further to amend the Indian Stamp Act, 1899 (2 of 1899), in its application to the State of Himachal
Pradesh.

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty-third Year of the
Republic of India as follows:-

1. This Act may be called the Indian Stamp (Himachal Pradesh Short title.
Amendment) Act, 2012.

2. In the Indian Stamp Act, 1899, in its application to the State of Substitution of
Schedule I-A.
Himachal Pradesh, for Schedule I-A annexed to the said Act, the
Schedule hereinafter annexed to this Act shall be substituted.

37 of 1976 3. (1) The Indian Stamp (Himachal Pradesh Amendment) Act, Repeal and
19 of 1978 savings.
11 of 1991 1976, the Indian Stamp (Himachal Pradesh Amendment) Act, 1978
and the Indian Stamp (Himachal Pradesh Amendment) Act, 1991 are
hereby repealed.

(2) Notwithstanding such repeal any action taken or anything


done under the Acts so repealed under sub-section (1), shall be
deemed to have been taken or done under the corresponding
provisions of this Act.

RATES OF STAMP DUTY ON CERTAIN INSTRUMENTS

Note. The Articles in Schedule I-A are numbered so as to correspond with similar
Articles in Schedule I, of the Indian Stamp Act, 1899.

merchandise exclusively, not being a Note or
Memorandum chargeable under No. 43;

(b) made in the form of tenders to the Central


Government for or relating to any loan.

Agreement to Lease. See Lease (No. 35).

6. Agreement relating to Deposit of Title-Deeds,


Pawn or Pledge. that is to say any instrument
evidencing an agreement relating to-

deposit of title-deeds or instrument constituting or 0.05% of the secured


being evidence of the title to any property amount, subject to the

Comments
An agreement of hypothecation and
question of stamp duty.There is distinction
between a transaction of hypothecation and a
transaction of pledge. Because unlike a pledge where
the possession of the goods pledged must pass on to
the pawnee, no such possession passes on to the
creditor in case of hypothecation. As the document in
the present case, sought to create two rights in favour
of the Bank, i.e. one pertaining to hypothecation of
the property and the other pertaining to creation of
attorneyship a total stamp of Rs. 11.50 was
chargeable to in respect of the document under
section 5 of the Stamp Act. Thus the document has
been duly stamped being neither a pledge nor a pawn
but an agreement of hypothecation covered by Cl. (e)
of Art. 5 of Schedule-I to the Stamp Act with a
covenant to confer rights of an attorney of the
defendant on the plaintiff.

Deed of Pawn or Pledge.There is no dispute


between the parties, and rightly so, because even on a
plain reading of Cl. 6 of the agreement it transpires

that the possession of the goods hypothecated was to
remain with the debtor itself. That being so, this deed
cannot be held to be a deed of pawn or pledge so as to
attract the mischief of Art. 6(2) of Schedule-I to the
Stamp Act.

7. Appointment in execution of a Power.whether of One hundred rupees.


trustees or of property movable or immovable, where
made by any writing not being a Will.

8. Appraisement or Valuation.made otherwise than


under an order of the Court in the course of a suit
in every case. Fifty rupees.
Exemptions
(a) Appraisement or valuation made for the
information of one party only, and not being in
any manner obligatory between parties either by
agreement or of operation of law.

(b) Appraisement of crops for the purpose of


ascertaining the amount to be given to a landlord
as rent.

9. Apprenticeship-Deed. including every writing As in Schedule-I.


relating to the service or tuition of any apprentice,
clerk or servant placed with any master to learn any
profession, trade or employment, not being articles of
clerkship (No. 11).

Exemption
Instruments of apprenticeship executed by a
Magistrate under the Apprentices Act, 1850, or by
which a person is apprenticed by or at the charge of,
any public charity.

10. Articles of Association of a Company.

in every case. Two hundred rupees.

Exemption
Articles of any Association not formed for
profit and registered under section 25 of the
Companies Act, 1956.

Comments
Conveyance of Property.-There is no difference
between a case of retirement and that of dissolution.
A partner stands on the same footing in relation to
partnership as a co-owner. In the present case the
document executed by the firm relinquishing the
rights in favour of the former partner could only be a
release. It was not a transfer having not been made in
favour of a partner who had no interest in the
property. The document executed does not transfer
property; hence it was not a conveyance.

23(A) Conveyance in the Nature of Part Performance. As in Schedule-I.


Contracts for the transfer of immovable property in
the nature of part performance in any Union territory
under section 53 A of the Transfer of Property Act,
1882.
24. Copy or Extract. certified to be true copy or Ten rupees.

chargeable under the law for the time being in force
relating to court fees, in every case.

