Legal Education System in paksitan.

Law is the cement of society and an essential medium of change'. Knowledge of law
increases one's understanding of public affairs. Its study promotes accuracy of the
expression, facility in arguments and skill in interpreting the written words, as well
as some understanding of social values. It is pivotal duty of everyone to know the
law. Ignorance of law is not innocence and it cannot be excused.

Legal education is a primary source of feeding the nation the capacity to act
as good populace. It provides nation the qualitative law and graduates which are
capable of becoming lawyers, judges and professionals in related fields. This
community possesses current knowledge of law and necessary skills to help the
state in maintaining rule of law and administration of justice in its social order.

Legal education is essentially a multi-disciplined, multi-purpose education


which can develop the human resources and idealism needed to strengthen the
legal system. A lawyer, a product of such education would be able to contribute to
national development and social change in a much more constructive manner.

Legal education and quality of law graduates have great impact on the
quality of judiciary - bar and bench. It is also substantively relevant for other
spheres of national life related to law-making and law-enforcing, governance and
administration, corporate legal counselling and alternative dispute resolution.

Legal education is imperative not only to produce good lawyers but also to
create cultured law abiding citizens, who are inculcated with concepts of human
values and human rights.
It can take the form of a variety of programs, including:

1. Primary degrees in law, which may be studied at either undergraduate or


graduate level.
2. Advanced academic degrees in law, such as masters and doctoral degrees.
3. Continuous legal education (CLE) will also provide a further opportunity for
learning even after passing strict entry tests. Young lawyers will
get a chance to learn from senior members of the bar. There is a dearth of
good lawyers in Pakistan. CLE will help meet this challenge. However,
adding more lawyers to the bar will saturate the profession, increasing the
likelihood of occasional clashes between competing and frustrated young
lawyers.

In Pakistan, however, CLE is even more necessary due to our poor legal
education system, flawed entry requirements, and lack of training for working
lawyers. CLE is even helpful for those who are trained through external degree
programs. In a nutshell, CLE will strengthen our bar and the legal profession.

The numbers of lawyers in Pakistan are increasing with rapid pace but quality
of their services and competency as a whole is also decreasing with same speed in
Pakistan. In past Pakistan produced many able and competent lawyers and jurist
who proved themselves at international stage. But today the situation is
deplorable. What is the main reason behind this? There is only one reason for this
phenomenon and that is the phenomenal increase of private law colleges in
Pakistan.
Today there are hundreds of private law colleges operating in Pakistan which are
producing thousands of law graduates every year. Most of these colleges are only
exist in papers without any proper building, faculty and class rooms.

In Pakistan the merit of Doctors and engineers are very high and only few
very competent and able students are admitted in medical and engineering
institutions. But what is the criterion for the Lawyers? There is no merit because
you can easily get admission in Private Law College with C or D grade marks in
graduation. All you have to do is to give them fees and there is no need to take
classes of law, at the end of every year you can sit in the annual exams and easily
pass it by just preparing few important questions. Even some colleges offer you
guess papers and guarantee you the success in exams for little more money. You
can become a law graduate in Pakistan very easily without even attending class in
college.

Majority of people try to get admission in different courses of Universities


after their graduation but when they fail to get admission anywhere they took
admission in Private Law College. Most of them start some job or business and
during those three years of LLB they even not bother to come to their college. Some
of them even dont know the name of their college and they got admission through
their friends who pay their fees and inform them when to sit in the annual exam.

After completion of LLB the entry test is conducted by other provincial Bar
Council before granting license of advocacy to law a graduate. But this test is big
joke as 99 % of applicants always pass in that test. Now after that a person is ready
to start his career as advocate.
Legal Education Would Focus on What Lawyers Do. Presently, law school
curricula focus on the law rather than on the many roles of lawyers in our society.
The vast majority of courses are designed to "cover" the law on a particular subject.
Very little attention is paid to what lawyers actually do or to how they do it.

Legal Education Would Teach More of the Types of Analysis that Lawyers
Use. Law study involves too much rote learning and coverage of material at the
expense of creativity and problem solving. Law schools purport to "teach people to
think like lawyers"; but they do not teach many of the kinds of analysis lawyers
really use. Again, the problem is an inadequate conception of lawyering.

Legal Education Would Give Students an Opportunity to Learn from


Experience. Learning to practice law is a lifelong educational process.

Conclusion and suggestions:

The Law and Justice Commission of Pakistan should ensure a study is done in
collaboration with the HEC to make appropriate changes in laws/rules relating to
legal education. Bar councils must functionalize their legal education committees
to ensure that law schools impart education relevant to fast-changing needs of the
legal profession. They should also review their mandate providing for CLE for
lawyers and paralegal staff. The bar must make this training mandatory for renewal
of license of every lawyer each year and offer certification and awards to encourage
participation in continuous legal education. It may give cash awards, medals, and
law books to new entrants in the profession and arrange international conferences
of lawyers to support CLE efforts in Pakistan.
