintenance programme for every aircraft that is
operated under the authority of the certificate.
(b) The maintenance programme required under paragraph () shall include:
1/ the registration, type and serial number of each aircraft that is subject to the
programme;
2/ instructions and procedures, that are at least equivalent to the requirements
prescribed in Part 91 and manufacturers maintenance schedule, for the
performance of maintenance of the aircraft including any required inspection and
test of the airframe, aircraft engine, propellers, rotors, appliances, and emergency
equipment, together with details of the parts and areas that;

2.1 must be inspected;


2.2 could result in a failure, malfunction, or defect endangering the safe operation
of the aircraft if maintenance is not performed properly or if an improper part
or material is used;
3/ a schedule for the performance of the maintenance under paragraph (b) 2/
expressed in terms of time-in-service cycles, calendar time, number of system
operations, or any combination of these;
4/ procedures for maintenance trend analysis if the programme utilises condition
monitored maintenance or information derived from health and usage monitoring
system;
5/ procedures to ensure that every inspection required by the programme is
performed;
6/ procedures for rectifying a defect or deferring defect;
7/ when the Director considers it is necessary, a continuing structural integrity
programme;
8/ procedures for varying an inspection interval because of service experience;
9/ procedures for retaining a maintenance record in accordance with Part 91.

(c) An applicant for the grant of an air operator certificate authorizes to conduct air
operations under Part 121 shall provide the authority of the State of Registry with a
maintenance programme required under paragraph (b) for approval.
(d) An applicant for the grant of an air operator certificate authorizes to conduct air
operations under Part 121 shall establish a maintenance programme. The design of the
maintenance programme shall observe human factors principles.
119.64. Flight safety documents system
() An applicant for the grant of an air operator certificate authorizes to conduct air
operations under Part 121 shall establish a flight safety documents system for the use and
guidance of operational personnel.
(b) An applicant for the grant of an air operator certificate authorizes to conduct air
operations under Part 121 shall understand that the development of a flight safety
documents is a complete process, and changes to each document comprising the system
may affect the entire system.
(c) It is important for operational documents to be consistent with each other, and
consistent with regulations, manufacturer requirements and human factors principles. It is
also necessary to ensure consistency across departments as well as consistency in
application.
(d) An air operator certificate holders documents system shall include major parts of
Appendix F.
119.65. Documentation
() Each applicant for the grant of an air operator certificate authorizes to conduct air
operations under Part 121 shall establish procedures to control, amend, and distribute its
operational, safety, and maintenance data.
(b) An applicant for the grant of an air operator certificate authorizes to conduct air
operations under Part 121 shall establish a procedure for the control of documentation
required by any applicable Part, including but not limited to Parts 91, 108 and 121.
(c) The procedure for the control of documentation shall include:
1/ all documentation is reviewed and authorised by appropriate personnel before issue;

2/ current issues of all relevant documents are available to personnel at all locations
where they need access to such documentation, in either hard copy, electronic, or
other form acceptable to the Director;
3/ all obsolote documentation is promptly removed from all points of issue or use;
4/ changes to documentation are reviewed and approved by appropriate personnel;
5/ the current version of each item of documentation can be identified to preclude the
use of superseded material.
119.67. Recordspersonnel
() Each applicant for the grant of an air operator certificate authorizes to conduct air
operations under Part 121 shall establish procedures to ensure that:
1/ an accurate record is maintained of;
1.1 each employee who, in the performance of their duties, is required to hold a
licence or rating; and
1.2 each employee who is exercising any delegation of the Directors functions or
powers; and
1.3 each employee who is exercising any authorisation granted by the certficate
holder; and
2/ the record includes details of:
2.1 the relevant experience, qualifications and training of each employee listed in
paragraph ();
2.2 the scope, validity, and currency of any licence or rating referred to in
subparagraph 1.1;
2.3 the delegations referred to in subparagraph 1.2;
2.4 the functions and powers granted by the certificate holder specified in 1.3.
3/ the record is retained for one year from the date that the employee:
3.1 ceases to perform duties requiring a licence or rating, or
3.2 exercises any delegation or authorisation.
119.69. Recordsresources
(a) Each applicant for the grant of an air operator certificate authorizes to conduct air
operations under Part 121 shall:
1/ establish procedures to ensure details are recorded of testing, checking, and
calibration of any safety-critical resources used in carrying out the operations
specified on the certificate; and
2/ retain the record of details required by subparagraph 1/ for two years from the date
the details are recorded.
119.70. Requirements for the operations manual
() An applicant for the grant of an air operator certificate authorizes to conduct air
operations under Part 121 shall establish an operations manual for the use and guidance of
operations personnel containing all instrucions and information necessary to perform their
duties. The design of the opeations manual shall observe human factors principles.

(b) The applicants operations manual shall comply with the requirements of organisation
and contents are provided in Appendix C.

(c) An applicant for the grant of an air operator certificate authorizes to conduct air
operations under Part 121 shall ensure that contents of operations manual including all
amendments or revisions, do not contravene the conditions contained in the Air Operator
Certificate or any applicable regulations and this Part.

(d) An applicant for the grant of an air operator certificate authorizes to conduct air
operations under Part 121 shall issue an operations manual in separate volumes.

(e) An applicant for the grant of an air operator certificate authorizes to conduct air
operations under Part 121 shall ensure that the operations manual is amended or revised so
that the instructions and information contained therein are kept up to date.

