SUB: Legal Notice to notify the admission test marks of Mohammad Izaz Arefin
Mridha, Admission test held on 24.11.2017 ( 59th batch of M.B.A session) under
Section 4 of Right to Information Act 2009 and to provide recourse to join the M.B.A
session.

Dear Sir,

We act on behalf of our client Mohammad Izaz Arefin Mridha (Hereinafter referred to
as “our client”) who has instructed us to serve this notice upon you as follows:

1. That our client was an ex-student of Dhaka University under the department of
Applied Physics. He has a keen intention to be a student of your institution. On
30.10.2017 a circular had been issued by the Institute of Business Administration (IBA)
inviting application from students for the post of M.B.A of Session 2017-2018. As per
the circular Our Client have applied for the above masters program. The Institute of
Business Administration after considering all qualification being pleased has issued an
admit card being admit card No. 3521 in favour of our client.

2. That our client had taken an extensive and solid preparation for the above exam.
He has dedicated his wholehearted effort in preparing for the exam specifically to
cover all the expected areas of question. On November 24, 2017 our client sat for the
exam. His exam was excellent and he was able to answer majority of the questions
successfully.

3. That after the examination Our Client was eagerly waiting for his expected
result. Later on 06.12.2017, the result was published but our client could not find his
name in the result list. Our Client became very disappointed and shocked with the
unexpected result.

4. That Our Client being helpless on 06.12.2017 has sent an email to your office
requesting them to inform his marks which he has obtained in the admission test.
Unfortunately nobody has responded to our client’s mail. Thereafter Our Client
personally visited your admission office to know his marks including individual marks
which he has obtained in each part of the exam. Your office confirmed that they
received Our Client’s email but the office would not able to help him anyway. Your
office vehemently denied to disclose any information to our client.

5. That thereafter without getting any help from anybody Our Client on 14.12.2017
sent a letter requesting you to notify him the marks of his admission test within 1 (One)
day from receiving the letter. Your office received the letter but ignored the letter and
failed to inform our client any update thereof.

6. That as per section 4 of the Right to Information Act 2009, Our Client has a right
to know his admission marks. You the notice receiver as an authority under section
2(b) is bound to provide the information to our client immediately.

7. That in addition Our Client after taking an extensive preparation took part the
examination and accordingly his examination was excellent. He expects that he must
be selected for the viva. But you having an ill intention did not select him and failed to

reply all his queries. It is his legitimate expectation to know his admission marks. You
deliberately and whimsically cannot snatch his right to know the marks.

8. That you an examination authority must follow a transparent system of


examination and result thereof. You can not follow choose and pick rules in selecting
students. Our Client of course has a right to know why he has not been selected. He
assumes because of your some technical fault he has not been selected. Because of your
own fault our client can not suffer.

9. That under Section 74 of Evidence Act 1872, Marks Sheets of an admission test
are public documents which are required to be disclosed to our client. In the case of –

Hon’ble High Court Division of Supreme Court has confirmed that Ignoring the
people’s right to know, keeping them in dark and playing hide and seek with them in a
democratic country like us where all powers belong to the people are illegal. Therefore
you cannot keep our client in darkness without informing his marks which will be
illegal and without lawful authority.
