1. If a member is cited, involved in conduct which results in a police response, or is considered a
suspect involving criminal conduct, the involved member shall notify his or her commanding officer in
writing as soon as practicable, but in no case later than the next business day.

2. When a member has negative contact with any other law enforcement agency while off-duty involving
criminal conduct or is cited for a moving violation, the involved member shall notify their immediate
supervisor by verbal communication no later than the members next work day.

G. Whenever an officer finds him or herself involved in any of the following incidents while in an off-duty

I. PURPOSE (Page 1)
A. The purpose of this directive is to set forth the policies and procedures of the East Haven Police
Department regarding properly fulfilling the reporting and testimonial requirements mandated under U.S.
Supreme Court decisions including Brady v. Maryland 373 U.S. 83 (1963) and Giglio v. U.S. 405 U.S.
150 (1972) and their progeny.

V. PROCEDURES (Page2)
A. Affirmative Duty to Report
1. This department shall exercise due diligence to ensure that material of possible Brady relevance is
made available to the States Attorneys Office.

2. The Department shall track and maintain records of all officers who have been determined to have
been deceptive or untruthful in any legal proceeding, Internal Affairs investigation, or other
investigation. EHPD shall make these records available to prosecutors.

6. Officers whose history regarding integrity, honesty, credibility, veracity, and related matters that
has negative bearing on their professional reputation may be subject to Brady disclosure
requirements.

8. Examples of Brady material that may be subject to disclosure by this Department include, but may not

Meriden Police Department (MPD).

On June 7, 2017, Deputy Chief Naccarato ordered me to conduct an Internal Affairs Investigation.

ACTION TAKEN

On June 7, 2017, I reviewed Lieutenant Montagna's DR report. Lieutenant Montagna wrote the following DR.

On 06/07/2017 while working as shift commander on the evening shift at approximately 2340 hrs I received a
phone call from notifying me that she was getting and that a
Lieutenant from Meriden PD will be calling. A short time later I received a phone call from Lt Delmastro from the
Meriden PD informing me that and two others at the residence were being for
disorderly conduct under family violence. He informed me that her weapons are here at the East Haven Police
Department due to the fact she is on military leave. I then notified my superiors of this information.

turned over three firearms. Two issued duty weapons and one personal off duty pistol which was a Keltec 9mm
pistol. stated that is all the firearms she has access too. Upon checking the CT weapons data
base it was discovered that her and her ex-boyfriend who was also a police officer and not involved in this
incident had bought the same exact gun approximately two months apart back in 2002. Some time ago when
they were together the guns were accidentally switched and each other wound up with the others without
knowing such. The next morning Detective DeCrosta made contact with her ex-boyfriend and it was learned he
had possession of the firearm and that he was unaware that they had accidentally been switched. This error
was corrected and the firearms were exchanged. All three guns were accounted for and logged into the
evidence room. No others were registered to My superiors are aware of the situation and said

Affairs Officer for East Haven Police Department (EHPD) and that I was conducting an official inquiry to the
facts. Sergeant Fry advised me that due to the off duty , that I could request any and all
reports and Axon body camera videos for an administrative investigation. I advised Sergeant Fry that I would
make an appointment to speak with him and Lieutenant Delmastro who made I was provided a copy
of Lieutenant Delmastro's initial report which confirmed being June 6,
2017 for the above listed

On June 7, 2017, I conducted a records check via COLLECT/NCIC to ascertain the conditions of release (File
20 orders) issued by MPD for (CT message #7163502) and (CT Message
#7163515). Both and had the same conditions issued to them. Both orders were no contact
and listed the following in the miscellaneous field (CT 01, CT 03, CT 05, Do not use or possess a dangerous
weapon, intoxicant or controlled substance).
CT01 - Do not assault, threaten, abuse, harass, follow, interfere with, or stalk the protected person.
CT03 - Stay away from the home of the protected person and wherever the protected person shall reside.
CT05 - Refrain from having any contact in any manner with the Protected Person.
Both orders had an expiration date of June 7, 2017 which was the date of their schedued court appearance.

