AFFIDAVIT OF NUCO QUINN

I, Nilco Qninn, being of soimd- iniftd and lawful age, hereby state on my oath as follows:

1. My name is Niko Qulnn, but I am often called (<Nikki." I was born in 1972, and have
resided in Kansas City, Kansas or Kansas City, Missouri, for almost my entire life. .

2, My mother's name is Joseplune Quiim. She is elderly and presently resides in a care
facility.

3. In April 1994,1 lived on fhe 3000 block ofHutchings Street, Kansas City, Kansas,
with my small children. One of my sisters, Stacy Quimi, lived with our mofher,
Josephine Quiim, just a couple of doors away, also on Hutcliings Street.

4. I have a large family, including many consitis, aunts and uncles. Throughout my life,
I have kept close relationships with many of my family members. One cousin with
whom I was especially close was Domel Quinn, the son of my uncle John Quimi.

5. OnApril 15,1994, Doniel was shot and killed while he sat in a car on. Hutchings
Street with another man, Donald Ewing, who was also a cousin of the family.

6. My mother and my sister Stacy and I all witnessed the shooting. To tihis day, I
continue to suffer from grief and trauma over flie loss ofDoniel and the horror of
witnessing the murder.

7, On the day of the shooting, I remember that I was walking up Hutchings Street to my
mother's house to use the phone. Across the street, I saw a young black male in dark
clothing walking through a field, coming down aliill fixm fhe next street, Hiawatha.
He came rapidly down the bill, a shotgun at his side and walked up to fhe passenger
side of a blue Cadillac parked on the street.

8. The man fired three shots into the car, at the passenger and the driver. He fhen turned
and ran back through- the field toward Hiawafha.

9. My uncle John and his brother, Robert, had been sitting in another car on the street.
At the time of the shots, they had been driving up fhe street They quickly turned
aroimd and came back.

10. My sister Stacy ran outside, and my mofher losepliine was on her porcli. They both
saw the shooting. Stacy was yelling and crymg that it was "Little Don."

11, My uncle John, who was DoniePs father, came up and busted out the window of the
driver's side offhe Cadillac. We saw my cousin Doniel, "Little Don," slumped over
in fhe passenger side of fee car. We were yelling at Doxiiel to hang on, but he was

"badly wounded and was taking Ids last breaths. The other man m the car was Don
Ewing, a consul on my grandfather's side.

12. Both Doniel and Don were taken to fho hospital, and many police soon arrived. on the
scene.

13.1 talked to a detective right after the shootmg and gave a statement. I don't remember
exactly what I said to police, but I do recall tiiat the shooter was wearing dark clothes,
that he had caraxnel colored skin, ameditimWldaiidwasabout5'6"or5^7"tall.
One fhmg I do remember teUing the police was that Doniel had been beaten up a few
days before by people who lived m the house where Doniel had been staying. That
house was a drug house, and Dcmiel was known to be involved with dmgs,

14.1 remember that after Doniel was beaten up, he came over to my house and told me
and my former boyfriend that Aaron Robinson and some of his "boys" had beaten
him up because they suspected he had stolen drugs from Uiem. "Ace" is Nell Edgar,
and his son is Neil Edgar, Jr., whose name on the street is "Monster."

15. Doniel denied that he stole the drugs. But we knew that he sometimes stayed at a
house on Norfch 21 Street that was known as "Aaron's spot." It was a drug house
that I later found out was operated by Cecil Brooks and Aaron Robinson, and Domel
sometimes worked there as a doorman, letting people in and out. Daniel's family
knew Ibat Doniel was spending time with dangerous people, and his family worried
about him.

16. Sometime after the shooting -1 don't recall exactly when my sister, Stacy, told
me that Monster was the shooter. She said Cecil Brooks had paid Monster (Ndl
Edgar, Jr.) toIdllDoniel. Of all of us onHutctdngs Street that day, Stacy had the best
opportunity to see the shooter. She was dght across the street when Doiuel was shot.

17. The day after the shooting, tihe police came to my house to talk to me again about
what I saw. Detective Golubsld and another detective showed me four or five photos,
and Detective Golubsld told me that if I knew who it was, I'd better testify and that it
would be 'better for me if I did.

