Privacy policy

General

CEX.IO. and its affiliates (hereinafter, "CEX.IO", "we", "us" or "our") are committed to
protecting and respecting your privacy.

This Privacy Policy (together with our Terms and Conditions of Use) governs our collection,
processing and use of your Personal Information. We define "Personal Information" as
information which identifies you personally, e.g. your name, address, e-mail address, trades etc.

The purpose of this Privacy Policy is to inform you of:

1. the kinds of Personal Information which we may collect about you and how it may be
used;
2. our use of information regarding IP Addresses and our use of cookies;
3. any disclosure of Personal Information to third parties;
4. your ability to correct, update and delete your Personal Information; and
5. the security measures we have in place to prevent the loss, misuse, or alteration of
Personal Information under our control.

Gathering and Use of Personal Information

We may collect your Personal Information if you use the Site, open an Account to use the
Platform or perform any Transactions on the Platform. The types of Personal Information which
we collect may include:

1. your name;
2. your photographic identification;
3. your address;
4. your phone number;
5. your e-mail address;
6. your banking details including account numbers;
7. your date of birth; and
8. your trades.

We may use your Personal Information for the following purposes:

1. to allow you to open and operate an Account on the Platform;


2. to enable you to complete Transactions on the Platform;
3. if you contact us, to reply to your queries;
4. to analyse use of our Site;
5. as required for regulatory purposes;
6. to provide you with information about products and promotions that may be of interest to
you, from ourselves and third parties, although only if you have specifically agreed to
receive such information;
7. for market research e.g. surveying our Members' needs and opinions on issues, such as
our performance etc.

We will process your Personal Information only for the purpose(s) for which it has been
provided to us.

IP Addresses

We may collect information about your computer, including where available your IP address,
operating system and browser type, for system administration and to report aggregate
information to our advertisers. This is statistical data about our users' browsing actions and
patterns and does not identify any individual.

Cookies

We use a browser feature known as a "cookie", which assigns a unique identification to your
computer. Cookies are typically stored on your computer's hard drive. Information collected
from cookies is used by us to evaluate the effectiveness of our Site, analyse trends, and
administer the Platform. The information collected from cookies allows us to determine such
things as which parts of our Site are most visited and difficulties our visitors may experience in
accessing our Site. With this knowledge, we can improve the quality of your experience on the
Platform by recognising and delivering more of the most desired features and information, as
well as by resolving access difficulties. We also use cookies and/or a technology known as web
bugs or clear gifs, which are typically stored in emails to help us confirm your receipt of, and
response to, our emails and to provide you with a more personalised experience when using our
Site.

We use third party service provider(s), to assist us in better understanding the use of our Site.
Our service provider(s) will place cookies on the hard drive of your computer and will receive
information that we select that will educate us on such things as how visitors navigate around our
site, what products are browsed, and general Transaction information. Our service provider(s)
analyses this information and provides us with aggregate reports. The information and analysis
provided by our service provider(s) will be used to assist us in better understanding our visitors'
interests in our Site and how to better serve those interests. The information collected by our
service provider(s) may be linked to and combined with information that we collect about you
while you are using the Platform. Our service provider(s) is/are contractually restricted from
using information they receive from our Site other than to assist us.

By using our Site you are agreeing that we may use cookies for the purposes set out above.

Disclosure of Personal Information


We use the Personal Information for the purposes indicated at the time you provide us with such
information, and/or otherwise for the purposes set out in this Privacy Policy and/or as otherwise
permitted by law. We may make available the Personal Information that you provide to us to our
affiliates, agents, representatives, trusted service providers and contractors for these limited
purposes. We may also share Members Personal Information with financial institutions,
insurance companies or other companies in the case of a merger, divestiture, or other corporate
re-organisation. We may also share Members' Personal Information with law enforcement or
regulatory agencies, as may be required by law. Any third party which receives or has access to
Personal Information shall be required by us to protect such Personal Information and to use it
only to carry out the services they are performing for you or for CEX.IO, unless otherwise
required or permitted by law. We will ensure that any such third party is aware of our obligations
under this Privacy Policy and we will enter into contracts with such third parties by which they
are bound by terms no less protective of any Personal Information disclosed to them than the
obligations we undertake to you under this Privacy Policy or which are imposed on us under
applicable data protection laws.

CorrectionUpdatingDeletion of Personal Information

You have the right to access your Personal Information and to require the correction, updating
and blocking of inaccurate and/or incorrect data by sending an email to us at:
webmaster@cex.io.

You may also request the deletion or destruction of both the Account and Personal Information
by sending an email to us at: webmaster@cex.io. CEX.IO will action your request only where
this is not inconsistent with its legal and regulatory obligations.

