The Complainant submits this complaint to the Court and states that there is probable cause to believe
Defendant committed the following offense(s):
COUNT I
Charge: Traffic - DWI - Operate Motor Vehicle Under Influence of Alcohol
Minnesota Statute: 169A.20.1(1), with reference to:  169A.25.2
Maximum Sentence: One (1) year imprisonment and/or $3,000 fine
Offense Level: Gross Misdemeanor
Offense Date (on or about): 02/05/2018

Charge Description: That the defendant, Thomas Richard Bromen, then and there being, did wrongfully
and unlawfully drive, operate, or be in physical control of any motor vehicle within the State of Minnesota
while he was under the influence of alcohol, and two aggravating factors were present, to-wit: having an
alcohol concentration of 0.16 or more as measured at the time, or within two hours of the time, of the
offense, and having children under the age of 16 in the motor vehicle at the time of the offense if the
children are more than 36 months younger than him.

Charge: Traffic - DWI - Commercial Motor Vehicle - Alcohol Concentration 0.04 Within 2 Hours
Minnesota Statute: 169A.20.1(6), with reference to:  169A.25.2
Maximum Sentence: One (1) year imprisonment and/or $3,000 fine

Charge Description: That the defendant, Thomas Richard Bromen, then and there being, did wrongfully
and unlawfully drive, operate, or be in physical control of any class of school bus or Head Start bus within
the State of Minnesota when there was physical evidence present in his body of the consumption of any
alcohol, and the violation occurred while children under the age of 16 were in the vehicle and the children
were more than 36 months younger than him.

STATEMENT OF PROBABLE CAUSE 2/7/2018 10:34:16 AM

The Complainant states that the following facts establish probable cause:
 
On February 5, 2018, at approximately 4:58 p.m., Officer Von Wahlde was dispatched to Sauk Centre
Public Schools bus garage located in the City of Sauk Centre, County of Stearns, State of Minnesota, for a
driving complaint. Officer Von Wahlde arrived at the bus garage and was met by Transportation Director
J.L.F., fully identified in the police reports, and Thomas Richard Bromen, DOB: 6/5/1954, the defendant
herein. Officer Von Wahlde observed that the defendant's eyes were bloodshot and watery and could smell
an overwhelming odor of alcohol coming from the defendant. J.L.F. stated that he had received three
driving complaints about the defendant while the defendant was on his school bus route. J.L.F. stated that
he met the defendant at the bus garage as the defendant was exiting the school bus after his route. J.L.F.
said he noticed that the defendant's eyes were bloodshot and watery at that time and observed signs of
impairment. 

J.L.F. stated that the defendant arrived for his afternoon route at 2:30 p.m. At that time, the defendant
picked up approximately 50 students from the school. J.L.F. said the first call he received was from a
daycare provider stating that the defendant forgot to drop off two students. The second call was from
another daycare stating that the defendant forgot to drop off students. The third call was from a truck driver
who stated that he had just been cut off by the defendant with the bus and shortly after that, the defendant
ran a red light. J.L.F. said he asked the defendant if he had been drinking and the defendant admitted
being impaired and driving drunk with the kids. 

The defendant agreed to take a breath test. The results of the DataMaster test showed that the defendant's
alcohol concentration was .16 at 5:43 p.m. 

Complainant has reason to believe and does believe that all of the above information is true and correct. 

The above facts constitute your complainant's basis for believing that the above-named defendant, on or
about the 5th day of February, 2018, in the City of Sauk Centre, County of Stearns, State of Minnesota,
committed the offenses described herein.

From the above sworn facts, and any supporting affidavits or supplemental sworn testimony, I, the Issuing Officer, have
determined that probable cause exists to support, subject to bail or conditions of release where applicable, Defendant’s arrest
or other lawful steps be taken to obtain Defendant’s appearance in court, or Defendant’s detention, if already in custody,
pending further proceedings. Defendant is therefore charged with the above-stated offense(s).

SUMMONS
