1. INTRODUCTION

2. Contributions to Sarawak Civil Service

During my 35 years of service till today, my duties and responsibilities are


closely related to functions and various activities in Land Branch, inclusive of
Enforcement and Land Registry activities. The functions of Land Branch are as
follows:-

2.1 Temporary Occupation Licence (T.O.L.)

I was entrusted to process applications for Temporary Occupation Licence. For


your information, Temporary Occupation Licence or in short T.O.L. is issued by
Land and Survey Department to legalize one’s occupation of State Land and it is
not transferable.

To be a successful applicant, a person needs to be genuinely landless. Therefore,


prior to the issuance of T.O.L., actions are taken to check and ensure that the
applicant concerned does not own landed property in the State. Furthermore,
land inspection is carried out to investigate the current usage of the land to
ensure that the applicant had been in occupation on the land for a certain
period. Upon completion of the land inspection, I have to submit a report to
support the application before the application can be considered for
recommendation to the Divisional Superintendent of Land and Survey
Department for approval.

Normally, at the initial stage, T.O.L. is issued for a term of one (1) year and
subjected to the payment of the requisite fees such as preparation and annual
licence fees. Before its expiration, the Licencee can request for a renewal of
term. Generally, the renewal is made on a yearly basis but it may be renewed for
a term of three (3) years with the approval from the Divisional Superintendent of
Land and Survey Department.
2.2 Extension of Term of Title/Renewal of Leases (RLL)

I was also responsible for the processing of applications with respect to


extension of term of title for alienated land. Prior to the implementation of new
land policy in 2007, an application for extension of term of title dealt with
application to extend the term of existing land title, whereas an application for
renewal of leases is an application to renew land title in which the term has
expired.

The law be reverted to the state as state land. A copy of plan showing the
locality of the land in question and full details of the improvement (if any) on the
land such as buildings and cultivations are to be submitted together with the
applications.

With the implementation of new land policy in 2007, the process is now
commonly referred as renewal of land leases (RLL). Application for renewal of
land leases (RLL) is an application to renew the existing term of existing land
title. Under the new land policy announced by Yang Berhormat Datu Amar Haji
Awang Tengah bin Ali Hassan, the Second Minister of Planning and Resource
Management cum Minister of Public Utilities and implemented state wide in
2007, all land owners can now apply to the Department to renew the term of
their existing land titles at any time as they wish and regardless of the remaining
term of their existing land titles. Hence, the flexibility in the new land policy.

On receipt if the application, I shall check and ensure that the land in question is
not required for Government development projects or development purpose.
Inspection on the land is carried out to ensure that the utility of the land is in
accordance with the current imposed title special condition or approved usage.
In other words, there should not be any breach of title condition before I proceed
with preparation with recommendation to Pengarah Tanah dan Ukur for approval
with respect to application for renewal of term of title. Once approval is given, I
will then prepare letter of Offer to the applicant, followed by the preparation of
Memorandum of Surrender and Re-Alienation of Land for the applicant’s
acceptance and signature accordingly and payment of land premium by the
applicant.

2.3 Collection of Land Rent & Land Premium


I also have experience serving in Land revenue Section. I have served at the
revenue counter handling daily collection of land rent and land premium. The
Revenue System, (RVS) was implemented as part of the Land and Survey
Information System (LASIS Phase 1) in 1998. The Revenue System is designed to
facilitate the daily operation of revenue collection and the monitoring of
payment. Types of payments handled by revenue are as follows:-

I. Cash Bills – used for cash sales and immediate departmental services

II. Credit Bills – issued for sales services on credit

III. Deposits – advance payment made before major services are performed
by Land and Survey Department

IV. Land Rent and Premium – majority of the revenue collection are from land
rent and installments of premium

In the past, all annual land rent, and installment of premium were due on the
same date, which 30th June of the financial year. Therefore, payment of annual
rent and installment made after 30th June would be subject to 50% surcharge of
the current (outstanding) rent/premium. This has resulted in usual long queues
at the Revenue collection counter especially during the last week of June
annually. As a move to improve the Revenue counter service, the Land and
Survey Department has explored alternative with respect to due date for the
above mentioned payment types. The new alternative being devised and
implemented is the adoption of the title registration date of the land title as the
due date for payment for all land rent and installment of premium. That means
rent and premium payments are due on the title registration date and payment
must be made on or before the title registration date as indicated on the Land
Rent Booklet. This implementation of registration as the due date for payment
has indeed succeeded in minimizing
