TECHNICAL REQUIREMENTS FOR OVERHEAD LINE RAILWAY CROSSING

1. ANGLE OF CROSSING'
The overhead line crossing shall ncrma!!y be at right angle to the railway track. In special case
a deviation up to 30 may be permitted by the Railway authorities.
2. LOCATION OF TOWER
Only "D" type tower on either side of the Railway track are permitted to be used. The towers
are to be located at minimum required distance from centre of the nearest railway track shall
not be less than the actual height of the tower in Meters above normal ground level plus 6
Meters.
3. CROSSING SPAN
The railway crossing span shall be restricted to 300 meters or 80% of the normal span for
which the structures are designed, whichever is less.
4. TYPE OF INSULATION
A double tension insulator string shall be used in crossing span in conjunction with a yoke
plate where necessary. Each tension insulator string shall have one insulator more than the
no. of units used in normal over head lines. The Factor of Safety of each string of insulators
under the worst conditions shall not be less than 2.
5. FOUNDATION OF RAILWAY CROSSING TOWERS
Foundation of Railway crossing towers should be in accordance with water table and soil
encountered at these locations. The classification of foundations for such towers should be
done cautiously keeping in view safety considerations.
6. EARTHING
(a) Each tower on either side of railway crossing span shall be earthed effectively by two
separate and distinct earthing and connections. At least one separate earth electrode shall be
provided for each earth connection.
(b) Where the earth resistance of the independent tower is higher than 10 ohms, the
counterpoise earthing shall be provided as per requirement of Railways. The method of
earthing the towers for crossing span shall also be approved by the Railways.
7. JOINTS IN CROSSING SPAN
No joints in conductors or earthwire (s) shall be permitted, in crossing span.
8. ANTI-CLIMBING DEVICES AND WARNING NOTICES
The supporting structures on railways land shall be provided with anti climbing devices.
Besides, suitable caution/warning notices shall be erected on all such structures in such
languages as may be prescribed for the purpose. The anti climbing devices and the
caution/warning notices shall be approved by the Railway.
9. NO INTERFERENCE WITH RAILWAY COMMUNICATION LINES
The crossing shall in no way interfere with or endanger railway communication lines and
approval given by the Railways to the placing of any crossing shall not be construed to
compromise or reduce in any way the requirements of Indian Posts & Telegraphs Department
for the protection of communication lines.
10. FACTOR OF SAFETY
The factor of safety of all structures, conductors, guards and ground wires used in the
crossing shall be as stipulated in the Indian Electricity Rules 1956 (as amended in November
1984) and the relevant code of practice.
MINIMUM CLEARANCE BETWEEN THE OVERHEAD LINE & RAILWAY TRACK & RAILWAY
STRUCTURES ETC.

1. Clearances Over the Track


(i) Minimum height above rail ievel of the lowest portion of any conductor of a crossing, including
guard wire, under, conditions of maximum sag shall be as follows:

(ii) No overhead line crossing shall be located over a booster transformer, traction switching station,
traction Substation or a track cabin location in an electrified area. structures, the height above the
rail level of the highest high tension line shall be taken into account for calculating the clearances.

2. Clearances From The Traction Mast or Structure


The distance between any of the crossing conductors and the nearest traction mast or structure
under the most adverse conditions shall not be less than 5 meters.

3. Minimum Vertical Clearance Between Power Line Crossings


The minimum vertical clearances to be maintained between any of the Railways power line
crossings at the same or at different voltages shall be as specified in Rule 37 of the Indian Electricity
Rules 1956 (As amended up to November 1984).

4. Minimum Clearance Between Highest Traction Conductor And Lowest Crossing Conductor
Minimum clearances between the highest traction conductor and the lowest crossing conductor
shall be maintained, as per details given in the following table :

Su.b: Joint Procedure order for granting permission to Overhead Power Line
crossings over Railway track and Under Ground power Cable Crossings of
Railway Tracks on Indian Railways.

Slates have been complaining on excess time being taken by Railways in
granting permission for Overhead Power line crossing (including that for Railway TSSs)
of Railway lines and Under Ground Power Cable Crossings of Railway Tracks. Ministry
of Powel' in this reference requested Ministry of Railways to issue guidelines with
definite tlmelines for issuance of the Railway clearance within one month.

