The Insured stipulated in this policy shall be the person named in the Schedule who has
applied for coverage with Malayan Insurance Company, Inc. herein referred to as the
Company.
The Company shall, subject to the limits terms, conditions and exceptions mentioned herein,
and the payment of premium as consideration of this insurance, indemnify the Insured against
(a) Late Check-in or (b) Missed Cebu Pacific Flight due to any of the following reasons:
a. public transport (including scheduled flights) does not run according to its timetable;
b. the vehicle carrying the insured has figured in an accident or breaks down.
DEFINITION OF TERMS
LATE CHECK-IN
Late check-in shall refer to the non-admission of the passenger to board, due to his
arrival at the check-in counter of the airport of departure, later than 45 minutes before the
estimated time of departure (ETD) as reflected in the plane ticket.
MISSED FLIGHT
Missed Flight shall refer to the non-admission of the passenger to board, due to his
arrival at the check-in counter of the airport of departure after the original ETD reflected in the
ticket, with the intention of continuing his planned trip by taking the next available flight, provided
that purchase of travel ticket for the replacement flight is done at the airport and within 8 hours
from the original scheduled flight that the passenger missed.
Coverage of this policy takes effect twelve (12) hours before the time of departure or from the
time the Insured leaves his place of work or residence with the intention of commencing the
scheduled flight whichever is later; and terminates upon boarding of the Insured on his/her
plane or the happening of the insured event stipulated herein.
EXCLUSIONS
The Insurers will not indemnify the Insured directly or indirectly caused by, or arising out
of:
a. Delay caused by riot, civil commotion, strike or industrial action which began or
was announced before the covered period or before the travel tickets for the
journey were bought, whichever is later.
b. Failure of public transport caused by riot, civil commotion, strike or industrial
action which began or was announced before the insured passenger left his
residence or where the passenger could have made other travel arrangements.
c. Withdrawal from service of an aircraft, cross-channel train or sea vessel
(temporarily or permanently), on which the passenger was booked to travel, by
2. Premium Receipts
No payment in respect of any premium shall be deemed to be payment to the Company
unless a printed form of receipt for the same signed by an Official or duly appointed Agent of
the Company shall have been given to the Insured.
3. Notice of Claim
The Insured shall, on the happening of any event giving rise or likely to give rise to a claim,
give immediate written notice to the Company within seven (7) days upon occurrence of the
event, with full particulars thereof and shall execute and do all such acts and things as the
Company may reasonably require.
4. Records
The Insured shall keep verifiable records in such manner that the Company can accurately
determine therefrom the amount of loss.
5. Assignment
No assignment of interest under this Policy shall be binding upon the Company without its
written consent. If the Insured shall be adjudged bankrupt or insolvent, or die during the
Period of Insurance, this Policy, unless cancelled shall continue in favor of the legal
representatives of the Insured, provided written notice shall be given to the Company within
thirty (30) days after the date of such death or adjudication.
8. Arbitration Clause
By agreement of the parties, any dispute arising under this policy shall be referred to
arbitration pursuant to Alternative Dispute Resolution of 2004 (R.A. 9285).
10. Subrogation
In the event of any payment under this Policy, the Company shall be subrogated to all the
Insureds right of recovery thereof against any person or organization and the Insured shall
execute and deliver instruments and papers do whatever else is necessary to secure such
rights. The Insured shall do nothing after loss to prejudice such right.
11. Cancellation
This Policy shall not be cancelled by or on behalf of the Company except in accordance with
and pursuant to the provisions of Sections 64 and 65 of the Insurance Code. In the event of
such cancellation, the Company shall refund the paid premiums less the taxes and charges
applied, i.e., Documentary Stamp Tax, Municipal Tax and VAT. Likewise, this Policy may be
cancelled on the short rate basis set forth in the Short Period Rate Scale provided for herein
at the request of the Insured.
If cancellation is requested more than 7 days before date 50% of the premium
of departure charged
If cancellation is requested 7 days or less before date of 75% of the premium
departure charged
Under pertinent regulations of the Bureau of Internal Revenue, liability for documentary stamp
tax (DST) accrues upon issuance of the Insurance Policy. Hence, in the event of a valid
cancellation of the Policy under Section 64 of the Insurance Code, liability for the DST subsists
and the same shall be chargeable to the Assured. Therefore, payment of the corresponding
DST is immediately due and demandable, i.e., on a "cash and carry" basis, as soon as the
Assured receives a copy of this Policy.
IMPORTANT NOTICE
The Insurance Commissioner, with offices in Manila, Cebu and Davao, is the government official
in charge of the faithful execution and enforcement of all laws relating to insurance and has
supervision over insurance companies. He is ready at all times to render assistance in settling
any controversy between Insurance Company and a policy holder relating to insurance matters.