18. When I looked at the photos and told Detective Golubsld I wasn't sure, he pressured
me to make an identification. But I told him I wasn*t sure and could not make an
identification. But I noticed, that when the ofker defective was holding the photos for
me to look at, he placed his thumb on Lamonte Mclntyre's photo, as if he were
pointing at it. At the same time that detective was pointing at Lamonte, Detective
Golubski was teIHng me that police liad an-ested tlie shooter and had tiie gun. I
remember seeing the name Lamonte" on the photo, and I remember that Ruby said
the name "Lamonte" on fhe day of the shooting.

19. A week or two or maybe a month later, I spoke again with. Defective Golubski. We
met behind the Wyandotte High School track. I was scared because I had seen two

men on a vacant lot near my house. I told Defective Golubsld about this, a^d lie said
he would help me move to a new place, which he later did.

20. In fhis same conversation, Detective Golubski continued to put a lot of pressure on
me to make an identification. I thought that Lamonte in some ways looked somewhat
similar to the shooter. I was scared, and I allowed Detective Golubsld to push me to
identify Lamonte Mcltityre from his photograph.

21, When I came to the coni'thouse to testify^ I saw Lamonte Mchityre. As soon as I saw
him stand up in the courtroom, I realized that he absolutely could not be the shooter
because he was much taller than the shooter. Also, his ears are too large and stick out
too far away from his face, and the shooter's ears did not. I knew then, and I know
now, lihat Lamonte Mclntyi'e was not the man who shot Doniel and Don. At the
courthouse, I talked to the prosecutor, Terra Moreliead, and told her twice that
Lamonte Mclntyre was not the shooter, that the police had the wrong man. Ms.
Morehead dismissed my statement and told me I could be held in contempt and go to
jail and have my children taken from me. I testified, and let tlie prosecutor lead me
tlirough my testimony. When I left the courfeouse, I was very upset.

22, Before that hearing, a woman (who I believe to be Ms. Morehead) and two men had
come to my house. I was not fhere at the time. They told my cousin, Sandy Quinn,
fhat if I did not testify to what I had said in my statement, that I would be held in
contempt of court and that my children would be taken away or I could go to jail.
Wlien I teamed about this, I was extremely^. I contacted a cousin who was a lawyer at

23.1 also recall talking to Ms. Morehead one other time. I met wifh_ her at the ^ll-"v" ' .
courthcmse, and she showed crime scene photographs to me. The photographs of the
scene were very upsetting.

24> Over fhe years, I have told many people fhat the wrong man was convicted for
Dordel's murder. Lamonte IVTcIntyre was not the shooter. In fact, I signed an
affidavit in April 1996 stating that I toiew Laxnonte Mclntyre was not the Idller and
that the police had pressured me and had threatened to take away my children.

25. Several years after tiie m-m'der, Bemai-d May, who was a friend of Monster's and who
wag also an acquaintance of mine, told me that Mobster was fhe one who had Idlled
Daniel, He said Monster had been paid to do the murder.

26. Bernard May's statement confirmed what I att-eady knew. Stacyliad told me the
sliooter was Monster. Also, about two years after the shooting, Bernard May (who is
now deceased) had come to my house one day with Monster, and Monster had said to
me, in a menacuig manner: "Do you Jaiow who I am?" Monster was clearly trying to
inlimidute me and send me a message. When Bernard May later told me fhat Monster
was the one who had killed Doniel, that all made sense.

27.1 also remember on two occasions after the shooting that I was out with Stacy when
sbe saw Monster. Seeing hij-n upset lier, as she was afraid of liim. Stacywas also
afraid of the police. She told me one time that a police officer had intentionally
Mnned her wifli a cigar. I also knew that Stacy had a sexual relationship witli
Detective Golubsld that went on over a mmiber of years.

28.1 remember telliitig Detective Golubski on a number of occasions througlii the years
that police had gotten fhe wrong man for DoniePs murder. I told him that my sister
said the real killer was Monster, Detective Golubsld said nothing when I told him
fhis, and he took no action.

29.1 am signing this affidavit because I know that Lamonte Mclntyre was not the man
who shot my cousin, Doniel. I saw the shooter myself, and I know that Lamonte is
not the sHootet. He is significantly taller than tlie shooter and looks very different
fi'om the shooter because of the way his ears stick out from his head,
