AGREEMENT ON WEEKLY SUPPORT

KNOW ALL MEN BY THESE PRESENTS:


This agreement is entered into by and between:
JOSEPH D. VILLANUEVA, of legal age, married, Filipino, employed as
SALESMAN at JRC Auto Supply and resident of Calindagan Road, Dumaguete City, Negros
Oriental hereinafter referred to as the FIRST PARTY; and
ZERLYD A. ESMALLA, of legal age, married, Filipino, unemployed, and resident
of Lopez Jaena Street, Oton, Iloilo, hereinafter referred to as the SECOND PARTY;

WITNESSETH:
WHEREAS, parties are former live-in partners/common law spouses and have two
children, namely: Exzy Jo Villanueva, nine (9) years old and Ezzy Joy Villanueva, eight
(8) years old;
WHEREAS, a case has been filed by the SECOND PARTY against the FIRST PARTY for
violation of Section 5 (i) of R.A. 9262 specifically due to alleged denial by the FIRST
PARTY of financial support to his two children above-mentioned;
WHEREAS, the issue on support has become and is put into issue between the parties
herein;
WHEREAS, for the best interest of their children Exzy Jo Villanueva and Ezzy Joy
Villanueva, it is the mutual desire of both parties to settle amicably and come up with a
written agreement on support.
WHEREFORE, by these presents, with their mutual covenants and their oath to faithfully
comply with their respective obligations, the parties herein agree as follows:
1. That the First Party shall provide a weekly support of THREE HUNDRED PESOS
(300.00) to be remitted from his salary as salesman in connection with his
contract of employment with JRC Auto Supply;
2. That said weekly support shall be for food expenses and daily school allowances
of the above-mentioned children;
3. That remittance of the weekly support shall be through ;
4. That the bank passbook shall not be pledged to any person, bank, or institution
to secure any loan;
5. That no part from said money shall be used to pay for loans incurred previously;
6. That the First Party is obliged to send support for the necessary and educational
expenses of their children during months that he is not on board;
7. That emergency expenses including but not limited to hospital bills shall be
paid separately by the First Party;
8. That said monthly support shall be subject to adjustment one year after this
agreement is entered into or before the First Party leaves for another contract,
whichever is favorable;
9. That both parties agree to stop gambling and betting on cockfight;
10. That this agreement shall not bar or be a hindrance to any other agreement
more favorable to the children;
11. Extraordinary expenses and/or expenses not herein provided for shall be
subject to talks or agreement between the parties.
IN WITNESS WHEREOF, the parties have hereunto affixed their respective signatures this
8th day of August 2017 at Iloilo City, Philippines.
