The Polluters Pay Principle

STATEMENT OF PROBLEM
In recent days, the polluter pays principle is seen as a way of internalizing pollution-related costs within
the context of the economic rationality of the enterprise. There is a close relationship between a
country's environmental policy and its overall socioeconomic policy. Furthermore, under this principle it
is not the responsibility of government to meet the costs involved in either prevention of environmental
damage, or in carrying out remedial action, because the effect of this would be to shift the financial
burden of the pollution incident to the taxpayer. But State practice does not support the view that all
depollution costs should be borne by the polluter, particularly where transnational dispute is involved.

OBJECTIVE OF RESEARCH

The objective of this research work is to find the scope of the Polluters Pay Principle. It is also to
extend the discussion evolve with the help of already existing laws and international
conventions.

RESEARCH METHODOLOGY

The research is largely doctrinal and analytical. Doctrinal research asks what the law is on a
particular point and is concerned with the analysis of legal doctrine and how it had been developed
and applied while analytical research involves critical thinking skills and the evaluation of facts
and information related to the research. By using the secondary data, a set of indicators is
developed and analyzed.
LITERAURE REVIEW
Majorly doctrinal research has been performed and the author has referred to numerous articles
dealing with Environment law and the International Environmental Law, especially the online
course material and each of these has been very enlightening. Global Environment Change and
International Law by G. Sing has proven to be a very easy to read book, written in a very lucid
manner, which helps the reader surmount the difficulties surrounding the giant subject which is
the laws related to environment and it protection through codified laws and conventions.
