PARKING AND TRAFFIC REGULATIONS

1. PURPOSE: To establish policy for registering, parking and operating vehicles at South
Texas Veterans Health Care System (STVHCS) facilities.

2. POLICY: Persons operating vehicles on property of the STVHCS are required to comply
with posted traffic signs, state traffic laws, federal regulations, policy contained herein and
instructions from Department of Veterans Affairs (VA) Police Officers in the performance of their
duties. The procedures contained herein apply to all property under the control of the STVHCS.

3. ACTION

a. The Director has the overall responsibility of parking at STVHCS.

b. The Chief, Police Service is responsible for enforcing traffic and parking regulations
and procedures.

c. Service Chiefs are responsible to ensure that each employee receives a copy of this
memorandum to include subsequent changes and that employees are appropriately counseled
upon notification of their violation of policy contained herein. Service Chiefs are responsible to
orient their employees to this policy. The Chief, Police Service is available upon request to
conduct training sessions pertaining to this policy.

d. All operators of vehicles at STVHCS facilities are responsible for compliance with
policy and procedure contained herein.

e. Terms defined

(1) Vehicle: A conveyance used for transportation that is powered by an internal


combustion engine or by electrical power (i.e., automobiles, buses, motorcycles, motor
scooters, motor bikes, motor assisted bikes, trucks, trailers, and recreation vehicles).

(2) Visitor: A person who is not an employee, student, Volunteer, WOC (without
compensation), work study, contractor, vendor or patient of STVHCS.

(3) Hangtag: A parking permit issued by the STVHCS to be hung on the rear view mirror or
displayed on dashboard.

(4) Facility Property: All property under the control of the STVHCS, to include leased
property.

(5) Reasonable Accommodation Committee (RAC): The RAC is designated to review


employee requests for special parking based on VA Handbook 0730.

f. General provisions:

(1) Vehicles operated or parked on STVHCS property must comply with all federal and
state laws, city ordinances, policies and procedures contained herein. VA Police Officers will

only enforce Federal laws, policies and procedures contained herein; however, local law
enforcement officers may enforce state law.

(2) All employees, patients and visitors must comply with the posted 10 miles per
hour speed limit on all STVHCS roads, and streets unless posted otherwise.

(3) The operation of vehicles shall be restricted to facility roads, streets or parking
lots except for police and emergency vehicles on a "bona fide emergency", or
maintenance/service vehicles used in the performance of official duty.

(4) On special occasions and during emergencies, the Chief, Police Service, or the
Supervisory Police Officer, may impose temporary parking and traffic control restrictions.

(5) The driver of any vehicle involved in a collision at a STVHCS facility shall
immediately stop at the scene of such accident or collision, render first aid to the injured, (dial
911 for emergency response), if any, and by the quickest means of communication report such
accident or collision to the VA Police:

(6) Irregular tour parking: Irregular tour parking is defined as parking for employees who
work outside normal work schedules. Irregular tour parking is located in P-4 adjacent to
Wurzbach Road along the fence line in front of the Community Living Center (CLC). Managers
will be asked to provide a list of staff on irregular tours to VA Police; the individuals on the list
will be provided a hang tag for their vehicle with the expectation that it will be used only while
the employee is on an irregular tour. Employees who are issued a hang tag and are not
working the irregular tour for that day are expected to park in the parking garage. VA Police will
issue one courtesy violation to any employee found to be in violation. If the employee is found
to be abusing the use of the area a second time his/her privileges will be revoked (i.e. parking
there on regular tours). Irregular tours will consist of employees who report to work prior to 5:00
a.m. and employees who report to work after 9:30 a.m.

(7) VA Police Officers are empowered with arrest authority, are authorized to stop,
question, check drivers licenses and liability insurance of suspects or offenders and issue verbal
warning, courtesy and/or United States District Court Violation Notices (USDCVN) to violators of
any violation described in this memorandum or other appropriate law or regulation.

g. Reasonable Accommodation Committee (RAC): Reviews request and medical


documentation of employee requesting permanent or temporary handicap parking permits.
RAC will forward approval or disapproval to Police Service.

