MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Memorandum of Agreement made and executed between:

JOSE MARIA COLLEGE , a non-stock, non-profit educational institution,


organized and existing under Philippine Laws with office/business address at
Philippine-Japan Friendship Highway, Sasa, Davao City, represented herein by
DR. NELIA Q. CANADA, the school administrator , hereinafter referred to as the
FIRST PARTY

and

ASSISTANCE TO POOR CHILDRENS AGENCY (APCA) with office


address at 51 Street, Talak Village San Commune, Gudong District Kg Speu,
Cambodia, represented herein by MR. SIM DARA, APCA Director, hereinafter
referred to as the SECOND PARTY.

WITNESSETH:

The parties hereby bind to undertake a Memorandum of Agreement for


the purpose of supporting the FIRST PARTYS on-the-job-training (OJT) for
student-trainees under the following terms and conditions:

1. The FIRST PARTY agrees and allows the affiliation and placement for
internship of two (2) BS Social Work student-trainees at the facility of
the SECOND PARTY, subject to the policies, procedures and
guidelines governing the Affiliation and Training of Students stipulated
on the Assistance to Poor Childrens Agency and that the FIRST
PARTY and the SECOND PARTY shall be responsible and liable to
the fullest extent of their respective roles, task and responsibilities, as
follows:

a) That the FIRST PARTY shall assign a School/College


Coordinator/Instructor to provide liaison function between the
school and the agency;

b) That the School/College Coordinator/Instructor focuses on what the


individual student-trainee is gaining and learning in the field of
exposure in relation to his or her total learning experience;

c) That the FIRST PARTY shall be responsible for briefing the OJT
student-trainees who intend to conduct practicum exposure in the
SECOND PARTY as part of the FIRST PARTYS curriculum.

d) The FIRST PARTY shall provide the OJT student-trainee the


basic orientation on work values, behavior, and discipline to
ensure smooth cooperation with the SECOND PARTY;

2. The SECOND PARTY shall be responsible for the provision of the


Policy/Guidelines under the APCA Students Training Program stated
as follows:

a) That the SECOND PARTY shall provide the students with the
general orientation to include the APCAs Vision, Mission, Goals,
Roles and Functions; its programs and services, organizational
structures and polices and procedures;

b) The SECOND PARTY, upon consultation with the FIRST PARTY,


may require qualified students to submit themselves to
examinations, interviews, and file pertinent documents to support
their application;

c) SECOND PARTY is not obliged to employ Student-Trainee upon


completion of the training;

d) The Student-Trainees shall be personally responsible for any and


all liabilities arising from negligence in the performance of his/her
duties and functions while under training;

e) The SECOND PARTY shall have the right to suspend or revoke for
cause the Memorandum of Agreement or placement after the
consultation with another party for grounds stated hereunder, to wit:

i. Habitual absences of the student/trainee without valid cause


ii. Frequent tardiness
iii. Releasing of confidential information
iv. Misconduct and
v. Other prejudicial acts against the clients of the
center/institution the students will be assigned.

f) The FIRST PARTY shall issue a Certificate of Completion to attest


that the student-trainee have satisfactorily met the requirements for
the program.

3. The duration of the program shall be equivalent to ______ working


hours unless otherwise agreed upon by the FIRST PARTY and the
SECOND PARTY;

4. Any violation of the foregoing covenants will warrant the cancellation of


the Memorandum of Agreement by the SECOND PARTY within thirty
(30) days upon notice to the FIRST PARTY.

5. This Memorandum of Agreement shall become effective upon


signature of both parties and implementation will begin immediately
and shall continue to be valid hereafter until written notice is given by
either party thirty (30) days prior to the date of intended termination.

IN WITNESS WHEREOF, the parties hereto have signed this
