MINUTES

WILLOW FORK DRAINAGE DISTRICT

April 29,2009

The Board of Directors (the "Board") of Willow Fork Drainage District (the
"Distrrcl"), met in regular session, open to the public, on April 29, 2009, at the Willow
Fork Country Club, 21055 Westheimer Parkway, Katy, Texas, inside the boundaries of
the District, and the roll was called of the members of the Board:

and all of the above were present, thus constituting a quorum.

Also present at the meeting were Dennis Gorden of Severn Trent Services 1"5T");
Fran Matuska of F. Matuska,Inc.; Melony Gay of Uretek/ICR; Lou Triche and Rob Karl
of Champions Hydro-Lawn, Inc.; Larry Mueller of AECOM, Inc.; and Stephen M.
Robinson and Patti Porter Hopper of Allen Boone Humphries Robinson LLP ("ABHR").

APPROVE MINUTES

The Board first reviewed the minutes of the March 12, 2009, meeting. After
review and discussion, Director Robinson moved to approve the minutes as submitted'
Director Renberg seconded the motion, which carried unanimously.

COMMENTS FROM DISTRICT RESIDENTS

There were no residents present wishing to address the Board. The Board
discussed a report from a District resident regarding a neighbor driving a four-wheel
vehicle along the ditches and illegal dumping of yard debris. The Board requested Mr.
Triche to drive by the site and take pictures.

SECURITY SERVICES

Director Lyons reported on security matters. The Board requested Ms. Matuska
to request Deputy Stark to provide the report with the payroll information.

Mr. Triche stated one of the deputies requested the Board to authorize placing a
sign on the channel behind the South Wastewater Treatment Plant. The Board
concurred to place a sign at the location.

MAINTENANCE OF STORM SEWER LINES

Mr. Gorden distributed the storm sewer maintenance report. Ms. Guy
introduced herself to the Board and reviewed the types of services provided by Uretek
in sealing, Iifttng, and stabilizing the ditch outfalls. In response to a question from
Director Ward, Ms. Gay stated the product is environmentally safe and does not
degrade or release chemicals. Mr. Robinson requested Ms. Gay to inspect one of the
outfalls needing repairs and provide an estimate of the typical price to repair one
structure. Mr. Triche then reviewed Harris County Flood Control specifications and
pricing for maintaining and replacing outfall structures. Mr. Robinson recommended
Ms. Gay and Mr. Triche provide information to Mr. Mueller and Mr. Mueller prepare a
study to help the Board in determining a plan regarding replacement or repair.

BOOKKEEPER'S REPORT

Ms. Matuska reviewed the bookkeeper's report, a copy of which is attached,


including the checks presented for payment. Mr. Robinson stated Standard & Poor's
increased the District's bond rating from BBB+ to A+. After review and discussiory
Director Robinson moved to approve the bookkeeper's report, the investment report,
and payment of the bills. Director Kainer seconded the motion, which passed by
unanimous vote.

TAX ASSESSOR'S REPORT

The Board reviewed the tax assessor's report, a copy of which is attached. The
Board also reviewed the delinquent tax collections report, a copy of which is attached.
Director Robinson moved to approve the report. Director Renberg seconded the
motion, which carried unanimously.

OPERATOR'S REPORT. INCLUDING AUTHORIZING DITCH MAINTENANCE

Mr. Tiff reviewed the operator's report with the Board, a copy of which is
attached.

Mr. Tiff next reviewed pictures of ditches'

Mr. Tiff requested authorization to repair sinkholes on the Diversion Channel at


Mason Road and VALl at Westheimer Parkway for a cost of $2,950.00 each.

After review and discussiory Director Renberg moved to approve the operator's
report, the May mowing, sign placement, sinkhole repairs, and the action items.
Director Kainer seconded the motiory which carried unanimously.

ENGINEER'S REPORT

Mr. Mueller submitted to the Board the written engineer's report, a copy of
which is attached.