(f) An applicant for the grant of an air operator certificate authorizes to conduct air
operations under Part 121 shall provide the Director a copy of the operations manual
together with all amendments and/or revisions for approval.
119.71. Flight authorisation and control
() Each applicant for the grant of an air operator certificate authorizes to conduct air
operations under Part 121 shall establish procedures to ensure that the initiation,
continuation, and termination of each operating cycle of an air transport operation is
authorised by the person required by 119.51 (b) 1.1.
119.73. Flight following service
() Each applicant for the grant of an air operator certificate authorizes to conduct air
operations under Part 121 shall establish procedures to ensure that a flight following service
is provided for any air operation that is conducted without a flight plan being submitted to an
ATS unit.
(b) The procedures required in paragraph () shall ensure that for each air operation
being provided with a flight following service, the person providing the flight following service:
1/ has the information required under Part 91 for a VFR flight plan;
2/ has a pre-arranged time for the completion of the air operation;
3/ subject to paragraph (c), has a time for re-establishing communications if the flight will
operate in an area where communications cannot maintained;
4/ has details of any other arrangements that may be appropriate for the safety of the
operation for the pilot-in-command to report to the following service;
5/ makes timely notification to -
5.1 the national rescue co-ordination centre; or
5.2 an organisation capable of taking emergency activation action that is
acceptable to the Director - if the pilot-in-comand fails to establish
communications within pre-arrenged times.

(c) An aircraft may not be without communication under paragraph (b) 3/ for longer than
30 minutes unless such longer period is acceptable to the Director.
119.75. Air operator security programme
() An applicant for the grant of an air operator certificate authorizes to conduct air
operations under Part 121 that proposes to operate a regular air transport passenger service
from or within Mongolia with any aircraft that has a passenger seating configuration of 13
seats or more, excluding any required crew member seat shall establish an air operator
security programme that meets the requirements of Part 108.
119.77. Establishment of operations procedures
() Each applicant for the grant of an air operator certificate authorizes to conduct air
operations under Part 121 shall establish procedures necessary to enable any requirement
of this or any other Part to be complied with.

119.78. Safety management system (into in force 2011.Jan.1)


(a) A holder of an air operator certificate or an applicant for the grant of an air operator
certificate authorizes to conduct air operations under Part 121 shall establish , maintain and
adhere to a safety management system in compliance with this Par:
.
1/ The safety management system includes;

1.1 a safety policy;


1.2 a process for setting goals for the improvement of aviation safety and for
measuring the attainment of those goals;
1.3 a process for providing safety and maintain an acceptable level of safety;
1.4 a process for identifying hazards to aviation safety and for evaluating and
managing the associated risks;
1.5 safety performance monitoring and measurement to verify the safety
performance of the orgainsation and to validate the effectiveness of the
safety risk controls;
1.6 the management of change;
1.7 a process for ensuring that personnel are trained and competent to perform
their duties;
1.8 a process for the internal reporting and analyzing of hazards, incidents and
accidents and for taking corrective actions to prevent their recurrence;
1.9 a document containing all safety management system processes and a
process for making personnel aware of their responsibilities with respect to
them;
1.10 coordination of emergency response planning;
1.11 a manual including all activities associated to the safety management
system;
1.12 a process for conducting periodic reviews or audits of the safety
management system and reviews or audits for cause of the safety
management system; and
1.13 any additional requirements for the safety management system that
are prescribed under these Regulations.

(b) A safety management system shall correspond to the size, nature and complexity of
the operations, activities, hazards and risks associated with the operations of the holder of a
certificate.

(c) The maintenance organisations management system and its implementation


framework shall include the components prescribed in Appendix E.

119.79. Internal quality assurance


() Each applicant for the grant of an air operator certificate authorizes to conduct air
operations under Part 121 shall establish an internal quality assurance system to ensure
compliance with, and the adequacy of, the procedures required by this Part..

(b) The internal quality assurance system shall include:


1/ A safety policy and safety policy procedures; and
2/ a procedure to ensure quality indicators, including defect and incident reports, and
personnel and customer feedback, are monitored to identify existing problems or
potential causes of problems within the system; and

3/ a procedure for correctiive action to ensure existing problems that have been
identified within the system are corrected; and
4/ a procedure for preventive action to ensure that potential causes of problems that
have been identified within the system are remedied; and
5/ an internal audit programme to audit the applicants organisation for conformity
with the procedures in its exposition and achievement of the goals set in its safety
policy; and
6/ management review procedures that may, where appropriate, include the use of
statistical analysis, to ensure the continuing suitability and effectiveness of the
internal quality assurance system in satisfying the requirements of this Part.

(c) The safety policy procedures shall ensure that the safety policy is understood,
implemented, and maintained at all levels of the organisation.
(d) The procedure for corrective action shall specify how:
1/ to correct an existing problem; and
2/ to follow up a corrective action to ensure the action is effective.
(e) The procedure for preventive action shall specify how:
1/ to correct a potential problem; and
2/ to follow up a preventive action to ensure the action is effective, and;
3/ to amend any procedure required by this Part as a result of a preventive action.
(f) The internal quality audit programme shall:
1/ specify the frequency and location of the audits taking into account the nature of
the activity to be audited; and
2/ ensure audits are performed by trained auditing personnel who are independent of
those having direct responsibility for the activity being audited; and
3/ ensure the results of audits are reported to the personnel responsible for the
activity being audited and the manager responsible for the internal audits; and
4/ measure the effectiveness of any preventive or corrective action taken by the
personnel responsible for the being audited since the last audit; and
5/ require preventive or corrective action to be taken by the personnel responsible for
the activity being audited if problems are found by the audit; and
6/ ensure follow-up audits to review the effectiveness of any preventive or corrective
action taken.