Upon your written request, we will inform you of the Personal Information relating to you that
we hold and the use and general disclosure of your Personal Information. We will also give you a
copy of the Personal Information we have retained. There may be a minimal charge for accessing
your Personal Information.

Security

We have implemented security measures to ensure the confidentiality of your Personal


Information and to protect your Personal Information from loss, misuse, alteration or destruction.
Only authorised personnel of CEX.IO have access to your Personal Information, and these
personnel are required to treat the information as confidential. The security measures in place
will, from time to time, be reviewed in line with legal and technical developments.

Retention of Personal Information

We will hold your Personal Information only for as long as it is necessary for us to do so, having
regard to the purposes described in this Privacy Policy and our own legal and regulatory
requirements. In accordance with our record keeping obligations we will retain Accounts and
Personal Information for, at least a period of five years after they are closed by Members.
Links

There may be links from our Site to other sites and resources provided by third parties. This
Privacy Policy applies only to our Site. Accessing those third party sites or sources requires you
to leave our Site. We do not control those third party sites or any of the content contained therein
and you agree that we are in no way responsible or liable for any of those third party sites,
including, without limitation, their content, policies, failures, promotions, products, services or
actions and/or any damages, losses, failures or problems caused by, related to or arising from
those sites. We encourage you to review all policies, rules, terms and regulations, including the
privacy policies, of each site that you visit.

Marketing

You have the right to ask us not to process your Personal Information for marketing purposes.
You can exercise your right to prevent such processing by checking certain boxes on the forms
we use to collect your Personal Information. You can exercise the right at any time by contacting

Changes

Our Site policies, content, information, promotions, disclosures, disclaimers and features may be
revised, modified, updated, and/or supplemented at any time and without prior notice at the sole
and absolute discretion of CEX.IO. If we change this Privacy Policy, will take steps to notify all
users by a notice on our Site and will post the amended Privacy Policy on the Site.

KNOW-YOUR-CUSTOMER POLICY

The purpose of the Know-Your-Customer Policy (KYC) is to prevent CEX.IO from being used,
intentionally or unintentionally, for illegal activities, including money laundering and terrorist
financing activities. Both international and local regulations require CEX.IO to know its
customers, which are the Users, and take action in case of any form of suspicious activity. For
such purposes CEX.IO reserves the right to collect personal identification information and
whatever needed information for KYC purposes.

CEX.IO respects User's right to privacy and do not wish to infringe upon this right on a regular
basis; however, CEX.IO must operate within its KYC procedure to comply with national and
international legislation.

CEX.IO wishes to trust its Users to always act in good faith, and believes in open dialogue with
its Users with regard to KYC fulfilment.

Only law-abiding Users who do not wish to commit any violations through the CEX.IO Platform
or/and Services can obtain the Premium Account Status, including for dealing with fiat
transactions.

To be clear CEX.IO is not in the business of offering anonymous services and it intends to
follow both national and international regulations, and any User who wants to obtain Premium
Account Status should agree to all KYC procedures.

KYC covers the following:

1. Premium Account Status Policy.


2. Compliance Officer.
3. User Identification Procedures.
4. Monitoring of Transactions.
5. Risk Management.
6. Miscellaneous.

NOTE: All definitions in KYC are used in the same meaning as under the Terms of Use

1. Premium Account Status Policy

CEX.IO sets explicit criteria for the Premium Account Status to be obtained, which are as
follow:

1. No Premium Account Status is to be obtained in anonymous or fictitious name;


2. No Premium Account Status should be obtained where CEX.IO is unable to apply appropriate
User Identification Procedure, i.e. CEX.IO is unable to verify the identity and/or obtain required
documents due to non-cooperation of the User or non-reliability of the data/information
provided to CEX.IO;
3. No Premium Account Status should be obtained if the documents provided by the User within
the Identification Procedure are unclear, non-sufficient or dubious;
4. No Premium Account Status should be obtained if the User refuses to provide additional
documents on CEX.IO request;
5. No Premium Account Status is to be obtained if the User refuses to go through on-line video
verification;
6. No Premium Account Status is to be obtained by the User considered to be an anti-social
element (e.g., criminals).
7. No Premium Account Status is to be obtained by the User with a record of fraud, cheating or
forgery.

Before obtaining Premium Account Status CEX.IO has the right to verify whether the User
matches any person with a known criminal background.

THERE SHALL BE NO DISCRIMINATION WHEN OBTAINING PREMIUM ACCOUNT


STATUS ON WHATEVER BASIS.

However, CEX.IO reserves the right to refuse the User in Premium Status based on reasonable
suspicions.

