TO THE HONORABLE COURT:

NOW COMES, Plaintiff, ROOSEVELT CAYMAN ASSET COMPANY II

(hereinafter, RCAC-II), through its undersigned attorneys, and for

its cause of action, respectfully alleges as follows:

JURISDICTION, VENUE AND PARTIES

1. This collection of monies and foreclosure of mortgage

action is based on SANDRA ISABEL BENITEZ-RODRIGUEZ, (hereinafter,

Defendant), defaulting on the terms and conditions of a mortgage

loan in the amount of ONE HUNDRED SEVEN THOUSAND TWO HUNDRED DOLLARS

($107,200.00) executed on March 24, 2006 by Defendant with Doral Bank.

2. Jurisdiction of this Court lies in diversity of

citizenship, and the amount in controversy exceeds, exclusive of legal

interests and costs, the sum of $75,000.00, as 28 U.S.C. 1332

mandates.

3. Plaintiff, RCAC-II, is a Cayman Islands corporation,

organized, existing, and in good standing, under the laws of Cayman

Islands. RCAC-II's principal place of business is located in Cayman

Islands.

4. Defendant is a resident of the Commonwealth of Puerto Rico,

with the following residential and mailing addresses: OQ-11 520

Street, Country Club Development, Fourth Section, Carolina, PR 00924;

OQ-11 520 Street, Country Club Development, Fourth Section, Carolina,

PR 00924; P. O. Box 4405, Valle Arriba Heights, Carolina, PR 00984.

5. In compliance with Local Rule 7.1 and Rule 7.1 of the

Federal Rules of Civil Procedure (FRCP 7.1), RCAC-II certifies that

its parent Company is Roosevelt Cayman Holding Company; that no

publicly held corporation owns 10% or more of its stock; and has no

parent, subsidiaries and affiliates that have issued shares to the

public.

6. Complete diversity between Plaintiff and Defendants exists.

FACTS

7. On March 24, 2006, Defendant, SANDRA ISABEL BENITEZ-

RODRIGUEZ, received a mortgage loan from Doral Bank, which repayment

obligation Defendant evidenced with mortgage note in the amount of ONE

HUNDRED SEVEN THOUSAND TWO HUNDRED DOLLARS ($107,200.00), repayable

with an annual interest rate of SIX POINT SEVENTY FIVE PERCENT

(6.75%), due on April 1, 2036. See Exhibit 1.

8. As guarantee of the repayment obligation, Defendant, also

executed a mortgage deed, in favor of Doral Bank, encumbering the

property described in the Spanish language hereinbelow, in the amount

of ONE HUNDRED SEVEN THOUSAND TWO HUNDRED DOLLARS ($107,200.00):

y propiedad No. 12. En dicho solar enclava una casa de una sola planta
de concreto y bloques de concreto para residencia.

Carolina, Registry of the Property of Carolina, First Section.

9. On September 28, 2013, Defendant and Doral Recovery II,

LLC, as holder of the mortgage note, modified the principal amount,

interest and maturity date, becoming its new principal of ONE HUNDRED

FIFTY THREE THOUSAND FIVE HUNDRED EIGHTY TWO DOLLARS WITH TWELVE CENTS

($153,582.12), with interest of three percent (3%), beginning on

November 1st, 2013 up to maturity on October 1st, 2053, principal and

interest; with a last payment of THIRTY THREE THOUSAND SEVEN HUNDRED

FIFTY FIVE DOLLARS WITH NINETEEN CENTS ($33,755.19).

10. Plaintiff, RCAC-II, is the owner and holder of the

aforementioned mortgage note.

11. Plaintiff, RCAC-II, has appointed as its servicer and

lawful Attorney-in-fact, Rushmore Loan Management Services LLC, 221

Muoz Rivera Ave., Sixteenth Floor, San Juan, PR 00918.

12. Defendant defaulted on the loan repayment obligations by

failing to make their payment as agreed upon, hence, according to the

loan documents, the whole outstanding balance may become due and

payable. Therefore, as of October 31st, 2017, Defendant, jointly and

severally, owed Plaintiff the principal balance of $149,972.57,

accrued interests since January 1st, 2016, at the annual interest rate

of 3.00%, which will continue to accrue interest at the contractual

rate, accrued late charges in the amount of $386.10, and expressly

agreed-upon attorneys' fees and legal costs in the amount of

$15,358.21.

13. Defendant is the debtor of the aforementioned mortgage loan

in favor of RCAC-II.

14. Defendant is the owner of the mortgaged property, according

to the Puerto Rico Property Registry.

WHEREFORE, Plaintiff demands judgment providing a declaration as

follows:

a) That, as of October 31, 2017, Defendant, jointly and

severally, owed Plaintiff the principal balance of $149,972.57,

accrued interests since January 1st, 2016, at the annual interest rate

of 3.00%, which will continue to accrue interest at the contractual

rate, accrued late charges in the amount of $386.10, and expressly

agreed-upon attorneys' fees and legal costs in the amount of

$15,358.21, pursuant to the terms of the mortgage note included as

Exhibit 1.

b) That, in default of the satisfaction of such sums, that the

real property described in paragraph 8 above be sold at public auction

and that the monies due to Plaintiff be satisfied from the proceeds of

the judicial sale.

c) That should any deficiency arise, Plaintiff may move the

court for further relief.

5. LOAN CHARGES