Exemptions
(a) Copy of any paper which a public officer is
expressly required by law to make or furnish for
record in any public office or for any public

25. Counterpart or Duplicate. of any instrument Ten rupees.

Counterpart of any lease granted to a
cultivator, when such lease is exempted from duty.

Comments
Whether the stamp duty payable is payable
on a counterpart.-Article 25 of the First Schedule to
the Indian Stamp Act simply states the stamp duty
payable on a counterpart or on a duplicate. Hence, an
unstamped counterpart can be validated by payment
of proper stamp duty and penalty therefor.
26. Customs-Bonds.

27. Debenture. (where a mortgage debenture or not),

Explanation.- The term Debenture includes


any interest coupons attached thereto, but the amount
of such coupons shall not be included in estimating
the duty.

Exemption
A debenture issued by an incorporated
company or other body corporate in terms of a
registered mortgage-deed, duly stamped in respect of
the full amount of debentures to be issued thereunder,
whereby the company or body borrowing makes
over, in whole or in part their property to trustees for
the benefit of the debenture holders; provided that the
debentures so issued are expressed to be issued in
terms of the said mortgage-deed.

Explanation. When a lessee undertakes to


pay any recurring charge such as Government
revenue, the land-lords share of cesses, or the

law recoverable from the lessor, the amount so agreed
to be paid by the lessee shall be deemed to be part of

Comments
Any agreement to let-Whether amounts to a
lease.- Article 35 would indicate that it is not only a
lease which is covered by this Article, but also any
agreement to let. An agreement to let need not be a
lease. In order to determine whether in any given
case, it is reasonable to infer the existence of
agreement one has to see if one party has made an
offer and the other party has accepted the same. To
constitute an agreement, it is necessary that the
intention of the parties must be definite and common
on both. This can be achieved if the terms and
conditions are expressly arrived at or could impliedly
be found.

STATEMENT OF OBJECTS AND REASONS

The rates of stamp duty in respect of different instruments chargeable under the Indian
Stamp Act were revised in the year 1970, except conveyance/sale, mortgage with possession and
gift. In order to generate additional resources of income, the State Government has taken various
steps in this direction. It has also been considered necessary that rates of stamp duty should be
increased, because rates in respect of most of the instrument have not been revised for the last four
decade. Moreover there are also other reasons such as devaluation of value of rupee and increase in
per capita income etc. for this proposed increase in rates of stamp duty. Further, some of the
existing rates are in paisa, whereas, the circulation of currency upto the denomination of twenty
five paisa have been stopped by the Reserve Bank of India. Thus, it has also been proposed to
round up the duty to nearest rupee ten. As such, it has been decided to substitute the existing
Schedule I-A appended to the Indian Stamp Act, 1899, in its application to the State of the
Himachal Pradesh.

The Bill seeks to achieve the above objectives.

thirty days from the date of publication of the draft rules in the Rajpatra, Himachal Pradesh;

The objections(s) or suggestions(s), if any, received within the period specified above shall
be taken into consideration by the State government, before finalizing these rules, namely:

DRAFT RULES

1. Short title.These rules may be called the Himachal Pradesh Panchayati Raj
(Appointment and Conditions of Service of Junior Engineer in Zila Parishads) Rules, 2012.

2. Definitions.(1) In these rules, unless the context otherwise requires,

(a) Act means the Himachal Pradesh Panchayati Raj Act, 1994; and

(b) Form means a form appended to these rules.

(2) The words and expressions used but not defined in these rules shall have the same
meaning as respectively assigned to them in the Act.

3. Number of Posts.There shall be such number of posts of Junior Engineer as


sanctioned and may be sanctioned by the State Government from time to time in the respective Zila
Parishads.

4. Scale of Pay.The scale of pay for the post of Junior Engineer shall be as under:

(a) Pay band for regular appointees: PB-Rs.10300-34800 + 3800 Grade Pay; and
(b) Emoluments for contractual appointees: Rs. 14100/- per month, as per details
given in rule 14.
5. Type of post (whether selection or non selection post).The post of the Junior
Engineer shall be Non-Selection.