Mr. Mueller updated the Board on the Grand Lakes development and stated he
had no items for the Board's approval.

Mr. Mueller updated the Board on Meadowbrook Farms and stated he had no
items for the Board's approval.

Mr. Mueller stated that the U.S. Army Corps of Engineers ("Corps") has
requested a typical cross section of all the ditches to be covered by the jurisdictional
permit. He stated the Corps review will take approximately 9 to 12 months. He stated
the District will be required to post a notice to all residents in the District when the
application is posted on the Corps website to request comments'

Mr. Mueller stated AECOM received a request from the property owner
association for the District to construct a sidewalk along the south side of Westheimer
Parkway crossing Ditch VA1. He stated the estimated cost is between $3,400 and
$4,500. Mr. Robinson stated since the District does not collect water and sewer revenue/
he will have to research whether the District can construct the sidewalk.

Mr. Mueller stated no additional silt removal should be done until the new
permit is received.

Mr. Mueller next reviewed the updated MS4 year two action items. Director
Renberg stated she knows a group interested in installing the inlet and manhole
markers. Mr. Mueller stated the estimate to translate the construction brochure is
$3,000. The Board requested Ms. Hopper to soiicit a proposal from another translator.
Mr. Mueller then reviewed an example of a protocol to detect and eliminate elicit
discharges. He also reviewed a sample checklist for reviewing plans and a construction
site inspection form.

Mr. Mueller updated the Board on the status of the new drainage model.

After review and discussion, Director Kainer moved to approve the engineer's
report and action items. Director Lyons seconded the motion, which passed by
unanimous vote.

The Board then reviewed and discussed the action items list.

The Board of Directors of Willow Fork Drainage District will hold a regular meeting on
Wednesday, April 29, 2009 at 11:30 a.m., at the Willow Fork Country Club, 2'1.055 Westheimer
Parkway, Katy, Texas, to discuss and, if appropriate, act upon the following items:

For the Jurisdictional Waters Permit, the U.S. Army Corps of Engineers (USACE) requested a typical cross section of
all the ditches, this was received by the USACE on March 18, 2009. The USACE will require the District to post a
notice to all residents in the District when the application is posted on their wesite to request any public commments.
We are coordinating with the USACE and the operator on what will be required to be sent out and that it can be
included on the water bills.

2. We have received a request for the District to construct a S-foot wide concrete sidewalk along the south side of
Westheimer Parkway, crossing Ditch VAI . We have received an estimate for this cost in the amount of $4.SO/square
foot, which would increase to $6.00/square foot is sodding is needed. The cost is estimated to be between $3,400 and
$4,500. Cinco MUD No. 'l will also be constructing a sidewalk in the same area if the Board would like to combine
these two projects.

MS4 Matters

tube of adhesive. ln addition, we included a draft introduction letter, draft instruction page, a draft group registration
form, and a draft safety procedures that would be included in the kit for your review. We have received all of the
markers the District ordered.
2. We are presenting to the Board the Construction Brochure (BMP 4.3.4) and a Post Construction Brochure (BMP 5.3.3).
We have attached a copy. We did look into a Spanish version of the Construction Brochure and have received a verbal
quote of approximately $3,000 to translate the construction and post construction brochure into Spanish by SL
lnternational. These two brochures would be distributed to the contractor so they can help maintain the project site
during and after construction.

3. For Permit Year 2, we need to develop a protocol regarding an illicit discharge detection and elimination (BMP 3.3.3).
We have attached a copy explaining how to go about in investigating illicit discharges and how to do the sampling. We
have received comments from the Attorney and the Operator and finalized the protocol for the Board's approval.

4. For Permit Year 2, we need to develop a plan set review checklist that will aid us in reviewing a set of plans (BMP
4.3.1 , 4.3.2,5.3.2). The checklist is attached for the Board's approval.

