Halulic with the West Valley City Police Department in reference to agency case no. 181001014, upon a written declaration states on information and belief that the defendant, ISAIAH WEAVER, committed the crimes of: COUNT 1 CRIMINAL HOMICIDE, AGGRAVATED MURDER, 76-5-202(2)(a) UCA, First Degree Felony, as follows: That on or about January 16, 2018, in Salt Lake County, State of Utah, the defendant, with reckless indifference to human life, caused the death of J.R.S. incident to an act, scheme, course of conduct, or criminal episode during which the actor was a major participant in the commission or attempted commission of child abuse, Subsection 76-5-109(2)(a). COUNT 2 CHILD ABUSE, 76-5-109(2)(a) UCA, Second Degree Felony, as follows: That on or about January 15, 2018, in Salt Lake County, State of Utah, the defendant did (a) intentionally or knowingly inflict serious physical injury to J.S.; or (b) having the care or custody of J.S., intentionally or knowingly caused or permitted another to inflict serious physical injury on J.S. COUNT3 CHILD ABUSE, 76-5-109(2)(a) UCA, Second Degree Felony, as follows: That on or about January 15, 2018, in Salt Lake County, State of Utah, the defendant did (a) intentionally or knowingly inflict serious physical injury to A.S.; or (b) having the care or custody of A.S., intentionally or knowingly caused or permitted another to inflict serious physical injury on AS. THIS INFORMATION IS BASED ON EVIDENCE OBTAINED FROM THE FOLLOWING WITNESSES: S. Thompson, W. Stanworth, L. Shamaly, A.S., B. Perez, R. Morrill, R. McDonough, D. Lougy, R. Lore, S. Lipscomb, D. Johnson, T. Hoyne, M. Haywood, J. Gillespie, T. Freir, J. Christiansen, K. Breazeal, G. Brady, A. Baty, J. Arrington, G. Amold, C. Rood, J. Etherington, Dr. J. Lozano, and A. Halulic. DECLARATION OF PROBABLE CAUSE: Your Declarant, Detective A. Halulic with the West Valley City Police Department, based on information in report number 181001014, interviews of witnesses, and investigation by law enforcement officers states as follows: 4.8. was born on April 18, 2016. Gena N. Sanchez is J.S.’s biological mother. Her boyfriend of approximately 8 months, ISAIAH WEAVER, was staying with her, J.S., and the child’s 2 older siblings in the home of Ms. Sanchez’s mother located in West Valley City, in Salt Lake County, Utah for approximately one month. On January 16, 2018 at approximately 12:15 p.m., patrol officers were dispatched to the home (previously described above) on a ‘full arrest” report involving J.S., a 21-month-old male, ‘who was unresponsive and unconscious. When West Valley Fire Department personnel arrived on scene shortly after, they performed CPR on J.S. J.S. was transported to Primary Children’s Hospital where he was pronounced dead at 1:19 p.m. by Dr. Robinson. Dr. Robinson noted that it was likely that J.S. had been deceased for some time before emergency personnel had arrived. Officer G. Freir entered the apartment and encountered Ms. Sanchez and WEAVER. They directed Officer Freir to where J.S. was lying on his back on the bathroom floor. Officer Freir observed J.S."s eyes were partially open and the child had a large bruise on his left cheek. Officer Freir performed CPR on J.S. and observed multiple bruises on the child’s face and noted that J.R.’s body felt cold. Medical personnel confirmed the J.S. had bruising all over his body and severe trauma to the head. Detective R. Morrill observed J.S.’s body soon after J.8. was declared deceased. Medical personnel showed Detective Morrill that J.S. had obvious bruising on his cheeks, his left eye, and his mouth. J.S. also had linear marks and bruises on his buttocks, lower back, and the backs of his thighs that were consistent with having been caused by a hard, thin object. J.S. also had other bruises and scars elsewhere on his body. During the search of the apartment, officers located fresh blood droplets on the walls, ceiling, and many other pieces of furniture, in the bedroom shared by WEAVER and Ms. Sanchez. JS. had two siblings, 5-year-old N.S. and 2-year-old A.S. Detective K. Arrington interviewed N.S. N.S. told Detective Arrington that WEAVER recently disciplined J.S. and A.S. by spanking them with a clothing