CITY ORDINANCE NO. 2009-28

AN ORDINANCE PRESCRIBING RENTAL FEE OF THE

BOXING RING FOR ITS USE OUTSIDE OF CABADBARAN
CITY.

WHEREAS, as part of its program to promote the sport of boxing, the

City Government has allowed the free use of its boxing facilities, including the
boxing ring, for the Barangay LGUs, schools and other institutions in
Cabadbaran City that hold boxing events;

WHEREAS, on several occasions, requests to borrow the boxing ring to

be used outside Cabadbaran City were granted by the City Government free of
any charge;

WHEREAS, the use of said boxing ring outside of Cabadbaran City

does not in any manner promote the sport of boxing for Cabadbaran, but
nonetheless, it entails cost due to the normal wear and tear associated with
its use but which cost the City Government was not remunerated;

WHEREAS, in order to preserve the boxing ring and to keep it in top

condition, it is proper that a certain amount be set-aside to cover the cost of
its maintenance and repairs;

WHEREAS, to achieve the aforesaid purpose, the imposition of a rental

fee for its use by non-Cabadbaranons outside of Cabadbaran City is proper
and fitting.

NOW THEREFORE

BE IT ORDAINED, by the 1st Sangguniang Panlungsod, in its 108 th

Regular Session assembled, t h a t:

SECTION 1. SCOPE

This Ordinance shall apply to the use of the City Boxing Ring outside of
Cabadbaran City; excluding other equipment such as boxing gloves, mitts,
pads, etc. .

SECTION 2. RENTAL FEE FOR THE USE OF BOXING RING OUTSIDE

OF CABADBARAN CITY.

There shall be collected a rental fee for the use the Boxing Ring of the
City Government outside Cabadbaran City by any private organization, or by
any public entity or Local Government Unit except as otherwise herein
exempted; or by any public officer/official or private individual shall be subject
to a RENTAL FEE as follows:

a. Three Thousand Pesos ( P 3,000.00) for the first 3 days starting on

the day the boxing ring is taken out from the place where it is
stationed/deposited, and

b. Additional Five Hundred Pesos ( P 500.00) for every day thereafter.

The funds collected by virtue of this Ordinance shall accrue to the

General Fund.

SECTION 3. EXEMPTION

The rental fee prescribed in the next preceding Section shall not apply
to the use of the Boxing Ring by any of the Barangay LGUs of the City of
Cabadbaran.

SECTION 4. COST OF TRANSFER

The Lessee or Borrower shall shoulder the cost of the transfer of the
said boxing ring to and from the place where it is stationed or deposited to
the point of destination including the transportation expenses of two duly
authorized persons of the City Government of Cabadbaran who shall be
dispatched to direct and assist in the assembling and dismantling of the said
Boxing Ring.

SECTION 5. DAMAGE/IMPAIRMENT WHILE IN CUSTODY OF THE

LESSEE OR BORROWER

Any damage or impairment to the boxing ring while under the custody of
the Lessee or Borrower shall be borne by him, the cost to be determined by
the proper officer in the General Services Office.

SECTION 6. LEASE CONTRACT

Any request for the rental of the boxing ring shall not be granted unless
a Lease Contract shall be signed between the City Government, represented
by the City Mayor and the Borrower.

The Lease Contract shall be prepared by the General Services Office

and shall contain the conditions on the use of the said boxing ring as
provided by this Ordinance or by other agreements.

SECTION 7. PENALTY Failure to comply any provision of this

Ordinance shall be fined Five Thousand Pesos (P 5,000.00).

SECTION 8. EFFECTIVITY

This Ordinance shall take effect immediately upon approval.