5. We have attached a Construction Site Inspection Form for the Board's review and approval. This document, BMP
4.3.2, is be used for Construction Site Inspections where the Operator will be inspecting construction site within Willow
Fork Drainage District.

6. We have attached an updated checklist for Permit Year 2 items. We will need the Board's approval to release the
checklist to the other Cinco MUDs.

Dear Volunteer Group:

First, let me extend a heartfelt thank you for your group's assistance in installing storm water inlet
decals for \Mllow Fork Drainage District. Our Storm Water Inlet Decal Program is one aspect of our
TPDES Phase ll Storm Water Permit (TXR040196). Our Phase ll Storm Water Permit requires us to
create and implement a Storm Water Management Program (SWMP) which details the steps that we
will take to reduce or eliminate pollutants in storm water runoff.

With the implementation of the Storm Water Inlet Decal Program, Willow Fork Drainage District comes
closer to completing one of the Public Education and Outreach goals stated in the SWMP. The Public
Education and Outreach portion of the SWMP entails the distribution of educational materials to the
community or conducting equivalent outreach activities. Below is a brief explanation of the purpose of
the Storm Water Inlet Decal Program.

What are Storm Water Inlet Decals and Why is it necessary?


Many people mistakenly believe storm drain inlets empty to water treatment facilities and are treated
before eventually reaching Galveston Bay, so they pour chemicals or sweep debris directly into storm
drains. This dumping greatly increases the level of leaves, soil, litter, fertilizers, pesticides, and other
street residues already present in urban storm water runoff and can contribute substantially to a
decline in water quality. More communities are working to reduce storm water pollution by placing
storm drain inlet markers warning citizens not to dump polluting materials. These storm drain marking
projects usually are conducted by volunteer groups in cooperation with local authorities. Any volunteer
groups are eligible to participate in the program. Examples of groups that can help include Girl
Scouts, Boy Scouts, 4-H clubs, environmental clubs, church youth groups, neighborhood associations,
grade-school classes, and a wide range of civic and service organizations.

This Storm Water Inlet Decal kit provides all the materials necessary to assist with the program.
Please review with your group the documents provided within the kit such as the instructions on
installation, safety procedures, and tips. A good estimate for applying markers is 1 marker every 3
minutes, if working in groups ol2 or 3. For a kit of 30 decals, please allocate an hour and a half for

GUIDE on CURB INLET
DECAL INSTALTATION
The decals are to be placed at storm water !4!g!g such
as grate inlets, curb inlets, and other areas where storm
water runoff enters the storm water sewer system (not
manholes, etc.)

The das Curb Decal should be applied to flat, non-soil surfaces and applied when the
temperature ranges from 40-90" F.
1. Glean Surface
Make sure the application surface is flat, dry and free of any
loose debris. Use the provided brush to remove dirt and
sediment from the application surface.

2. Apply Adhesive
Using the provided adhesive, coming in 1/8" from the outside
edge of the decal, apply a bead of adhesive following the
adhesive guide towards the center.

3. Stick lt!
Push the decal down on the application surface forcing a bead
of adhesive out around the entire edge. lt is important that the
entire edge of the decal is sealed so do not remove excess
adhesive from around the decal.

$444. Demand letters have been sent, we are trying to reach each owner by phone and we are contacting
mortgage companies on the real property accounts. Unless the Board would like this handled another
way, we plan to continue collection efforts and consider filing suit in July when the 2008 taxes are
turned over to us for collection.

your site inspections. This sample inspection report was created consistent with EPA's
Developing Your Storm Water Pollution Prevention Plan.

Using the Inspection Report


For ease of use, it is recommended to get a copy of the site layout from the Storm
Water Pollution Prevention Plan (SWP3) prior to the site inspection. lf a site layout is
not obtained prior to the site inspection, please request a copy upon arrival.

When conducting the inspection, walk the site by following the site layout provided in
the Storm Water Pollution Prevention Plan. Note any required corrective actions and
the date and responsible person for the correction in the Corrective Action Column.

your site inspections. This sample inspection report was created consistent with EPA's
Developing Your Storm Water Pollution Prevention Plan.

