Census Act, 2009

Whereas, it is expedient to enact some laws to conduct Census, the


following Adiniyams are being enacted-
1. This Act shall be called the Census Act, 2009.
2. The Government may, if it finds necessary and appropriate, make
public its intent to conduct Census all over the country or any part of
it, and thereafter, the task of Census shall be commenced.
3. (a) An officer appointed by the line (Taluk) Ministry shall
supervise (Dekhrekh) all activities relating to Census;
(b) The officer designated for an area (Ilaka) to conduct the
activities of Census shall perform the task of Census in the
areas so divided for the purpose of Census; and there shall be
an assistant officer to help the officer.
(c) The Inspector appointed in each local unit within an area shall
supervise the activities of Census.
4. Each officer, assistant officer or inspector, in his /her area, may issue
written order to all of the-
(a) Thari, Mukhia, Patawari and Jimmawal (local heads)
(b) Jamindar (Landlord) and Raiti (Tenant)
(c) Members of local Panchayat
(d) Employees of Mill, Factory, Karkhana, Hotel, School etc. in
relation to the task of Census and such persons shall extend
their necessary help in conducting the task of Census following
such an order.

5. The inspector of the local unit shall appoint those persons who shall
really take Census and such appointees shall be called the enumerator
(Ganak)
6. (a) Each Census officer may ask necessary questions to the persons
who come under his/her jurisdiction. Government shall publish
the list of such questions in the Gazette.
(b) Every one, who is asked such questions, shall answer correctly
as far he/she knows it.
Provided that, no one shall be compelled to take the name
of his wife or husband or whose name is not taken by them.
One who can write may give such name in writing.
7. (a) No news (information) received in the course of Census shall
be used for any other purpose. No one, except the employees
involved in the process of census, shall be entitled to see the
list, inventory (Lagat) or register prepared in the course of
census.
(b) No information (matter) written in the census list, inventory or
register shall be produced as an evidence in a law suit before
any court except in a case filed pursuant to this Act.
8. (a) Every enumerator (Ganak) or any other person who denies to
follow the order issued pursuant this Act or who does not show
due care (Sabdhani) or promptness (Tatparata); or
(b) Every enumerator (Ganak) who knowingly asks improper or
objectionable (aapatijank) question, or knowingly writes false
answer or makes public any information received in the course
of census without the approval of the Government; or

(c) If, any employee engaged in the task of census, destroys or


conceals or harms any document relating to census or uses such
document in such a manner that it may lead to a false result; or
(d) If, anyone denies to answer any question which is mandatory to
answer pursuant to Section 6 of this Act or does not answer
correctly as far he/she knows; or
(e) If, a person joins to the post of census officer through any
illegal means, such a person shall be liable for a fine up to Two
Hundred Rupees and he/she shall be liable for an imprisonment
of One month, in addition to such fine, if he/she found guilty
for violating Sub-sections (Clauses) (b) and (c).
9. (a) If a person publishes any matter not to help in the function of
census or causes any obstacle in this regard; or
(b) If an inspector, in his/her local unit, does not show promptness
(Tatparta) or shows negligence (asaabdhani) in abiding by the
order issued in the course of census, such a person shall be
liable for a fine up to Four Hundred Rupees or an imprisonment
up to Two months or the both.
10. The government, if so required, may frame necessary Rules to meet
the objectives of this Act.