2. Compliance Officer

The Compliance Officer is the specifically trained person located at the CEX.IO office, who will
be responsible for, including but not limited to:

Collection, verification, safety and non-disclosure of personal identification information;


Additional checks procedures, including but not limited to on-line video verification;
Monitoring and reporting of all transactions;
Handling risk profiling;
Providing information as required under the laws and regulations.

The Compliance Officer will be in close cooperation with authorities, which are involved in
prevention of money laundering, terrorism financing and other illegal activity.

3. User Identification Procedure

Before obtaining Premium Account Status the User must go through Identification Procedure
(IP).

Under KYC identification means a set of attributes which together uniquely should identify the
User.

CEX.IO will take steps to confirm the authenticity of documents provided by the Users. All legal
methods for double-checking personal information will be used and CEX.IO reserves the right to
investigate certain Users who have been determined to be risky or suspicious.
CEX.IO will not conduct any business with Users who wish to remain anonymous or intend to
use the Platform for illegal activities.

Once the Users identity has been verified, CEX.IO is able to remove itself from potential legal
liability in a situation where its services are used to conduct illegal transactions.

CEX.IO provides for the following IP:

(I) Basic IP

The Basic IP is obligatory for all Users who want to obtain the Premium Account Status and deal
with fiat transactions; moreover, the User can go through Basic IP without intend to deal with
fiat transactions, but to obtain prestigious Premium Status.

For the Basic IP the User is required to provide the good quality (cf. below) scanned copies of
the following original documents:

1) Valid ID - acceptable documents are:

-Passport national and/or international (all pages); or

-National ID (both sides).

2) Proof of permanent address - acceptable documents are:

-Utility bill (i.e. bill for utilities consumed at the Users permanent address); or

-Bank statement (account statement).

3) Additional documents which can be provided at the discretion of the User:

-Driving license; or/and

-Income tax forms, tax return bill, council tax bill; or/and

-Certificate of residency issued by a state or a local authority, or

-Any other document that can confirm the identity of the User and his/her permanent address.

To be accepted by CEX.IO, the scanned documents should meet the following requirements:

Documents should be valid due to issue date;


Documents should be provided in English or with certified translation in English;
Scanned images should be in color and in high resolution (at least 300 dpi);
Allowed formats: JPG, GIF, PNG, TIFF or PDF;
File size should be no more than 15 MB
CEX.IO reserves the right to reject any unclear, low-resolution or poor quality documents or/and
images.

CEX.IO RESERVES THE RIGHT TO ASK FOR ANOTHER VERIFICATION PROCEDURE


EVEN AFTER SUCCESSFUL IP.

(II) Payment cards IP

The User who is going to use Payment card to fund his/her Account or to make any fiat
transactions, in addition to the documents for the Basic IP must provide:

4) scanned copy of his/her Payment card (both sides) with viewable first four and last four
numbers of the Payment card.

ALL OTHER NUMBERS OF THE PAYMENT CARD, AS WELL AS CVV CODE ON THE
BACK SIDE OF THE PAYMENT CARD SHOULD BE COVERED.

In case the User disregards the requirement to cover the numbers and CVV code of the Payment
card (except for the numbers indicated in para 4 above) CEX.IO will not be responsible for the
possible consequences.

To be clear CEX.IO requires the scanned copy of the Payment card only with intend to verify the
fact that the declared Payment card really exists and compare the identity of the cardholder with
the identity of the User who applies for use of the declared Payment card.

(III) Additional IP

The Additional IP can be applicable on a case-by-case basis for any other type of the Account
funding, except for Bank transfer and Payment card.

3.1. Keeping Database

The Compliance Officer will process and handle identification documents, including the Users
Profile, related to the User and transactions to meet the requirements of KYC and relevant
regulations.

3.2. Review/update of Users Identification Data

CEX.IO reserves the right to handle database of the Users identification data (Users Profile),
which can be modified and updated from time to time.

CEX.IO system of periodical review and update of the Users identification data will be the
following:

CEX.IO will continue to carry out on-going due diligence with respect to the Users Premium
Account Status use;
CEX.IO will closely examine all transactions in order to ensure that they are consistent with its
knowledge of the User and risk profile;
CEX.IO reserves the right to keep database of the Users identification information which can be
reviewed and updated form time to time;
CEX.IO reserves the right to request the documents indicated in above paras (1), (2) and (4) to
be re-provided by the User.

The database with the Users Profiles will be used exclusively for the purpose of KYC and for
the prevention of the prohibited conduct (cf. Anti-Fraud Policy) that could be attempted by the
Users.

In view of necessity to keep up-to-date with the latest changes in personal information, the Users
must contact CEX.IO as quickly as possible when there is any changes in their identification
information provided (e.g., change of address, issuance of new ID document, etc.).