Using the Inspection Report


For ease of use, it is recommended to get a copy of the site layout from the Storm
Water Pollution Prevention Plan (SWP3) prior to the site inspection. lf a site layout is
not obtained prior to the site inspection, please request a copy upon arrival.

When conducting the inspection, walk the site by following the site layout provided in
the Storm Water Pollution Prevention Plan. Note any required corrective actions and
the date and responsible person for the correction in the Corrective Action Column.

461.1 Description. Comrgated metal pipe shall consist of furnishing and


placing corrugated metal pipe conforming to these specifications. The
pipe shall be furnished to the sizes and dimensions required and shall be
installed in such places as shown on the drawings or as designated by
Engineer, in accordance with these specifications and in conformity with
the lines and grades given.

46r.2 / Materials. Metal pipe shall be full circle conforming to AASHTO M36,
or AASHTO M196, Typ. I as specified on the plans.

/ Galvanized Steel coated sheets shall confonn to AASHTO M2lB and


structural plate material shall meet eitherAASHTO MI67 or M219. It
may be fabricated with circumferential corrugations, l"p joint
construction with riveted or spot welded seams or it may be fabricated
with helical corrugations with continuous helical lock seam or ultra high
frequenry resistance butt welded seams.

/ Pre-.coatgd Galvanized Steel pipe shall be full circle conforming to


AASHTO Designation M246, Typ. I as specified on the drawings. It
may be fabricated with circumferential corrugations, l"p joint
construction with riveted seams, or it may be fabricated with helical lock
seams. Unless otherwise noted on the drawings, both the inside and
outside coating shall be a minimum of l0 mils.

Gaskets to be O ring type. Gasket material shall meet the requirements


of ASTM C361. Diameter to be l3ll6-inch for l/2-inch deep
corrugations (pipe size 12 inches through 54 inches), and I 3/B-inch for
l-inch corrugations. (60 inches and larger) gasket lengths shall be in
accordance with the pipe manufacturer's recommendations.

r/ Coupling bands shall conform to the requirements of AASHTO M36.


Width of ffiiconnectinq bands shall be in accordance with Texas
Department of Transportatidn's Specification "Corrugated Metal Pipe-
Coupling Bands". Dimple bands will not be accepted.

Bituminous coated circular pipe shall conform to this specification both


as to base metal and fabrication and in addition shall be coated inside

and out with a bituminous coating which shall meet the performance
requirements set forth herein and with AASHTO M-190. The pipe shall
be uniformly coated inside and out to a minimum thickness of 0.05-
inch, measured on the crests of the corrugation.

When a paved invert is specified, the pipe, in addition to the fully


coated treatment described above, shall receive additional bituminous
material, of the same specifications as above, applied to the bottom
quarter of the circumference to form a smooth pavement with a
minimum-thickness of l/B-inch above the crests of the corrugations.

Fully lined (either asphalt or concrete linings) corrugated metal pipe


shall be in conformance with AASHTO M190, Typ" D or ASTM A849.

Field coating of pipe shall be in conformance with AASHTO M243 1f


specified. It shall not be allowed as an alternate to hot dip asphalt
coating per AASHTO MI90.

be accomplished safely and efficiently. Trenches shall be excavated with
suitable type equipment such as ladder type trenching machines or
trench hoes or other equipment. Trench widths for pipes less than 30-
inches shall as a minimum be the width of outside barrel of pipe plus
l2-inches. The maximum trench width shall be the maximum width of
the outside barrel of the pipe plus l8-inches.

Where necessary, excavations shall have sheathing and bracing to


prevent caving. All sheathing and bracing shall be designed to the
requirements of OSFIA Standard 1926, Subpart P (latest edition).
Depth of trenches without sheathing or bracing shall comply with
OSHA Regulation 1926.650.