Upon conducting the COLLECT/NCIC records check, it was revealed that had an entry in the
State Police Records Check (SPRC)/ State Police Suspension Check (SPSC) computer database. The

On the night of June 6, 2017, Lieutenant Montagna seized Department issued guns and personal gun
for safekeeping due to her domestic violence Lieutenant Montagna learned that
owned the same type of personal handgun while entering the serial number into COLLECT/NCIC and it
appears that somehow they accidentally had switched them at one time. On June 7, 2017, I spoke with
and I advised him we had his handgun and I made arrangments to meet with him. Sergeant DeCrosta
and I met with in Meriden, CT. I then exchanged handgun, which was a KelTec 9 mm
handgun model #P11 with serial number and he signed the property form. I then took possession of
KelTec 9mm handgun model #P11 with serial number and it was later placed into the EHPD
property room for safe keeping.

On June 7, 2017, at approximately 1805 hours, I was able to view the File 20 Protective Orders via
COLLECT/NCIC. The two orders were issued to and by GA #7-Meriden, CT.

was issued a protective order as the subject with CT message #7164201 and
as the protectee. This order did not list an expiration date. The order indicated that had to
adhere to the following conditions:
CT01 - Do not assault, threaten, abuse, harass, follow, interfere with, or stalk the protected person.
CT03 - Stay away from the home of the protected person and wherever the protected person shall reside.
CT14 - Respondent may return to the protecteed person's home one time with police to retrieve belongings.
CT15 - If the protected person has moved out of the home of the respondent, the respondent shall permit the
protected person to return to the respondent's home on one occasion, with police, to retrieve the protected
person's belongings.

On June 11, 2017 at 0617 hours, Captain Cossette of the MPD called the EHPD and spoke with Lieutenant
Murgo who was the on duty shift commander. Captain Cossette notifed Lieutenant Murgo that

On June 11, 2017 at 0621 hours, Deputy Chief Naccarato was advised by Lieutenant Murgo that he received a
phone call from MPD that w

On June 11, 2017, Lieutenant Murgo completed a DR report #1700000491 regarding notification from MPD
that was on June 11, 2017.

On 06/11/2017 at approximately 0600 hours, I received a phone call from Meriden Police Department
Lieutenant Cossette. Lt. Cossette advised me that was currently in their custody for
a Protective Order Violation He stated that they went to earlier in the night for a domestic
dispute regarding her sons but found and together, which is a violation of the
protective order that is currently in place from a previous domestic Lt. Cossette advised me that this
was just a courtesy call because of her employment with this agency.

On June 13, 2017, I made contact with Sergeant Fry of MPD and I asked him if I could make an appointment to
review any material and videos regarding both of Sergeant Fry advised me that due
to scheduling conflicts, vacations, and training that I would have to find a day to meet with Sergeant John
Mennone, who was in charge of the Axon body worn camera videos.

Sergeant Fry also advised me that after speaking with Lieutenant DelMastro, who was the supervisor who
made the first on June 6, 2017, he received information that an officer was struck by
while separating the parties involved. Sergeant Fry stated that I would have to speak with Lieutenant
Delmastro to gather further details.

On June 13, 2017, at approximately 1126 hours, I was able to view the File 20 Protective Orders via
COLLECT/NCIC. The order was issued to by GA #7-Meriden, CT.

adhere to the following conditions:
CT01 - Do not assault, threaten, abuse, harass, follow, interfere with, or stalk the protected person.

CT05 - Do not contact the protected person in any manner, including by written, electronic or telephone
contact, and do not contact the protected person's home, workplace or others with whom the contact would be
likely to cause annoyance or alarm to the protected person.
CT14 - Respondent may return to the protecteed person's home one time with police to retrieve belongings.
CT15 - If the protected person has moved out of the home of the respondent, the respondent shall permit the
protected person to return to the respondent's home on one occasion, with police, to retrieve the protected
person's belongings.

On June 14, 2017, Deputy Chief Naccarato completed a letter to for unpaid leave of absence
due to her two recent . In the letter, Deputy Chief Naccarato wrote that because you

unpaid leave of absence effective upon receipt and execution of the letter. You are to notify the Department
immediately in writing if there are any changes or modifications in your court proceedings. This shall not be
considered to be discipline in any way, shape or form; it is merely placing you on unpaid status because you
are unable to perform your job functions. Deputy Chief Naccarato provided a written notice of
such on Department letterhead. Both Deputy Chief Naccarato and signed this letter on June
14, 2017.

