(Consumer Product Safety Improvement Act, CPSIA)

On 14 August, 2008 President Bush signed into law the Consumer Product Safety Improvement Act (H.R.
4040). This legislation forms part of a comprehensive effort by the U.S. government to enhance the safety of
imported consumer goods.
Goals:
The legislation provides greater authority to the CPSC to prevent the entry of unsafe products into the
United States.
The CPSC will have the authority to prohibit exports from the U.S. of any consumer product that does
not conform to a consumer product safety standard under the Consumer Product Safety Act.
Penalties:
Civil penalties for violations of the CPSA, the Federal Hazardous Substances Act and the Flammable
Fabrics Act will be increased to a maximum of US$100,000 per individual violation (up from US$5,000),
with a US$15 million cap (up from US$1.25 million).
Scope:
The current lead content standard for surface paint in furniture, toys and other children's products will be
reduced from a maximum of 0.06 percent lead by weight to a maximum of 0.009 percent lead by weight,
effective one year after the date of enactment of the legislation.

The sale, distribution and importation of children's toys and childcare articles containing specific
phthalates in concentrations exceeding 0.1 percent will be banned. Effective within 180 days after
enactment of the legislation.

Section 102 of CPSIA also imposes third-party testing requirements for all consumer products primarily
intended for children 12 years of age or younger. SGS Taipei Laboratory has received accreditation from the
U.S. Consumer Product Safety Commission to test children's products for the presence of lead in paint and
surface coatings in accordance with the Consumer Product Safety Improvement Act (CPSIA) of 2008. Also