For pipe 3O-inch and larger, the minimum width of the trench shall be
the width of the outside barrel of the pipe plus l6-inches and the
maximum width of the outside barrel of the pipe plus 24-inches.

After the trench has been excavated to the bottom. the trench shall be
fine graded to the established subgrade. Any over excavation of the
subgrade shall be filled with 1.5 sack/ton of cement stabilized sand.

The Engineer will furnish and set vertical and horizontal control stakes
which will establish the base line or centerline and bench marks and will
furnish the Contractor with all necessary information relating to lines
and grades. The Contractor shall establish the grade line in the trench
from grade stakes. The Contractor shall maintain this grade control a

minimum of 100-feet behind and ahead of the pipe laying operation.
The Contractor shall, at his own expense, furnish and place in position
as directed by the Engineer all necessary stakes, grade and batter boards
for locating the work. The Contractor may, at his own expense, use a
laser beam to maintain line and grade of the work as authorized by the
Engineer.

tnThe pipe shall be bedded in a foundation of cement stabilized sand


conforming to Item 433, "Cement Stabilized Sand Bedding and
Backfill", Item 430 "Construction of Underground Utilities, and the
drawings. When requested by the Engineer, the Contractor shall furnish
a simple template for each site and shape of pipe to be placed for use in
checking the shaping of bedding.

Unless otherwise authorized by the Engineer, the laying of pipes on the


prepared foundation shall be started at the outlet end, the separate
sections firmly joined together, with outside laps of circumferential
joints pointing upstream and with longitudinal laps on the sides. Any
metal in joints which is not protected by galvanizing, shall be coated
with a suitable asphaltum paint. Proper facilities shall be provided for
hoisting and lowering the sections of pipe into the trench without
damaging the pipe or disturbing the prepared foundation and the sides
of the trench. Any pipe which is not in alignment or which shows any
undue settlement after laying, or is damaged, shall be taken up and re-
lpid without extra compensation.

Multiple installations of corrugated metal pipe shall be laid with the


center lines of individual barrels parallel. Unless otherwise indicated on
the plans, the following clear distances between outer surfaces of
adiacent pipes shall be maintained as shown in Table No. t.

Where new structures are constructed as extensions to structures in


place or as iointed to existing structures, the construction shall include
all work necessary to provide a proper connection between the new
structure and the old as indicated on the drawings, including coating of
the connection with bituminous material when required.

After the metal pipe structure has been completely assembled on the
proper line and grade and headwalls constructed when required by the
drawing details, selected material from excavation or borrow shall be
placed along both sides of the completed structure(s) equally, in uniform
layers not exceeding 6-inches in depth (loose measurement), wetted if
required and thoroughly compacted between adiacent structures and
between the structure(s) and between the sides of the trench, or for a
distance each side of the structure equal to the diameter of the pipe.
Backfill material shall be compacted to the same density requirements as
specified for the adjoining section of the embankment. Above the three-
fourths point of the structure, the fill shall be placed uniformly on each
side of the pipe in layers not to exceed l2-inches. For backfilling, until a
minimum cover of l2-inches is obtained, only hand operated tamping
equipment will be allowed within vertical planes two feet beyond the
horizontal projection of the outside surfaces of the structure.

Pipe damaged by the Contractor's backfilling operation shall be removed


and replaced by the Contractor at no additional cost to Harris County.
Unless otherwise shown on the drawings or permitted in writing by the
Engineer, no heavy earth moving equipment will be permitted to haul
over the structure until a minimum of 4-feet of permanent or temporary,
compacted fill has been placed thereon. Pipe damaged by the
Contractor's equipment shall be removed and replaced by the
Contractor at no additional cost to Harris County.

During the backfilling operations, special emphasis shall be placed upon


the need for obtaining uniform backfill material and uniform compacted
density throughout the length of the pipe. Prior to adding each new
layer of loose backfill material, until a minimum of l2-inches of cover is
obtained, and inspection will be made of the inside periphery of the
structure for local or unequal deformation caused by improper
construction methods. Evidence of such will be reason for corrective
measures as directed by the Engineer.