6. Age for direct appointment.A person to be appointed as Junior Engineer shall be


eligible if he is having the age between 18 and 45 years:

Provided that the upper age limit for direct recruits will not be applicable to the candidates
already in service of the Government including those who have been appointed on ad-hoc or on
contract basis;

Provided further that if a candidate appointed on ad-hoc basis had become overage on the
date when he was appointed as such he shall not be eligible for any relaxation in the prescribed age
limit by virtue of his such ad-hoc or contract appointment;

Provided further that upper age limit is relaxable for Scheduled Castes/Scheduled Tribes/
Other Categories of persons to the extent permissible under the General or Special Order (s) of the
State Government;

Provided further that the employees of all the Public Sector Corporations and Autonomous
Bodies who happened to be Government Servant before absorption in Public Sector Corporations/
Autonomous Bodies at the time of initial constitution of such corporations/Autonomous Bodies
shall be allowed age concession in direct recruitment as admissible to Government servants. This
concession will not, however, be admissible to such staff of the Public Sector Corporations/
Autonomous Bodies who were/are subsequently appointed by such Corporation/Autonomous
Bodies and who are/were finally absorbed in the service of such Corporations/Autonomous Bodies
after initial constitution of the Public Sector Corporations/Autonomous Bodies.

(1) Age limit for direct recruitment will be reckoned on the first day of the year in
which the Post(s) is/are advertised for inviting applications or notified to the Employment
Exchanges, as the case may be.

(2) Age and experience, in the case of direct appointment, are relax able at the
discretion of the State Government in case the candidate is otherwise well qualified.

7. Minimum educational qualifications required for direct appointment.(1)


Degree/Diploma in Civil Engineering with minimum 50% marks or its equivalent, from any
recognized Institution.

(2) Preference shall be given to those candidates who have knowledge of customs,
manners and dialect of Himachal Pradesh and suitability for appointment in the peculiar condition
prevailing in the Pradesh.

8. Period of Probation.The regular appointee shall remain under probation for


period a of two years subject to such further extension for a period of not exceeding one year, as
may be ordered by the Director in special circumstances and reasons thereof to be recorded in
writing.

9. Method of appointment.The candidate shall be appointed either by direct


recruitment on regular basis or on contract basis, as the case may be.

10. Essential requirement for direct/contract appointment.The candidate to be


appointed as Junior Engineer must be a citizen of India.

11. Selection for appointment.The selection to the post, in case of direct or


contractual appointment, as the case may be, shall be made on the basis of viva-voce test, if
Himachal Pradesh Subordinate Services Selection Board Hamirpur or other Appointing Authority,
as the case may be, so consider necessary or expedient by a written test or practical test, the
standard/syllabus etc. of which, will be determined by the Board or other Appointing Authority, as
the case may be.

12. Provident Fund.The regular appointees shall be entitled for availing the facility
of provident fund as may be notified by the State Government.

13. Conditions of Service for regular appointees.The other conditions of service in


the case of regular appointees shall apply mutatis-mutandis as are applicable in the case of State
Government Junior Engineers.

14. Selection for appointment to the post by Contract Appointment.


Notwithstanding anything contained in these rules, contract appointments to the post will be made
subject to the Terms and Conditions given below:

(I) CONCEPT.(a) Under this policy the Junior Engineer in Zila Parishad will be
engaged on contract basis initially for one year, which may be extendable on year to year basis:

Provided that for extension/renewal of contract period on year to year basis, the concerned
Chief Executive Officer shall issue a certificate that the service and conduct of the contract
appointee is satisfactory during the year and only then his period of contract is to be renewed/
extended after taking prior approval of the Director.

(II) POST SHALL BE IN THE PURVIEW OF HPSSSB, HAMIRPUR.The Chief


Executive Officer of the concerned Zila Parishad after obtaining the approval of the Government to
fill up the posts on contract basis shall send requisition to the Himachal Pradesh Subordinate
Services Selection Board Hamirpur for appointment/selection.

(c) The selection shall be made in accordance with the eligibility conditions specified in
these rules.

(III) CONTRACTUAL EMOLUMENTS.The Junior Engineer appointed on contract


basis will be paid consolidated fixed contractual amount @14100/-P.M. (which shall be equal to
minimum of the pay band + Grade pay). 3% of the minimum of pay band + grade pay of the post as
annual increase in contractual emoluments for the subsequent years(s) will be allowed if contract is
extended beyond one year.

(IV) APPOINTING/DISCIPLINARY AUTHORITY.The Chief Executive Officer


of the concerned Zila Parishad will be the appointing and disciplinary authority.

(V) SELECTION PROCESS.Selection for appointment to the post in the case of


Contract Appointment will be made by the Himachal Pradesh Subordinate Services Selection
Board, Hamirpur or other Appointing Authority, as the case may be, on the basis of viva-voce test
or if so considered necessary or expedient by a written test or practical test the standard/syllabus
etc. of which will be determined by the Board or any other Appointing Authority, as the case may
be.