On June 14, 2017, I spoke with Sergeant Herget of MPD who was the acting Lieutenant on June 11, 2017.
Sergeant Herget stated that he was the supervisor that made the of who was in
violation of the protective order. Sergeant Herget stated that while on scene the COLLECT/NCIC system went
down so he was unable to confirm that also had an active protective order at the time of the incident.
Sergeant Herget stated that nobody on scene, including had advised him that
also had a protective order. Sergeant Herget stated that he advised Captain Cossette to notify a supervisor at
EHPD due to an off duty officer being . Captain Cossette spoke with Lieutenant Murgo and explained
that

Sergeant Herget informed me that on a later date he was able to confirm through COLLECT/NCIC that
was in fact in violation of his protective order on June 11, 2017. Sergeant Herget informed me that he
would be .

On June 16, 2017, I was able to review both reports by MPD that were in the LinX database.

For the on June 6, 2017, I read MPD report case #17-004301 which was written by Lieutenant
Delmastro. The report indicated that upon his arrival at that he could hear yelling coming
from within the residence. Lieutenant Delmastro and Officer Vazquez heard a female who was identified as
yelling at . Lieutenant Delmastro wrote that as he was escorting the male
from the bedroom, spit on him. For the full incident report, see Exhibit #A.

In a supplemental report case #17-004301 written by Officer Ficara, he also writes that spit on
while escorting him from the bedroom. For the full incident report, see Exhibit #A.

In a supplemental report case #17-004301 written by Officer Vazquez he writes that he tries to separate the
parties involved in a dispute and then when he tries to remove she slapped Officer Vazquez's inner

right elbow causing his skin to turn red and stings. then pointed at Officer Vazquez's face and stated,
"Don't you touch me!" Officer Vazquez then wrote that as was being escorted out of the room,
spit on . Officer Vazquez also wrote that when the parties were separated he stayed with .
Officer Vazquez wrote that had the odor of alcohol emanating from her person and stated she
only had one drink of wine after her military duty. For the full incident report, see Exhibit #A.

For the on June 11, 2017, I read MPD case #17-004419 written by Sergeant Herget. MPD was
dispatched to the residence for the report of a dispute. In the report written by Sergeant Herget, he writes that
he had two of sons for having a domestic dispute that was physical. Sergeant Herget writes
that he was able to verify with Captain Cossette that was in violation of her protective order.
Sergeant Herget advised of the violation and he informed her that she . For

On June 16, 2017, I met with Sergeant Chris Fry and Sergeant John Mennone who are both assigned with
MPD Internal Affairs Unit. After speaking with Segeant Mennone he stated that he had nine (9) Axon body
camera videos from both involving Sergeant Mennone stated that one of the videos was
concerning due to demeanor and actions as an off duty police officer and that he wanted me to view it
with him. In the video, which was later confirmed to be from Officer Ficara's Axon body camera you can see
three (3) adults ( and son with four (4) MPD officers attempting to separate
and control the situation. is heard and seen yelling at MPD officers and she states, "Don't push me.
Don't touch me. I'm not gonna go outside, I got no clothes on are you serious. I'm a cop. I'm a cop. He's gonna
go. He's gonna go. No, listen this my house. Disrespect me. He's gonna go, No, Listen this is my house, he's
gonna go, he's gonna go, this bitch ass marine nigger gonna go real quick. You want me coming outside with
no underwears on. Fuck you bitch ass. He did this." You can also hear spitting. later confirms
in the video that she has been married for one year and states that is her husband. also
states in the video that the argument became physical but that she only shoved Sergeant Mennone
later provided me with copies of the videos. (Exhibit #C)

I then informed Sergeant Fry that I would like to speak with Lieutenant Delmastro and Sergeant Herget
regarding these incidents. Sergeant Fry advised me that due to scheduling and vacations that I would have call
him and find a date that would be available for both supervisors to meet with me.

On June 16, 2017, I reviewed some of the Axon body camera videos provided by MPD.

no underwears on. Fuck you bitch ass. He did this." You can hear spit and when she backs up, you can
see saliva on her lip/chin.

