It is submitted that the railways have imposed an amount of Rs.3,86,100/- towards demurrage charges
for the delay in clearing of coal and oil wagons for the period from 01.04.2017 to 10.04.2017. The reasons
for accrual of demurrages were.

1. The Railways are allowing 7-hours free time only for un-loading of N type rakes and 2 hours for
unloading BOBR rakes at KTPG/GLE siding w.e.f. 01-01-2006.
2. Due to bunching of rakes.
3. The topographical arrangement of the KTPS/O&M marshalling yard is in such a way that minimum four
placements are required for clearing full N type & BOBR rakes.

The reasons for the delay in clearing of wagons were brought to the notice of the railway authorities and
it has been requested to arrange 100% waiver of demurrage charges imposed by the railways. After
consideration of the matter the railways have waived the levied demurrage charges as mentioned below vide
reference cited 1&2.

Out of total demurrages accrued 50%, 50% and 40% waiver has been issued for part amounts of
1,18,500/-, 1,71,150/- & 96,450/- respectively. The total amount waived to an extent of Rs.1,83,405/- and
requested for payment of the balance amount of Rs.2,02,695/-. As such, an amount of Rs 2,02,695/-. is payable
to the railways towards demurrage charges for the delay in clearing the coal & oil wagons for the period from
01.04.2017 to 10.04.2017. As per the clause no.(ix) of Railway commercial circular 199/2012,the levy of
demurrage charges in case of transportation of goods by Rail shall attract Service Tax at the rate of
3.708% on the gross amount. The Service tax is being imposed on demurrage charges w.e.f. 01.10.2012. The
Service tax has been revised from 3.708% to 4.2% w.e. f 01.06.2015. Further the Service tax has been revised
from 4.2% to 4.35% w.e.f 15.11.2015. Further the service tax has been revised from 4.35% to 4.5% due to
krishi kalyan cess @ 0.5% w.e.f. 01.06.2016. Further the service tax has been revised from 4.35% to 4.5% due
to krishi kalyan cess @ 0.5% w.e.f. 01.06.2016.As per ref (3), the service tax is to be refunded on waived
amount of demurrages. Hence the service tax amount to be paid is Rs. 9,121/-. Now the total demurrage
charges to be paid to the Railways including service tax is Rs.2,11,816/-.
The delay in clearing the coal wagons resulting in imposing of the demurrage charges by
railways is unavoidable as per the prevailing site conditions.

1. The delay in clearing the wagons is not attributable to slackness on the part of any of the corporation
employees.
2. The matter of obtaining further waiver from the railways will be pursued with the railways as per
procedure in vogue.
3. Sufficient budget provision is available for the year 2016-17 for incurring demurrage charges.
4. Every possible measure is implemented to minimize the levels of demurrage charges.

As per Sl.No.2.19.A.(a) of the G.O.O.No.270, Dt: 24.07.2003 (Revised delegation of powers), the Chief
Engineer is having full powers for authorizing expenditure of demurrages or warfare charges payable to the
railways.

In view of the above and pending appeal for further waiver it may please be
considered to accord sanction for payment of Rs.2,11,816/- towards Demurrage Charges on
coal and oil wagons to the Railways for the period from 01.04.2017 to 10.04.2017.

for the delay in clearing of coal and oil wagons for the period from 11.04.2017 to 20.04.2017. The reasons
for accrual of demurrages were.

for the delay in clearing of coal and oil wagons for the period from 21.04.2017 to 31.04.2017. The reasons
for accrual of demurrages were.

to the railways towards demurrage charges for the delay in clearing the coal & oil wagons for the period from
21.04.2017 to 31.04.2017. As per the clause no.(ix) of Railway commercial circular 199/2012,the levy of

to krishi kalyan cess @ 0.5% w.e.f. 01.06.2016.As per ref (3), the service tax is to be refunded on waived
amount of demurrages. Hence the service tax amount to be paid is Rs. 98276/-. Now the total demurrage
charges to be paid to the Railways including service tax is Rs.22,82,186/-.
The delay in clearing the coal wagons resulting in imposing of the demurrage charges by
railways is unavoidable as per the prevailing site conditions.

5. The delay in clearing the wagons is not attributable to slackness on the part of any of the corporation
employees.
6. The matter of obtaining further waiver from the railways will be pursued with the railways as per
procedure in vogue.
7. Sufficient budget provision is available for the year 2017-18 for incurring demurrage charges.
8. Every possible measure is implemented to minimize the levels of demurrage charges.

As per Sl.No.2.19.A.(a) of the G.O.O.No.270, Dt: 24.07.2003 (Revised delegation of powers), the Chief
Engineer is having full powers for authorizing expenditure of demurrages or warfare charges payable to the
railways.

In view of the above and pending appeal for further waiver it may please be considered to accord
sanction for payment of Rs.22,82,186/- towards Demurrage Charges on coal and oil wagons to the Railways
for the period from 11.06.2017 to 20.06.2017.

It is submitted that the railways have imposed an amount of Rs.13,89,150/- towards demurrage
charges for the delay in clearing of coal and oil wagons for the period from 21.06.2017 to 30.06.2017. The
reasons for accrual of demurrages were.

1. The Railways are allowing 7-hours free time only for un-loading of N type rakes and 2 hours for
unloading BOBR rakes at KTPG/GLE siding w.e.f. 01-01-2006.
2. Due to bunching of rakes.
3. The topographical arrangement of the KTPS/O&M marshalling yard is in such a way that minimum four
placements are required for clearing full N type & BOBR rakes.

The reasons for the delay in clearing of wagons were brought to the notice of the railway authorities and
it has been requested to arrange 100% waiver of demurrage charges imposed by the railways. After
consideration of the matter the railways have waived the levied demurrage charges as mentioned below vide
reference cited 1&2.

Out of total demurrage accrued 50%, 50% and 50% waiver has been issued for part amounts of
1,31,550/-, 2,91,300/-& 9,66,300/-respectively. The total amount waived to an extent of Rs. 6,94,575/-and
requested for payment of the balance amount of Rs. 6,94,575/-. As such, an amount of Rs .6,94,575/-. is payable
to the railways towards demurrage charges for the delay in clearing the coal & oil wagons for the period from
21.06.2017 to 30.06.2017. As per the clause no.(1.0) of Railway commercial circular 193/2017,the levy of
demurrage charges in case of transportation of goods by Rail shall attract Goods and Service Tax on the
gross amount. Now the Goods & Service tax @5% is being imposed on demurrage charges w.e.f.
01.07.2017. Hence the GST amount to be paid is Rs. 34,728.75/-. Now the total demurrage charges to be
paid including GST is Rs.7,29,303.75/-.