2. To streamline the process and avoid delays of granting permission for Overhead
line electrical crossings (including that for Railway TSSs} over railway lines and
Under Ground Power Cable Crossings of Railway Tracks in a time bound manner,
Ministry of Railway, Railway Board has approved a joint procedure order along with
timelines for various activities as per Annexure I.

3. This must be followed as there have been number of complaints in this regard.

should be considered as NOC from Sr. DEE/Tr.D.

considering Lump sum charges of power and traffic block
including supervision by the relevant Railway departments

For Under Ground power line crossing:


VI Lump sum amount of Rs. 5 lakhs in the form of Bank Guarantee (0+13)
(BG) shall be deposited by the party towards Security Deposit against
possible damage to OFC/Quard/Under ground power cable in
respect of all the under ground power cable track crossing cases
applied by a party in the Division. In case of damage to
OFC/Quard/Under ground power cable, the party will be asked to
deposit the penalty amount otherwise same may be recovered by

PROCEDURE OF CROSSING OF RAILWAY TRACK BY ELECTRICAL POWER LINE.

All the electrical Crossings of Railway Track by overhead transmission lines or cable are to be

processed and cairied out in accordance to the following:

1. The Superintending Engineer of RVPN shall submit all following documents initially:

2. For online submission of Railway crossing case click on https://ircep.gov.in/WLRMS/Then


click on link "click here for online application". Fill all the particulars and submit the
application(at page no. 3)
3. Print the generated copy, sign and submit to Sr. DEE/G enclosing the above tabulated
documents with details including drawings , estimate, sag calculation and block time
required.
4. After checking of above documents Sr. DEE/G permits RVPN for depositing registration fee
amounting Rs. 2000 /-as DD or MR.
5. Feasibility survey to be conducted by Railway authority.
6. After checking, if the site is found in order, then a joint inspection of site shall be fixed by
Sr.DEE/G along with Sr. DEN and RVPN officers and a Joint Inspection report is prepared
and signed by representative of Railway and RVPN. (at page no.27-29)
7. Drawing of railway crossing plan is prepared by RVPN & duly signed by Superintending
Engineer, Sr.DEE/G, Sr.DEN and Sr.DSTE
8. Sr. DEE/G will send the details to following wings for making estimates
i) Sr. DEE/co ordination for Way leave charges
ii) Signal wing for laying of underground cables
iii) Operation wing for Block charges
iv) Electrical wing for Supervision charges.
9. After receiving the estimates from above wings, consolidated estimate for power line
track crossing shall be processed by Sr. DEE/G for vetting by Sr. DFM.

10. After Account 's vetting & sanctioning of estimate, demand note issued by Sr.
DEE/General to RVPN for depositing the estimated charges. (at page no.30)
11. Above mentioned three agreements will be filled & signed by Sr. DEE/G and Sr.
DEN/coordination.
12. The power line track crossing work eecution permission will be issued by Sr.DEE/G on
completion of all formalities i.e. receipt of demand charges, finalization of plan etc. &
intimation of the same shall be issued to all concerned of railway department.
13. The work will be executed by RVPN authorities under the supervision of SSE {P-way), SSE
(Electrical) and SSE {TRD) and SSE {PW) will arrange line block of the section as required.
14. On completion of work(at page no.31), a joint report by Railway and RVPN authorities will
be prepared and RVPN authorities will submit the same to Sr. DEE/G for final inspection
of site.
15. Sr.DEE will issue orders for final inspection of Track crossing with the Electrical and
Engineering Supervisors along with the representative of RVPN.
16. Final inspection shall be carried out in accordance with the Track Crossing Regulation
1987 and all measurements and clearances will be recorded. (at page no.32)
17. On receipt of final inspection report in Sr. DEE's office, if found as per regulation & as per
approved proposal, the permission for energisation will be given by Chief Electrical
Engineer & Electrical Inspector General. (at page no.33)
18. After energisation of railway crossing line by RVPN, the intimation of energisation of
crossing will be given to all concerned officials & date of energisation should be recorded
in track crossing register maintained by division in Electrical branch.
19. Maintenance of crossing:- The periodical inspection of all crossings shall be done in view
of safety as per the clause 9.2 of the regulation. The inspection shall be done by Sr.
DEE/AEE/Sr. Supervisor of the section along with the representative of RVPN at least
once in a year.

