RIGHT OF WAY AGREEMENT

Know All Men By These Presents:

This AGREEMENT OF EASEMENT OF RIGHT OF WAY, entered into this ___ day of _____________
2017 by and between Ms. Susan Chavez owner of the dominant estate, of legal age and a resident of Brgy.
Bayanihan, Mabitac, Laguna, and Mrs. Ludy Abary, owner of the servient estate, also of legal age, married to
Mr. ______Quesao, and a resident of ________, Mabitac, Laguna.

WITNESSETH

That Susan Chavez is the owner of a parcel of agricultural land located in Sitio Mayrayana, Brangay
Lambak in the municipality of Mabitac, Laguna and more particularly described as follows, to wit:

A parcel of land covered by Tax Declaration No. ________ with property


identification number 023-14-0008-005-21, identified as Lot 2142 in Survey No. 890-
D Mabitac Cadastre; bounded on the North East by 22, 25 (2130, 2127, creek); on
the South West by 02 (2143), on the South East by Mabitac River ; and on the North
West by 21, 20 ( 2141,2138).

which lot is adjacent to Ludy Abary’s property located in Sitio Mayrayana, Brangay Lambak in the municipality
of Mabitac, Laguna and more particularly described as follows, to wit:

A parcel of land covered by Tax Declaration No. 14000800336 with property


identification number 023-14-0008-004-21, identified as Lot 2141 in Survey No. 890-
D Mabitac Cadastre; bounded on the North by 02, 03 & 04 (2139, 2137); on the South
by 01(2142), on the East by 20(2138); and on the West by creek.

That Susan Chavez, in order to have an access to and from, and to cultivate the above-mentioned
land and other activities and in order to have an outlet to the provincial road, the nearest public road and
least burdensome to the servient estate and to third persons, it would be necessary for her to pass through
Ludy Abary’s property and for this purpose, a passageway of not less than three (3) meters wide through the
whole length of Ludy Abary’s property which will connect to the existing right of way of the latter to the
Provincial Road is necessary for the use of Susan Chavez and for all her needs in cultivating his land;

The said path or passage way is particularly described in the attached plan as Annex “A”.

Wherefore, for and in consideration of the sum of One Hundered Fifty Thousand Pesos (Php
150,000.00), receipt of which is hereby acknowledged by Ludy Abary, the latter agree to and permits Susan
Chavez to have permanent easement of right of way over the abovementioned property of said Ludy Abary
limited to not less three (3) meters wide throughout the whole length of the western side of the said property
that will connect to the existing right of way the servient estate to the provincial road as specifically indicated
in the attached plan which is made an integral part of this contract, as Annex “A”.

It is further agreed that Ludy Abary shall deliver unto Susan Chavez all the necessary papers, deed,
or documents in relation to the servient estate in order to facilitate the registration of the above-mentioned
right of way.

This agreement shall be binding between the parties and upon all their heirs, successors, and assigns.

IN WITNESS WHEREOF, the parties hereto have signed this agreement the day and the year first
above written, in the municipality of _______________, province of Laguna, Philippines.