(g) The procedure for management review shall:


1/ specify the frequency of management reviews of the quality assurance system
taking into account the need for the continuing effectiveness of the system; and
2/ identify the responsible manager who shall review the quality assurance system;
3/ ensure the results of the review are evaluated and recorded.

(h) The senior person who has the responsibility for the internal quality assurance shall
have direct access to the Chief Executive on matters affecting safety.
119.81. Airline air operator exposition
() An applicant for the grant of an air operator certificate authorizes to conduct air
operations under Part 121 shall provide the Director with an exposition that contains:
1/ a statement signed by the chief executive on behalf of the applicants organization
confirming that the exposition and any included manuals

1.1 define the air operator organisation and demonstrate its means and
methods for ensuring on going compliance with this Part and any other
applicable Part; and
1.2 are required to be complied with by the organisations personnel at all
times; and
2/ the titles and names of the senior persons required by rules 119.51 () 1/ and 2/;
and
3/ the duties and responsibilities of the senior persons identified under paragraph ()
2/, including matters for which they have responsibillty to deal directly with the
Director, on behalf of the applicants organisation; and
4/ a summary of the scope of actvities at each location where the applicants
operations pesonnel are based for the purpose of providing air transport
operations; and
5/ an organisation chart showing lines of responsibility of the senior persons identified
under paragraph () 2/ and extending to each location listed under () 4/; and
6/ a summary of the staffing structure at each location listed under paragragh () 4/;
and
7/ details of the principal place of operation and, if applicable, the main operation
base and the maintenance base; and
8/ details of the resources required by rule 119.55; and
9/ details of the procedures required by this Part; and
10/ details of:

10.1 the maintenance control manual required by rule 119.61; and


10.2 the maintenance programme required by rule 119.63; and
10.3 the maintenance organisation that performs maintenance of the
applicants aircraft.
11/ details of the programmes required, as appropriate, by this Part, and Part 121, or
Part 135; and
12/ details of the operations manual required by rule 119.70;
13/ details of the procedures that ensure compliance with the laws of any foreign State
in which the applicants aircraft operate; and
14/ procedures to control, amend, and distribute the exposition.

(b) The exposition must remain acceptable to the Director.

C SUBPART. AIR OPERATOR CERTIFICATION REQUIREMENTS


119.101. Personnel requirements
() An applicant for the grant of an air operator certificate which authorizes to conduct air
operations under Part 135 shall employ, contract or otherwise engage:
1/ a senior person identified as the Chief Executive who:

1.1 has the authority within the applicants organisation to ensure that every
activity undertaken by the organisation can be financed and carried out in
accordance with the requirements and standards prescribed by this Part;
1.2 is responsible for ensuring that the organisation complies with the
requirements of this Part.
2/ senior persons:
2.1 responsible for ensuring that the applicants organisation complies with its
exposition;
2.2 responsible for the functions referred to in paragraph (b) 1;

2.3 ultimately responsible to the Chief Executive.


3/ sufficient personnel to plan, perform, supervise, inspect, and certify the operations
listed in the applicants exposition.

(b) The senior persons required by paragraph ():


1/ unless otherwise acceptable to the Director as a consequence of the size and
expected scope of the applicants organisation, each be responsible for no more
than one of the following functions:

1.1 air operations, including the flight operations and the supporting ground
operations;
1.2 crew training and competency assessment;
1.3 the control and scheduling of maintenance;
1.4 the organizaional management system;
1.5 conducting occurence investigations in accordance with Part 12.

2/ hold the minimum qualifications and experience listed in Appendix B as applicable


to the function for which they are responsible.

(c) Notwithstanding paragraph (b) 1.2, and if applicable to the structure of the applicants
organisation, the senior responsibilities for competency assessment may be assumed by the
senior person responsible for air operations under paragraph (b) 1.1.
119.103. Personnel competency requirements
() Each applicant for the grant of an air operator certificate authorizes to conduct air
operations under Part 135 shall establish procedures:
1/ to initially assess and to maintain the competence of personnel authorised to plan,
perform, supervise, inspect or certify the air operations listed in applicants
exposition;
2/ to ensure personnel are provided with written evidence of the scope of their
authorisation.

(b) Each applicant for the grant of an air operator certificate authorizes to conduct air
operations under Part 135 may contract with organisation that is certificated under Part 141
and appropriately authorised under that certificate to perform the functions of checking to
assess, or training to maintain, the competence of the applicants personnel in accordance
with paragraph () 1/.

(c) Each applicant for the grant of an air operator certificate under Part 135 that contracts
with an organisaion under paragraph (b) shall include in its exposition details of:

1/ the functions to be transferred to the organisation;


2/ the scope of the checking or training to be carried out by the organisation;
3/ the authority of the organisation in respect of the checking and training functions
to be carried out.