KYC related updates could be provided to CEX.IO via email, telephone conversation, forms,
interviews, including through the video verification, etc.

The personal information of the User, including his/her identification data, will be collected and
preserved strictly in accordance with CEX.IO Privacy Policy and related regulations.

4. Monitoring of Transactions

Constant monitoring of the Users transactions related to the Premium Account Status is an
essential element of effective KYC policy.

With regard to KYC policy CEX.IO will monitor all transactions and it reserves the right to:

1. Ensure that transactions of suspicious nature is reported to the proper authority through the
Compliance Officer;
2. Request the User to provide any additional information and documents in case of suspicious
transactions;
3. In case the User already obtained the Premium Account Status, but CEX.IO has not been able to
apply appropriate KYC procedures due to false information and/or non-cooperation by the User,
or due to any other cause, CEX.IO reserves the right to suspend further Users transactions.

NOTE: The above list is not exhaustive and the Compliance Officer will verify Users
transactions on a day-to-day basis in order to define whether such transactions are to be reported
and treated as suspicious or are to be treated as bona fide.

5. Risk Management

KYC is to be put in place by establishing appropriate procedures and ensuring their effective
implementation. KYC will cover proper management oversight, systems and controls,
segregation of duties, training and other related matters. CEX.IO will ensure that its Policies and
procedures are implemented effectively.
The nature and extent of due diligence will depend on the risk perceived by CEX.IO; however,
while preparing Users Profile CEX.IO will take care to request only that information from the
User which is relevant for KYC and is not exceeding the necessary scope. The User Profile will
be a confidential document and details contained therein shall not be divulged for cross selling or
any other purposes.

6. Miscellaneous

This KYC policy will be amended from time to time if there is any change in the legislation.
Terms and conditions of this KYC are subject to change by CEX.IO and in the case of any
amendments, CEX.IO will make appropriate announcement on its Platform. The changes will
apply after CEX.IO has given notice.

In case if the User does not wish to accept the revised KYC, he/she should not continue to use
CEX.IO Services. If the User continues to use the Services after the date on which the changes
come into effect, his/her use of the Services to be bound by the new KYC.
ANTI-FRAUD POLICY

1. POLICY STATEMENT

CEX.IO creates opportunities for the people and builds trust between them worldwide. CEX.IO
is committed to conducting business in accordance with the highest ethical, professional and
legal standards. The public, CEX.IOs partners and Users have the right to expect that
professional, competent and trustworthy people are employed by CEX.IO.

CEX.IO will comply with applicable legislation. In line with applicable legislation CEX.IO has a
zero tolerance policy towards fraud, corruption, collusion, money laundering, financing of
terrorism and other criminal conduct (jointly Prohibited Conduct) and will thoroughly
investigate and seek to take disciplinary and/or legal action against those who perpetrate, are
involved in, or assist with fraudulent or other improper actions in all CEX.IO activity and related
transactions.

CEX.IO will provide adequate and appropriate resources to implement the Anti-Fraud Policy and
will ensure it is communicated and understood.

2. LEGISLATION COMPLIANCE

The Anti-Fraud Policy has been drafted to comply with the current applicable local and
international legislation, including, but not limited to applicable EU legislation.

Adherence to the Anti-Fraud Policy CEX.IO will ensure compliance with all relevant legislation
and internal policies.

3. DEFINITIONS

In pursuance of the Anti-Fraud Policy, Prohibited Conduct includes fraud, corruption, collusion,
money laundering, financing of terrorism and other criminal conduct defined as follows:

A. Fraud: any act or omission, including a misrepresentation that knowingly or recklessly


misleads, or attempts to mislead, a party to obtain a financial or other benefit or to avoid an
obligation.

B. Corruption: offering, giving, receiving, or soliciting, directly or indirectly, anything of value


to influence improperly the action of another party.

C. Collusion: arrangement between two or more parties designed to achieve an improper


purpose, including influencing improperly the actions of another party.
D. Money laundering: (a) the conversion or transfer of property, knowing that such property is
derived from criminal activity or from an act of participation in such activity, for the purpose of
concealing or disguising the illicit origin of the property or of assisting any person who is
involved in the commission of such activity to evade the legal consequences of his action; (b) the
concealment or disguise of the true nature, source, location, disposition, movement, rights with
respect to, or ownership of property, knowing that such property is derived from criminal activity
or from an act of participation in such activity; (c) the acquisition, possession or use of property,
knowing, at the time of receipt, that such property was derived from criminal activity or from an
act of participation in such activity; (d) participation in, association to commit, attempts to
commit and aiding, abetting, facilitating and counselling the commission of any of the actions
mentioned in the foregoing points

E. Terrorist financing: provision or collection of funds, by any means, directly or indirectly, with
the intention that they should be used or in the knowledge that they are to be used, in full or in
part, in order to carry out any of the offences within the meaning of Articles 1 to 4 of Council
Framework Decision 2002/475/JHA of 13 June 2002 on combating terrorism.

