INTRODUCCIN
Tambin ha de incluirse la marca distintiva de material para
atmsferas explosivas seguida de las indicaciones de Grupo,
Categora e indicacin relativa a gases (G) y/o polvo (D) (aparatos
del Grupo II), como se expone en el siguiente ejemplo:

Adicionalmente a este marcado segn directiva, y de acuerdo con
las normas de aplicacin correspondientes, se efecta el marcado
normativo que establece el cdigo especfico de modo o modos de
proteccin, tal y como ya se utilizaba. Por ejemplo: EEx ia IIC T6.
Tambin se incorporan al marcado, al menos los siguientes
campos: Nombre o marca comercial y direccin del fabricante,
designacin de la serie o el tipo, el nmero de serie si existe, el
ao de fabricacin, as como cualquier indicacin indispensable
para una utilizacin segura del aparato.
Ejemplos concretos de marcado segn directiva en el caso de
productos APLEI seran:

Adems del marcado segn ATEX, los aparatos y sistemas de
proteccin han de suministrarse acompaados de la Declaracin
de Conformidad CE, que es un documento emitido por el
fabricante, o por su representante legal, por el que se afirma que
un determinado aparato, sistema o componente, cumple todas las
prescripciones de la directiva o directivas aplicables.
Tambin se adjuntar con cada unidad suministrada un Manual
de Instrucciones tanto en la versin original como en el idioma del
usuario el cual incluye al menos:
Instrucciones que permitan proceder sin riesgos a la puesta en
servicio, a la utilizacin, al montaje y desmontaje, al
mantenimiento (reparacin incluida), a la instalacin y al ajuste.
Informacin relativa al marcado y a la facilitacin del
mantenimiento.

It has also to be included the distinctive mark of the equipment for
explosive atmospheres followed by the indications of Group,

Furthermore, according to the corresponding application rules, it is
carried out the marking that establishes the specific code of type
or types of protection, as it used to be done. For example: EEx ia

In addition, the following fields shall be marked as well: Name or
commercial mark and manufacturer address, the series or the
type, the reference if it exists, the year of manufacture, as well as
any necessary indication for a safe utilization of the equipment.

Besides the marking according to ATEX, the equipment and
protection systems have to be supplied enclosing the EC-
Declaration of Conformity, which is a document issued by the
manufacturer, or by its legal representative, in which it states that
a certain equipment, system or component fulfills all the
requirements of the applicable directive or directives.
Also a Instruction Manual shall be attached to every unit supplied
both in the original version and in the language of the user. This
manual includes at least:
IInstructions that allow to proceed without risks to the putting in
service, to the utilization, to the assembly and disassembly, to
the maintenance (included repair), to the installation and to the
adjustment.
Information related to the marking and to facilitate the
maintenance.

Cuando proceda, indicacin de las zonas peligrosas de alivio
de presin, las instrucciones de formacin, los detalles acerca
de la utilizacin en el lugar y en las condiciones previstas, los
parmetros elctricos y de presin, temperaturas mximas de
superficie y otros valores lmite.
Instrucciones, planos y esquemas tiles desde el punto de vista
de la seguridad.
LA DIRECTIVA 1999/92/CE (ATEX 137)
El Artculo 100A del Tratado Constitutivo de la Comunidad
Europea pretende asegurar que los productos industriales puedan
ser marcados libremente mediante el establecimiento de una serie
de requisitos esenciales que han de cumplir, y por ello las
Directivas basadas en dicho artculo, entre ellas la 94/9/CE, estn
dirigidas a los fabricantes y diseadores.
Por el contrario, el Artculo 137 tiene como propsito lograr un
ambiente de trabajo ms seguro en lo que concierne a la
prevencin de determinados riesgos a los que se pueden ver
expuestos los operarios en el lugar de trabajo, y en consecuencia
sus Directivas tienen como primer objetivo definir una base comn
para las condiciones de trabajo, estando dirigidas principalmente,
una vez traspuestas a la legislacin nacional, a los empresarios.
En el mbito especfico de las operaciones en atmsferas
potencialmente explosivas, como complemento a la ATEX 100
existe otra directiva fechada el 28.01.00, la Directiva 1999/92/CE
"Relativa a las disposiciones mnimas para la mejora de la
proteccin de la salud y la seguridad de los trabajadores
expuestos a los riesgos derivados de atmsferas explosivas". Al
estar basada en el Artculo 137, se le denomina ATEX 137 y se
traspuso el 12.06.03 a la Legislacin espaola mediante el RD
681/2003. De esta Directiva, al contrario que en la ATEX 100,
quedan excluidas las industrias extractivas, que tienen sus
directivas especficas, las 92/104/CEE y 92/91/CEE.
Los equipos y lugares de trabajo relacionados con reas en las
que puedan formarse atmsferas explosivas, y que se utilicen por
primera vez despus del 30 de junio de 2003, debern cumplir
obligatoriamente las disposiciones de esta Directiva; mientras que
aquellos que ya se hayan utilizado antes del 30 de junio de 2003
tienen un periodo transitorio de adaptacin, debiendo cumplir las
disposiciones mnimas tres aos despus de dicha fecha.
El distintivo principal que se puede considerar de la Directiva
ATEX 137 es la de establecer que el empresario propietario de la
instalacin es el responsable del mantenimiento seguro de las
instalaciones, estando obligado a tomar medidas de carcter
tcnico y/u organizativo en funcin del tipo de actividad, siguiendo
un orden de prioridades y conforme a los principios bsicos
siguientes:
impedir la formacin de atmsferas explosivas o, cuando la
naturaleza de la actividad no lo permita,

