Laws and Regulations on Foreign Direct Investment

FDI in Indonesia is regulated by Law 25/2007 (the Investment Law). Under the law, any form of FDI
in Indonesia must be in the form of a limited liability company, with the foreign investor holding
shares in the company. In addition, the government outlines restrictions on FDI in presidential decree
44/2016, issued in May 2016, commonly referred to as the 2016 Negative Investment List. It aims to
consolidate FDI restrictions in certain sectors from numerous decrees and regulations to create

Political and Security Environment

Fighting terrorism remains a top priority for the Indonesian government, and President Jokowi has
demonstrated a continued strong commitment to combating terrorism. Since the 2002 Bali bombings,
which killed over 200 Indonesians and foreigners, Indonesian police have applied sustained pressure
to successfully degrade the capabilities of terrorists and their networks operating within Indonesias
borders. Nonetheless, U.S. designated terrorist organizations Jemaah Islamiyah (JI) and Jemaah
Anshourt Daulah (JAD), as well as other violent extremist groups continue to plot attacks. Indonesia
has effectively pursued counterterrorism efforts through legislation and law enforcement. The
January 14, 2016 terrorist attack in central Jakarta and subsequent small-scale attack linked to JAD
demonstrated that these groups continue to demonstrate a willingness and ability to carry out attacks
with little or no warning (though operational capabilities remain weak).
Indonesia Investment Coordinating Board (BKPM)
BKPM has launched an online portal for its National Single Window for Investment which
allows foreign investors to apply for and track the status of licenses and other services online.
In an effort to streamline the investment licensing and permitting process, BKPM launched a
national one-stop-service center to coordinate many of the permits issued by more than a
dozen ministries and agencies required for investment approval.
Though Indonesian companies only require one approval at the local level, businesses report
that foreign companies often must obtain both administrative and de facto legislative
approval in order to establish a business.

3,000 m2
4. Minimum requirements of learners, education personnel and non-teaching personnel
as follows. :
a. The source of the learners is at least 10 students
b. Teachers: 1 headmaster, 1 DGT-2 PGSD graduate teacher for each class, 1 religious
teacher and one teacher
c. Non-educational personnel: 1 school guard, 1 TU officer

5. Curriculum / Program Learning activities use nationally accepted curriculum and

8. Ensure to recruit new students minimum of 30 students for type E and 60 students for
type D every year
9. Have a special policy that can ensure justice for poor families to get educational
opportunities
10. Ensure that schools can operate within 20 years in accordance with SPM (Govts
Minimum Qualification) from MoNE, this guarantee is stated in the agreement between
the foundation and the district government authorized by notaries.
11. Prepare ESTABLISHMENT OF NEW SCHOOL UNITS management plan over the
next 20 years (future reference of SPM) assessed and verified by the Provincial
Education Office.
12. Got written support of the needs of the establishment of schools of at least 3

GENERAL REQUIREMENT
1. It is the result of a feasibility study which describes the purpose of establishing a
school, the form and name of the school, community support, the source of learners,
teachers and learners, funding sources, environmental facilities and education patterns
2. Developing a School Development Master Plan (RIPS) is a basic guideline for school
development for a period of at least five years and is prepared on the basis of a
feasibility study
3. Provide Land (Grant / Wakaf or buy) on behalf of the local Government / District
Education Office with certificate of land status or in the process of obtaining a certificate
proven by a letter from the local BPN at least 6,000 m2 for type C, 9,000 m2 type B and
type A
4. The existence of District Government Support through the guarantee of the smooth
operation of ESTABLISHMENT OF NEW SCHOOL UNITS through the provision of
Principals, Teachers and Administrative staff in accordance with the minimum
government applied qualification (SPM) and allocate funds in the budget of the
Department of Education Education starting next academic year.
5. The existence of District Government Support in the smooth operation of
ESTABLISHMENT OF NEW SCHOOL UNITS through the provision of books, tools,
materials and school operating costs are adequate (reference SPM) starting next year
6. Support of District Government for the construction of ESTABLISHMENT OF NEW
SCHOOL UNITS SMP / co-fund at least 30% of fund received
7. The existence of the guarantee will not give permission to build new SMP / MTs within
a radius of 5 Km from the location of ESTABLISHMENT OF NEW SCHOOL UNITS
8. Written support from community members at least 3 persons, community leaders 3
persons, 3 youth leaders, 3 Village Heads, 1 school supervisor and Head of Education
Office / Education Board
9. Plotting School locations on the map District / District
10. District APK data per sub-district
11. Data Analysis of student availability
12. State / private SMP / MTs data within a radius of 5 Km from US location

SPECIAL REQUIREMENTS ABOUT THE LOCATION RECIPER BLOCK GRANT


ESTABLISHMENT OF NEW SCHOOL UNITS SMP PUBLIC

1. The priority of building a ESTABLISHMENT OF NEW SCHOOL UNITS building is


given to poor, rural and remote areas
2. Being in the districts with APK or transition rates from primary to low secondary level
(<80%)
3. Be in the area in accordance with the general plan of sub-district spatial planning
4. In accordance with the priority in the annual plan of the construction of the SLTP
ESTABLISHMENT OF NEW SCHOOL UNITS based on the mapping of schools at the
District level
5. There are no public SLTP / MTs within a radius of 5 km from the proposed
ESTABLISHMENT OF NEW SCHOOL UNITS location and the district government will
not build any other SLTP / MTs within a 5 km radius unless the prospective student is at
least 30% more than the available capacity of ESTABLISHMENT OF NEW SCHOOL
UNITS
6. The land / site plan must meet the following criteria
1. The slope of the soil is less 15%
2. Easy to reach by students
3. Free floods, puddles, swamps and landslide potential
4. Available sources of clean water
5. Adequate entrance is available
6. Located around residential areas
7. Free from sound, noise and crowd noise such as market, entertainment center and
others
8. Free from high voltage power lines
9. Fertile easily overgrown plants for experimental gardens as well as for the comfort and
beauty of the environment

7. The agency request for each ESTABLISHMENT OF NEW SCHOOL UNITS is


accompanied by a piloting of the school location on the map in the District by including
the following drawings. ;
1. The existence of the boundaries of each regency and every sub-district
2. River, bridge and main road
3. Central districts, sub-districts and other cities and surrounding villages
4. Elementary School / MI either public / private that exists
5. Junior and Junior High Schools both public and private
6. Location of public / private junior / MTs to be built