Permission to erect and maintain the crossing : The Railway will. subject to
, provis.ions ofclause 3 hereinafter contained. permit the owner to erect and maintain
accordance with the Regulations the crossing over and across the Railway tracks and
ir land at the place(s) shown on the said drawing and to execute all repairs in
nnection therewith when necessary from time to time and all such works shall be
ecuted at the cost oi the owner at such times as may be permitted and to the
tisfaction of the Railway in all respects Provided that if shifting of or modification to or
;mantling of the crossing is required for the proper functioning of the Railway and is
be carried out by the owner <JS desired by the Railway, the costs of such works
1all be borne by the Railway except in those cases where the need for such works
i account of Railway's anticipated development/requirements was foreseen in time
id the owner had agreed in writing prior to the construction of the crossing to meet the
>sts of such works.

Railway to carry out protection work!' . In the event of it being necessary in


1e opinion of the Rc.ilway to support or protect the Railway tracks and I or land or works
uring the erection of the crossing or the execution of any repairs thereto or any
~moval thereof the work of supporting of or protecting the Railway tracks or land and
~sorting the tracks and I or land to its original condition or such part of the said work as
1e Railway shall deem fit will be carried out by the Railway at the cost of the owner in
II respects. The amount of such costs will be determined by the Railway in its absolute
iscretion and will be paid by the owner to the Railway On demand. The owner will, if so
=quired, deposit with the Railway prior to the carrying out of the said work such sum of
ioney as may be' estimated by the Railway to be the cost of the work required to be
lone and the amount of the said deposit will be set off against the said cost to be
letermined as aforesaid and the balance paid as aforesaid.

k Cost of superv1s1on of works All works in connection with the matters


eferred to in clauses 2. 3 and will be subject to such supervision by the Railway as
nay be considered necessary by the Railway and the owner will pay to the Railway on
:lemand all cost of such supervision including the cost for the staff required to look after
:he safety of the Railway tracks and I or land while all or any of such works are I work is
.n progress. The costs of such supervision and other costs as aforesaid shall be
determined by the Railway in its C1bsolute discretion.

5. Access : Neither the owner nor his employees will at any time enter upon the
Railway land for any purpose whatsoever in connection with the crossing as aforesaid
without the consent in writing of the Railway.

nsat1sfactory maintenance or for any reason whatsoever the Railway desires special
aintenance, repairs, mod1f1cat1on, shifting or removal of the crossing the owner will
E ubject to the provisions of clause 3 hereof carry out such works or such portion thereof
ifrom the date of notice issued by ihe Railway and to the satisfaction of the Railway
within a reasonable period determined by the Railway in its absolute discretion as the
Railway shall not under provision of clause 3 hereof proposed to carry out the work. If
the owner so desires he may re-erect the same at this own expense but to the
satisfaction of the Railway in all respects on such other land or trcick of the Railway, as
it may in its absolute discretion consider suitable and available for the purp5se. In the
event of the crossing being so re-erected the land on which the same is re-erected will
be used and occupied upon the terms of the Agreement mutatis mutandis, as if the
same has originally been subject to this Agreemerit.

7. Termination of Agreement by the Railway: The Railway may be any time


(and from time to time) be at liberty in its absolute discretion to suspend temporarily and
I or termi;1ciie this Agreement and aii or any uf t!1e privileges hereby granted upon the
expiration of three month's notice in writing of its intention to do so being left at or sent
0
to the registered office of the owner I and not withstanding that the owner may have
executed any work of a permanent or temporary character and incurred expenses in the
execution thereof. The owner shall not be entitled to any damages or compensation by
~ the reason .of such termination or suspension

8. S'ame as otherwise provided in this contract, all notices to be given on behalf of


the president of India and all other actions to be taken on his behalf may be given or
taken on his behalf by the Chief Electrical Engineer/Divisional Railway Manager I
Divisional Railway Manager(Electrical) of the Railway.