F. Criminal conduct: conduct, which constitutes an offence in any part of the world or would
constitute an offence in any part of the world if it occurred there.

4. KEY RESPONSIBILITIES

CEX.IO performs a Know-Your-Customer Policy (KYC) due diligence on all new Users and a
due diligence on all transactions in order to detect possible compliance or integrity concern. Such
due diligence is performed in accordance with the requirements of the money laundering and
terrorist financing activities regulations, pursuant to the terms of KYC.

In view of the Anti-Fraud Policy CEX.IO is responsible for:

ensuring efficient and effective systems, procedures and internal controls are in place to
enable the prevention and detection of Prohibited Conduct;
ensuring the Anti-Fraud Commissioner identifies Prohibited Conduct risks in their areas
of business and that all systems, procedures and internal controls are properly
implemented and enforced;
ensuring all members of the operational anti-fraud department have a duty to report any
internal and external suspicions or incidents of Prohibited Conduct;
reviewing continuously its systems, procedures and internal controls through risk
management processes and audit arrangements;
reporting any suspicions regarding Prohibited Conduct to the relevant state authorities.

5. FRAUD DETECTION AND INVESTIGATION

CEX.IOs Operational Anti-Fraud Department, in particular, the Anti-Fraud Commissioner, is


the first line of detection, investigation and protection in preventing Prohibited Conduct through
the Users and transactions appraisal process. The Anti-Fraud Commissioner will be responsible
for the proper fulfillment of the Anti-Fraud Policy.
(a) Authority

The Anti-Fraud Commissioner, through the Operational Anti-Fraud Department, working in


close collaboration with the Nominated Officer (cf. Know-Your-Customer Policy), shall be
responsible for:

receiving reports of alleged or suspected Prohibited Conduct involving CEX.IO, its Users
and/or related transactions;
investigating such matters and cooperating directly with the Nominated Officer in order
to facilitate the investigations;
reporting its findings to the CEX.IO management and relevant authorities, as well as any
other third party on a need-to-know basis.

For situations requiring an urgent response, the Anti-Fraud Commissioner may take any
necessary measures required for the investigation, notably to preserve evidence.

(b) Independence

The Operational Anti-Fraud Department shall enjoy complete independence in the exercise of its
responsibilities. The Anti-Fraud Commissioner shall have full authority to open, pursue, close
and report on any investigation on Prohibited Conduct within its remit without prior notice to,
the consent of, or interference from any other person or entity.

(c) Professional Standards

All Prohibited Conduct investigations conducted by the Operational Anti-Fraud Department shall
be fair and impartial, with due regard to the rights of the Users and persons or entities involved.
The presumption of innocence applies to those alleged to have engaged in misconduct. Those
involved in the Prohibited Conduct investigation (be those under investigation or those
conducting the investigation) should be aware of their rights and obligations and ensure they are
fully respected.

(d) Cooperation

All Users are required to cooperate with the Operational Anti-Fraud Department and the Anti-
Fraud Commissioner promptly, fully, efficiently and in the manner specified by the Operational
Anti-Fraud Department, including by answering relevant questions and complying with requests
for information and records.

(e) Confidentiality

In accordance with CEX.IO internal rules on access to information, all information and
documents collected and generated during a Prohibited Conduct investigation, not already in the
public domain, shall be kept strictly confidential. The confidentiality of the information collected
will be respected both in the interests of those concerned and the integrity of the investigation.
In particular, during the Prohibited Conduct investigation the confidentiality will be respected in
so far as it would not be contrary to the interests of the investigation.

The Operational Anti-Fraud Department shall disclose such information and documents only to
those persons or entities authorized to receive them or otherwise on a need-to-know basis.

6. MISCELLANEOUS

CEX.IO will review the Anti-Fraud Policy to reflect new legal and regulatory developments and
ensure good practice.

I WARRANT AND GUARANTEE THAT I HAVE NO INTENTION TO COMMIT ANY OF


PROHIBITED CONDUCT ACTS DESCRIBED HEREIN; FURTHERMORE, I CONSENT TO
ANY CHECKS DUE TO INVESTIGATION UNDER THE ANTI-FRAUD POLICY AND I
AGREE TO COOPERATE FULLY AND PROMPTLY WITH THE ANTI-FRAUD
COMMISSIONER WITHIN SUCH INVESTIGATION.
Payment Policy & Procedure

1. PURPOSE

The purpose of this Payment Policy & Procedure (hereinafter the Payment Policy) is to
establish operational processes and procedures for Bank transfer and Card payments on the
Platform, which will minimize risk and provide the greatest value, and availability of high
quality services to each CEX.IO User.

