User Agreement and Waiver of Liability

1. I understand that Brickman Olympic LLC (“Owner”) is making the Bike Room & Shower
Facilities (“The Facilities”) available to tenants and their employees (“Users”). The Facilities
shall be used only by such tenants and their employees who have signed a Waiver
Agreement. No guest, family members or other unauthorized user will be allowed access.

2. I understand that the Owner and Property Manager may, from time to time as they deem
necessary, establish reasonable rules and regulations relative to the use and care of the
Facilities, and that I agree to comply with such rules and regulations. I understand that the
Owner and Property Manager reserve the right to deny access to the Facilities to anyone who
fails to comply with the rules and regulations.

3. I understand and agree that neither Owner nor Property Manager will provide any
instruction, supervision, or direction regarding use of the Facilities and any of its
equipment, and that I will not use any piece of equipment with which I am not thoroughly
familiar and which I do not completely know how to operate. Any malfunctioning or
damaged equipment, or other damage to the Facilities, should be reported to the Property
Manager via email at dgrove@brickmanre.com, or by calling 206.903.0662.

4. The Owner reserves the right to charge a fee for the use of the Facilities. If the Owner
elects to charge a fee, any payments in advance shall be non-refundable.

5. I understand that my use of the Facilities and any equipment located therein, is at my own risk.
I further acknowledge that neither the Owner nor Property Manager accept responsibility for
bikes, clothing or other items left in the Bike Room, lockers or shower facilities.

6. I understand that any equipment shall be used only in the manner for which it is intended.
I understand that lockers are for temporary use and the Property Manager may remove
any items left overnight.

7. I understand that my access card is not transferrable, and no unauthorized access to the
Facilities is to be given.

8. I will take care to ensure that other bikes, equipment, and the Facilities are not damaged when
I enter, exit or otherwise utilize the Facilities.

9. I understand that bikes are to be stored on the hooks, or in the rack(s) provided.

10. I understand that bikes are not allowed anywhere in the building other than the bike room
located in the parking garage.

11. I understand that Users are responsible for ensuring that trash and other disposable items are
not left in the Bike Room.

12. I understand that no advertising or posting of notices, pictures, etc. is allowed without
permission of the Property Manager.

13. I understand that smoking is not allowed on the Property or in or around the Facilities.

14. I understand that no loud music of any kind, or other disruption, shall be permitted.

15. I understand that appropriate attire including a shirt and shoes is required, and that no
changing of clothes is to take place in the Bike Room.

16. I understand that Bike Boom access is 24/7, however, access to the showers on the 1 st
floor is limited to Monday through Friday, 5am to 7pm.

17. I understand that Users are responsible for ensuring that showers are brief and water is
turned off in the shower before leaving the Facility.

Owner reserves the right to amend these rules and regulations at any time.
