ISSUE(S)/PURPOSE:
Toconsideraroadclosure,inresponsetoarequestfrom3adjacentpropertyowners,topurchaseaportionofthe
propertyidentifiedastheGableRoadendfromtheDistrictofLakeCountry,forfairmarketvalue.

RECOMMENDATION(S):
THATRoadClosureandRemovalofHighwayDedicationBylaw(GableRoadEnd)1031,2017bereadafirst,second
andthirdtime.

EXECUTIVESUMMARY:
Thisreportrepresentsamultidepartmentaleffortandwaswrittenbyvariousdepartments.Thisisthereason
thereportissubmittedbytheChiefAdministrativeOfficer.
The 3 adjacent property owners have expressed an interest in the property in question, making them upland
propertyownersandgrantingthemriparianrights.
Council has directed staff to negotiate the land sale with the interested property owners and prepare the
attachedRoadClosureBylaw.
Public access to water will be preserved at both Gable Road End and Toby Road End as only a portion of the
GableRoadrightofwaythathasbeenunmaintainedisbeingproposedforclosureandsale.
An analysis of parkland supply identified that the ward of Carrs Landing is well served, under the established
800mand400mbuffers,byalltypesofparksandlakeaccesseswiththeexceptionofaschoolsite.
Thesaleofthelandsisexpectedtoresultinproceedstotheamountof$1.34million.
AsperCouncilsdirection,theDistrictintendstousethefundstoreducetheinterestoftheCityofKelownain
thelandsoftheLakeCountryportionoftheOkanaganRailTrail.
Staffisinsupportofthe roadclosure.Sellingthecurrentlyunmaintainedrightofway,whichisapproximately
210minlength,willprovidesignificantrevenueforcommunitybenefit.

BACKGROUND:
In2011,theuplandpropertyownerswereplaintiffsinacase,namingtheDistrictofLakeCountryasdefendants,
disputing the declaration that the foreshore strip of land was dedicated as a public highway. The case was
dismissed,aswellasthesubsequentappealin2012,infavouroftheDistrictsposition.
DISCUSSION/ANALYSIS:
Theownersofthepropertieshighlightedintheabovemapswouldliketoacquireasectionoftheroadrightof
way,adjacenttotheirproperties,fromthemunicipality.
CouncilhasdirectedstafftonegotiatethelandsalewiththepropertyownersandpreparetheattachedRoad
ClosureBylawtobeginproceedingsforthedispositionoftheland.
TheCommunityCharterSection40(1)(a)givesCounciltherighttocloseallorpartoftherightofway.
CommunityCharterSection41(1)(c)hascertainrestrictionsfortheuseofthefundsfromtheproceedsofthe
saleoftherightofwaywhetherinpartorinwhole.Themunicipalitycanexchangethepropertyforother
propertythatthecouncilconsiderswillprovidepublicaccesstothesamebodyofwaterthatisofatleastequal
benefittothepublic.
AsperCouncilsdirection,theDistrictintendstousethefundstoreducetheinterestoftheCityofKelownain
thelandsoftheLakeCountryportionoftheOkanaganRailTrail.
TheDistrictissatisfiedthattheuseofthefundsasdescribedabovecomplywithSection41(1)(c)ofthe
CommunityCharter.
Enhancementofpubliclakeaccess/beachparksinCarrsLandingatGableBeach,CoralBeach,andWhiskey
Cove,aswellasthepathwaybetweenMakiRoadandCoralBeachRoadisproposed.
ThedraftLakeCountryParksandRecreationMasterPlannotesthattheunmaintainedportionroadrightofway
alongthewaterfrontisnotessentialtofutureparkplanningeffortsbytheDistrict.
NotificationforpropertydispositionisdealtwithunderSection26andSection94(1)oftheCommunityCharter.
Thiswillprovideanopportunityforpersonswhoconsiderthemselvesaffectedtomakerepresentationsto
Council.

15.3WaterfrontAccess

ThevastmajorityoflakefrontagewithinLakeCountryisownedorcontrolledbyprivatebodies.Nonetheless,
theDistrictofLakeCountrycontrolsapproximatelysixkilometresofatotalof45kilometresoflakefrontage,
which consists of all public beaches, boat launches and road ends along Okanagan, Wood and Kalamalka
Lakes.

