PETITION

COMES NOW, the Petitioner in his capacity as the named


executor in the last will and testament of the deceased _______
before this Honorable Court, most respectfully avers the
following:

1. On _______, deceased ________ died in Quezon City, then


residing at _______________, which was his residence at
the time of his death, leaving a will, true copy of which
is attached hereto as Annex A and made an integral
part hereof.
2. That the petitioner, of legal age and resident of
_________, is the executor in said will, and hereby
consents to act as such executor.

A parcel of land (Lot 1-B-1 of the subd. plan, Psd-00-069777,


being a portion of Lot 1-B, Psd-007-405-030903-D, LRC Record
Nos. 699, 875 & 917), ), situated in Brgy. Sta. Lucia, City of San
Juan, Metro Manila, Island of Luzon. Bounded on the SE., along
line 1-2 by Lot 1-B-2 of the subd. plan; on the SW, along lines 2-
3-4-5 by Lot 22, Psu-25904; on the NW., along line 5-6 by Lot 1-A
Psd-007405-030903-D; and on the NE., along line 6-1 by Lot 3-B;

Street. Beginning at a point marked 1 on plan, being N. 34 deg.
25E., 1723.70 m. from BLLM # 1, Mandaluyong; thence s.65 deg.
28W., 20.53 m. to pt. 2; N. 28 deg. 32W., 0.26 m. to pt. 3; N. 28
deg. 32W, 3.51 m. to pt. 4; N.16 deg. 36W, 2.58 m. to pt. 5; N. 66
deg. 34E., 19.94 m. to pt. 6; S.29 deg. 20E., 5.95 m. to pt. of
beginning, containing an area of ONE HUNDRED TWENTY FOUR
SQUARE METERS AND FIFTY DECIMETERS (124.50) more or less.
All points referred to are indicated on the plan and marked on the
ground by: PS cyl. Conc. Mons. 15 x 40 cm. except pts. 5 & 6 by
Old PS and pts. 3 & 4 by Old PLS bothof cyl. Conc. Mons. 15 x 60
cm. Bearings true; date of original survey, April 8, 1920 Feb. 21,
1921 (Swo-7237); that of the subdivision survey, Jan. 12 2006;
and approved on Jan. 31, 2006.

4. That the subscribing witnesses to said will are DEXTER


B. DIMAGIBA, of legal age, single, Filipino and a resident of
Room 3. PRP Condominium, General Luna St, Quezon City;
WILMA B. FELIPE, of legal age, single, Filipino and a resident
of Room 3. PRP Condominium, General Luna St, Quezon City;
and JAYCEE D. SOMALI of legal age, single, Filipino and a
resident of Room 3. PRP Condominium, General Luna St,
Quezon City.

5. That the decedent is an inhabitant of the Philippines and


a resident of No. 08 Brgy Commonwealth, Quezon City at the
time of her his death;

6. That the petitioner, JOFRANK RIEGO, named in the will


as executor thereof, be allowed to serve without the required
bond and that the Petitioner is legally qualified, competent,
willing and ready to accept the appointment as Executor of the
last will and testament and hereby signifies her willingness to
serve and discharge her duties and responsibilities as such:

7. That the property left by the decedent consists of real and


personal property, estimated to have the gross value of FIFTY
MILLION PESOS ( Php50,000,000) more or less.

8. That the testatatrix, at the time of the execution of the


said will, was 53 years old of sound mind and disposing mind,
and not acting under duress, fraud, or undue influence and
was in evry aspect capacitated to dispose of his estate by will.

9. That the decedent JUAN RIEGO was survived by Jant


Napoles, married and Jaime Riego, single, both of leal age,
Filipinos, and residents of No. 08 Brgy Commonwealth,
Quezon City where thet can be served notices.

PRAYER
WHEREFORE, premises considered, it is most respectfully
prayed unto this Honorable Court that judgement be rendered
the following:

a. That upon proper notice,publication and hearing, the


abovementioned will of deceased JUAN RIEGO be approved,
allowed and admitted to probate;

b. That letters testamentary (or of administration) be issued


to herein petitioner, without bond;

c. That such other relief be granted as shall be deemed just


and equitable in the premises.

Court, court of Appeals or any other tribunal agency, I hereby
undertake to report that fact within five (5) days therefrom to
the court or agency wherein the original pleading and sworn
certification contemplated herein have been filed;

6. I executed this verification/certification to attest to the


truth of the foregoing facts and to comply with the provision of
Adm. Circular No. 04-94 of the Honorable Supreme Court.

executed this document while of sound mind and memory.

bottom of the last page and on the left hand margin of each
and every page, and we, in turn, at the Donors behest have
witnessed and signed the same on every page thereof, in the
