Legality of a CREDIT PROFILE NUMBER

Legality of CPN: Presently, federal law allows the ability for someone to legally use a private ID
# for financial reporting purposes instead of a Social Security Number.

Title 5, Section 7 of Publication Law 93-579 of Government Organization and Employees Act:
(a) (1) It shall be unlawful for any Federal, State or Local Government Agency to deny any
individual any right, benefit, or privilege provided by law because of such individual’s refusal to
disclose his or hers Social Security Account Number.

What this means is Federal Law protects those who do not wish to disclose their personal
information (SS#) except where required to do so. Disclosure of your social security number is
only required when dealing with the IRS, your employer, or when applying for a federally

EIN/TIN. This is for any business. An Employer Identification Number/Tax Identification
Number is one of the first things any business gets. You can even go on the Internet, fill out a
form and have one issued to you immediately. The government likes business. It's free, quick
and easy. You can make up a business like being a toilet plunger consultant or butterfly wing
painter. The idea is that you may do something and accept income for your actions and want the
ability to write off business tax benefits like travel to Europe or magazine subscriptions or gas
milage credit you don't get with you 9 to 5 job.

Credit Privacy Number (CPN). On the other hand, why not get a CPN? A CPN is essentially like
a SS# but has nothing to do with your wages and SS retirement benefits. It's used to identify a
credit file for an individual or company. Many times this can be done directly from the IRS by
creating a home business of some kind (you're now a consultant on toilet flushing) and getting an
EIN/TIN or a business SS#. The CPN is set up with the credit bureaus. Many online businesses
will declare it is legal to have a CPN and the alw says so. It does. The problem comes from a
different source. They are correct in saying that the law requires government agencies to accept a
CPN instead of a SS# and you can use it as such. However, the law does NOT say a non-
government company, agency, individual, bank, credit card company, or anything else must
accept it. If you are asked specifically for your SS# (all applications are specific) and you give a
CPN instead so your terrible credit history is hidden, you just committed fraud which is a crime.
Not only can and will the lender yank their credit from you, but they can turn you over to the
District Attorney for prosecution for fraud. Guess what, if you did it by mail, it's now a federal
crime. Here's another catch. It usually costs you money to get a CPN and you don't know if it's
really legitimate or an old SS# from a dead person. It look very similar.
As you can see, it shouldn't be hard to get a new SS#, EIN/TIN, or a CPN. The first two are free,
the second cost you money. But that's the easy part. There are some major hurdles to making the
process work to hide your old credit history. That's a lot harder than most people think and very
easy to screw up.

Cross Linking. Credit reporting bureaus are constantly linking data together from many sources.
This is one of the problems with individuals finding their credit has been damaged - it's
somehow linked with someone else's credit history. You would think it's all done by SS#. It's
NOT. Any link will do. Similar name at a similar address, employer, bank, credit company,
phone number, utility company, car or store credit application, even driver's license information.
Think for a minute. How many different transactions can you think of that asks for your SS#?
What about address, phone number, bank or employer? How possible is it for someone to
reference the data and mix the two at some point?

How it Affects You. Now let's look at the full picture. If you are truly wanting a new SS# to
create a new clean credit history, how many links will you have with your old life (yes life!)? If
you use the same address, phone number, employer, bank, anything that can be cross linked,
suddenly all your old credit history will show up on your now trashed new SS# and there's little

Two Problems. The first is cross linking as above. The second is that many lenders request a
SS#. You have the right to overwrite SS# with CPN to notify them you will be using a CPN
instead and give the number and even provide federal law documentation that states they can
NOT discriminate based on your not using a SS#, etc. etc. etc. but what does this do? RED
FLAG TIME!!! You must remember that if it's a private company versus a government agency,
they may not legally require a SS# but their actions can become very, very restrictive and cause
an in depth research to uncover the reason for your not wanting to "follow their rules".
Ultimately, they can simply say, "No SS#, goodbye!"

Summary. Hopefully you can see that using this approach is not to be taken lightly. It requires
real effort and constant attention to details over a long period of time (at least 7 to 10 years until
your old credit history wears off). We aren't suggesting not to use it, just be aware of the
implications and consequences of this approach. It still may be the best for you. Just think before
