TERMS & CONDITIONS:

01. PRICES: Prices are firm and final as per the schedule of Quantity,
Rate and Amount including all taxes and duties and no price
variation is allowed.
02. Running Account Bill shall be submitted by contractor as per the
quantities measured in the presence of our representative and
certified for the quantities of work by our engineer /project manager
on a monthly basis after deducting the recoveries as detailed below.
a). Income Tax at TDS will be deducted at the applicable rate as per
the Income Tax Act and a TDS certificate will be issued.

03. TIME SCHEDULE: The contractor has to start the work w.e.f.
…………………………………. and the entire work is required to be
completed by ……………..

04. ENGINEERING-IN-CHARGE: Project Engineer all components (H.E.


Project, Baragaon (24 MW )

05. ACCOMODATION, ELECTRICITY & WATER: Arrangements of


labour hutment, water supply and electricity only related material
will be provided by M/s Sai Engineering Foundation and others
arrangement cost borne by contractor.
06. SAFETY: Tools such as helmet , gloves, regulator, cutting set with
nozzle, etc. will be supplied by M/S Sai Engineering Foundation.
free of cost. However in case of loss or damage of any material
issued the same shall the recovered from the bill as per the
prevailing rates. Most important is that the Contractor shall ensure
all the safety measures during execution of this work as per Sai
Engineering safety officer directions and in case of any mishap, all
financial liabilities shall be borne by the contractor as per workmen
compensation Act.

07. INSURANCE:-Insurance for all the workmen shall be obtained for


the workmen by the contractor. No liability shall be entertained by
M/s Sai Engineering Foundation on any circumstances or third
party claim.

08. T&P: All the required T&P and material will be supplied by M/s Sai
Engineering Foundation. However, in case of loss or damage of any
material issued the same shall the recovered from the bill as per the
prevailing rates.

09. Contractor shall be responsible for the fulfillment of all statutory


requirement and in case of any migrated labours are engaged to
execute the work, the contractor shall obtain necessary permission
for such employment from local administration, M/S Sai
Engineering Foundation will not be responsible for such deployment
of migrated labour.

10. One Civil/mechanical Foreman/Site Engineer from contractor side


must be present daily the work at every component throughout the
working hours.

11. SECURITY DEPOSIT: 5% Security Deposit will be deducted from


the Contractor’s R.A. Bills and the same shall be released after six
months from the last completion bill of work.

12. The Contractor shall follow the necessary labour laws for execution
of this work, & shall ensure that the payment to labourers engaged
for this work be made as per Govt. of Himachal Pradesh for
minimum wages Act to different categories of workers.
13. The Contractor shall comply with the rule of ESI, Labour and EPF
Departments and shall maintain all the requisite/relevant records
including all out of state workers entered in nearest Police station
within three days of duty joining.

14. ARBITRATION: In case of any dispute arising between the


Contractor and the Sai Engineering Foundation, same shall be
referred to the Arbitrator to be appointed by the CEO Sai
Engineering Foundation whose decision in all such matters shall be
final and binding upon both the parties. However, such cases shall
be registered within one month of arising of dispute.

15. Contractor shall return the duplicate copy of this order to this Office
duly signed on all the pages as a token of having accepted the terms
& conditions. The acceptance copy must be returned to this office
within 03 days of receipt of this order.

16. Welding set, welding rods, Owens, tools, chain blocks, U-clamps,
required nut bolts /scaffolding /steel jack balies ,gas cutter set,
cooking gas, beadings & oxygen cylinder will be supplied by M/s sai
Engineering Foundation.

17. No claims on idle time wages or any compensation is allowed if the


labour, equipment, plant and machinery remains idle for any
reason. No claims or compensation shall be paid for any
breakdowns or loss of work for any reason whatsoever.

18. No change/ escalation of prices in the work order will be made


irrespective of the prevailing/forthcoming conditions.

19. The Contractor while accepting the order should be aware of the
Scope of the work, technical Specifications, Site Conditions, Soil
Conditions, Working Conditions, Climatic Conditions, Availability of
Technicians, labour tradesmen, materials, equipments, power,
water, transport and communication facilities, etc. No claims will be
allowed in case of any misunderstanding and/or non awareness of
these requirements.

20. THE ABOVE TERMS AND CONDITIONS OF CONTRACT ARE READ


AND CONSTRUED IN CONJUNCTION WITH GENERAL
CONDITIONS OF CONTRACT FOR CIVIL WORKS OF SAI
ENGINEERING FOUNDATION BARAGOUN (24 MW) PROJECT.