(d) The applicant for the grant of an air operator certificate authorizes to conduct air
operations under Part 135 may, as an alternative to paragraph (b), utilise an external
checking or training programme acceptable to the Director that is carried out by an
appropriately qualified holder of a fllight examiner rating.

119.105. Resource requirements


() Each applicant for the grant of an air operator certificate authorizes to conduct air
operations under Part 135 shall provide resourse, acceptable to the Director:
1/ that enable the satisfactory provision of the operations listed in the applicants
exposition that shall, where appropriate, include:

1.1 accommodation, offices, workshops, hangars, and buildings;


1.2 equipment, tools, material, trainng aids, data and documentation necessary
to perform the operations listed in the applicants exposition.

(b) The applicant for the grant of an air operator certificate under Part 135 shall ensure
the environment it provides:

1/ is appropriate for the tasks to be performed;


2/ where appropriate, offers protection from weather elements.
119.107. Proving flights or tests
() Each applicant for the grant or amendment of an air operator certificate under Part
135 shall, if required by the Director, perform proving flights or tests to satisfy the Director
that it can meet the relevant prescribed requirements.
(b) The flight or tests shall be conducted in a manner acceptable to the Director.
119.109. Maintenance procedures
() An applicant for the grant or amendment of an air operator certificate authorizes to
conduct air operations under Part 135 shall establish procedures to ensure the continued
airworthiness of every aircraft that is operated under the authority of the certificate, and any
equipment installed in or attached to the aircraft.
(b) An applicant for the grant or amendment of an air operator certificate authorizes to
conduct air operations under Part 135 that contracts with another person to perform
maintenance of the applicants aircraft shall include in the exposition required under rule
119.125 details of:
1/ the functions to be transferred to the other person;
2/ the scope of the maintenance to be carried out by the other person;
3/ the authority of the other person in respect of the functions and maintenance to be
carried out.
119.111. Maintenance programme
() An applicant for the grant or amendment of an air operator certificate authorizes to
conduct air operations under Part 135 shall establish a maintenance programme for every
aircraft that is operated under the authority of the certificate.
(b) The maintenance programme required under paragraph () shall include:
1/ type, serial number and the registration of each aircraft that is subject to the
programme; and
2/ instructions and procedures, that are at least equivalent to the requirements
prescribed in Part 91 and manufactures maintenance schedule, for the
performance of maintenance on the aircraft including any required inspections
and tets of the airframe, aircraft engine, propellers, rotors, appliances, and
emergency equipment, together with details of the parts and areas that:
2.1 must be inspected;

2.2 could result in a failue, malfunctions, or defect endangering the safe operation
of the aircraft if maintenance is not performed properly or if improper parts or
materials are used; and
3/ a schedule for the performance of the maintenance under paragraph (b) 2/
expressed in terms of the time-in-service, cycles, calendar time, number of
system operations, or any combination of these; and
4/ procedures for maintenance trend analysis if the programme utilises condition
monitored maintenance or information derived from health and usage monitoring
systems; and
5/ procedure to ensure that every inspection required by the programme is
performed;
6/ procedures for recording defects, including examples of records;
7/ procedures for rectifying and deferring defects;
8/ procedures for varying an inspection interval because of service experience:
9/ procedures for retaining maintenance records in accordance with Part 91.
10/ procedures for reporting to the Director the type of service information of the
aircraft per month;
11/ procedures to receive mandatory continuing airworthiness information from the
State of Design or assess the information received and take appropriate action;
12/ procedures for notifying the Director of information on faults, malfunctions, defects
and occurences that cause or might cause adverse effects on the continuing
airworthiness of the aircraft and recording its corrective action.
119.113. Documentation
() Each applicant requiring a management system in accordance with 119.124 (c) for the
grant of an air operator certificate authorizes to conduct air operations under Part 135 shall
establish procedures to control, amend, and distribute its operational, safety and
maintenance data.
(b) Each applicant for the grant of an air operator certificate authorizes to conduct air
operations under Part 135 shall establish a procedure for the control documentation required
by any applicable Part, including not limited to Parts 91 and 135.
(c) The procedure for control for documentation shall ensure that:
1/ all documentation is reviewed and authorised by appropriate personnel before
use; and
2/ current issues of all relevant documents are available to personnel at all locations
where they need access to such documentation, in either hard copy, electronic, or
other form acceptable to the Difrector;
3/ all obsolote documentation is promptly removed from all points of issue or use;
4/ changes to documentation are reviewed and approved by appropriate personnel;
5/ the current version of each item of documentation can be identified to preclude
the use of superseded material.
119.115. Recordspersonnel
() Each applicant for the grant of an air operator certificate authorizes to conduct air
operations under Part 135 shall establish procedures to ensure that:
1/ an accurate record is maintained of:
1.1 each employee who, in the performance of their duties, is required to hold
a licence or rating;
1.2 each employee who is exercising any delegation of the Directors functions
or powers;