(VI) APPOINTMENT AND AGREEMENT.After appointment of a candidate,


he/she shall sign an Agreement as per Form-II appended to these rules.

(VII) TERMS AND CONDTIONS.(a) The contractual appointee will be paid fixed
contractual amount @ Rs. 14100/- (P.M. (which shall be equal to minimum of the pay band + grade
pay). The contract appointee will be entitled for increase in contractual amount i.e. 3% of minimum
of the pay band+ grade pay of the post for further extended year(s) and no other allied benefits such
as senior/selection scales etc. will be given.

(b) The service of the Contract Appointee will be purely on temporary basis. The
appointment is liable to be terminated in case the performance/conduct of the contract appointee is
not found satisfactory.

(c) Contract Appointee will be entitled for one day causal leave after putting one month
service. This leave can be accumulated up to one year. No leave of any other kind is admissible to
the contract appointee. He/She shall not be entitled for Medial Re-imbursement and LTC etc., only
maternity leave will be given as per rules.

(d) Unauthorized absence from the duty without the approval of the Chief Executive
Officer, Zila Parishad shall automatically lead to the termination of the contract. Contract
Appointee shall not be entitled for contractual amount for the period of absence from duty.

(e) An official appointed on contract basis who has completed five years tenure at one
place of positing will be eligible for transfer on need basis within the respective Zila Parishad on
administrative ground.

(f) Selected candidate will have to submit a certificate of his/her fitness from a
Government/Registered Medical Practitioner. Woman candidate pregnant beyond 12 weeks will
stand temporarily unfit till the confinement is over. The woman candidate will be re-examined for
the fitness from an authorized Medical Officer/Practitioner.

(g) Contract appointee will be entitled to TA/DA if required to go on tour in connection


with his/her official duties at the same rate as applicable to regular counter-part official at the
minimum of pay scale.

(h) Provisions of service rules like FR/SR Leave Rules, GPF Rules, Pension Rules and
Conduct rules etc. as are applicable in case of regular employees will not be applicable in case of
contract appointees. They will be entitled for emoluments etc. as detailed in this Column.

15. Appointing Authority and allocation of Panchayats.(1) The Chief Executive


Officer of concerned Zila Prishad shall be the appointing authority and letter of appointment shall
be issued by the Chief Executive Officer, Zila Parishad, who shall allocate the Panchayat Samiti to
a Junior Engineer.

(2) The Secretary of the concerned Zila Parishad shall be the controlling officer for tour
programme, leave etc. The Secretary of Zila Parishad shall allocate the Panchayats in consultation
with Executive Officer, Panchayat Samiti in such a way that contiguity of the allocated Panchayats
are ensured.

16. Seniority of Junior Engineer.The seniority of the regular Junior Engineers shall
be determined from the date of joining and consolidated and maintained at Directorate level.

17. Reservation.The appointment to the service shall be subject to orders regarding


reservation in the service for Scheduled Castes/Scheduled Tribes/Backward Classes/Other
Categories of persons issued by the Himachal Pradesh Government from time to time.
18. Job Chart.The job chart for the Junior Engineer shall be such as may be specified
by the Director Panchayati Raj from time to time.
19. Training and Examination.The members of the service shall have to qualify
examination or to undergo such courses for training to be specified by the Director, from time to
time:

Provided that three chances shall be provided to qualify such examination within five years
and in the event of not qualifying the examination by the concerned employee, the services of such
employee shall liable to be terminated.
20. Power to relax.Where the State Government is of the opinion that it is necessary
or expedient to do so, it may, by order for reasons to be recorded in writing, relax any of the
provisions(s) of these rules with respect to any class or category of person (s) or post (s).
21. Repeal and Savings.(1) On and from the date of commencement of these rules,
the Scheme notified for the appointment of Junior Engineers on contract basis by Panchayat
Samitis vide notification No. PCH-HB (1) 12/02-II dated 4th November, 2010 shall stand repealed.
(2) Notwithstanding such repeal, any appointment made or anything done or any action
taken, under the scheme so repealed, shall be deemed to have been validly made, done or taken
under these rules.

7. That the attested copies of original certificates in respect of educational


qualifications, caste, bonafide resident, physically handicapped, member belonging to below
poverty line or past experience, as the case may be, shall be submitted along with joining report.

Medical Reimbursement and LTC etc. Only Maternity Leave will be given as per
rules.
5. Unauthorized absence from the duty without the approval of the Controlling Officer
shall automatically lead to the termination of the contract. A contractual Junior