hanger. N.S. also told Detective Arrington that WEAVER used a lighter to heat the hanger, and then hit J.S. and A.S. with the hanger. N.S. said that Ms. Sanchez and Ms. Sanchez’s mother go to work during the day, and that WEAVER walks N.S. to school and then watches J.S. and A.S. during the day. Ms. Sanchez told Officer Freir that she had gone to work at about 5:30 am. and that WEAVER stayed home with her three children. Surveillance video at N.S.’s elementary school shows WEAVER at the school from 11:09 a.m, -11:20 a.m. on January 16, 2018. The video shows that WEAVER had A.S. and J.S. in a stroller, that J.S.’s face was discolored, and that J.S. remained motionless the entire time even when jostled by A.S. School nurse, J. Etherington, reported that when she saw WEAVER at the school, she looked at A.S. and J.S. in the stroller. Ms. Etherington noted that J.S.’s color was off and recommended that WEAVER should take J.S. to a doctor. WEAVER did not respond to her comment. Ms. Etherington also noted that J.S. felt cold to her, that he was motionless, and that she didn’t feel a pulse when she checked his hand for one. Ms. Etherington also observed bruising on J.S.’s cheek. Child Abuse Pediatrician C. Rood, who is employed by Safe and Healthy Families at Primary Children’s Medical Center, examined 2-year-old A.S. on January 17, 2018. Dr. Rood reported that A.S. had patterned bruises on his buttocks and upper thighs. The bruises are most consistent with a solid object striking the child’s body repeatedly. A.S. had a healing bum with a similar pattern on his left upper chest, consistent with a heated solid object of the same pattem. Dr. Rood found the injuries to A.S. to be consistent with inflicted trauma, and not consistent with accidental injury, medical illness, or reasonable discipline. Ms. Sanchez reported that she has been dating WEAVER for about 8 months, that he has been staying at her apartment with her and her children for the last month. About two weeks prior, WEAVER stopped working and has been staying home and watching her three children while she is at work. WEAVER seems jealous of Sanchez’s relationship with J.S. She had seen WEAVER spank J.S. on the bare buttocks, causing redness, and on one occasion she saw WEAVER kick J.S. in the back. WEAVER had told her that he had left some small marks on J.S. and A.S. with a hanger. She had seen WEAVER hit A.S. in the mouth once, causing his lip to be puffy. She had noted that J.S. was scared of WEAVER. WEAVER almost never bathes the kids, but he had bathed them while she was at work on January 15, 2018. Sanchez saw stripe marks on J.S.’s and A.S.’s buttocks on January 16, 2018, and she saw marks on A.S. chest on January 15, 2018. On January 16, 2018, Sanchez started work at 7:00am. She interacted with J.S. before she went to work that moming, and he seemed fine. WEAVER and Sanchez spoke by phone at around 9:30am that morning, and he told her that J.S. was not acting right, and J.S. seemed sleepy, and was sleeping with his eyes open. WEAVER told her that he put J.S. in the stroller and J.S. was not very responsive. WEAVER called Sanchez again at about noon that day, and told her that J.S. wasn’t moving, and was limp, but that he was breathing, and was cold. Sanchez told WEAVER to call 911, and she went home, and police arrived soon thereafter. Post-Miranda, WEAVER admitted to hitting J.S. with a coat hanger and causing him to hit his head against the ceiling, wall and floor. This occurred over a period of several days. WEAVER also admitted to hitting J.S.’s older sibling with a coat hanger as well. WEAVER reported to Officer Freir that at about 9:30am that day, J.S. had a hot dog in his mouth and started dozing off, so WEAVER removed the hot dog and put J.S. in bed and stayed near him watching him breathe. WEAVER reported that J.S. stopped breathing at about 11:30 am., so WEAVER rolled J.S. over and J.S. wouldn’t move. WEAVER first told officers that on January 16, 2018, he fed A.S. and J.S. hot dogs for breakfast, and then he spun the boys in circles for about five minutes, and that J.S. got a nosebleed from being spun. J.S. then started to doze off and slept for most of the moming. WEAVER said that all day J.S. was “out of it,” that ever since the previous day he was walking fanny “like a toddler,” as if he was just learning to walk. At 10:30am, WEAVER checked on J.S. and J.S, arms were next to his face and stiff, with his arms locked in a “fighting position.” He said that at 12:30pm, he shook J.S.’s arm, that J.S. didn’t move, that he put J.S. in cold water in the bathtub to wake him up, but J.S. didn’t wake up so WEAVER called 911. WEAVER denied knowing how J.S. got the bruises on his face, but admitted that the marks on J.S.’s and A.S.’s backs were from WEAVER spanking them with a hanger. After being informed that J.S. was deceased and being asked additional questions, WEAVER admitted that he had been spinning both boys on his back during the last few days, and throwing them in the air, He had given both A.S. and J.S. a lot of spankings on January 15th. On January 16th, he had thrown J.S. in the air and J.S. hit his head on the ceiling or on the floor. Later that morning, J.S. was not breathing and WEAVER sat with J.S. and waited for Sanchez to call. Later in the interview, WEAVER admitted that he had a bad temper, and that he had actually spanked A.S. and J.S. “too hard” with the hanger with their clothes off the previous day, causing immediate welts. He admitted hitting J.S. in the mouth the previous day, causing it to bleed. He admitted that on January 16th, J.S. lost consciousness while WEAVER was swinging him, and WEAVER panicked and iaid him down. WEAVER stated that once J.S. passed out, he realized he had gone too far. He admitted that he threw J.S. in the air on January 15th because he wanted him to be quiet, and that J.S. hit his head on the ceiling. He admitted that on January 16th, he spun J.S. really hard and really fast, such that WEAVER had to sit down for about 10 minutes to compose himself. He admitted that he had been throwing J.S. in the air for the last couple of days, and that a few times when being thrown, J.S.’s head hit the floor. According to Detective Halulic, on January 17, 2018, Dr. Jason Lozano, Assistant Medical Examiner with the Utah Office of the Medical Examiner, performed an autopsy on J.S. Detective Halulic was present for the autopsy. During the autopsy, Detective Halulic noted bruising all over J.S.’s head including his left cheek, right cheek, left eye, and forehead area. Detective Halulic noted a large amount of blood visible on the brain. According to Detective Halulic, based on his training and experience, the blood he observed on the brain is indicative of head trauma to include, but not limited to, head impacts as well as vigorous head shaking. Detective Halulic noted significant injury under the rear of the scalp, and the injury was severe enough that part of the scalp was separated from the skull. There was injury to both eyeballs. There was blood within the spinal cord which is indicative of physical injury to the back. There was injury to the upper and lower lip around the gum line, and there was an area where the upper lip had separated from the gum line. There were linear marks on the lower back, buttocks, and thighs, consistent with being hit with a hard, thin object, and there was damage to the muscles underlying those areas, indicating very hard strikes. There were also various injuries at different stages of healing, Dr. Lozano’s preliminary opinion is that J.S.’s cause of death is from blunt force injury and the manner of death is homicide. REQUEST FOR ISSUANCE OF A WARRANT: The State hereby requests that the Court issue a Warrant of Arrest in this case due to the nature of the offense and facts as alleged in the probable cause statement. Furthermore, the State has been informed that the Defendant is originally from Indiana, and poses a potential flight risk. The State is requesting the defendant be held without bail in accordance with UCA 77-20-1(2) (a) or (c) to: 1) Prevent risk of injury to a person or property; 2) Protect the public safety and welfare of the community or an individual; and 3) Secure the appearance of the accused. Pursuant to Utah Code Annotated § 78B-S-705 (2008) I declare under criminal penalty of the State of Utah that the foregoing is true and correct to the best of my belief and knowledge.