In Officer Vazquez's Axon body camera video it shows being confrontational and physical with MPD
officers. is seen swinging her left arm/hand at Officer Vazquez three (3) times and you can hear a
smacking sound two (2) times. When Officer Vazquez is in the kitchen with he states to her,"You got
me good" and states, "I'm sorry cause I have like these fake nails."

In one of Officer Ficara's Axon body camera videos, is heard stating, "We've known each other for
years and we got married in August. He's my husband." In one of Officer Ficara's Axon body camera videos,
states, "My wife been running around with her baby's father lying to me."

On July 17, 2017, I called Superior Court GA #7 in Meriden, CT. I was advised that State's Attorney Jim
Turquote Due to being granted a
she was advised in writing by Deputy Chief Nacarrato that she could return for duty, due to the protective
orders being lifted.

On July 18, 2017, a written notice was completed by Chief Lennon on Department letterhead. The purpose of
this letter was for to return to duty since her court cases were nolled in Meriden Superior
Court and the protective orders were cancelled. Further, due to two , she was advised by Chief
Lennon that she was still the subject of an internal affairs investigation to determine if any policies or
procedures of the Department were violated. This letter was hand delivered to by Captain
Slane on July 31, 2017 and they both signed it.

On August 1, 2017, I was able to confirm an appointment to speak with Sergeant Herget on August 8, 2017
and I was told that Lieutenant Delmastro may be available that day as well.

On August 2, 2017, I completed a Notice to Personnel letter on department letterhead informing


that she was the subject of an internal affairs investigation due to her off duty conduct involving two
incidents in Meriden, CT on June 6, 2017 and June 11, 2017. The letter indicated that was

ordered to report to my office on August 11, 2017 at approximately 0900 hours for an investigative interview.
This letter was sealed and hand-delivered to by me on August 2, 2017.

On August 8, 2017, I met with Lieutenant Delmastro and Sergeant Herget at MPD. Prior to the interview,
Lieutenant Delmastro stated that he was surprised that cases were nolled so fast. Lieutenant
Delmastro also stated that he couldn't believe behavior when she spit on . Lieutenant
Delmastro was concerned after he received information a few days later that one of his officer's was struck by
on the June 6, 2017 incident. Lieutenant Delmastro stated upon hearing of this information he walked
the supplemental report over to GA #7 and he requested the prosecutor's office to add additional charges to
Sergeant Herget stated that he was notified from the GA #7 that the warrant he applied for on
was denied by the court. I then explained to both Lieutenant Delmastro and Sergeant Herget that I
would like to audio record interviews with them and they both agreed.

The audio recorded interview with Lieutenant Delmastro began at 1220 hours on August 8, 2017. A copy of the
entire interview transcript is enclosed with the case file (See Exhibit #D). The pertinent questions and answers

DELMASTRO: Uh, we obtained a written statement from the male concerning the incident that took place that
night. I believe her, uh, two sons were there and maybe her uncle. And then she, uh, the female did not give a
statement, but told us, uh, part of what happened.

DELMASTRO: I believe it's in my report.

BROCKETT: All right. From, uh, from the report, there was other officers in there that gave supplemental
reports, uh, from the investigation. When did you find out about one of your officers being struck?

DELMASTRO: I believe the next day.

department policy, uh, anytime a, an officer from another department is involved, uh, we are required to
respond. Uh, in this case we had prior knowledge through a recent that there was an East Haven
uh, living at the residence, so I responded.

BROCKETT: Okay. And when you arrived, uh, what did you ascertain on scene?

HERGET: Uh, when I arrived, I met with the officers. We approached, uh, and, uh, were met outside by a,
uncle who resided in the residence. Uh, we could hear loud screaming, yelling from, uh, male and female
voices, uh, from the opposite side of the home. He gave us permission to enter, at which point we, uh, made
entrance at the basement or rear.

BROCKETT: Okay. And, uh, what were your findings on scene?

HERGET: Uh, when we made our way into the house, we went up through the kitchen. In a back bedroom, uh,
we could hear several parties, uh, yelling and screaming. We asked the parties to come out and, uh, we
identified them, uh, individually.

