MOTION TO RECTIFY NAMED COMPLAINANT

COMES NOW, the complainant in the above-entitled case, through legal counsel, most
respectfully asseverates that:
1. On __, an Isuzu elf canopied truck described below owned and operated by ___, was
recklessly driven by respondent thereby causing the bumping of said truck with a Ford
Everest with conduction sticker under the name of __ its registered owner, in the
possession and used by the latters agent and attorney-in-fact___, the above-named
complainant, which incident occurred at Camp 1, Tuba, Benguet;

2. The named complainant is merely an agent and attorney-in-fact of the registered owner
of the Ford Everest that was bumped and damaged in the aforesaid incident;

3. Said registered owner of the Ford Everest, due to the distance of the venue of the case,
could not personally attend to the prosecution of his case and seek for the
indemnification of the damages he has incurred due to the incident;

4. The named complainant thus most respectfully requests the Honorable Prosecutors
Office to rectify the Title of the subject case and substitute the registered owner of the
Ford Everest, ___, as the proper complainant of the case, suing through his attorney-in-
fact, ___ and that all pleadings, motions, and other court processes be served at the
latters residence at ___;

5. Such request was made in consideration of the ruling of the Supreme Court in the case of
_______________ which provided for

6. The Special Power of Attorney which authorizes the attorney-in-fact, __, to sue for and in
behalf of the registered owner of the __ is attached herein.

WHEREFORE, MANIFESTATION AND PREMISES CONSIDERED, it is most respectfully

prayed of this Honorable Provincial Prosecutors Office that the Complainant in the instant case
be rectified to reflect the name (principal), as the proper complainant, AS REPRESENTED BY HIS
ATTORNEY-IN-FACT, _____.
Such other reliefs and remedies just and equitable are respectfully prayed for.