2. DEFINITIONS

1. Bank transfer: means an electronic transfer of the User's Funds from one bank/financial
institution to another.
2. Bank: means any bank, which collects payments made by the CEX.IO Users on its account.
3. Banking Day: means the part of a day on which the Bank is open to the public for carrying on
substantially all of its banking functions.
4. Cardholder: means any User, who makes payments on the Platform using a Payment Card.
5. Funding (also mentioned as Deposit on the Platform): means a transfer of a certain amount of
money to the Users Account via a Payment Card or Bank transfer.
6. Funds: means a certain amount of money transferred to and accumulated on the Users
Account.
7. Invoice: means an electronic document issued by CEX.IO to the User, which contains payment
details and establishes an obligation for the User to pay.
8. Online bank transfer: means a technical connectivity service enabling any User to fund their
Accounts with a valid bank account by submitting an electronic transfer request to their bank for
selected funds to be transferred to CEX.IO.
9. Order: a personal application to the Terms of Use.
10. Payment Card or Card: means a payment card Visa, Visa Electron, MasterCard, Maestro or CUP
verified under KYC, which is used by the User as the means of payment on the Platform.
11. Rules of International Payment Systems: means any rule, instruction, recommendation, etc., of
MasterCard and/or Visa, which regulates order of processing transactions, technical
requirements for processing transactions, as well as other provisions on acceptance of a
Payment Card.
12. Withdrawal: means removing Users Funds from his/her Account under the Users instructions.
13. SEPA (Single Euro Payments Area): means process initiated by European banks and supported,
inter alia, by the Eurosystem and the European Commission with a view to integrating retail
payment systems and transforming the euro area into a true domestic market for the payment
industry.
14. 3-D Secure: XML-based protocol designed to be an additional security layer for online payment
card transactions.

All other terms and definitions in the Payment Policy are used in the same meaning as under the
Terms of Use.
3. PAYMENT METHODS

For the Users convenience, CEX.IO offers following payment methods for Funding Account:

Bank transfer, or
Card payment.

WITHDRAWAL IS AVAILABLE FOR VERIFIED USERS ONLY THROUGH WIRE


TRANSFER AND SEPA BANK TRANSFER.

3.1. Bank transfer

Bank transfer includes: (a) Wire transfer, (b) SEPA bank transfer and (c) Online bank transfer.

(a) Wire transfer

- Payment procedure

For Wire transfers, to initiate Funding, the User needs to obtain an electronic Invoice on the
Platform, which will contain details of the transaction and the amount due, as well as the Invoice
validity period that will be up to five (5) Banking Days as of its date. The Invoice should be
printed and provided to the Users bank for relevant payment.

In order to initiate Withdrawal via Wire transfer, the User has to fill in the electronic form on the
Platform. After successful acceptance of the details provided by the User within the electronic
form, the Withdrawal transaction will be done within the timeline indicated herein.

- Amount limits

Referring to CEX.IO internal policies and rules, the User should make payments with regard to
the following amount limits set for the Wire transfer:

(b) SEPA bank transfer

SEPA bank transfer is available in the countries covered by SEPA. The information on the
countries covered by SEPA is available here. User will be able to use SEPA bank transfer under
the following conditions:

a payment should be done in EUR, and


user who wants to use SEPA bank transfer has at least one successful Wire transfer on the
Platform.

- Payment procedure

For SEPA bank transfer, to initiate Funding, the User needs to obtain an electronic Invoice on the
Platform, which will contain details of the transaction and the amount due, as well as the Invoice
validity period that will be up to five (5) Banking Days as of its date. The Invoice should be
printed and provided to the Users bank for relevant payment.

In order to initiate Withdrawal via SEPA bank transfer, the User has to fill in the electronic form
on the Platform. After successful acceptance of the details provided by the User within the
electronic form, the Withdrawal transaction will be done within the timeline indicated herein.

- Amount limits

Referring to CEX.IO internal policies and rules, the User should make payments with regard to
the following amount limits set for the SEPA bank transfer:

(c) Online bank transfer

- Payment procedure

Online bank transfer is available in the following countries: Austria, France, Germany, Italy and
Spain. Users from the mentioned countries will be able to use Online bank transfer to fund their
Accounts on the Platform under conditions provided by the Online bank transfer service provider
and with regard to the following limits:

3.2. Card payment

- Payment procedure

In order to make Funding, CEX.IO will accept from the User only that Payment Card on which
he/she is indicated as the Cardholder.
CEX.IO WILL ACCEPT ONLY THOSE PAYMENT CARDS THAT ARE VERIFIED UNDER
KYC.