VEHICLE OPERATION

1. Operators of vehicles must have in their possession a valid state drivers license and liability
insurance issued to him/her for the type or combination of the type vehicle they are operating.
Operator of motor vehicles will produce their drivers' license and/or proof of liability insurance
upon request by a VA Police Officer when involved in a traffic infraction/ accident and/or
incident. Registered owners of vehicles are responsible for the manner in which their vehicles
are operated by themselves or others.

2. Vehicle operators are responsible for removing their ignition key, setting the vehicles brake
and locking vehicle doors when parking on STVHCS property. Merchandise or valuables should
never be left exposed to view and should be locked in the vehicle trunk if possible.

3. Vehicles operated on STVHCS property must be in good mechanical condition and meet all
safety and equipment standards required by the State of Texas.

4. All vehicles are required to stop completely at each Stop sign and then proceed cautiously
without creating a hazard to other vehicles or pedestrians.

5. All vehicles are required to Yield Right of Way to other traffic at all posted yield signs and
too pedestrian in a crosswalk or intersection.

6. Vehicles shall not be operated on pedestrian walkways or sidewalks, except for vehicles
(police, fire, ambulances, tow trucks, etc.) performing emergency functions.

7. No operator of a vehicle shall drive beyond a barricaded area, area outlined by traffic cones,
or where prohibited by temporary or permanent signs. No operator or other unauthorized person
shall remove such barricades or signs. Only VA Police personnel may remove barricades erected
by VA Police Officers.

8. No person in control or possession of a vehicle shall bring it to a sudden start (drag) or stop,
accept in emergencies, or accelerate or race the motor as to cause a loud noise in a manner
calculated to disturb the general public.

9. Failure to comply and repeated offenses of violations with South Texas Veterans Health Care
System Parking and Traffic Regulations will result in losing parking privileges.

VEHICLE REGISTRATION

1. Permanent Registration:

Employees will register with the VA Police all vehicles they operate on STVHCS
property. Employees must register all vehicles during new employee orientation, and no later
than, the second day (when they have their VA ID) the vehicle(s) operated on facility property.
When registering vehicles, the employee must present a valid VA Employee ID Card, valid state
drivers license and provide pertinent vehicle information for all vehicle(s) being registered
(make, model, year of vehicle, color, type, license plate number and state of issue). One hangtag
will be issued to employees that will be hung from the rear-view mirror on the vehicle. Failure to
turn-in hangtag upon clearing may result in bill of collection.

Without Compensation (WOC) individuals that come to STVHCS on an appointment are


required to register their vehicle with VA Police. WOCs will follow the same parking rules/regulations
as employees. Upon departure, WOCs are required to surrender their issued parking hangtag. Failure to
turn in hangtag upon clearing may result in bill of collection.

2. Temporary Registration:

a. Employees- Employees that operate loaned/rented vehicles or vehicles that will be


operated on the VA grounds for a period of two but less than 90 days will register the vehicle
with the VA Police and affix the issued temporary paper decal to the left portion of the vehicle
rear window (inside); whereby it can be read from the rear of the vehicle.

b. Others generally students and contractors will not receive parking but may be
reviewed on a case by case basis.

3. The following apply to all vehicles registered with the VA Police (includes permanent,
temporary):

a. Registration hangtags are valid for the period the vehicle is in possession of the
registrant and the registrant remains an employee of the STVHCS.

b. Whenever changes occur which alter the information contained in the Privately Owned
Motor Vehicle Registration file, (i.e., service, name, license plate number, etc., the registrant will
notify the VA Police within five (5) days.

c. Whenever a vehicle is sold, traded, disposed of, or the registrant is no longer employed
at the STVHCS.

4. Handicapped:

Handicapped spaces will be marked with the International Symbol of Access for the
Handicapped.

a. Handicapped Persons: Those eligible for reserved handicapped parking include:

(1) Those confined to wheelchairs.


(2) Single or double lower-limb amputees.
(3) Those with lower-limb impairments which require the use of assistor devices for
ambulation, such as use of a walker, brace, leg braces, or artificial limbs.
(4) Disabilities that do not prevent persons from overcoming obstacles such as curbs,
steep inclines, and steps are not qualified for the use of handicap spaces.

b. Visitor Parking:

(1) Parking available to the general public at this facility is considered acceptable for use
by most handicapped persons. Although in some cases, designated parking areas are distant
from the facility proper; pathways to and from these parking areas are void of obstacles and steep
inclines.
Therefore, designated parking is not usually required for handicapped persons whose physical
disabilities consist of lower limb impairments and who are fitted with orthotic or prosthetic
devices, and who have demonstrated that they are functional wearers of such appliances.

