KATIPUNAN v.

TENORIO

FACTS:
Petitioner Katipunan asked for the annulment of his marriage with respondent herein, Tenorio
Katipunan insists that his wife was not of sound mind when he married her
He testified that they were both living peacefully as husband and wife from 1919 until the year
she exhibited insanity in 1926
Katipunan said that she was normal during the marriage and that she did not show any signs of
insanity during the celebration
It was only days after the marriage that he noticed the apparent insanity
He also stated that she was confined in a psychiatric hospital
The trial court dismissed the complaint by the petitioner

ISSUE: Whether or not the marriage should be annulled due to insanity

HELD:
NO
The Court of Appeals ruled that the marriage should not be annulled.
According to law, insanity of one of the spouses which occurred after the celebration
cannot constitute a case of nullity
It must be noted that the petitioner himself testified that he only noticed the alleged insanity
AFTER the marriage
He said that he did not notice anything out of the ordinary before and during the celebration of the
marriage
Moreover, he failed to provide substantial evidence supporting his claims

PETITION DISMISSED