1.3 each employee who is exercising any authorisation granted by the


certificate holder.
2/ the record includes details of:
2.1 the relevant experience, qualifications, and training of each employee
listed under subparagraph 1/;
2.2 the scope, validity and currency of any licence or rating referred to in
subparagraph 1.1;
2.3 the delegations referred to in subparagraph 1.2;
2.4 the authorisation referred to in subparagraph 1.3;
3/ the record is retained for one year from the date that the employee:
3.1 ceases to perform duties requiring a licence or rating, or
3.2 exercise any delegation or authorisation.
119.117. Recordsresources
(a) Each applicant for the grant of an air operator certificate authorizes to conduct air
operations under Part 135 shall:
1/ establish procedures to ensure details are accurately recorded of testing,
checking, and calibration of any safety critical resources used in carrying out the
operations specified on the certificate.
2/ retain the record of details required by subparagrah 1/ for two years from the date
the details are recorded.
119.119. Flight authorisation and control
() Each applicant for the grant of an airline operator certificate shall establish
procedures to ensure the initian, continuation, and termination of a flight or series of flights is
authorised by the person required by 119.101 (b) 1.1.
119.121. Flight following service
() An applicant for the grant of an air operator certificate authorizes to conduct air
operations under Part 135 shall establish procedures to ensure that a flight following service
is provided for any air operation that is conducted without a flight plan being submitted to an
ATS unit.
(b) The procedures required in paragraph () shall ensure that for each operation being
provided with a flight following service, the person providing the flight following service:
1/ has the information required under Part 91 for a VFR flight plan; and
2/ has a pre-arranged time for the completion of the air operations; and
3/ subject to paragraph (c), has a time for re-establishing communications if the flight
will operate in an area where communications cannot be maintained;
4/ has details of any other arrangements that may be appropriate for the safety of
the operation for the pilot-in-command to report to the flight following service;
5/ makes timely notification to -
5.1 the national rescue co-ordination centre; or
5.2 an organisation capable of taking emergency activation action that is
acceptable to the Director - if the aircraft is overdue or missing, pilot-in-
command fails to establish communications within the pre-arranged time.

(c) The maximum time period for which an aircraft may be planned to be without
communication capability as provided for in paragraph (b) 3/ is 30 minutes or such longer
period that is acceptable to the Director.

119.123. Establishment of operations procedures


() Each applicant for the grant of an air operator certificate authorizes to conduct air
operations under Part 135 shall establish procedures necessary to enable any requirement
of this or any other Part to be complied with.
119.124. Organisational management system
() ) Each applicant for the grant of an air operator certificate authorizes to conduct air
operations under Part 135 shall establish an organisational management system to ensure
compliance with, and adequacy of, the procedures required by this.
(b) The organisational management system procedures shall be of sufficient detail when
considering the size and complexity of the operation to ensure that the appropriate
organisational procedures are understood, implemented and maintained at all levels of the
organisation.
(c) The organisational management system shall include:
1/ a safety policy and safety policy procedures, including the procedure for occurrence
investigations conducted in accordance with Part 12;
2/ a procedure to ensure personnel and customer feedback are monitored to identify
existing problems or potential causes of problems within the system;
3/ a procedure to ensure problems, or potential problems, that have been identified
within the systems are;
3.1 corrected; and
3.2 checked to ensure any corrections have been effective; and
4/ a procedure to check that the organisations programmes and procedures achieve the
stated aims of its safety policy;
5/ a procedure to ensure that the management of the organisation continues to be
effective in satisfying the requirements of this Part, including;
5.1 a regular plan of review; and
5.2 regular feedback to personnel including the results of the review and any
actions undertaken to correct problems identified;

(d) The senior person who has the responsibility for the organisational management
system shall communicate with the Chief Executive on matters affecting safety.
119.125. Air operator exposition
() An applicant for the grant of an air operator certificate authorizes to conduct air
operations under Part 135 shall provide the Director with an exposition that contains:
1/ a statement signed by the chief executive on behalf of the applicants organization
confirming that the exposition and any included manuals:

1.1 define the air operator organisation and demonstrate its means and methods
for ensuring ongoing compliance with this Part and any other applicable Part;
1.2 are required to be complied with by the organisations personnel at all times.

2/ the titles and names of the senior persons required by 119.81 () 1/ and 2/; and
3/ the duties and responsibilities of the senior persons identified under paragraph () 2/
including matters for which they have responsibility to deal directly with the Director
on behalf of the applicants organisation; and
4/ an organization chart showing lines of responsibility of the senior persons identified
under paragraph () 2/; and
5/ details of the principal place of operation and the main maintenance base; and
6/ details of the applicants procedures required by this Part; and

D SUBPART. OPERATING REQUIREMENTS


119.151. Continued compliance
(a) A holder of an air operator certificate must comply with operations specifications
required by rule 119.15.
(b) A holder of an air operator certificate must:
1/ continue to meet the standards and comply with the requirements of Subpart B or
Subpart C as appropriate; and
2/ comply with every procedure and programme detailed in the certificate holders
exposition; and
3/ hold at each location prescribed in the certificate holders exposition:

3.1 at least one current copy of the certificate holders operations specifications;
3.2 in hard copy, electronic, or other form acceptable to the Director, at least
one current copy of the relevant sections of the certificate holders exposition
that are applicable to the operations at the location.
119.153. Flight operation requirements
() A holder of an airline air operator certificate conducting an air operation with-
1/ an aeroplane that has a passenger seating configuration excluding any required crew
member seat, of more than 13 seats or a MCTOW of greater than 5700 kg, shall
comply with the applicable operating requirements of Part 121; and
2/ an aeroplane that has a passenger seating configuration of 12 or less, and a MCTOW
of 5700 kg or less, shall comply with the applicable operating requirements of Part
135;
3/ helicopter shall comply with the applicable operating requirements of Part 135.
119.155. Flight crew qualifications
(a) No holder of an air operator certificate shall authorise any person to act as a flight
crew member, no person may serve as a flight crew member, on an air operation, unless the
person holds the licence and rating in accordance with Part 61 that includes the privileges
necessary to perform the operation.
(b) Each person authorised to perform an air operation shall have the licence required by
paragraph () and that persons current medical certificate.
119.157. Charter, cross-hire, and leasing of Mongolian registered aircraft
(a) Each holder of an air operator certificate that charters, cross-hires, or leases an
aircraft, with or without flight crew, form another holder of an airline air operator certificate

shall clearly establish with that other operator, and inform the pilot-in-command, prior to the
aircrafts use in an air operation, uinder which air operator certificate the operation will be
conducted.
(b) Each holder of an air operator certificate shall keep a copy of each written charter,
cross-hire, or lease arrangement, under which it performs an air transport operation, for a
period of at least one year after the date of completion of the last flight under the
arrangement.
(c) In the case of a charter, cross-hire, or lease arrangement, that is made orally, the
certificate holder shall keep a memorandum stating the elements of the arrangement, of any
amendments to it, for a period of at least one year after the date of completion of the last
flight under the arrangement.
119.159. Use of non-Mongolian registered aircraft
(a) Each holder of an air operator certificate that uses a non-Mongolian registered aircraft
under a charter, lease, or similar arrangement, to perform an air operation shall, at least 30
days prior to the performance of the operation, unless a shorter period is acceptable to the
Director, notify the Director of the basic terms of the charter, lease, or similar arrangement,
including:
1/ where the aircraft provider is authorised by an ICAO contracting State to perform air
operations; and
2/ the names and address of the parties to the arrangement; and
3/ the duration of the arrangement; and
4/ the nationality, the registration markings and the type of each aircraft involved in the
arrangement; and
5/ duty and responsibility for aircraft safety;

(b) The certificate holder shall obtain approval from the Director prior to the use of a non-
registered aircraft on air operations.
119.161. Business or trading name
() Each holder of an air operator certificate shall conduct its air operations using the
trading or business name that appears on the certificate holders certificate.
(b) ) Each holder of an air operator certificate shall clearly identify, when it advertises any
air operation conducted by it, the business or trading name that appears on the certificate.
119.163. Limitations of Part 135 air operator certificate holder
() Each holder of an air operator certificate authorizes to conduct air operations under
Part 135 shall not conduct operations to which Part 121 applies.
119.165. Changes to certificate holder's organisation
(a) Each holder of an air operator certificate shall:
1/ ensure that its exposition is amended so as to remain a current description of its
organisation.
2/ ensure that any amendments made to its exposition meet the applicable
requirements of this or any other Part and comply with the amendment procedures
contained in its exposition;
3/ forward to the Director a copy of each amendment to its exposition as soon as
practicable after the amendment is incorporated into its exposition;
4/ make such amendments to its exposition as the Director considers necessary in the
interests of aviation safety.

(b) Where the certificate holder proposes to make a change of the following, prior
application for and acceptance shall be required:
1/ the Chief Executive;
2/ the listed senior persons;
3/ the locations nominated in 119.81 (a) 7/, or 119.125 (a) 5/, as appropriate, from which
the certificate holder conducts air operations;
4/ the scope of the certificate holders certificate;
5/ if an airline air operator certificate holder, the overall scope or intent of the
organisations internal quality assurance procedures;
6/ if holder of an air operator certificate authorizes to conduct air operations under Part
135 to which 119.124 (c) applies, the overall scope or intent of the organisations
management system;
7/ the maintenance programme;
8/ any contractor carrying out the certificate holders maintenance or training;
9/ the flight and duty scheme;
10/ where required, the air operator security programme.

(c) Except as provided in paragraph (g), the holder of an air operator certificate
authorizes to conduct air operations under Part 135 shall, if the holders organisation
changes to require the organisational management system specified in 119.124;

1/ amend their exposition to include the organisational management system specified in


119.124 (c);
2/ employ, contract, or otherwise engage a senior person in accordance with 119.101
(b) 1.4;
3/ ensure that that system is acceptable to the Director before performing the increased
level of air operations;

(d) The Director may prescribe conditions on the air operator certificate during or
following any of the changes specified in paragraphs (b) or (c).
(e) The certificate holder shall comply with any conditions prescribed under paragraph (d)
(f) Where any changes referred to the paragraph (b) or (c) requires an amendment to the
certificate, the certificate holder shall forward the certificate to the Director as soon as
practicable.
(g) The holder of an air operator certificate authorizes to conduct air operations under
Part 135 shall operate for a period of up to 7 days without completing the amendment
required by paragraph (c) provided the changes to the level of air operations:
1/ is complete otherwise unplanned operations; and
2/ does not involve the organisation operating of two aircraft or less; and
3/ is notified to the Director as soon as practicable.
119.167. Changes to the maintenance programme
(a) A certificate holder shall, upon the Director request, make any revisions to a
maintenance programme found the Director to be necessary to satisfy the continuing
airworthiness requirements of that programme.
APPENDIX "". QUALIFICATIONS AND EXPERIENCE OF SENIOR PERSONS AIR
OPERATOR CERTIFICATE HOLDER TO CONDUCT AIR OPERATIONS UNDER PART

This Appendix prescribes the qualifications and experience for senior persons responsible
under 119.51 (b) 1/.