(2) Motor vehicle operators permanently confined to wheelchairs will be provided


parking space in the designated parking area of the type to facilitate transfer between vehicle and
chair.

(3) Parking spaces designated as "Handicap Parking", are reserved for "Handicap
Drivers" ONLY and must display either a handicap placard or handicap license plate.

c. Employee Parking: Employee that already have handicap plates or placard on their
vehicle(s) are required to register their vehicles with the VA Police to obtain a STVHCS
handicap permit. Employee designated handicap parking is located in P-4 and P-6 with
additional employee handicapped parking in the parking garage. Refer to Attachment 9 for
Kerrville.

(1) Employees that require temporary handicap parking privileges upon approval of the
Reasonable Accommodation Committee (RAC) will register their vehicles with the VA Police.
The temporary handicap permit when issued will be displayed from the vehicle rear view mirror.
Only one reserved handicapped parking permit will be authorized each person requiring this
designated handicapped parking.

(2) When an employee request to park in the designated handicap parking areas due to
temporary handicap condition the employee will provide Reasonable Accommodation
Committee (RAC) approval documentation. Medical documentation may be requested by the
RAC. Employees that are approved will be given a temporary STVHCS handicap permit that
will be displayed inside window.

PROHIBITED PARKING AND PRACTICES

1. Parking as outlined below is prohibited:

a. Parking along any curb unless otherwise specified by sign or at the direction of a VA Police
Officer.

b. Parking along curbs painted red, within 15 feet of fire hydrants, in areas that hinder the normal
flow of traffic or that block traffic or other legally parked vehicles or in a Tow Away Zone.

c. Parking of employee vehicles in areas other than as specified for employees, except as
otherwise specified in this memorandum or at the direction of a VA Police Officer.

d. Parking in restricted/reserved parking areas (handicapped, employee, valet, Government


Vehicle etc.) without the required hangtag, permit or authorization.

e. Parking over white line (occupying a portion of two parking spaces).

f. Parking in areas within the parking lots and elsewhere on STVHCS property that are not
designed or designated as a parking space.

g. Parking of bicycles in any area other than designated bicycle or motorcycle parking area.
Bicycles will not be brought inside of STVHCS buildings, nor will they be secured to a pole, sign, trees
or shrubs, parts of building or any other structure other than racks, poles, chains or cables within
designated bicycle parking areas.

h. Rear Dock area unless vehicle is being loaded or unloaded, except for specially designated
government vehicles. (Employee personal vehicles may not park in this area at any time.)

i. Ambulance entrance parking area, except for ambulance and official vehicles transporting
patients and when a person is directed to park therein by a VA Police Officer.

j. Use of parked vehicle, to include campers, recreational vehicles, trailers, etc., for sleeping
purposes or camping.

k. Parking in spaces designated for police vehicles.

l. Parking in spaces designated for government vehicles see Transportation Policy.

2. During the hours of darkness (dusk) to dawn, persons will not be permitted to sit in parked vehicles or
loiter on STVHCS grounds. If such persons have business inside of a STVHCS facility, they will be
permitted to enter; otherwise, they must depart the facility property.

ENFORCEMENT
1. Parking and traffic regulations will be enforced by the VA Police through issuance of verbal directions
and warning, issuance of Courtesy Violation Notices (VA Form 6160) and United States District Court
Violation Notice (VA Form 9019).

2. An employee will receive two (2) courtesy warnings and one (1) counseling prior to receiving a
parking citation by VA Police except where the infraction is a flagrant violation or in a clearly marked
emergency lane or parking space. All citations issued will be reviewed by the Director or appropriate
Departmental official who may make a recommendation to the Federal court. The citation or parking
warnings will be purged in accordance with the VA Records Control Schedule. The Chief, Police Service
reserves the right on an individual basis and based on the circumstances and may void the violation
notice, if appropriate.