However, the User has the right to change the verified Payment Card to another payment card,
which should be also verified though the Payment Card Identification Procedure under KYC.

CEX.IO warns that for the payment purposes the User can use only a 3-D Secure Payment Card.

NOTE: You can check if your card is 3-D Secure protocol with your bank.

- Amount limits

With regard to CEX.IO internal policies and rules, as well as taking into account the Rules of
International Payment System the User should make payments with regard to the following
maximum amount limits, but no less that USD20/EUR20:

4. PAYMENT PROCESSING TIMELINE

In accordance with the internal rules and requirement of CEX.IO and taking into account the
Rules of International Payment Systems, Bank transfer and Card payment processing timeline
will be as follows:

CEX.IO reserves the right, in its sole discretion, to change the above processing timeline.

Banks/financial institutions, which initiate and make the Bank transfer and Card payment, can
prolong the above processing timeline with regard to their internal rules and procedures.

5. PAYMENT INVESTIGATION

In case if the User discovers that Funding or Withdrawal has failed (i.e. no Account
Funding/Funds Withdrawal occurred within the processing timeline indicated above and no
notification on processing timeline prolongation was obtained) the User has the right to initiate
the investigation by notifying CEX.IO on the payment problems. The User should comply with
notification procedure indicated in the Terms of Use.

CEX.IO will investigate Users case and will notify the User on the investigation results. The
time needed to complete an investigation will be set on the case-by-case basis.

CEX.IO reserves the right to lock the Users Funds while the case is under investigation, which
means that the Funds could be inaccessible during such investigation.

NOTE: All expenses, which arise upon investigation process, shall be borne solely by the User.

6. FUNDING/WITHDRAWAL CHARGES

Bank/financial institution fee will be charged on the amount of Withdrawal/Funding and will
depend on the chosen payment method.

Abovementioned fee will be reflected on the Platform when choosing payment method.
Bank/financial institution will charge its fee automatically while processing payment transaction.

7. MODIFICATIONS

The amount limits and processing timeline, as well as other terms and conditions of this Payment
Policy are subject to modification by CEX.IO and in the case of any such modification, CEX.IO
will make proper announcement. The modifications will apply after CEX.IO has given notice.

In case if the User does not wish to accept the revised Payment Policy, he/she should not
continue to use CEX.IO Services. If the User continues to use the Services after the date on
which the modifications come into effect, his/her use of the Services to be bound by the modified
Payment Policy.
Refund and return policy

1. BACKGROUND

CEX.IO guarantees to any its User his/her right for refund, in case if such User is not satisfied
with the quality of the provided Services.

Furthermore, CEX.IO declares that its User has the right to change his/her mind in case if the
Users Account was already funded and to request his/her Funds to be returned.

NOTE:

This Refund Policy concerns exclusively Transaction fees and Users Funds.
This Refund Policy does not cover any transactions between the Users related to
purchase-sale of crypto-currencies, as well as GHS, and it does not refer to any refunds
for purchased crypto-currencies and GHS.
CEX.IO undertakes to make its best efforts to assist the Users in case of any disputes
related to refunds of purchased crypto-currencies and GHS.
Refunds and Returns in excess of the original amount are prohibited.

2. DEFINITIONS

1. Banking Day : ( cf. Payment Policy).


2. Business Day : means every official working day of the week in the United Kingdom.
3. Chargeback : means return of the Users money by his/her Issuing Bank due to the
disputed and/or fraudulent transaction.
4. Eligibility Criteria : means the set of requirements that must be met for Refund or
Return.
5. Funding : ( cf. Payment Policy).
6. Return Form : means the CEX.IOs form to be completed by the User, who has
requested for his/her Funds to be returned.
7. Funds : ( cf. Payment Policy).
8. Issuing Bank : means the bank that has issued payment card to the User as Cardholder.
9. Refund original amount : means the precise amount of Transaction fee deducted from
the amount of certain Users Transaction.
10. Refund Form : means the CEX.IOs form to be completed by the User, who has
requested the Refund.
11. Refund : means giving back the amount of Transaction fee paid by the User with regard
to certain Transaction.
12. Return original amount : means the precise amount of the Users Funds accumulated on
his/her Account.
13. Return : means giving back the Users Funds transferred to his/her Account.
14. Transaction Charges : means any fee charged by a bank/financial institution upon
processing a valid refund request.

