Committee on Human Settlements & Land Use
The Committee Hearing was conducted on August 29, 2017 at 9:00 in the morning in
the Session Hall of the Sangguniang Barangay of Libertad, Butuan City.
The referred matter was the request of Mr. Victor S. Uy, President/General Manager of
VCDU Realty Corporation for a Barangay Resolution interposing on objection to their
proposed projects, namely: (A) Northtown II Subdivision and (B) VCDU Riverdale
Village, all located in Barangay Libertad.

Upon inquiry by the committee chairman and the vice chairman, Mrs. Villanueva
declared that she is validly authorized to represent the VCDU Realty Corporation
(Corporation for brevity) per two (2) Board Resolutions all dated April 11, 2016 duly
signed by Cindy Y. Uy, Corporate Secretary. These two (2) Board Resolutions are
found in the compilations which were attached to the letter-request to the Hon. Punong
Barangay, Bernard S. Encarnado, which was received on June 23, 2017.
In the same vein, Mrs. Villanueva averred that the corporation is asking the
Sangguniang Barangay Office for a resolution of Obligation to its proposed projects, the
VCDU Northtown II Subdivision and the VCDU Riverdale Village because the said
resolution is one of the prerequisites for the simultaneous application for Preliminary
Subdivision Development Permit (PSDP) and Subdivision Development Permit (SOP).
The chairman informed Mrs. Villanueva that as a precedent for the insurance of a
Resolution of No Objection by the SB, a public hearing, right on the proposed project
will be conducted by the committee concerned so that the populace of the adjoining lots
will be informed about the proposed undertaking.
Upon motion of the Hon. Urcesio C. Tobias duly seconded by the Hon. Rosilo V.
Cuenca, the public hearing is set on September 12, 2017 as follows: 9:00 oclock in the
morning at VCDU Northtown II Subdivision and at 3:00 oclock p.m. at VCDU Riverdale
Village.
A careful perusal of the zoning certification for Northtown II Subdivision and the
VCDU Riverdale Village from the Office of the City Planning & Development
Coordinator and the zoning certification for Northtown II Subdivision and the VCDU
Riverdale Village from the Office of the Housing & Land Use Regulatory Board which
were submitted on August 30, 2017, reveal that as far as Northtown II Subdivision is
concerned, the Corporation was already issued Zoning Certifications by the Office of the
City Planning & Development Coordinator, Butuan City on July 7, 2017, and the
Housing and Land Use Regulatory Board, Northern Mindanao Region, Cagayan de Oro
City on July 05, 2017. However, as far as Riverdale Village is concerned, the
Corporation has relied solely on the Zoning Certification issued by the Office of the City
Planning & Developing Coordinator, Butuan City, dated July 4, 2013 and the Zoning
Certification issued by the Housing and Land Use Regulatory Board, Northern
Mindanao, dated 2nd day of November 2016, Cagayan de Oro City. In Zoning
Certification issued by the former office, the name of the owner is Leonila Cambray
while in the Zoning Certification issued by the latter office, the name of the registered
owner is Antonietta Baldo Aguit. The title of the land covered by the certification issued
to Leonila Cambray is portion of TCT No. T-14665 with an area of 20,731 square
meters while the title of the land covered by the certification issued to Antonietta Baldo
Aguit is TCT No. 157-2013001075 containing an area per zoning certification, however,
both lots are within residential zone. It should be borne in mind that the proposed
project named VCDU Riverdale Village has consolidated areas of 19, 531 square meter
only while the lot mentioned in the certifications issued to Leonila Cambray and
Antonietta Baldo Aguit is 20,731 square meters and 2.0731 square meters respectively.
It has a difference of 1,200 square meters.