9. Termination of Agreement by the owner : The owner may on giving to the


Railway one month's notice in writing terminate this Agreement and such notice shall be
sufficiently served if sent by registered post to the Chief Electrical Engineer/Divisional
Railway Managi;r I Divisional Railway Manager(Electrical) of the Railway or left at his
office.

10. Termination of Agreement for default : In the event of the Railway giving
notice under clause 7 hereof for special maintenance, repairs, modification, shifting or
removal of the crossing and the owner failing within the time stipulated to carry out the
._said works except such position thererif as the Railway may propose to carry out under
the provisions of clause 3 hereof or in the event of the owner committing any other
breach of this Agreement or any part thereof, the Railway shall be entitled in its absolute
discretion (notwithstanding the provisions. of clause 8 hereof) to terminate this
Agreement and all and any of the privileges hereby granted upon the expiration of six
month's notice in writing of its intentions to do so being given in the manner provided in
clause 7. ~

incurred by the Railway in connection with such work including supervision charges, the
amount which will be determined by the Railway in its absolute discretioq The said
crossing and the materials usec1in connection there with and belonging to the owner will
be and rem<Jin the property of the owner but the Railway will be entitled t6 retain the ~

same but without any liability therefore until the amount of such costs as aforesaid have
been paid by the owner to the Railway. ;~

12. Indemnity: The said crossing w1il be used at the sole ri::;k and resp1:msibility of
the owner. If at any time Owing directly or indirectly to such use or to the E!xistence of
the said crossing or to the carrying Out of the work of erection and I or rep~ir and I or
removal of the said crossing and restoring The land to its original conditio;n or to the
exercise by the owner of any privileges hereby granted or to any other cause' arising out
~ of tha operation of the agreement any damage Will be caused to the Rail\V~Y or to the
permanent way and works, Rolling stock or any other Property of the Rail'ftay or if in
consequence of any of the matters aforesaid or of any default In fulfilling} any of the
conditions of this agreement or of any negligence on the part of the owner or any
person connected with him, any claim or damage or loss be substanti~ted by any
person or persons against the Railway the owner will upon derr>and pay fJrthwith and
make good the same and shall also make good to the Railway all costs an"d expenses
which It may incur in regard to any such claim or damage or loss as afor~said. In the
event of there being any dispute as to what specific loss and I or damage has been
caused by reason of any of the matters aforesaid such dispute will be refrred to the
Chief Electrical Engineer of the railway, whose decision thereon shall be final and
binding. f
13. Railway Accidents : The Railway sfiall not be responsible for an} damage to
the crossing and other property of the owner due to any accident in the wqrking of the
Railway due to any cause whatsoever. 1 ;

14 Sub-letting : The owner will not sub-let, transfer or assign this Agre~ment or
any of the privileges hereby Granted without the previous consent in writing of the

16. Cost of Agreement : All costs and expenses incidental to the pr :fration and
completion of these presents including Stamp dut'/ will be borne and paid t the owner.
17. If at the instance of the Railway, the crossing is to be shifted c .riodified or
disr.1antled, the work shall be. carried out by the owner at. the cost of 1e Railway.
However, in those cases where the need for such works on accoun (:Railway's
anticipated developments I requirements was foreseen in time and U qwner had
agreed in writing prior to the construction of the crossing to meet the cost . >uch works.
Such works shall be carried out on a priority basis by the owner within a f. d. schedule,
as mutually agreed upon between the owner and the Railway and to the tisfaction of
the electrical inspector. The Railway shall have the right to claim camper lion for any
loss and/or inconvenience caused if there is avoidable delay in completin~: .e works.

CEE/EIGfNWR/Jaipur for 220 KV OH Railway track crossing at Krn no. 8519-8610 between
CHNN-CKS Jl.ailway stations. "It should be ensured that All safety precaution are observed
before energization of power line as per T~e Electricity Rules,2005 ,Electricity Act 2003 and
p0wer line track crossing regulation I 987 etc:'.

should be always be !n good condition so prevent any human losses .

