Criminal law

In the criminal justice system, violent crime, property crime white collar crime

and organized crime are considered intolerant. The federal, state and local law provide

for the classifications and punishment of hundreds of thousands of criminal acts. Criminal

law is the part of law that relates to crime. This law helps to regulate social conduct and

proscribes whatever is threatening, harmful, health safety and also moral welfare.

Criminal law is an important part of the legal environment of business. To have a better

understanding of the types of crimes that relates to business, I will start defining what a

crime is. A wrong against society set forth in a statue and punishable by a fine and or

imprisonment or even with death in some cases.

For a person to be convicted of a crime there must be two simultaneously elements

which are the performance of a prohibited act act reus and a specified state of mind, or

intent, on the part of the actor means rea. If a person has the intention of attempting a

murder or robbery this person can be punished for the intent only if it actions are some

steps toward the criminal objective. The act Reus refers to those omission situations in

which this action can be considered a crime. The Mens Rea is a wrongful mental stare is

typically required to establish criminal liability. For example murder involves the guilty

act of killing another human being, and the guilty mental state is the desire or intent to

take another life.


In todays society, criminal behavior and criminal trials are highly publicized in

the media and commonly the storyline in hit television shows and movies. As a result,

people may consider themselves well-informed on the different types of crimes.

However, the law can be quite complicated. There are many different types of crimes but,

generally, crimes can be divided into five major categories, the first one is violent crime

is the Offenses against the Person These are crimes on this category that result in

physical or mental harm to another person. Each violent crime is further classified by the

degree of the circumstances surrounding the criminal act. The second type of crime is

Property crime which is the Offenses against Property: These are crimes that do not

necessarily involve harm to another person. Instead, they involve an interference with

another persons right to use or enjoy their property. Is the most common type of crime

in which the offender goal is to take economic advantage of the property stolen. Some

crimes are Bulgary which is defined as a breaking and entering the dwelling of another at

night with the intent of commit felony.

To continue with the types of crime in the third type of crime we have public order

crime,this crimes are sometimes referred to as victimless crimes. This crimes normally

harm only the offender. From a broader perspective, however, they are deemed

determined to society as a whole because they may create an environment that gives rise

to property and violent crimes. The fourth type is white collar crime which is a nonviolent

crime committed for financial gain. Securities fraud, embezzlement, corporate fraud and

money laundering are examples of white-collar crime. Usually this types of crimes takes

places in the course of a legitimate business corporation occupation. Also corporate

crimes fall in this category. Embezzlement is when a person is in position of trust takes

money or property for his/her own use. The last type is organized crime, this operates

illegitimately by, amount other things, providing illegal goods and services. Traditionally,
the preferred markets for organized crime have been gambling, prostitution, narcotics

amount others.

Finally, in all this types of crimes always are someone affected by this illegal

actions. Violent crime usually is a person affected or less than 3, in property crime the

objective of the offender is to advantage of the property of a person. In the case of White

collar crime in most of the cases is an employee who tries to steal all the money for a

company and this crime affect thousands of people within in a business who may lose

their jobs. But the difference with organized crime is that an entire business affect many

people because of their good that they sell. As in the case of Drug trafficking this business

destroy the life of the consumers, the employee, innocent people die and this continue.

Instead of white collar that in some cases even the CEO is the one who destroy a business.

For example in the movie fun with Dick and Jane of Jim Carey he was ascended to be

vice-president of the company and he was cheated by his boss to ruin the company and

he keeps with the all company money.
