NYS ATTORNEY GENERAL CANDIDATE FILES ACTION AGAINST NYC

COUNCIL SPEAKER CHRISTINE QUINN TO ENJOIN DISCRETIONARY,


SLUSH-FUND PAYMENTS AS COERCIVE AND IN VIOLATION OF ONE-
MAN, ONE-VOTE RULE

FOR IMMEDIATE RELEASE:


NEW YORK, NY, August 23, 2010 — One of the candidates for New York State Attorney
General has filed a federal action today to enjoin the NYC City Council, its Speaker, NYC and
the Mayor from using discretionary, slush-fund payments to control how the other 50 Council
members vote.
Libertarian Party candidate Carl E. Person, a New York lawyer, stated: “I’m starting my job as
NYS Attorney General early, to end the existing dictatorship of Mayor Bloomberg, who has
eliminated City Council opposition to his governance of NYC by cutting off discretionary
payments to non-profit organizations within the Districts of Council Members who vote against
the wishes of the Mayor and Speaker Christine Quinn.”
Person explained that this custom and usage has deprived New Yorkers of the representation of
their elected representatives and violates the “one-man, one-vote” rule under the Equal
Protection and Due Process clauses of the 14th Amendment to the U.S. Constitution.
The effect of this Constitutional violation, has resulted in
● a deteriorating school system in NYC,
● citizens and residents unqualified to work in today’s economy,
● a worsening of the economy in NYC for voters and other residents,
● a do nothing policy while NYC suffers from true unemployment and
underemployment comparable to the Great Depression,
● a total disregard of the rights and interests of voters and other residents to favor
the banks, investment bankers, hedge funds and other financial institutions
which have been destroying the nation’s and NYC’s economy,
● a financial dependence on continued violation of federal and state laws by the
financial industry as a prime source of tax revenues to run NYC,
● a reduction of about 30% of the lanes for vehicular traffic in lower Manhattan,
without any environmental impact statement or public hearings, resulting in
longer traffic delays, more congestion, ambulance, fire and police delays,
cardiac patient deaths, 30% more use of fuel and emissions (est.),
● a NYC debt beyond the ability of New Yorkers to pay, and increasing, and
● a loss of the checks and balances that could have prevented the foregoing.