PROCEDURE OF MODIFICATION IN EHV LINE AT CROSSING OF RAILWAY TRACK

For any modification/ alteration of track crossing to be carried by the Railways department during
the gauge conversion, the Railway authority shall apply wrt to the modification of existing
transmission line crossing the railway track.

1. Railway authority shall apply to concerning Superintending Engineer of RVPN. (at page
no.35)
2. Initially, the Railway department is required to deposit file charges with RVPN. (at page
no.36) The Superintending Engineer according to voltage level will intimate the file charges
to be deposited by Railway department which is to be adjusted into final demand note.
Amount of file charges as approved by RVPN is as under:

3. 400KV Rs. 2,00,000 per case

3. After depositing the file charges by Railway authority, concerned Accounts Officer of RVPN
will issue confirmation letter having receipt number of File charges. (at page no.37)
4. Concerning Superintending Engineer/ Executive Engineer will check the feasibility of
modification and prepare cost estimate for the above said work including estimated shut
down charges and railway crossing permission charges. (at page no.38-41)
5. Meanwhile Tower schedule & profile will be approved by competent authority of RVPN. (at
page no.42-44)

6. After finalization of cost estimate.Administrative approval is accorded by Chief Engineer


(PPD) as per DOP and Technical Sanction is accorded by Chief Engineer (T&C). (at page
no.45 & 47)
7. After Technical Sanction, demand note is issued to Railways. (at page no.48)
8. Demand Note is deposited by Railway and receipt issued. (at page no.49-50)
9. RVPN will apply for permission for railway track crossing considering the work of
modification as a new work.

10. The procedure indicated under head "PROCEDURE OF CROSSING OF RAILWAY TRACK "
which ever applicable needs to be followed & new agreements are required to be executed
also. (at page no.51-68)
11. Work Breakdown Structure Element code is generated by SE(P&P)/CE(PP&D) for the project
in SAP Module & accordingly all entries/payments are to be made under this code by
concerning officers of T&C circle.

12. Permission will be taken by the concerning Superintending from ORM, Railway for execution
of work. (at page no.69)

13. Letter will be issued by the ORM, Railway for depositing Way leave charges. (at page no.70)
14. Railway authority will issue letter of approval for the modification work of EHV line crossing
the railway track and grant permission to start work. (at page no. 71)
15. The final account of the deposit work of Railway needs to be settled for closing the project.

As per track crossing regulation 1987 following parameters are to be strictly followed .
1. . Horizontal clearance of towers from centre of the track should be minimum H+6 (i.e. His height

As the BG conversion of the said section i~ under fast ;.regress and without modification of these

'2. The line when laid a' aforesaid shall be vested in and shall become the property of the
Administration and shall be under their sole control and the applicant shall have no right or
interest in or claim to the pipe whatsoever subject to the provision of clause thereof

3. At the instance of the application, the Railway administration have agreed to grant
way leave facilities/cas~ment right for the specified purpose of the track crossing for laying
of OVERHEAD TRACK CROSSING FOR LA YING ELECTRIC LINES at above Km's and
drawing No. as approved by the Railway and conditions stated therein.

4. It is agreed that way leave facilities/easement right is allowed and that the Railway
land/way leave facility is not licensed but only permission granted for a limited use as
specified in detail the applicant will carry out all repairs and maintain in good order the way
'leave premises and no construction (where pennanent, quasi- permanent or temporary) is
permitted on Railway land. In case of any construction coming up subsequently, it should be
removed immediately and the way leave facility will be discontinued with. In case of
crossing of Railway tracks rules, terms and conditions for crossing Railway tracks should be
complied with by the applicant.

5. The applicant will deposit as way leave charges a sum of Rs. 1,00,000/- with the
Railway which are calculated as per .Railway Boards letter No. 2001/LML/24/20 dt.
18.10.200!. These charges will be taken for lO years in advance subject to revision of
charges from time to time by Railway. The other charges which include departmental charges
etc aie as per demand note advised by Railway vide No ............................................ .
6. In the event of the way leave facilities being discontinued with, The Railway will not
be liable to pay any comp~nsation or reimburse any amount to the applicant, not to provide

any alternative arrangement for access etc. In such cases, any underground installations etc.
put up by the applicant are liable 1o removed /shifted by the applicant to have the existing
open drainage and surface /overhead pipelines etc. replaced by underground installations at
his cost.

