FLY ME NEXT INSURANCE
TERMS AND CONDITIONS

The Insured stipulated in this policy shall be the person named in the Schedule who has
applied for coverage with Malayan Insurance Company, Inc. herein referred to as the
Company.

The Company shall, subject to the limits terms, conditions and exceptions mentioned herein,
and the payment of premium as consideration of this insurance, indemnify the Insured against
(a) Late Check-in or (b) Missed Cebu Pacific Flight due to any of the following reasons:

a. public transport (including scheduled flights) does not run according to its timetable;
b. the vehicle carrying the insured has figured in an accident or breaks down.

DEFINITION OF TERMS

LATE CHECK-IN

Late check-in shall refer to the non-admission of the passenger to board, due to his
arrival at the check-in counter of the airport of departure, later than 45 minutes before the
estimated time of departure (ETD) as reflected in the plane ticket.

MISSED FLIGHT

Missed Flight shall refer to the non-admission of the passenger to board, due to his
arrival at the check-in counter of the airport of departure after the original ETD reflected in the
ticket, with the intention of continuing his planned trip by taking the next available flight, provided
that purchase of travel ticket for the replacement flight is done at the airport and within 8 hours
from the original scheduled flight that the passenger missed.

COMMENCEMENT AND TERMINATION OF COVERAGE

Coverage of this policy takes effect twelve (12) hours before the time of departure or from the
time the Insured leaves his place of work or residence with the intention of commencing the
scheduled flight whichever is later; and terminates upon boarding of the Insured on his/her
plane or the happening of the insured event stipulated herein.

EXCLUSIONS

The Insurers will not indemnify the Insured directly or indirectly caused by, or arising out
of:

a. Delay caused by riot, civil commotion, strike or industrial action which began or
was announced before the covered period or before the travel tickets for the
journey were bought, whichever is later.
b. Failure of public transport caused by riot, civil commotion, strike or industrial
action which began or was announced before the insured passenger left his
residence or where the passenger could have made other travel arrangements.
c. Withdrawal from service of an aircraft, cross-channel train or sea vessel
(temporarily or permanently), on which the passenger was booked to travel, by

the carrier or on the recommendation or order of any government, civil aviation
authority, port authority, rail authority or other similar authority in any country.
d. Loss or damage caused by or resulted from:
1. Hostile or warlike action in time of peace or war, including action in
hindering, combating or defending against or actual, impending or
expected attack.
a. by any government or sovereign power (de jure or de facto), or by any
authority maintaining or using military, naval or air forces;
b. by military, naval or air force;
2. Any weapon or war employing atomic fission or radioactive force whether
in time of peace or war.
3. Insurrection, rebellion, revolution, civil war, usurped power or action taken
by government authority in hindering, combating or defending against
such occurrences, seizure or destruction under quarantine or customs
regulations, confiscation by order of any government or public authority,
or risk of contraband or illegal transportation or trade;
e. Nuclear reaction, nuclear radiation or radioactive contamination.
f. Third Party or General Public Liability;
g. Delay, Confiscation or Detention by Customs or other Officials or Authorities
h. Willful act or negligence of the insured or his representatives.

THE CONDITIONS UPON WHICH THIS POLICY IS GRANTED

1. Construction of Contract and Definitions


This Policy and the Schedule shall be read together as one contract and any word or
expression to which a specific meaning has been attached in any part of this Policy or of the
Schedule shall bear such meaning wherever it may appear.

2. Premium Receipts
No payment in respect of any premium shall be deemed to be payment to the Company
unless a printed form of receipt for the same signed by an Official or duly appointed Agent of
the Company shall have been given to the Insured.

3. Notice of Claim
The Insured shall, on the happening of any event giving rise or likely to give rise to a claim,
give immediate written notice to the Company within seven (7) days upon occurrence of the
event, with full particulars thereof and shall execute and do all such acts and things as the
Company may reasonably require.

4. Records
The Insured shall keep verifiable records in such manner that the Company can accurately
determine therefrom the amount of loss.

5. Assignment
No assignment of interest under this Policy shall be binding upon the Company without its
written consent. If the Insured shall be adjudged bankrupt or insolvent, or die during the
Period of Insurance, this Policy, unless cancelled shall continue in favor of the legal
representatives of the Insured, provided written notice shall be given to the Company within
thirty (30) days after the date of such death or adjudication.

