KARLA PAINTER, Deputy County Attorney, deposes and says that on or about the
18
4th day of January, 2018, in Missoula County, the Defendant committed the offenses of
19

20 COUNT I: THEFT - 1ST OFFENSE $1,500-$5,000, a Felony, in violation of Montana law,

21 namely: Mont. Code Ann. 45-6-301(1)[1st], punishable by 3 years MSP and/or $1,500 fine;
22
COUNT II: THEFT - 1ST OFFENSE $1,500-$5,000, a Felony, in violation of Montana law,
23
namely: Mont. Code Ann. 45-6-301(1)[1st], punishable by 3 years MSP and/or $1,500 fine;

COUNT III: CRIMINAL ENDANGERMENT, a Felony, in violation of Montana law, namely:

26 Mont. Code Ann. 45-5-207, punishable by 10 years MSP and/or $50,000 fine; COUNT IV:

27 CRIMINAL MISCHIEF, a Felony, in violation of Montana law, namely: Mont. Code Ann.

45-6-101(1)[2], punishable by 10 years MSP and/or $50,000 fine; COUNT V: BURGLARY,
 1 a Felony, in violation of Montana law, namely: Mont. Code Ann. 45-6-204(1), punishable

by 20 years MSP and/or $50,000 fine.

The facts constituting the offense are:

5 COUNT I: On or about the 5th day of January, 2018, the above-named

6 Defendant purposely or knowingly obtained or exerted unauthorized control over a Ford

7
F-150 and a Meyers straight plow owned by Ibey Nursery with the purpose of depriving
8
the owner of the property. The value of the property exceeds $1,500 and does not
9
exceed $5,000.

11 COUNT II: On or about the 5th day of January, 2018, the above-named

12 Defendant purposely or knowingly obtained or exerted unauthorized control over a

13
Chevrolet flat-bed pickup with a Meyers Boss V-plow owned by Ibey Nursery with the
14
purpose of depriving the owner of the property. The value of the property exceeds
15
$1,500.

17 COUNT III: On or about the 30th day of January, 2018, the above-named
18 Defendant knowingly engaged in conduct that created a substantial risk of death or
19
serious bodily injury to Christopher Bryant by nearly striking him with a vehicle.

COUNT IV: On or about the 30th day of January, 2018, the above-named
21

22 Defendant committed the offense of criminal mischief by knowingly or purposely

23 damaging or destroying a wooden fence, a house, and a Chevrolet flat-bed pickup

24
without consent of the owners. The cost of the damage exceeds $1,500.00

COUNT V: On or about the 30th day of January, 2018, the above-named

Defendant knowingly entered or remained unlawfully in an occupied structure with the

 1 purpose to commit an offense therein, to wit: theft of clothes and other personal
2
property.
