AFFIDAVIT OF APPREHENSION

I, ACE SALCEDO, of legal age, married, Barangay Official and a

resident of Brgy. , after having duly sworn to an oath in accordance with
the law, do hereby depose and say to wit:
(1) that I am the same and identical person executing this
affidavit;
(2) that on or about 1:55 p.m. of October 15, 2017, I
received a cellular phone call from SPO2 Intel PNCO, PNP
member of Magsaysay MPS that the alleged suspect of rape
EDSEL JAMES SANDICO, was sited at Prk 5, Brgy Kanapolo,
Magsaysay, Davao del Sur.
(3) That after receiving the information, I as Barangay
Captain immediately proceeded to the said place to respond
and verify the said report. Upon my arrival at Purok 5 in front
of SANDICO residence it was positive that the said suspect
EDSEL JAMES SANDICO, male, jobless, Cebuano and a resident
of ___ was at the said place;
(4) That immediately, I approached the said suspect EDSEL
JAMES SANDICO and informed him that he was the alleged
suspect of rape on October 14, 2017 at about 11:00 p.m. that
transpired at Purok 5, Brgy. New Upon, Magsaysay, Davao del
Sur;
(5) That on the same day of October 15, 2017, I immediately
effect the arrest of the suspect EDSEL JAMES SANDICO and
informed him of his constitutional rights under Miranda Doctrine
in Cebuano dialect which the suspect used to understand;
(6) That thereafter, I endorsed the said suspect to the
authorities of Magsaysay Municipal Police Station, Magsaysay,
Davao del Sur for further investigation and filing of appropriate
charges.

IN WITNESS THEREFOR, I here unto set my hand this 17th day of