3. A person that receives a USDCVN and believes it was issued in error or that there are mitigating
circumstances may appear and present testimony in United States District (Magistrate) Court. Persons
that do not pay the designated collateral within seven (7) days will automatically be notified, by the
Court, of their scheduled court date. (Follow instructions on USDCVN.) A person who receives a
USDCVN may also present mitigating circumstances as to why he/she should not have received the
USDCVN, to the Chief, Police Service prior to the court's copies of the USDCVN being forwarded.
United States Court Violation Notices are forwarded to the U.S. District Court within twenty-four (24)
hours of issue. The Chief, Police Service may void the violation notice if it is technically incorrect or it
was issued in error.

4. There are two (2) classes of traffic violations of which a violation notice may be issued (flagrant and
non-flagrant).

a. Flagrant: A violation is flagrant when it is apparent that the violator had or should have had prior
knowledge before commission of the violation. U.S. District Court Violation Notices may be issued for
these violations without regard to the number of previous courtesy violations. The following is a partial
list of flagrant violations:

(1) Failure to comply with directions of a VA Police Officer.


(2) Parking along curbs painted Red or other spaces that are specifically marked for other purposes.
(3) Parked in a posted Tow Away Zone.
(4) Parked in excess of the specified time period.
(5) Parked within 15 feet of a fire hydrant.
(6) Parked in an area that blocks traffic or other legally parked vehicles.
(7) Moving violations.
(8) Driving on fire lanes. (Police, maintenance and emergency vehicles accepted.)
(9) Unauthorized parking in a handicapped parking space or parking in a handicapped space without
the required permit.
(10) Parking on the left side of a one-way street.
(11) Parking in a reserved parking space.

b. Non-flagrant: Violation (other than flagrant) that do not have an immediate impact on traffic
flow or where it was not apparent that the violator had or should have had prior knowledge before
commission of the offense. Two Courtesy Violation Notices for this type violation, but not necessarily
for the same violation, is normally observed before issue of a U.S. District Court Violation Notice.

5. Continued/deliberate violations or failure to take the appropriate corrective action in response to


violation notices may result in suspension of parking privileges.

6. Illegally parked vehicles which obstruct traffic, or activities, or those parked in a Tow Away Zone,
which are abandoned, or those with suspended parking privileges, may be towed away at the owner's
expense by a commercial towing agency.

7. Illegally parked vehicles in designated areas without proper hangtags, authorization or parked in a tow-
away zone, etc., may be towed at the owners expense.

PARKING AREAS AND PROCEDURES, ALMC


The following describes parking by category within the various areas at the ALMC (See Attachment 8 for
diagram of parking areas).
a. Handicapped Parking: The first two rows of parking area #2 and in parking area #4 outside of
CLC are reserved for handicapped drivers (outpatients, visitors, and Volunteers) 24 hours daily. There
are also handicapped parking spaces in Parking Area 8; however, these spaces are reserved for Spinal
Cord Injury Center patients and require a special SCIC Permit, issued by SCIC.

b. Designated Parking Areas:

(1) Parking Area 1 - is reserved for authorized/designated staff


(2) Parking Areas 2, 3, 4 and 6 - are primarily Patient/Visitor except for specific designated spaces
for Employee Handicap in P-4 and P-6.
(3) Parking Area 3 - is designated parking for VA Employees who work a tour beginning at
3:00PM or later (employees may not park prior 2:30PM); employees on night tour(s) must have their
vehicles removed from this lot by 8:15AM.
(4) Parking Area 8 - is reserved for SCIC Patients and Visitors with SCIC permit required
(5) Parking Area 9 - is reserved for government vehicles
(6) Parking Garage - is for employees and WOCs with STVHCS issued hangtags.
(7) Emergency Vehicles - (i.e. Police, ambulance and/or government vehicles transporting patients
may be parked in the ambulance entrance parking area or under the outer canopy at the front entrance of
ALM when loading or discharging patients. Privately owned vehicles transporting emergency patients
may park under the canopy at the front entrance of ALMC for period necessary to get the patient into
Urgent Care; if possible making notification of situation to VA Police desk.
(8) Motorcycle Parking: Motorcycle parking area for employees is specifically identified on level 4
of the garage.
(9) Emergency Service Vehicles: There are spaces in Parking Area 8 reserved for Emergency
Service vehicles. Point of contact for service call must make contact with VA Police desk @ 1-5168
prior to parking.
(10) Bicycle Parking: Bicycle racks are located next to the Polytrauma Rehabilitation Center
(PRC), outside of CLC and also next to building 4. These are the only authorized parking areas for
bicycles.
(11) Loading Zone: All spaces adjacent to the loading dock marked as loading zone are reserved for
vehicles while cargo is being loaded/unloaded. Vehicles may park in those zones with a time limit for
only the amount of time so indicated. Employees may not park their personal vehicle in any designated
loading zone space or the loading dock area, at any time.
(12) Patient Shuttle Van Parking: There are several parking spaces along the exit lane of the Main
Entrance/Exit drive that are reserved for shuttle vans being used to transport patients (from OPCs).
(13) Valet Parking: Valet parking is reserved parking for patients and visitors. Contractors and
vendors are not authorized to utilize valet parking.

