Which group of worker had been declared by the Labor Code as
employees of an establishment even without establishing employee- employer relationship?
The Labor Code provides that
Female workers in nightclubs, bars, sauna, and similar establishments
with or without compensation as long as they work in that establishments be controlled by the owner then they are declared by the labor code. No need to establish the existence of the employee- employer relationship. By codal provision, the Labor Code declares them to be employees of the establishment
(Note) This provision is not applicable to male nightworkers. As to
them, it is indispensable to establish the employer-employee relationship.
2. Are domestic workers included in the coverage of the Wage Orders
that the RTWPB had issued?
No. Only those employees engaged in commercial, industrial and
agricultural. However, the Regional Wage Board can set the minimum wage for domestic workers. In fact that is a mandate by the Kasambahay Law that is should be adjusted yearly.
