CRIMINAL COMPLAINT

The undersigned Complainant RIZZA JOY GATERING MATEO, minor, a resident of Brgy.
San Fermin, Cauayan City accuses ORLANDO B. PORLUCAS, a resident of Sillawit, Cauayan City,
for violation of Republic Act No. 8353 otherwise known as “Anti Rape Law of 1997” committed
as follows;

“That on December 26, 2017 at on or about 6:00 o’clock in the

evening, particularly in Our Lady of Pilar Parish College, Brgy. San Fermin,
Cauayan City, Province of Isabela, Philippines, and within the preliminary
jurisdiction of this Prosecution Office, the above-named respondent did
then and there, willfully, unlawfully, and feloniously committed rape
against the Complainant by means of inserting his finger into his vagina
with force and intimidation and against her will.” Wherein said act is
detrimental to the development of the child.

“That the offense is attended by aggravating circumstance wherein

The victim is a minor, 15 years of age.”

CONTRARY TO LAW.

I, ORLANDO B. PORLUCAS, wish to avail my right to a preliminary investigation and for

JOINT AFFIDAVIT OF ARREST

WE, PO3 JOHN MICHAEL L. BABAS with Badge Nr. 980042 and PO2 IOAN BUENO with
Badge Nr. 000137, both of legal age, single, college graduate, elements of Philippine National
Police (PNP), and presently assigned at Cauayan City Police Station, after having been duly
sworn to in accordance with law hereby depose and state;

That at around 6:15 in the evening of December 26, 2017, while having routinary roving
patrol on board of PNP Patrol Car with Plate Nr. SKE 484 along San Fermin, Cauayan City,
Isabela, particularly the around Our Lady of Pilar Parish College (OLPC) area, we heard a scream
for help coming from the grassy area in front of OLPC;

That we immediately stopped the car and tended to the location of the shouting when
we saw an abandoned tricycle, bearing City Tricycle No. 4403, which we identified to be owned
by Respondent, later on identified as Orlando Porlucas;

That we then coursed thru the tall grasses when we stumbled upon herein Complainant,
Rizza Joy G. Mateo having a physical struggle against Respondent, who was sitting above
Complainant, particularly at her hip region;

That upon seeing such circumstances, we immediately called for the surrender of
Respondent and apprehended him;

That the suspect together with the victim were brought to the Cauayan City Police
station and turned-over to the duty investigator for further investigation and request for the
Medico-Legal examination of the victim;

That we are executing this affidavit in good faith, attesting the truth of all the forgoing
statement;

S: Para po magsampa ng reklamo laban ky Orlando Porlucas.

04. T: Bakit anong ginawa sa iyo ni Orlando Porlucas at nais mong sampahan ng kaso?
S: Sa ginawa niya pong pang hahalay sa akin.

05. T: Maaari mo bang isalaysay kung ano ang mga sirkumstansiya bago ito nangyari?
S: Opo Ma’am. Kanina po mga 5:50 ng gabi, sumakay po ako ng tricycle na minamaneho
po ni Orlando Porlucas. Pauwi po sana ako sa San Fermin. Galing po ako sa bahay ng
kaibigan kong si Edwardson Malangen para daluhan ang kanyang Birthday Party.

06. T: Saang lugar matatagpuan ang bahay ng kaibigan mong si Edwardson Malangen?
S: Sa Brgy. Sillawit po dito din sa Cauayan City, Ma’am.

07. T: Habang ikaw ay nakasakay sa naturang tricycle, anong nangyari?

S: Habang tinatahak po namin ang kalsada sa may OLPC ay bigla pong ihininto ni Orlando
Porlucas ang sinasakyan kong tricycle. Tapos ay sapilitan niya po akong hinila palabas at
kinaladkad sa may damuhan malapit sa tapat ng eskwelahan.

08. T: Anong ginawa mo nung ginawa niya iyon?

S: Nagpupumiglas po ako at nagsisisigaw. Kinagat ko rin po siya sa balikat pero sinuntok
niya po ako sa may aking tagiliran at di po ako nakahinga;

09. T: Pagkatapos nito, ano ang nangyari?

S: Tinakpan niya po ang aking bibig at saka hinawak hawakan ng madiin ang aking dibdib.
Pagkatapos po ay kanyang tinanggal ang suot kong pambaba at kanyang ipinasok ang
kanyang daliri sa aking ari ng paulit-ulit.

10. T: Ano ba ang suot mo ng mga panahong iyon?

S: Naka asul na t-shirt po ako pantaas at nakasuot ng itim na palda pambaba.
11. T: Paano ka nakatakas kay Orlando?
S: Nung ibababa na po niya yung kanyang pantalon ay nabitawan niya po ang
pagkakahawak niya sa aking bibig. Doon na po ako nakasigaw ng malakas na “TULONG!”

12. T: Pagkaraan nito, ano ang sumunod na naganap?

S: May bigla pong lumapit na dalawang pulis at saka po tinutukan ng baril si Orlando.

13. T: Dati mo na bang kilala si Orlando Porlucas?

S: Hindi po.

14. T: Kung gayon paano mo nalaman ang kanyang pangalan?

S: Isinakay po ako ng kaibigan kong si EDWARDSON sa tricycle niya. Doon po ipinakilala ni
EDWARDSON si ORLANDO.

15. T: Ano ang gusto mong mangyari ngayon?

S: Gusto ko pong makulong siya upang pagdusahan ang ginawa niya sa akin, Ma’am.

16. T: Sa ngayon may gusto ka pa bang sabihin o idagdag sa iyong salaysay?

S: Wala na po, Ma’am.

S: Kasi po bumisita si Riza sa amin kanina dahil birthday ko. Pagkatapos po niya kumain ay
nagpaalam na po siyang uuwi dahil bawal siyang gabihin. Doon ay ihinatid ko na po siya
palabas. Dun ko po ibinilin kay Kuya Orlando na pakihatid si Riza sa kanilang bahay sa San
Fermin.

09. T:Pagkatapos nito, ano ang mga sumunod na nangyari?

S: Umoo po si Kuya Orlando at pinasakay ko na po si Riza sa kanyang tricycle. Inabutan ko
pa nga po si Kuya Orlando ng trenta pesos bilang pasahe. Pagkatapos po nito ay bumyahe
na sila.

10. T: Ano ang gusto mong mangyari ngayon?

 S: Gusto ko pong makulong si Kuya Orlando upang pagdusahan niya ginawa niya sa aking
pinsan, Ma’am.
