Charge Description: That on or about 9/24/2017, in Hennepin County, Minnesota, DERRICK AARON
KINCHEN, born 03/22/1989, attempted to engage in sexual contact with Victim A, a person under the age
ofthirteenyears,andmorethanthirty-sixmonthsyoungerthanDERRICKAARONKINCHEN.

 STATEMENTOFPROBABLECAUSE

Complainanthasinvestigatedthefactsandcircumstancesofthisoffenseandbelievesthefollowing
establishesprobablecause:

OnSeptember24,2017,atapproximately12:22a.m.,Minnetonkapoliceofficersweredispatchedtoa
residenceonBellevueDriveintheCityofMinnetonka,CountyofHennepin,andStateofMinnesotaona
criminalsexualconductcomplaint.Uponarrival,officersspokewithWitnessA(adultmalefullyidentifiedin
thepolicereports),whoadvisedthatDERRICKAARONKINCHEN,DOB3/22/1989,thedefendantherein,
attemptedtosexuallyassaultWitnessA'sseven-year-olddaughter,VictimA.

AccordingtoWitnessA,thedefendantwasaguestintheirhomewhohadrentedtheirsparebedroom
throughtheAirbnbwebsite.Thatevening,WitnessAandhiswifeputVictimAtosleepintheirbedroom.
WitnessAheardthedefendantarrivehomefromaweddingaroundmidnight.Approximatelyfifteen
minuteslater,WitnessAwalkedtohisbedroomwhereheobservedthathisbedroomdoorwasopenand
thelightswereon.WitnessAfoundthedefendantlyingonthebednexttoVictimA.Thedefendantwas
nakedandhispeniswaserect.VictimA'snightgownwaspulledupandWitnessAcouldseeVictimA's
stomachandunderwear.WitnessAyelledatthedefendant.Thedefendantgrabbedhissuitcoatandwallet
andfledthehome.

Officersinitiatedacaninetrackandlocatedthedefendanthidinginapartiallycoveredfishingboatata
neighboringresidence.Thedefendantwasnakedexceptforasuitcoat.Officerstookthedefendantinto
custody.

VictimAunderwentaforensicinterviewandmedicalexaminationatChildren'sHospital.Accordingto
VictimA,shewokeuptothedefendantenteringherparents'bedroom.Thedefendantwasnaked.The
defendantwhisperedsomethingintoVictimA'searandVictimAfeltlikethedefendantwantedhertokeep
asecretfromhermomanddad.ThedefendantpulleddownVictimA'sunderwear.VictimApulledher
underwearbackup.VictimAsawthedefendant'spenisandthoughtthatthedefendantwantedhertotouch
it.ThedefendantwastouchinghispeniswhenWitnessAenteredtheroomandyelledatthedefendant.

Thedefendantisincustody.

determined that probable cause exists to support, subject to bail or conditions of release where applicable, Defendants arrest