DIRECTIVE 1999/92/EC (ATEX 137)
Article 100A of the Constitutive Treaty of the European Community
tries to ensure that the industrial products may be freely marked by
means of the establishment of a series of essential requirements
that they have to fulfill. For that, the Directives based on the above
mentioned article, including 94/9/EC, are addressed to
manufacturers and designers.
On the contrary, the purpose of Article 137 is to achieve a safer
work environment regarding prevention of certain risks to which
the workpeople can be exposed in the workplace. Therefore its
Directives have as the first aim to define a common base for work
conditions, being addressed mainly, once included in the Spanish
legislation, to the businesspeople.
In the specific area of the operations in potentially explosive
atmospheres, as a complement to the ATEX 100 there is another
Directive dated 28.01.00, Directive 1999/92/EC " Relating to the
minimum conditions for the improvement of the protection of health
and safety of the workers exposed to the risks derived from
explosive atmospheres". Since it is based on Article 137, it is
called Atex 137. It was included in the Spanish legislation on
12.06.03 by means of the RD 681/2003. This Directive, unlike
ATEX 100, does not involves mining industry, that has its specific
directives, which are 92/104/EEC and 92/91/EEC.
The equipment and workplaces related to areas in which explosive
atmospheres could be formed, and that are in use for the first time
after June 30, 2003, shall have to fulfill obligatorily the
requirements of this Board. On the other hand those that already
have been in use before June 30, 2003 have a transitory period of
adjustment, although they must fulfill the minimum requirements
three years after the above mentioned date.
The main hallmark of Directive ATEX 137 is establishing that the
businessperson owner of the installation is the person in charge of
the safe maintenance of the facilities, being obliged to take
technical and / or organizational measures depending on the type
of activity, following an order of priorities and in conformity with the
following basic principles:
to prevent the formation of explosive atmospheres or, when the
nature of the activity does not allow it,

evitar la ignicin de atmsferas explosivas y
atenuar los efectos perjudiciales de una explosin de forma
que se garantice la salud y seguridad de los trabajadores.
Para ello, el empresario deber adoptar entre otras medidas:
Evaluar los riesgos de explosin.
El entorno de trabajo sea tal que este se pueda realizar de
forma segura.
Clasificar en zonas, las reas en las que pueden formarse
atmsferas explosivas, garantizando en ellas la aplicacin de
disposiciones mnimas establecidas y si procede la
sealizacin de accesos a estas reas.
Cuando en un mismo lugar de trabajo se encuentren trabajadores
de varias empresas, cada empresario ser responsable de todos
los asuntos que se encuentren bajo su control, aunque sin
perjuicio de la responsabilidad individual de cada empresario; el
empresario que tenga la responsabilidad de ese lugar de trabajo
coordinar la aplicacin de todas las medidas relativas a la
seguridad y salud de los trabajadores.
La Directiva impone al empresario la obligacin de elaborar y
mantener actualizado un documento de proteccin contra
explosiones o una serie de documentos que satisfagan los
requisitos mnimos. Este documento incluye la identificacin de
los supuestos, la evaluacin de los riesgos y la definicin de las
medidas mnimas a adoptar para garantizar la salud y seguridad
de los trabajadores.
Con la finalidad de asegurar un trabajo sin riesgo para la salud,
higiene, y seguridad de los trabajadores en instalaciones de
atmsferas explosivas, los empresarios propietarios como
mximos responsables de estos emplazamientos deben hacer
hincapi en la mentalizacin hacia la seguridad por parte del
personal que trabaja en las instalaciones, poniendo para ello a su
alcance los medios para la formacin adecuada.
Por ltimo, indicar que las directivas basadas en los artculos
100A y 137 son aproximadamente una docena fijando cada una
de ellas un nmero mayor o menor de requisitos esenciales de
seguridad, siendo de vital importancia la obligacin, tanto para
fabricantes como para usuarios, la evaluacin de los riesgos.

to attenuate the harmful effects of an explosion so that there
the health and safety of the workers are guaranteed.
For it, the businessman will have to adopt, between among other
measurements:
To evaluate the risks of explosion.
To ensure the work environment is safe enough to carry out the
work with no risk .
To classify in zones the areas in which explosive atmospheres
can be formed, guaranteeing the application of minimum
requirements and the signposting of accesses to these areas,
if applicable.
When there are workers from several companies in the same
workplace, every businessperson shall be responsible for all the
matters under their control, though without prejudice of the
individual responsibility of every businessperson. The
businessperson who is responsible for that workplace shall
coordinate the application of every measure relevant to the
workers safety and health.
The Directive imposes on the businessperson the obligation to
elaborate and keep an updated document of protection against
explosions or a series of documents that meet the minimum
requirements. This document includes the identification of the
cases, the risks evaluation and the definition of the minimum
measures to be taken to guarantee the workers health and safety.
With the purpose of ensuring a work without risk for workers
health, hygiene, and safety in facilities of explosive atmospheres,
the businesspeople owner and therefore maximum responsible for
these emplacements must emphasize the making aware of safety
on the staff that is employed at the facilities, facilitating the suitable
training.
Finally, it must be indicated that directives based on articles 100A
and 137 are approximately a dozen, fixing each of them the
essential requirements for safety, being of vital importance the
obligation, both for manufacturers and for users, of the risks
evaluation.