As of this year, the District directly or jointly owns approximately 21 kilometres of lake frontage, which is
nearly half of the lake frontage in the municipality. This includes 8 km of publicly accessible lake frontage
withthepurchaseoftheRailCorridor;aswellas7kilometresofpubliclyaccessiblelakefrontagewiththe
transferofPelmewashParkway.OntopofthisarethelakeshorepropertiesownedbytheRegionalDistrict
andotherlevelsofgovernmentwithinLakeCountry.

GoalsandpoliciesfromSection15oftheOCPbeingsupportedinclude:
Improveandexpandtheparknetworkandrecreationalfacilitiestomeetcommunityneeds.
Improvepublicaccesstotheforeshoreofalllakes.

REFERRALRESPONSES:
ParksandInfrastructureServicescomments:
WorkundertakenthroughthedevelopmentofthedraftLakeCountryParksandRecreationMasterPlandeemed
thecurrentlyunmaintainedportionofroadrightofwayalongthewaterfrontinthevicinityofGableandToby
RoadsasnonessentialtofutureparkplanningeffortsbytheDistrict.Analysisofparklandsupplywasundertaken
todeterminethecoverageareawithinestablished800mand400mbuffers.(seeAttachmentCParksSpatial
DistributionMap).ThisexerciseidentifiedthatthewardofCarrsLandingiswellservedunderthese800mand
400mbufferswithavarietyofparktypes,amenitiesandlakeaccessopportunities.

StrategicandSupportServicescomments:
ItwasidentifiedwiththepurchaseoftheRailTrail,thatthesaleofsurpluslands,nottaxation,willbeappliedin
reducingKelownas50percentinterestintheRailTrail(approximately$2.6million).Todate,therehavenot
beensufficientsurpluslandsexclusivelywithintheRailCorridortocovertheentireamountowing.Itisproposed
that$1.1millionofthesalebeappliedtoreducingKelownasinterestinLakeCountryRailTraillands.

FinanceandCorporateServicescomments:
TheproceedsfromthesaleofthelandwillbetransferredtotheAccesstoBodyofWaterReserveFund.Council
has,bymotion,determinedthefundsinthisreservewillbeusedtoreducetheinterestoftheCityofKelownain
the lands of the Lake Country portion of the Okanagan Rail Trail. The Rail Trail has provided approximately 8
kilometresofwaterfrontaccesstotheDistrictofLakeCountry.

COMMUNITYIMPLICATIONS:
ImprovementsacrossCarrsLandingareproposed(seeAttachmentDParkEnhancementPlan)
TherearenoplanstoextendtheprogrammedandmaintainedsectionofGableBeachfurtherthatwouldrequire
theselands.
AccesstowateratGableRoadEndorTobyRoadEndwillnotberemovedasaresultofthisclosure.

COST,BUDGETCONSIDERATIONSANDFINANCIALIMPLICATIONS:
Thecostoftheproposedroadendclosureandsaleisapproximately$40,000.

IMPACTONSTAFFCAPACITYANDWORKLOAD:
Thereareminorimpactstostaffcapacityorworkloadiftheroadclosureproceedsandtitleisraised.

ALTERNATERECOMMENDATION(S):
THATRoadClosureandRemovalofHighwayDedicationBylaw(GableRoadEnd)1031,2017bedeniedfirstreading.

We're demanding now.

It's time to honestly, publicly identify and acknowledge all the unanticipated costs associated with the
Rail Trail including litigations, natural hazards, construction, clean-up costs etc. Also any
potential future expenses such as "Wish List" projects the District may be considering and have not
yet publicly disclosed. If the District intends to use funds from the sale of Gable Public Beach lots for
things like a pool, a conference centre, etc., taxpayers want (and expect) to be informed of this now.

We still only know we know very little about the actual financial and current debt situation in the
District of Lake Country. Selling a Public Beach is akin to selling one's wedding ring when still
married. It's viewed as an act of financial desperation.

As a home owner in Lake Country, I am writing to ask that you vote against proposed bylaw 1031,
2017.
As you are aware, Lake Country is one of the fastest growing communities in all British Columbia.
With our continued growth, the need for public lake access is ever increasing. Selling public
lakefront, any public lakefront would only serve to demonstrate a lack of forethought on behalf of
our community. A decision which is irreparable once made.
Land can be developed as the need for more homes, shops and amenities arise. Unfortunately, we
cannot just "make" more lakefront, it is an asset that is in limited supply.
As leaders of our community the decision you make on this issue will have consequences that
stretch far into the future. I ask that you chose not to sell an asset owned by our community which
is in limited supply. Please consider how your decision impacts our community not just now, but in
100 years from now. Please vote against bylaw 1031, 2017.