7. Whenever the party intends to carry out any repairs to their cables within the Railway
premises, they will obtain personal approval of AEN concerned before carrying out the
satisfaction of authorized Railway representative.

8. Railway will have underfeed right on the land and in case damage is caused by the
Railway to the cable during inspection/maintenance repairs or due to any reason whatsoever
Railway well not pay any damages.

9. The way leave feasibility will not involve any Railway asset and would not in any
way obstruct free use of the land I bridge /culve11s by the Railway.
10. Railway interest and maintainability for the structure track will not be affected in any
way whatever because of this cable.

ANAGREEMENT made this day of two thousand
an~ BETWEEN THE PRESISDENT OF INDIA acting through the Chief
Electrical Engineer/Divisional Railway Manager /Divisional Railway Manager
(Eltct]ical) of the _ __ Railway administration (hereafter called" the Railway")
of the one part and __ (hereinafter refetred to as "the o..-ner" of the other part.
WJiEREAS the owner wishes to erect an electric overhead line and carry out the works
con"nected there with for transmission of distribution of electrical energy over and
across the Railway 1racks and /or land at kilometrage_.___ in the section
_1_ at ____ Railway station., of the Railway, the said over
head line where it crosses the Railway tracks and /or land works connected therewith
hetf'inafter referred to as the "crossing" Now IT IS HEREBY AGREED AS Follows:

1. General: The Railway will permit the owner as from the _ day of 20 , to lay

2. Permission to erect and maintain the crossing:- The Railway will, subject to

maintain in accordance with the Regulations the crossing over and across the
~ Railway tracks and ior land at the place(s) shown on the said drawing and to

Railway to carry out protection works: - In the event of it being necessary


in the opinion of the Railway to support or protect the Railway tracks and
/or land or w>rks during the erection of the crossing or the execution of any
!J' repairs thereto or any removal thereof the works supporting of or protecting
the Railway tracks or land and resorting the tracks and /or land to its
original condition or such part of the said works as the Railway shall deem
fit will be carried out by the Railway at the cost of the owner in ali respects.
The amount of such costs will be determined by the Railway in its absolute
discretion and v..ill be paid by the owner to the Rly. on demand. The owner
will, if so required, deposit with the Railway prior to the carrying out of the
said works such sum of money as may be estimated by the Railway to be the
cost the work required to be done and the amount of the said deposit will be
set off against the said cost to be determined as aforesaid and' the balance
paid as aforesaid.

4. Cost of Supervision of works


All works in connection with the matters referred to in clauses 2,3 and 6 will
be subject to such supervision by the Railway as may be considered
necessary by the Railway and the owner will pay to the Railway on demand
all costs of such supe1vision including the cost for the staff required to look
after the safety of the Railway tracks and/ or land while all or any of such
works are/work is in progress. The costs of such supervision and other costs
as aforesaid shall be determined by the Railway in its absolute discretion.
5. Acces:::,;:-Neither the o\\~ner r1or his ernployees will at any time enter upon the
Railway land for any purpose whatsoever in connection with the crossing as
aforesaid without the consent in writing of the Railway.
6. Modification, shifting or removal of crossing
If for convenience of operation, unsatisfactory maintenance or for any reason
whatsoever the Railway desired special maintenance, repairs, modification,
shifting or removal of the crossing the owner will, subject to the provisions of
clause 3 hereof carry out such works or such portion thereof from the date
of notice issued by the Railway and to the satisfaction of the Railway within
a reasonable period determined by the Railway in its absolute discretion as
the Railway shall not under provision of clause 3 hereof proposed to carry
out the works. If the owner so desired he may re erect the same at this own
expense but to the satisfaction of the Railway in all respect on such other
land or track oi the Railway, as it may in its absolute discretion consider
suitable and available for the purpose. In the event of the crossing being so
re erected the land on which the came is re erected will be used and
occupied upon the terms of the agreement mutatis mutandis, as if the same
has originally been subject to this agreement.
7. Termination of agreement by the Railway
The Railway may be any time (and from time to time) be at liberty in its
absolute discretion to suspended temporarily and/or terminate this
agreement and all or any of the privileges hereby granted upon the
expiration of three months notice in writing of its intention to c)o so being left
at or sent to the registered office of the owner/and not withstanding that the
owner may have executed any work of a permanent or temporary character