6. Fraudulent Claims
If any claim be, in any respect, fraudulent or if any false declaration be made or used in
support thereof or if any fraudulent means or devices be used by the Insured or anyone
acting on his behalf to obtain any benefit under this Policy or if the loss or damage be
occasioned by the willful act or with connivance of the Insured, all benefits under this Policy
shall be forfeited.

7. Settlement of Claim Clause


The amount of any loss or damage for which the Company may be liable under this Policy
shall be paid within thirty (30) days after proof of loss is received by the Company and
ascertainment of the loss or damage is made either by agreement between the Insured and
the Company or by arbitration; but if such ascertainment is not had or made within sixty (60)
days after such receipt by the Company of the proof of loss, then the loss or damage shall
be paid within ninety (90) days after such receipt.

8. Arbitration Clause
By agreement of the parties, any dispute arising under this policy shall be referred to
arbitration pursuant to Alternative Dispute Resolution of 2004 (R.A. 9285).

9. Action against the Company


If a claim be made and rejected and an action or suit be not commenced either in the
Insurance Commission or in any court of competent jurisdiction within twelve (12) months
from receipt of notice of such rejection or (in case of arbitration taking place as provided
herein) within twelve (12) months after due notice of the award made by the arbitrator or
arbitrators or umpire, then the claim shall for all purposes be deemed to have been
abandoned and shall not thereafter be recoverable hereunder.

10. Subrogation
In the event of any payment under this Policy, the Company shall be subrogated to all the
Insureds right of recovery thereof against any person or organization and the Insured shall
execute and deliver instruments and papers do whatever else is necessary to secure such
rights. The Insured shall do nothing after loss to prejudice such right.

11. Cancellation
This Policy shall not be cancelled by or on behalf of the Company except in accordance with
and pursuant to the provisions of Sections 64 and 65 of the Insurance Code. In the event of
such cancellation, the Company shall refund the paid premiums less the taxes and charges
applied, i.e., Documentary Stamp Tax, Municipal Tax and VAT. Likewise, this Policy may be
cancelled on the short rate basis set forth in the Short Period Rate Scale provided for herein
at the request of the Insured.

Short Period Rate Scale

If cancellation is requested more than 7 days before date 50% of the premium
of departure charged
If cancellation is requested 7 days or less before date of 75% of the premium
departure charged

12. Changes in the Policy
None of the provisions, conditions, and term of this Policy shall be waived or altered except
by endorsement signed or initialed by an authorized official of the Company and issued in
accordance with the provisions of Section 50 of the Insurance Code.

13. Receipt of Payment Clause


Except only on those specific cases where corresponding rules and regulation which now
are or may hereafter be in force provide for the payment of the stipulated premiums in
periodic installment at fixed percentages, it is hereby declared, agreed and warranted that
the insurance provided under this Policy shall be deemed effective, valid and binding upon
the Company only when the premiums thereof have actually been paid in full and duly
acknowledged in a receipt signed by any authorized official or representative/agent of the
Company.

14. Civil Code Article 1250 Waiver Clause


IT IS HEREBY DECLARED AND AGREED that the provision of Article 1250 of the Civil
Code of the Philippines (Republic Act No. 386) which reads:
In case on extra-ordinary inflation or deflation of the currency stipulated should
supervene the value of the currency at the time of the establishment of the obligation
shall be the basis of payment.shall not apply in determining the extent of liability
under the provisions of this Policy.

15. General Conditions


The aforementioned coverage benefits (Missed Flight and Late Check-in) are only
applicable whilst the Insured is traveling in any Cebu Pacific flight.

DOCUMENTARY STAMPS CLAUSE

Under pertinent regulations of the Bureau of Internal Revenue, liability for documentary stamp
tax (DST) accrues upon issuance of the Insurance Policy. Hence, in the event of a valid
cancellation of the Policy under Section 64 of the Insurance Code, liability for the DST subsists
and the same shall be chargeable to the Assured. Therefore, payment of the corresponding
DST is immediately due and demandable, i.e., on a "cash and carry" basis, as soon as the
Assured receives a copy of this Policy.

IMPORTANT NOTICE

The Insurance Commissioner, with offices in Manila, Cebu and Davao, is the government official
in charge of the faithful execution and enforcement of all laws relating to insurance and has
supervision over insurance companies. He is ready at all times to render assistance in settling
any controversy between Insurance Company and a policy holder relating to insurance matters.