46r.4 Measurement. Comrgated metal pipe will be measured by the linear


foot. Such measurements will be made between the ends of the barrel
along its flow line. Where spurs of branches or connections to existing
pipe lines are involved, measurement of the spur of new connecting pipe
will be made from the intersection of its flow line with the outside

surface of the pipe into which it connects. Where inlers, headwalls,


catch basins, manholes, junction chambers or other structures are
included in lines of pipe, the length of pipe tytng into the structure wall
will be included for measurement but no other portion of the structure
length and width will be so included.

461.5 Payment.__ Payment for corrugated metal pipe measured and prescribed
above, will be made at the contract unit price bid per linear foot for the
various sizes of "Corrugated Metal Pipe" of the material and protective
coating as indicated on the plans.

PART 2 - PRODUCTS

2.1 PIPE AND FITTINGS

A. Corrugated metal pipe shall be galvanized steel, polymer precoated


galvanized steel or as shown on the Plans.
B. Coupling bands and other hardware for corrugated metal pipe:
1. Coupling bands shall be not more than 3 nominal sheet thicknesses
lighter than the thicknesses of the pipe to be connected and in no case
Iighter than 0.064 inch.
2. Provide 24 inch wide coupling bands with annular corrugations. Base
metal, corrugation, diameter and coating of the coupling band shall
match the pipe.
3. Bolts for coupling bands shall be l12inch diameter. Bands shall have a
minimum of 3 bolts at each connection.
4. Galvanized bolts may be hot dip galvanized, mechanically galvanized
or electrogalvanized.
C. Bituminous coated pipe or pipe arch shall be coated inside and out with a
bituminous coating.
1. The pipe shall be uniformly coated inside and out to a minimum
thickness of 0.05 inch, measured on the crests of the corrugations.
2, The bituminous coating shall adhere to the metal so that it will not chip,
crack or peel during handling and placement. Coating shall protect the
pipe from corrosion and deterioration.
3. \l/here a paved invert is shown on the Plans, the pipe or pipe arch, in
addition to the fully coated treatment described above, shall receive
additional bituminous material applied to the bottom quarter of the
circumference to form a smooth pavement. Apply a minimum thickness
of 1/8 inch above the crests of the corrugations.
D. Furnish all fittings and accessories required for bends, end sections,
branches, access manholes and connections to other fittings. Fittings and
accessories are subject to the same internal and external loads as straight
pipe.

2.2 PIPE FABRICATION

A. Steel Pipe:
1. Galvanized pipe conforming to AASHTO M 36 shall be full circle
Type l, Type lA or Type lR; or pipe arch Type ll or Type llR.
2. Fabrication with circumferential corrugations, lap joint construction with
riveted or spot welded seams, helical corrugations with continuous
helical lock seam or ultra-high frequency resistance butt-welded seams
are acceptable.

B. Polymer Precoated Galvanized Steel Pipe:


1. Pipe conforming to the requirements of AASHTO M 245 shall be full
circle Type l, Type lA or Type lR; or pipe arch Type ll or Type llR.
2. Fabrication with circumferential corrugations, lap joint construction with
riveted seams or helical lock seams is acceptable.
3. Inside and outside coating shall be a minimum of 10 mils.
PART 3 - EXECUTION

3.1 PREPARATION

A. Damaged spelter coating shall be repaired by thoroughly wire brushing the


damaged area and removing all loose, cracked or weld-burned spelter
coating. Paint the cleaned area with a zinc dust-zinc oxide primer paint
conforming to Federal Specification TT-P-641 g.
B. Damaged polymer coating shall be repaired in accordance with the
manufacturer's recommendations.

3.2 INSTALLATION

A. lnstall in accordance with the requirements of Section 02631 - Storm


Sewers and Outfalls unless shown otherwise on the Plans.