PARKING AREAS AND PROCEDURES,


KERRVILLE CAMPUS

1. Authorized Parking Areas (See map, Attachment 10):

a. Parking Area 1: This area is for outpatient and employees.

b. Parking Area 2: This area is reserved for outpatients and visitors. On duty volunteers with
Regularly Scheduled Volunteer (RSV) parking permits may also utilize this area, except spaces
designated for the handicapped spaces. Kerrville Campus employees may utilize this area only between
the hours of 2:30PM and 8:15AM., Monday through Friday, and all day on Saturday, Sunday, and
holidays.

c. Parking Area 3: This area is designated for visitors, volunteers, and outpatients. Kerrville
Campus employees may park in this area only during the hours of 2:30PM until 8:15AM., Monday
through Friday, and all day on Saturday, Sunday, and holidays.

d. Parking Areas 4 & 10: These areas are reserved for employees.

e. Parking Area 5: This area is reserved for employee parking.

f. Parking Area 6: This area is reserved for employee parking.

g. Parking Area 7: This area (East side of building 29) is employee parking.

h. Parking Area 8: This area is reserved for Community Living Center (CLC) visitors and
handicapped CLC visitors. CLC employees may park in the lot from 2:30PM until 8:15AM.

i. Parking Area 9 (located in front of building 11): This area is reserved for visitors and volunteer
parking. In addition, on duty Kerrville Campus employees may utilize this area from 2:30PM until
8:15AM daily.

j. Parking Area 11: This area is for outpatients, visitors or employees.

2. Parking Rules:

a. Commercial pickup and delivery service will be made at the commercial supply dock situated to
the northeast of the Kerrville main building (building 11).

b. Except for the pickup and delivery of incapacitated patients, private vehicles will not be stopped or
left standing in or near the ambulance entrance. All such pick-ups and deliveries will be limited to 15
minutes. Upon request of the owner or driver, the VA Police will provide relocation service.

c. Resident parking at Kerrville as a general rule is prohibited. Upon admission, the admitting
personnel will inform all newly admitted patients that resident parking is as a general rule prohibited.

Resident will be further advised that VA Police require the resident to make arrangements to have his/her
vehicle removed from Kerrville property by a personal representative; however, the north side of the
facility grounds, last or top row of area 4, has been designated as parking area 11 and is a temporary
vehicle holding area. Residents are to park their vehicles in this area until arrangements can be made to
remove their vehicles from the facility. This lot is designated for resident veteran parking.

d. Parking is permitted in designated parking areas only.

e. A bicycle parking rack is situated on the east side of the ambulance entrance. Persons parking
bicycles at the Kerrville will utilize said rack and their bicycles will be securely locked to the rack.

f. During initial processing, all new Kerrville employees will attend a newcomers briefing
conducted by the HRMS.

g. The Supervisory Police Officer, in coordination with the Assistant Chief, Voluntary Service,
will brief all volunteers on the contents of this police memorandum.

PARKING PROCEDURES, OUTPATIENT CLINICS

1. Reserved Parking:

a. Parking Area Designation

(1) Handicap parking will be designated in areas that facilitate easy access to the facility
and will be in the appropriate quantity to accommodate handicapped patients, employees, visitors
and volunteers. Vehicles parked in these spaces must display a valid handicap permit issued by
state or county government officials or in accordance with the provisions of this policy
memorandum.

(2) The Administrative Officer (AO) determines the need for separation of general
employee and patient/visitor parking. If the AO determine that the need exists, the areas will be
marked accordingly. The employee area designation signs will also include wording that state
"Permit required." All employee vehicles must display the employee issued hangtag when
parking on STVHCS property or leased property.