11. Removal of crossing.
Prior to the. termination of this agreement and subject to the provisions of

I clause 3 hereof the owner will at his own cost remove the crossing from the
property of the Railway and restore the land to its original condition to the
satisfaction of the Railway in all respects. In the event of the owner failing to
remove the said crossing and restore the land to its original condition in the
manner herein before provided the Railway will be entitled at its option
immediately after the termination of this agreement to carry out the work of
removal of the crossing or any part thereof. In such an event the owner will
pay to the Railway on demand all costs incurred by the Railway in
connection with such work including supervision charges, the amount which

will be determined by the Railway in its absolute discretion. The said


crossing and the materials used in connection therewith and belonging to
the own.er will be and remain the property of the owner but the Railway will
be entitled to retain the same but without any liability therefore until the
amount. of such costs as aforesaid have been paid by the Railway.

12. Indemnity.
The said crossing will be used at the sole risk and responsibility of the
owner. If at any time owing directly or indirectly to such use or to the
existence of the said crossing or to the carrying out of the work of erection
and/or repair and/or removal of the said crossing and restoring the land to
its original condition or to the exercise by the owner of any privileges hereby
granted or to nay other cause arising out of the operation of the agreement
any damage will be caused to the Railway or to the permanent way and
works, rolling stock or nay other property oi the Railway or if in consequence
of any of the matters aforesaid or of any default in fulfilling any of the
conditions of this agreement or of any negligence on the part of the owner or
any person connected with him, any claim or damage or loss be

15. Limitation of rlghts

I 16. Cost of Agreement.


Al! costs and expenses incidental to the preparation and completion of these
presents including stamp duty will be borne and paid by the owner.

17. Contents of Para 9.5 of regulations for power line crossing of railway
track- 1987.
"If at the instance of the railway, the crossing is to be shifted or modified or.
dismantled, the work shall be carried out by the owner. at the cost of the
Railway. However, in those cases where the need for such works on account
of Railway's anticipated developments/requirements was foreseen in time
and the owner had agreed -in writing prior to the construction of the crossing
to meet the cost of such works. Such works shall be carried out on a priority
basis by the owner within a fixed schedule, as mutually agreed upon
between the owner and the railway and to the satisfaction of the electrical
inspector. The railways shall have the right to claim compensation for any
loss and/or inconveniences caused if there is avoidable delay in completing
the works."

2. Pen!lission to erect and maintain the crossing:- The Railway will, subject to
the prmisions of clause 3 hereinafter contained, permit the owner to erect and
maintain in accordance with the Regulations the crossing over and across the
Railway tracks and i or land at the place(s) shown on the said drawing and to

execute all repairs in connection therewith when necessa1y from time lo time and all :)

such works shall be executed at the cost of the owner at such times as may be
permitted and to the satisfaction of the Railway in all respects.

"Provided that if shifting of or modifications to or dismantling of the crossing is


required for the proper functioning of the Railway and to be carried out by the owner as
desired by the Railway.the cost of, such works shall be born by the Railway except in those
cases where the need for such works on account of Railways anticipatd
development/requirement was foreseen in time and the owner had agreed in writing prior nto
the construction of the crossing to meet the cost of such works.

3. Railway to carry out protection works: - In the event of it being necessary in


the opinion of the Railway to support or protect the Railway tracks and i or land or
works during the erection of the crossing or the execution of any repairs thereto or
any removal thereof the works supporting of or protecting the Railway fracks or
land and resorting the tracks and i or land to its or; ginal condition or such part of the
8aid works as the Railway shall deem fit will be carried out by the Railway at the
cost of the owner'in all respects. The amount of such costs will be determined by the
Railway in its absolute discretion and will be paid by the owner to the Railway on
demand. The owner will, if so required, deposit with.
