Petition for Resignation in Lieu of Discipline
and Sworn Statement Pursuant to Rule 17-209(B) NMRA
COMES NOW, Sharon Pomeranz (“Respondent”), pursuant to Rule 17-209
NMRA and swears and affirms that she admits to the truth of the allegations set
forth in the attached Specification of Charges and accompanying Exhibits A - E
attached herewith as Exhibit | and by reference made a part hereof, and that rather
than incur the costs and emotional toll of a hearing on the Specification of Charges
she wishes to resign from the practice of law.
Respondent states that she understands and agrees that:
1. She may not apply for readmission or reinstatement any sooner than three
(3) years after the resignation is effective unless otherwise ordered by the
Court;
sy 6. Moya2. She agrees that she will seek reinstatement to the practice of law pursuant to
Rule 17-214(B)(2) should she choose to once again attempt to resume the
practice of law in New Mexico and Respondent understands the allegations
of misconduct to which she has admitted may be considered in her
reinstatement proceeding. Respondent further agrees to undergo a Character
and Fitness Evaluation by the New Mexico Board of Bar Examiners at her
‘own expense prior to any application for reinstatement;
3. The Office of Disciplinary Counsel hereby recommends, and Respondent
has no objection, that she not be reinstated unless and until she provide proof
that she has:
a. Taken and passed the New Multi-Sate Professional Responsibility
examination (“MPRE”) before seeking reinstatement to the practice of
law;

Successfully completed all continuing education credit requirements
applicable to active, licensed New Mexico attorneys for each
compliance year during the applicant’s absence from practice;
c. Within 30 days of the Order accepting this application for resignation,
paid the Client Protection Fund any amounts the Fund may have paid
based on claims against Respondent; however, as of the date of this
pleading, there are no such claims pending;d. Within 30 days of the Order accepting this application for resignation,
Respondent made restitution to any clients owed funds; however, as
of the date of this pleading Respondent is unaware of any restitution
owed; and
e. Any other conditions the Supreme Court may require.
4, The application for leave to resign and the Supreme Court’s final order
disposing thereof are matters of public record and subject to publication.
Respondent also states that:
1. She understands the proposed disposition of the proceedings;
2. She understands that if this resignation is accepted, she is waiving the right
to a hearing before a hearing committee, the Disciplinary Board and/or the
New Mexico Supreme Court, but that if this resignation is not accepted, the
admissions contained herein may not be used against her in any subsequent
proceeding;
3, She agrees that this proffered resignation and Sworn Statement are voluntary
and not the result of force, threats, or promises (other than those noted
herein); and
4, She has had the opportunity to confer with an attorney about this matter, or
has been given the opportunity to do so, and is satisfied with any advice she
has received.WHEREFORE, Respondent wishes to resign from the practice of law in
‘New Mexico pursuant to Rule 17-209 NMRA.
