TOPIC- GIFTS CONCEPT AND CREATION

INTRODUCTION

Gift" is the transfer of certain existing moveable or immoveable property made voluntarily and
without consideration, by one person, called the donor, to another, called the donee, and
accepted by or on behalf of the donee. Such acceptance must be made during the lifetime of
the donor and while he is still capable of giving. If the donee dies before acceptance, the gift is

ESSENTIALS OF A GIFT

The essentials of a valid gift are given below:-

1. There must be transfer of ownership.


2. The ownership must relate to a property in existence.
3. The transfer must be without consideration.
4. It must have been made voluntarily.
5. The donor must be a competent person.
6. The transferee must accept the gift.