BROCKETT: Okay. And when was it known to you that, uh, there was an officer involved in this incident?

HERGET: I did not have knowledge of if it was a male or female detective at that point, I don't believe. Uh, one
of the officers, uh, I believe Officer Carr had been to the residence prior and was familiar with

HERGET: Uh, when we ran the parties, uh, NCIC was down, uh, for a short time. When it came back up, uh,
we ran the parties, uh, there was that third order that was found for an Uh, when, when I
learned of this incident or the file later, I did file a warrant for for also, a violation for the incident.

BROCKETT: Okay. And did you make any that night?

HERGET: I made two that night.

BROCKETT: And who, who was

HERGET: Uh, and were both

BROCKETT: Okay. And what was for?

HERGET: Uh, I want to sayactually, there was a third I made as well. I'm sorry. Uh, there's another
son. Uh, violation of protective order and maybe disorderly, to my recollection.

HERGET: Uh, she did not agree with me. She felt that that was her home and that she couldn't be in violation
in her own home. I explained to her that it was clear to me that was s-, not only, uh, staying there but
sleeping there and was there in violation of that order, um, that she was in violation of that order. Um, she then
requested that and I advised her that we were gonna make an uh, and, uh, she still couldn't believe that
or understand that, so then she requested that I do that through a misdemeanor

BROCKETT: Okay. And what did you do after that?

HERGET: Uh, because it was a felony, uh, we allowed her to, uh, get some clothes on and, uh, we took her
into custody, double, double lock handcuffs behind her back, and escorted her to a cruiser.

BROCKETT: All right. And after she was brought to the station, uh, was she held on a bond or booked, uh

I obtained information from MPD that had being actively deployed by the US Armed Forces out of
state and he was unavailable for an interview.

On August 11, 2017, I asked Sergeant DeCrosta if had contacted him when she was
on June 6, 2017. Detective DeCrosta stated that he received a text from on night of June 6,
2017 and that she wrote, "I'm in a pickle and then a crying emoji face." Sergeant DeCrosta texted
back and he asked her what was wrong. Sergeant Decrosta stated that he also texted
that he couldn't talk, so he knew of no other details as to what was wrong. Sergeant DeCrosta stated he knew
of the next day (June 7, 2017) when she called him.

On August 11, 2017, I sent a Department e-mail to all supervisors regarding if made any
notification via phone call, writing, or e-mail that she was on June 11, 2017. I did not receive a
confirmation from any EHPD supervisor that made a notification of her in Meriden, CT
on June 11, 2017.

On August 16, 2017 at 1130 hours, I was able to make contact via telephone with Master Sergeant Michael
Gregory of the Criminal Investigations Division (CID) at Camp Pendleton in California. I asked Master Sergeant
Gregory if was currently assigned at Camp Pendleton. Master Sergeant Gregory confirmed
that was presently assigned at the base. I then asked Master Sergeant Gregory if he could confirm
that was married to a as I explained to him that I was curently conducting an
investigation. Master Sergeant Gregory then wrote me an e-mail of his findings.

On August 17, 2017 at approximately 1441 hours, I spoke with Master Sergeant Gregory via telephone. MS
Gregory advised me that the marriage license of and was confirmed and dated by the
Installation Administrator, which is a form of Human Resoursces and that a copy maybe obtainable from this
office. MS Gregory then advised me that he would attempt to gather this document for my investigation.

CONCLUSION

Based on the facts and circumstances gathered and the interview with Officer statements,
police reports, videos, and my investigation, it has revealed that has violated four (4)
Department policies. In addition, was untruthful with her statements to me during her audio
recorded interview on August 11, 2017 and it was contradictory to the evidence obtained regarding this
investigation.

Policies and Procedures No. 211.3 -- Off-Duty Powers and Responsibilities (Exhibit #J). A check in Power DMS
revealed that this policy was signed by on May 6, 2016 at 0736 hours.

Policies and Procedures No. 214.2 -- Brady Disclosures (Exhibit #K). A check in Power DMS revealed that this
policy was signed by on August 30, 2014 at 0928 hours.

