OFFER OF TESTIMONY; PURPOSE

Petitioners, thru counsel, respectfully offers the testimony of Tasyo Mananabas to

prove the allegations in the petition, particularly for the encroachment made by the

defendants:

1. To prove that he is the utility personnel authorized by Diego Yayamanin y

Galante to clean his land

2. To prove that the Spouses Eladio Gahaman y sagdat and Corazon Gahaman y

aswang , and contructor Pongkoy Mapanira encroached and occupied the land of

petitioner.

3. To prove other matters relevant to the petition and to identify documents related

to the petition.
 JUDICIAL AFFIDAVIT OF Tasyo Mananabas

I, Tasyo mananabas, hereby declare in this JUDICIAL AFFIDAVIT, the following:

(a) My name is Mr. tasyo mananabas Filipino, married, with residence address
at 69 J.P, Rizal St. Brgy. Acacia, Catarman N. Samar

(b) Atty. Dean Destura and Atty. Dadet* (edit nalang) conducted the
examination or questioning;

(c) In answering the questions asked of me, I was fully conscious that I was
doing so under oath, and that I may face criminal liability for false
testimony or perjury; and

(d) The questions asked of me and corresponding answers are herein

consecutively number, to wit:

1) QUESTION: Please state your name, age, occupation and other personal
circumstances.

ANSWER: I am tasyo mananabas, 24 years old married, professional utility

personnel, with residential postal address at 69 J.P, Rizal St. Brgy.
Acacia, Catarman N. Samar

2) QUESTION: You made mention that you are professional utility personnel?

ANSWER: Yes.

3) QUESTION: As a professional utility personnel, what do you do?

ANSWER: My profession is focused on cleaning jobs. From land cleaning to

house cleaning.

3) QUESTION: How do you know the petitioner?

ANSWER: I do not know the petitioner personally but I know as the owner of
land, Mr. Sumbongero hired my services to clean to.

4) QUESTION: When did start cleaning the land?

ANSWER: 1994, Mr. Ignancio Sumbongero hired me to clean the land.

5) QUESTION: How often you are hired to clean the land?

ANSWER: Every two years, I am being hired and paid by Ignacio Sumbongero.

6) QUESTION: When was your last job cleaning the land?

ANSWER: Around August 2016

7) QUESTION: Did you notice something peculiar about the land?

ANSWER: Yes.

8) QUESTION: What are these?

ANSWER: I observe that the land seems smaller than when I was cleaning it
before and a new building is being constructed in the neighboring
land.

8) QUESTION: Did you tell Mr. Sumbengero of your observation?

ANSWER: yes.

EXPLANATION
