Curtis (502) 561-2005 ceandace@justiceky.com Patients File Appeal in Medical Cannabis Lawsuit Frankfort, Kentucky -Plantffs, Dan Seum, Amy Stalker, and Danny Belcher, inthe Kentucky ‘medical cannabis lavsuit against Governor Bevin and Atiomey General Beshea filed a Notice ‘of Appeal today from Judge Wingate’s September 20, 2017 Order dismissing their ease Inhis opinion, Judge Wingate found thatthe Kentucky Supreme Court in Commonwealth Harrelson spoke “resolutely on the consttuionaity of statutes regulating cannabis plans in the Commonwealth” and that tie General Assembly isthe proper place to decide the issue. The Plaintifts whole-heartedly disagree and while Judge Wingate directed them to tur ther attention to the legislature (which they have done and continue to do), they now look tothe Kentucky Court of Appeals ‘One ofthe Plintifs, Amy Stalker, stated, “This ease is about doctors boing able to prescribe cannabis to Kentuckian inmedical need, jus like they're ale to doin 29 other states. My sight to treatment from my doctr is not the sae as planting a hemp fed like the Judge suggested. [ve gone tothe leislatureand been ignored fr too long.