On June 11, 2017, was by MPD for Violation of a Protective Order. Upon being
released from custody, did not notify her immediate supervisor, which is Sergeant DeCrosta,
verbally or in writing that she had been In fact, did not notify any EHPD supervisor
that she had been on June 11, 2017. In the audio recorded interview on August 11, 2017
was asked if she ever notified a supervisor about the that occurred in Meriden, CT on June 11,
2017 and stated, "I believe I did" and I asked, "Do you know who it was?" and
stated, "No it was hectic, so no." However, on June 7, 2017 at approximately 2340 hours,
called Lieutenant Montagna who was the shift commander and she advises him that she was being
in Meriden and that a MPD supervisor would also be calling him. Although notified
Lieutenant Montagna of her June 7, 2017 she failed to notify any EHPD supervisor of her second
on June 11, 2017.

In an audio recorded interview on August 11, 2017 with I asked her, "Did you make any
racial or derogatory comments towards your husband?" and stated, "No." However, in Officer
Vazquez's Axon body camera footage provided by MPD on June 6, 2017, is heard stating,
"Get him out. Get that motherfucker out. go. go. Don't push me. Don't touch me. I'm not gonna
go outside, I got no clothes on are you serious. I'm a cop. I'm a cop. He's gonna go, No, Listen this is my
house. Direspect me. He's gonna go, he's gonna go, this bitch ass marine nigger gonna go real quick. You
want me coming outside with no underwears on. Fuck you bitch ass. He did this." made a
derogatory comment by calling "A bitch ass marine nigger."

During the audio recorded interview on August 11, 2017, I asked if she struck or hit a Meriden
officer while being separated and she stated, "No." However, Officer Vazquez wrote a supplemental reporting
indicating that he was slapped by which caused his skin to turn red and sting. When Lieutenant
Delmastro heard of his officer being struck by he instructed Officer Vazquez to complete his report and
Lieutenant Delmastro advised the prosecutor's office of the incident. In Officer Vazquez's Axon body camera

video it shows swinging her left arm/hand at Officer Vazquez three (3) times and you can hear a
smacking sound two (2) times. When Officer Vazquez is in the kitchen with he states to her,"You got
me good" and states, "I'm sorry cause I have like these fake nails."

When I asked if she had argued or yelled at the officers, stated, "No."
However, in Officer Vazquez's and several other MPD officers Axon body camera video provided by MPD,
is heard yelling at the Meriden officers and being confrontational and physical.

and both confirmed that they were married during interviews on scene with MPD
officers. In one of Officer Ficara's Axon body camera videos, is heard stating, "We've known each other
for years and we got married in August. He's my husband." In one of Officer Ficara's Axon body camera videos,
states, "My wife been running around with her baby's father lying to me." In Lieutenant Delmastro's
written report he indicates that both and are married from written statement. In a
supplemental report written by Officer Pellegrini, he writes that he completed a LAP assessment and the
suspect was the victim's wife. In addition, provided a written statement to MPD and had indicated that
he and have been married for a year. During audio recorded interview on August
11, 2017, I asked if she made any racial or derogatory comments towards her husband, she
stated, "No." Union Representative Ron Suraci asked to take a recess with The audio
recording was paused/stopped for the recess.

Upon coming back into my office after a few moments from the recess, the audio recording was activated. It
should be noted that up until this point in the investigation, there has been no dispute of fact that and
were married at the time of on June 6, 2017 and June 11, 2017. However, when
Union Representative Suraci went back on the record he stated, "We had a couple of points we wanted to
clarify." Union Representative Suraci stated that the person that got into a dispute with was
not her husband. states, "Yeah" which indicates that she agrees with Union Representative
Suraci's statement that is not her husband. In addition, on August 16, 2017, Master Sergeant Gregory
of CID at Camp Pendleton in California confirms that both and have been married since
August 11, 2016 and is listed as the only dependent under

odor of alcohol emanating from her person. stated she only had one drink of wine after her military duty
while sitting at the kitchen table. This was also confirmed on Officer Vazquez's Axon body camera video.
Additionally, on Lieutenant Delmastro's Axon body camera, states, "She's not going to calm down
because when she drinks she starts lying."

This investigation is being forwarded to Chief Lennon for review.