All other terms and definitions in this Refund Policy are used in the same meaning as under the
Terms of Use.

3. GENERAL CONDITIONS

The User who has paid for the CEX.IO Services, i.e. paid a transaction fee, or has funded his
account may request a Refund or Return in accordance with the Eligibility Criteria as further set
out herein.

Refund/Return will only be considered where the User complies with the Eligibility Criteria in
full. Where the User fails to meet any of the Eligibility Criteria, CEX.IO shall have the right, in
its sole discretion, to decline the Users request for a Refund/Return.

In order to apply for a Refund/Return, the User must request and complete a Refund
Form/Return Form and send the respective form to the CEX.IO support address.

You can obtain the Refund/Return Form under request sent to support@cex.io.

To prevent Prohibited Conduct, all payments and information related to Refund/Return may be
verified by CEX.IO. In such case, CEX.IO may request the User to provide certain documents,
including, but not limited to, identification documents, copy of the Users Payment Card and
Invoice or/and any other prove of the fact that disputed payment was made. In case if the User
fails to provide appropriate documents or information within three (3) days upon the CEX.IO
request or in case of any doubts as to authenticity of provided documents, CEX.IO shall be
entitled to decline the Users Refund/Return request.

CEX.IO shall process the Users Refund Form/Return Form as soon as is reasonably practicable.
Response times will vary depending on stated reasons for the request. In any case, CEX.IO shall
notify the User on the outcome of the request in accordance with the timescales set out herein.

Refund/Return request will only be approved or declined after meticulous verification made by
CEX.IO.

NOTE: Submission of Refund Form/Return Form does not guarantee that the Users request will
be satisfied.

4. REFUND ELIGIBILITY CRITERIA

(i) All requests for Refund will only be accepted where notice is received by CEX.IO no later
than forty-eight (48) hours after made Transaction.

(ii) Notice mentioned in para (i) above should be provided to CEX.IO by completing Refund
Form.
(iii) Completed Refund Form should be sent to the CEX.IO electronic address with ' Refund
Request in the subject line.

5. RETURN ELIGIBILITY CRITERIA

(i) All requests for Refund should be provided to CEX.IO by completing Return Form.

(ii) Completed Return Form should be sent to the CEX.IO electronic address with 'Return
Request in the subject line.

(iii) Return is made only via Bank transfer and after the User provides all details for such Bank
transfer.

6. PROCESSING TIMELINE

Within fifteen (15) Business Days as of the date of Refund From/Return Form receipt, CEX.IO
shall contact the User to request further information (if required) and the User shall provide such
information as soon as reasonably practicable, but in any case no later than fourteen (14) days
following such request.

CEX.IO shall notify the User by e-mail on its final decision regarding Refund/Return:

within fifteen (15) Business Days following the receipt of the last requested additional
document or information;
within twenty (20) Business Days following the receipt of Refund Form/Return Form, if
no further information or document is requested .

Refund/Return will be processed within twenty (20) Business Days from the date of notifying the
User on the CEX.IO decision.

The User will have no Refund/Return :

When requested by CEX.IO to do so, the User fails to provide CEX.IO with information
or/and document(s) within the terms set herein.
If CEX.IO suspects that the User has, or is, engaged in, or have in any way been involved
in, fraudulent or illegal activity, including Prohibited Conduct.
There is no ground for Refund/Return.

NOTE: CEX.IO reserves the right to lock the Users Funds while Refund/Return investigation is
in process, which means that the Funds could be inaccessible during such investigation.

7. CHARGEBACKS

CEX.IO expects the User to contact it using CEX.IO contact details to resolve any problem or
issue related to his/her payments, before the User makes any Chargeback request. This Section
does not affect any rights and/or claims, which the User may have against the bank/financial
institution.

CEX.IO will investigate any Chargeback requests made by the User and in response will inform
the Users Issuing Bank whether any Service or Transaction has been cancelled.

CEX.IO reserves the right to suspend User's account and lock User's Funds during the
chargeback investigation procedure.

8. MISCELLANEOUS

Any charges, which arise upon processing Refund/Return, shall be borne solely by the User.
Such charges will be deducted from the final amount of Refund/Return.

This Refund Policy will be amended from time to time if there is any change in the legislation.
Terms and conditions of the Refund Policy are subject to change by CEX.IO and in the case of
any amendments, CEX.IO will make an appropriate announcement. The changes will apply after
CEX.IO has given notice.

In case if the User does not wish to accept the revised Refund Policy, he/she should not continue
to use CEX.IO Services. If the User continues to use the Services after the date on which the
change comes into effect, his/her use of the Services to be bound by the new Refund Policy.