-1. The holder of an air operator certificate authorizes to conduct air operations under Part
121 shall employ on the following positions persons with necessary professional
qualifications:
1/ a senior person responsible for air operations; and
2/ a senior person responsible for the control and direction of maintenance; and
3/ safety manager; and
4/ a senior person responsible for crew training and competency assessment; and
5/ a senior person responsible for internal quality assurance;
-2. Senior persons shall, other than Part 121:
1/ senior person responsible for air operation:
1.1 have an Airline Transport Pilot Licence; and
1.2 have 3 years as pilot-in-command of one type of operators aircraft during
last 6 years, and
1.3 have an operational control position.
2/ responsible for the control and direction of maintenance:
2.1 have a professional qualification of a special in hull and engine, or in the
avionics;
2.2 have at least 3 years experience in the maintenance parts of the
organisations exposition and the applicable maintenance provisions during
last 6 years;
2.3 have experience of the maintenance of aircraft which may be gained while
working in a maintenance supervision, engineering development, or workshop
environment.
3/ responsible for flight safety:
3.1 have held civil aviation higher education;
3.2 have at least 6 years experience in civil aviation system by profession
including 3 years managerial experience;
3.3 have a clear knowledge and understanding of the air law, regulations and
safety operation that is acceptable to the Director.
4/ responsible for crew training and competency assessment:
4.1 have held Airline Transport Pilot Licence; and
4.2 have 3 years as pilot-in-command of one type of operators aircraft during last
6 years;
4.3 have an operational control position.
5/ responsible for internal quality assurance:
5.1 have a certificate in Quality Assurance or equivalent qualification;
5.2 have at least 5 years experience in management system in the aviation
industry;
5.3 have held Airline Transport Pilot Licence and Aircraft Maintenance Engineer
Licence, and at least 5 years experience in aviation;
5.4 have ability to inspect companys exposition and organise internal quality
under that.

AIR OPERATOR CERTIFICATE HOLDER

This Appendix prescribes the qualifications and experience for the senior persons
responsible under 119.101 (b) 1/.

B-1 The holder of an air operator certificate authorizes to conduct air operations under Part
135 shall employ on the folowing positions persons with necessary professional
qualifications:

1/ safety manager;
2/ senior person responsible for the control and direction of maintenance;
3/ senior person responsible for crew training and competency assessment.
B-2 The senior person responsible for air operation shall, other than those rules in Part 135:
1/ responsible for flight safety:
1.1 have a Pilot Licence issued under Part 61,
1.2 have 3 years as pilot-in-command of one type of operators aircraft during last
6 years.
2/ responsible for the control and direction of maintenance:
2.1 have a professional qualification of a specialist in hull and engine, or in the
avionic,
2.2 have at least 3 years experience of aircraft which may be gained while
working in a maintenance supervision, maintenance planning;
2.3 have at least 3 years experience in the maintenance of aircraft during last 6
years;
3/ responsible for crew training and competency assessment:
3.1 have a Pilot Licence issued under 61;
3.2 have 3 years as pilot-in-command of one type of operators aircraft during last
6 years.

APPENDIX"C". CONTENTS OF AN OPERATIONS MANUAL


() Organization;
1/ An Operations manual shall be organised with the following structure:
General;
Aircraft operating information;
Areas, routes, and aerodrome;
Training;

(b) Contents of an operations manual referred to in paragraph (a) shall meet the
requirements of Annex 6, Part I, Appendix 2 to the Chicago Convention.

APPENDIX"D". REQUIREMENTS FOR MAINTENANCE CONTROL MANUAL


() An applicant shall have a maintenance control manual that contains:

1/ titles and names of senior persons required by rule 119.51 (b) 1.3 and other
maintenance personnel;
2/ an organisation chart showing lines of responsibility of the senior persons identified
under paragraph () 1/ and extending to each location;
3/ a maintenance programme required by rule 119.63;
4/ a description of methods used for the completion and retention of the operators
maintenance records;
5/ procedures for monitoring, assessing and reporting maintenance and operational
experience;
6/ a procedure for ensuring that any fault, malfunction, defects and other occurences
that cause adverse effects on the continuing airworthiness of aircraft is transmitted to
the organisation responsible for the type design of that aeroplane and civil aviation
authority;
7/ procedures for reporting to the Director the type of service information of the aircraft
per month;
8/ procedures to receive mandatory continuing airworthiness information from the State
of Design or assess the information received and take appropriate action;

9/ the procedures for the accomplishment of mandatory continuing airworthiness


information;
10/ a system of analysis and continued monitoring of the performance and efficiency of
the maintenance programme in order to correct any deficiency in that programme;
11/ a description of aircraft types and models;
12/ a description procedures for ensuring that unserviceabilities affecting airworthiness
are recorded and rectified;
13/ a procedure for notifying information in accordance with Part 12.

(b) An applicant shall submit a maintenance control manual and all proposed
amendments to the MCM to the Director for approval.

AAPENDIX "E". COMPONENTS OF SAFETY MANAGEMENT SYSTEM


() The safety management system shall include the following components:

1/ a safety management plan includes:


1.1 a safety policy that the accountable execute has approved and
communicated to all employees;
1.2 the roles and responsibilities of personnel assigned duties under the
safety management system;
1.3 performance goals and a means of measuring the attainment of those
goals;
1.4 a policy for the internal reporting of a hazards, incidents or accidents;
1.5 a review of the safety management system to determine its effectiveness;
1.6 procedures for reporting a hazard, an incident or an accident to the
appropriate manager;
1.7 procedures for collection of data relating to hazard, an incident or an
accident;
1.8 procedures for monitoring the results of preventive / corrective action how
to comply with organisations safety policy and objectives;
1.9 procedures for analyzing data obtained under 1.7 and during an audit
conducting under rule 119.79 (f) 5/ and for taking corrective actiions;
1.10 training requirements for personnel assigned duties under the safety
management system;
1.11 procedures for making progress reports to the accountable executive at
intervals and other reports as needed inurgent cases;
1.12 procedure to assure any changes to organisation structure and operation
effected,
2/ a safety management system defines lines of safety accountability throughout the
operators organisation, including a direct accountability for safety on the part of
senior management and other senior persons prescribed in rule 119.51 (b) 1/.
3/ the components specified in subsection 1/ shall be set in the certificate holders
operations manual.
(b) The person managing the safety management system shall:
1/ establish and maintain a reporting system to ensure the timely collection of
information relate to hazards, incidents and accidents;
2/ identify hazards and carry out risk management analyses of those hazards;
3/ carry-out risk management analyses based on combination of the reactive,
proactive and predictive methods;
4/ investigate, analyse and identify the cause or probable cause of all hazards,
incidents and accidents identified under the safety management system;

5/ establish and maintain a safety data system, either by electronic or other means to
monitor and analyze trends in hazards, incidents and accidents.
6/ monitor and evaluate the results of corrective actions with respect to hazards,
incidents and accidents.

APPENDIX "F". REQUIREMENTS FOR FLIGHT SAFETY DOCUMENTS SYSTEM


1. Organisation

() All safety documents shall be organised according to criteria which ensure easy
access to information required for flight and ground operations contained in the various
operational documents comprising the system and which facilitate management of the
distribution and revision of operational documents.

(b) Information contained in a flight safety documents system shall be grouped according
to the importance and use of the information, as follows:
1/ time critical information, information that can jeopardize the safety of the operation
if not immediately available;
2/ time sensitive information, information that can affect the level of safety or delay
the operation if not available in a short time period,
3/ frequently used information, /an organisation exposition and other operations
manual, operators policy etc;/
4/ reference information, /informion that is required for the air operation but does not
fall under subparagraph 2/ and 3/;
5/ information that can be grouped based on the phase of operation in which it is
used.
(c) Time critical information shall be placed early and prominently in the flight safety
documents system.
(d) Time critical, time sensitive information and frequently used information shall be
placed in cards and quick-reference guides.
2. Validation
() The flight safety documents system shall be validated before deployment, under
realistic conditions. Validation shall involve the critical aspects of the information use, in order
to verify its effectiveness. Interactions among all groups that can occur during operations
shall also be included in the validation process.
3. Design
(a) The flight safety documents system shall maintain consistency in terminology and in
the use of standard terms for common items and actions.

(b) Operational documents shall include a glossary of terms, acronyms and their standard
definition, updated on a regular basis to ensure access to the most recent terminology. All
significant terms, acronyms and abbreviations included in the flight documents system shall
be defined.
(c) A flight safety documents system shall ensure standardisation across document
types, including writing style, terminology, use of graphics and symbols, and formatting
across documents. This shall include consistent location of specific types of information ,
consistent use of units of measurement and consistent use of codes.
(d) A flight safety documents system shall include a master index to locate, in a timely
manner, information included in more than one operational document. The master index shall

be placed in the front of each document and consist of no more than three levels of indexing.
Pages containing abnormal and emergency information shall be tabbed for direct access.

(e) A flight safety documents system shall comply with the requirements of the operators
quality system, if applicable.

4. Deployment

(a) A holder of an air operator certificate shall monitor deployment of the safety
documents system, to ensure appropriate and realistic use of the documents, based on the
characteristics of the operational enviroment and in a way which is both operationally
relevant and beneficial to operational personnel. This monitoring shall include a formal
feedback system for obtaining input from operational personnel..
5. Amendment
(a) A holder of an air operator certificate shall develop information gathering, review,
distribution and revision control system to process information and data obtained from all
sources relevant to the type of operation conducted.

(b) A holder of an air operator certificate shall develop information gathering, review,
distribution system resulting from changes that originate within the organisation:
1/ resulting from the installation of new equipment;
2/ in response to operating experience;
3/ in a companys policies and procedures;
4/ in an operator certificate;
5/ for purposes of maintaining cross fleet standardization;

(c) A flight safety documents system should be reviewed:


1/ on a regular basis (at least once a year);
2/ after major events /mergers, acquisitions, rapid growth, downsizing;
3/ after technology changes /introduction of new equipment/; and
4/ after changes in safety regulations.

(d) The certificate holder shall develop methods of communicating new information. The
developed method shall be responsive to the degree of communication urgency.

(e) New information shall be reviewed and validated considering its effect on the entire
safety documents system.

(f) The method of communicating new information shall be complemented by a tracking


system to ensure currency by operational personnel. The tracking system should include a
procedure to verify that operational personnel have the most recent update.
